This study adopts a normative and empirical research paradigm as its primary methodological framework. A qualitative approach is used because of its ability to facilitate in-depth exploration of phenomena in the natural environment, with the researcher acting as the primary instrument for data collection and analysis. The result of this study are brick-kiln operations in Mekarmulya Village cause significant air, noise, and land degradation impacts, with the community gradually normalizing pollution due to weak regulatory oversight and limited institutional capacity in enforcing environmental policies for micro-enterprises. The study concludes that ineffective environmental governance and limited institutional capacity have allowed the micro-scale brick-kiln industry in Mekarmulya Village to cause significant pollution and land degradation, highlighting the need for the implementation of adaptive, socially aware, and inclusive environmental policies for the informal sector.

Abstract

Bankruptcy is a legal mechanism that provides certainty for creditors when debtors are no longer able to fulfill their payment obligations. This study aims to analyze the legal steps that creditors can take against debtors who are in default based on the Cooperation Agreement Deed, as well as to examine the judge's considerations in deciding bankruptcy cases in the Semarang District Court Decision No. 20/Pdt.Sus-Pailit/2022/PN.Niaga.Smg in accordance with Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. The research method used is normative juridical with a constitutional and case approach. The results of the study indicate that the bankruptcy petition was granted because the bankruptcy requirements were met, namely the presence of more than one creditor and debts that had matured as regulated in Article 2 paragraph (1) of the PKPU Law. The panel of judges emphasized the principle of pari passu pro rata parte and the application of the principle of simple proof based on Article 8 paragraph (4) of the PKPU Law as the basis for their considerations. In conclusion, the application of the principle of simple proof in bankruptcy cases effectively provides legal certainty while guaranteeing justice for the parties.

Abstract

The increasing incidence of drug abuse among street children in Karawang Regency has become a serious social and legal concern. As a vulnerable group, street children often fall victim to drug exploitation due to the absence of family supervision and their exposure to high-risk environments. This study aims to analyze the victimological factors that make street children vulnerable to drug abuse and to interpret this phenomenon through the Lifestyle Exposure theory. Using an empirical juridical method, this research combines normative analysis of legal regulations with field studies through interviews with street children, law enforcement officials, the National Narcotics Agency of Karawang Regency, and social institutions. The findings reveal that economic hardship, social pressure, and a lack of legal awareness significantly contribute to children’s exposure to drugs. In the context of Lifestyle Exposure theory, their street-based lifestyle increases the likelihood of contact with perpetrators and risky situations. Legally, these children qualify as potential victims requiring special protection. Therefore, integrated efforts between government institutions, law enforcement, and the community are urgently needed to strengthen prevention, protection, and rehabilitation mechanisms for street children affected by drug abuse.

Abstract

Land ownership and utilization in Indonesia has important dimensions both economically, socially, and politically, and is expressly regulated in the Basic Agrarian Law of 1960 and Article 33 paragraph (3) of the 1945 Constitution which emphasizes the social function of land. However, in practice, there is still a lot of land that is abandoned, causing social inequality, injustice, and obstacles to development. This research aims to analyze the implementation of Government Regulation Number 20 of 2021 concerning the Management of Abandoned Areas and Land as well as the legal consequences for rights holders who do not use their land. The research method is a normative juridical approach with descriptive analysis, based on a literature study of laws and regulations and related literature. The results of the study show that the implementation of PP 20/2021 in regulating unused land, that land that is deliberately left vacant or not used according to its intended purpose can be designated as abandoned land and has legal implications as explained in articles 3, 6, 7, and 30, both for individual rights holders and legal entities, except in certain conditions that are indeed excluded by regulations. The legal consequence of land abandonment is the abolition of land rights for the sake of law and the transition of its status into state land that can be used for public purposes, agrarian reform, and national development programs as explained in articles 30, 31, and 32. Therefore, this regulation not only emphasizes the aspect of legal certainty, but also acts as a strategic means to realize agrarian justice, equity, and maximum land use for the welfare of the community.
