Abstract

Indonesia's Basic Agrarian Law (UUPA) sets out the requirements for the conversion of verponding eigendom land, regulating the rights of Westerners to be included in the applicable land law system. Based on the UUPA, land rights must be converted until September 24 1980. However, there are still frequent claims of land ownership resulting from eigendom disputes that have not been legally resolved, which causes land disputes. Case of verponding eigendom land dispute between the heirs of the Muller Family, PT. Dago Inti Graha versus Dago Elos residents is a clear example of the complexity that can occur in land ownership issues. Since it started in 2016, this dispute has been decided four times, one of which was at the PK level with Case Register Number 109 PK/Pdt/2022. Normative juridical and analytical descriptive approaches, in legal studies and relevant legal cases are analyzed. Result: According to the provisions of UUPA and its implementing regulations, as well as Government Regulation no. 24 of 1997, if there is no land eigendom verponding convention, the land then becomes state property. Through the trial, the Panel of Judges considered that the heirs of the Muller Family had succeeded in proving that they were the legal holders of land rights, compared to the claims of Dago Elos Residents who did not have proof of ownership and that the Muller Family heirs had more complete and valid supporting documents than the Residents. Dago Elos. Based on these considerations, the judge decided that the heirs of the Muller family had stronger and more legal rights to the disputed land than the Dago Elos residents. Therefore, the legal consequences for control of disputed land are that the heirs of the Muller family have the right to register the land and obtain legal recognition of ownership of the disputed land.

Abstract

The implementation of leasing village treasury land is a common practice in Indonesia. However, in practice there are legal problems that often arise related to the protection of the rights of the parties involved in it. The implementation of this lease activity is related to the construction of the Subang Smartpolitan Industrial Estate by a private company that has obtained an Industrial Estate Business License (IUKI) in Subang Regency. One of the villages affected by the development of industrial estates has assets in the form of village treasury land that will be changed in function through the ruilslag or exchange process. To regulate the use of land during the ruilslag administrative process, it is considered necessary to first carry out a lease agreement. This legal event highlights the importance of regulating land use changes in a transparent manner and in accordance with applicable regulations. This research uses the Normative Juridical approach method, which is a form of scientific activity, which is based on certain methods, systematics, and thoughts, aiming to study one or several specific legal phenomena. The implementation of the lease agreement for village treasury land is linked to the Regulation of the Minister of Home Affairs Number 3 of 2024 concerning Amendments to the Regulation of the Minister of Home Affairs Number 1 of 2016 concerning Village Asset Management. Several legal aspects that need to be considered in a lease agreement such as Legal Basis, Village Authority, Lease Agreement, Transparency and Openness, Coordination, Protection of Village Rights, Alignment with Development, Supervision and Accountability, Legal Education, Public Supervision. Legal consequences for the parties involved, namely Binding Agreement, Rights and Obligations of the Parties, Duration of Rent, Rent Payment, Land Use, Maintenance and Repair, Transfer of Lease Rights, Sanctions and Fines, Dispute Resolution and Restoration of Village Rights.

Abstract

A pawn agreement is an agreement between the creditor and the debtor, where the creditor obtains collateral for the goods provided by the debtor, and the debtor obtains collateral for the goods bound by him in the form of a money loan. The goods used as collateral or bound by a pawn agreement must be goods that belong to the debtor. The problem that can be discussed in this paper is the legal consequences of a pawn agreement with a pawn object that does not belong to the debtor as collateral and the judge's consideration in Decision Number 170/Pdt.G/2018/PN Skt. related to the object of pawn collateral. This paper uses normative juridical research methods. The conclusion of this research is that a pawn agreement held as collateral for a pawn object that does not belong to the debtor can make the pawn agreement null and void in accordance with Article 1320 of the Civil Code and analogous to the provisions of Article 1471 and the judge's consideration is correct and in accordance with applicable regulations. The verdict decided that The Joe An had legally committed a tort against PT Pegadaian and stated that the evidence which was also the object of the pawn collateral in this case must be returned to Koentjahjono Tanto as the owner of the gold shop.

Abstract

One of the contents of Law Number 56 of 1960 concerning Determination of Agricultural Land Areas regulates the implementation of land mortgages. In reality, many mortgages last for years or even decades, and some are even continued by the heirs of the pawn holder, because the mortgagee is unable to buy back his land. The formulation of the problem in this study. First, what is the legal protection for pawning agricultural land based on Law Number 56 of 1960 concerning Determination of Agricultural Land Areas. Second, how to resolve disputes arising from the implementation of agricultural land mortgages. The purpose of the research is of course to answer the formulation of the problem in this research. This research is a normative research using a normative juridical approach. As for the results of the first study, protection for pawnbrokers eliminates the obligation to pay off debts if it has reached 7 years. Second, settlement of disputes arising from the implementation of land pledges can be pursued through non-litigation and litigation both civil and criminal.

Abstract

The process of buying and selling land should be carried out in front of an authorized official (PPAT) in order to obtain legal certainty in the form of a Sale and Purchase Deed (AJB) as evidence of the transfer of land rights or transfer of name at the Land Office. In general, there are still many buying and selling processes that are not carried out in front of PPAT or under the hands of some people. The research method used in this research uses qualitative methods and normative juridical approach methods with secondary data as the main data based on statutory approaches and primary data as supporting data obtained in the field. In this case, the sale and purchase carried out under the hand is still valid if it is in accordance with the agreement of the parties, but to ensure legal certainty, an authentic deed made by an authorized official is needed as proof of juridically valid ownership. Legal certainty in an agreement means that the agreement made by the parties applies like a binding law. Even though it is not in accordance with the provisions of the UUPA, the legal actions that occur have met the requirements of cash, light and real. The judge in deciding the case at No.535/Pdt.G/2018/PN/Smg. Stating that the sale and purchase carried out by the parties is valid, but needs to be completed with an authentic deed if it is going to change the name of the certificate or transfer of land rights.

Abstract

Pemesanan fiktif merupakan tindakan konsumen yang memesan tanpa niat membayar, sehingga merugikan driver secara finansial dan psikologis. Pemesanan fiktif terjadi ketika konsumen melakukan pemesanan tanpa niat untuk membayar, sehingga menyebabkan kerugian bagi mitra driver yang telah menjalankan kewajibannya. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kualitatif berbasis studi pustaka. Penelitian ini bertujuan untuk mengkaji perlindungan hukum bagi mitra driver GOJEK yang dirugikan akibat praktik pemesanan fiktif pada layanan GoFood dan GoMart. Hasil penelitian menunjukkan bahwa meskipun PT. Gojek Indonesia telah menyediakan fitur seperti GoShield dan Lapor Order Fiktif serta memberikan kompensasi, perlindungan yang diberikan masih belum optimal. Mitra driver masih menghadapi risiko kerugian akibat lemahnya sistem keamanan. Secara hukum, mitra driver dapat menempuh upaya non-litigasi dengan melapor kepada PT. Gojek Indonesia, serta litigasi berupa gugatan wanprestasi terhadap konsumen yang melanggar perjanjian. Penelitian ini menekankan pentingnya peningkatan perlindungan hukum dan sistem keamanan digital bagi driver GOJEK dalam ekosistem layanan transportasi online.

Abstract

Perdagangan bertujuan mewujudkan kesejahteraan sebagai bagian dari pembangunan nasional. Untuk melindungi hak para pihak dalam aktivitas perdagangan, perjanjian baku diatur dalam UUPK. Perjanjian ini umumnya tidak melalui proses tawar-menawar, sehingga menciptakan ketimpangan posisi antara pelaku usaha dan konsumen. Ketika terjadi pelanggaran akibat perjanjian baku, hak para pihak bisa terlanggar. Oleh sebab itu, penting memahami klausula terlarang sebagaimana diatur Pasal 18 UUPK, seperti klausula pembebasan tanggung jawab, pemutusan sepihak, pengalihan tanggung jawab, perubahan sepihak, dan sanksi tidak proporsional. Asas kebebasan berkontrak kini tidak lagi mutlak, karena perjanjian baku sering bersifat “take it or leave it”. Contohnya, kasus ZS pada Agustus 2019, di mana ia dirugikan oleh perubahan sepihak dalam program tantangan oleh PT Transportasi Online Indonesia. Klausula tersebut melanggar asas keadilan, sebagaimana ditegaskan Mariam Darus Badrulzaman bahwa hukum dibuat untuk melindungi hak dan menciptakan keadilan. Maka, pelaku usaha wajib merancang klausula sesuai hukum demi keadilan bagi semua pihak.

Abstract

Studi ini mengulas praktik penyerobotan tanah tanpa izin di Kabupaten Subang yang dianalisis melalui Putusan Pengadilan Negeri Subang Nomor 3/Pid.C/2021/PN.Sng, dengan menitikberatkan pada penerapan Peraturan Pemerintah Pengganti Undang-Undang (Perppu) Nomor 51 Tahun 1960. Penelitian bertujuan untuk mengetahui bagaimana regulasi tersebut diterapkan, bagaimana pertanggungjawaban pidana pelaku dikonstruksikan, serta sejauh mana efektivitas perlindungan hukum yang diberikan kepada pemilik tanah sah. Metode yang digunakan adalah kualitatif dengan pendekatan yuridis normatif. Data diperoleh melalui studi dokumen berupa putusan pengadilan serta bahan hukum primer, sekunder, dan tersier. Analisis dilakukan dengan menelaah unsur-unsur hukum yang dipertimbangkan hakim, baik dari aspek yuridis berupa pembuktian hak kepemilikan dan pelanggaran unsur “tanpa izin”, maupun aspek non-yuridis seperti kerugian materiil dan kondisi sosial pelaku. Hasil penelitian menunjukkan bahwa terdakwa terbukti melanggar Pasal 1 jo. Pasal 6 Perppu No. 51 Tahun 1960 dan Pasal 407 ayat (1) KUHP karena menguasai tanah tanpa izin dan merusak tanaman padi milik korban. Hakim menjatuhkan pidana kurungan satu bulan dengan masa percobaan dua bulan. Namun, vonis ini dinilai belum proporsional sehingga tidak memberikan efek jera yang optimal. Perppu No. 51 Tahun 1960 masih relevan sebagai dasar hukum menindak penyerobotan tanah, namun efektivitas penerapannya sangat bergantung pada konsistensi penegakan hukum, kekuatan bukti kepemilikan, dan sosialisasi hukum kepada masyarakat.

Abstract

Perkembangan industri menimbulkan masalah serius berupa pencemaran limbah Bahan Berbahaya dan Beracun yang mengancam ekosistem dan kesehatan masyarakat. Penelitian ini bertujuan mengkaji penegakan hukum terhadap korporasi pencemar limbah Bahan Berbahaya dan Beracun berdasarkan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, dengan fokus pada penerapan prinsip strict liability. Metode yang digunakan adalah yuridis normatif melalui kajian peraturan perundang-undangan, literatur hukum, dan analisis kasus pencemaran limbah medis di Desa Karangligar, Karawang. Hasil penelitian menunjukkan bahwa Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup bersama Peraturan Pemerintah No. 101 Tahun 2014 telah menyediakan dasar hukum yang kuat melalui prinsip polluter pays dan strict liability, dimana korporasi wajib menanggung biaya pemulihan tanpa perlu dibuktikan unsur kesalahan. Namun, implementasi di lapangan masih lemah. Penegakan hukum lebih sering terbatas pada sanksi administratif berupa peringatan atau perbaikan, sementara aspek pidana cenderung dianggap sebagai ultimum remedium. Kasus RS Bayukarta dan RS Hermina membuktikan lemahnya pengawasan, karena meski terbukti lalai mengelola limbah medis, sanksi yang dijatuhkan tidak menimbulkan efek jera. Penelitian ini menyimpulkan dan menegaskan pentingnya penerapan prinsip strict liability secara konsisten untuk mempercepat proses hukum, menghindari kendala pembuktian, serta memberikan efek jera kepada korporasi. Strategi penegakan hukum yang lebih tegas, terintegrasi, dan berkeadilan diperlukan agar perlindungan lingkungan dan hak masyarakat dapat terjamin.

Abstract

Penelitian ini bertujuan untuk mengkaji kekuatan hukum putusan Badan Penyelesaian Sengketa Konsumen (BPSK) terhadap kewajiban ahli waris dalam pelunasan utang debitur yang telah meninggal dunia, yaitu dengan studi kasus putusan BPSK Karawang Nomor Arbitrase/017/BPSK-KRW/VIII/2022 dalam sengketa yang terjadi antara ahli waris Almarhum Restina Lumban Gaol dengan PT. Oto Multiartha mengenai kontrak kredit mobil nomor 10-113-16-01884. Permasalahan ini muncul ketika perusahaan pembiayaan yaitu PT. Oto Multiartha menuntut pelunasan utang kepada ahli waris berdasarkan klausula baku yang menyatakan utang menjadi jatuh tempo apabila debitur meninggal dunia, hal ini dianggap bertentangan dengan prinsip perlindungan konsumen. Penelitian ini menggunakan metode hukum normatif dengan mengacu pada literatur yang terkait dengan permasalahan hukum yang dibahas seperti peraturan perundang-undangan, putusan pengadilan, serta mengkaji norma hukum, asas hukum pendekatan lapangan melalui wawancara mendalam dengan Ketua BPSK Karawang. Data primer yang diperoleh dari putusan BPSK dan Pengadilan Negeri Karawang, sedangkan untuk data sekunder berupa literatur hukum dan jurnal ilmiah. Analisis dilakukan secara deskriptif untuk menjawab permasalahan mengenai kewenangan BPSK dan kekuatan hukum putusannya dalam konteks perlindungan konsumen. Hasil penelitian menunjukkan bahwa BPSK Karawang memiliki kewenangan penuh untuk menangani perkara tersebut berdasarkan Pasal 52 UUPK, dengan catatan bahwa kedua belah pihak harus sepakat untuk menyelesaikan sengketa melalui mekanisme BPSK. BPSK memutuskan bahwa klausula baku yang membebankan kewajiban pelunasan kepada ahli waris melanggar Pasal 18 UUPK dan dinyatakan batal demi hukum, sehingga kewajiban pelunasan berakhir dengan meninggalnya debitur. Putusan BPSK memiliki kekuatan hukum mengikat berdasarkan Pasal 54 dan 58 UUPK, namun dalam praktiknya menghadapi kendala implementasi karena ketiadaan kesepakatan para pihak dan kemungkinan upaya hukum ke pengadilan negeri.
