Abstract

Copyright protection for musical works is a vital aspect of the music industry. However, the practice of using songs commercially without the creator’s authorization remains a significant problem that violates both economic and moral rights. This research aims to analyze the scope of legal protection for song copyrights under Law Number 28 of 2014 and the challenges of its enforcement. It also critically examines the Panel of Judges’ legal reasoning in Case Number 92/Pdt.Sus-HKI/Copyright/2024/PN Niaga Jkt.Pst concerning the determination of the Performer’s liability and the application of civil sanctions. This normative legal research employs a qualitative analysis of primary and secondary legal materials, drawing on statutory, case, and conceptual approaches. The findings indicate that although Law Number 28 of 2014 provides a robust basis for protection, various enforcement challenges persist. Case Number 92/Pdt.Sus-HKI/Copyright/2024/PN Niaga Jkt.Pst affirmed the occurrence of copyright infringement by the Performer. The ruling found the Performer liable despite the presence of an organizer. It also imposed economic damage sanctions by referencing parameters within criminal provisions. However, the court rejected the claim for moral rights damages for lack of proof. This case has implications for affirming the Performer’s liability and the paradigm for imposing sanctions in song copyright disputes. It also promotes increased legal awareness within the Indonesian music industry.

Abstract

The purpose of this study is to establish legal certainty regarding the validity of contracts and the legitimacy of execution by creditors in motor vehicle financing agreements that are not formalized through notarial deeds and court rulings, as well as to assess their impact on legal certainty and debtor protection. This research employs a normative legal method by collecting data through a literature review of legislation, court decisions, legal literature, and relevant motor vehicle financing contracts. The study finds that motor vehicle financing contracts without notarial deeds have weaknesses in evidentiary strength, creating opportunities for creditors in Indonesia to execute collateral without court authorization. However, the legality of such execution must be based on Constitutional Court Decision No. 2/PUU-XIX/2021, which states that execution may proceed without a court ruling if there is voluntary surrender and a clear basis for execution. Thus, this research provides an original contribution by thoroughly examining the legal aspects of fiduciary guarantee execution in the context of motor vehicle financing contracts, a topic that has received little attention in non-bank financing practices in Indonesia

Abstract

Angka pertumbuhan dan perkembangan manusia yang sangat pesat menjadikan tanah sebagai komoditas penting untuk dikelola menjadi lahan produksi dengan tujuan menunjang keberlangsungan hidup manusia. Penelitian ini bertujuan untuk mengetahui kepastian hukum perbuatan melawan hukum terhadap kepemilikan/menguasai tanah milik orang lain yang terdapat dalam Putusan Nomor 6/Pdt.G/2022/PN.Kwg. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum positif. Hasilnya penelitian ini menunjukkan bahwa perbuatan penyerobotan/penguasaan tanah milik orang lain merupakan perbuatan yang mengakibatkan kerugian kepada pemilik tanah dan sesuai dengan aturan dan isi KUH Perdata Pasal 1365 menyatakan bahwa setiap kerugian yang diakibatkan pada orang lain harus mengganti kerugian sesuai dengan jumlah kerugian yang ditimbulkan dan sesuai pertimbangan hakim pada kasus ini adalah penolakan gugatan karena penggugat tidak dapat membuktikan perbuatan melawan hukum yang dilakukan oleh tergugat dalam persidangan.

Abstract

Cosmetics are used primarily for women for various purposes such as to make an attractive appearance. One of them is the HN Cream product, which is still a serious problem, which includes products that are not as safe as consumer expectations. As a result of using these products, it causes financial losses and also skin diseases including skin peeling, acne breakouts, and others. This is not in accordance with Law no. 8 of 1999 regarding Consumer Protection. The main problem that the author raises in this study is how the process of applying legal protection to consumers of facial whitening cosmetics Cream HN in online buying and selling transactions according to Law no. 8 of 1999 concerning Consumer Protection and how are the factors inhibiting the implementation of consumer protection for Cream HN cosmetics in online buying and selling transactions. His method applies an empirical juridical approach, and is carried out directly to the place that is the object of his research. Researchers also obtained data through the interview process. His research was obtained from the results of selling Cream HN online. The approach uses a primary approach, which is in the form of data obtained from field studies. The result is that to provide legal protection guarantees regarding consumers, business actors when selling online must be based on Law no. 8 of 1999 regarding consumer protection.

Abstract

Capital punishment is a compelling and expansive type of discipline, and the discussion about the upsides and downsides of the death penalty go on today. The question of whether the death penalty should be retained in the Criminal Code or abolished in the justice system is inseparable from Indonesia's reform of criminal law, particularly through the creation of the Criminal Code. Despite the fact that its nature differs from that outlined in the Criminal Code, Indonesia will continue to use the death penalty, as evidenced by the Criminal Code Bill, which contains the death penalty. The purpose of this research is to identify the current legal formulation of death penalty policies in Indonesian criminal law and to examine the desired future legal formulation of death penalty policies in Indonesia. This study utilizes a subjective technique with a legitimate and administrative methodology as well as unmistakable scientific exploration details. According to the findings of this study, the death penalty is still regulated by Indonesian law as the primary form of punishment, resulting in disagreements between pro- and anti-death penalty groups. In the new version of Indonesian criminal law, change in death penalty policy, originally a principal punishment to become an alternative punishment . In the future, the death penalty will be a tangible expression of human rights that is in line with national and international perspectives.

Abstract

The motivation behind this composing is to specify the execution of Article 64 of Unofficial law (PP) Number 35 of 2021 Concerning Explicit Time Work Arrangements, Reevaluating, Working Time/Hours and Rest, and End of Business, as well as methodology for execution in light of Unofficial law 35 of 2021 concerning Time Arrangements. Explicitly re-appropriating, working time/hours and rest periods, as well as end of business connected with Unofficial law in Lieu of Regulation (Perppu) Number 2 of 2022 concerning Position Creation. In this review, the creators utilize a standardizing juridical methodology as a technique for approach. The end is that Administration Guideline (PP) Number 35 of 2021 concerning Work Arrangements for Explicit Periods, Re-appropriating, Working Hours and Breaks, and End of Business, which corrects Regulation Number 13 of 2003 concerning Labor makes regulations for laborers. The legitimate outcome is that the temporary guidelines are not directed, which makes managers randomly utilize laborers with PKWT status for over 5 years with no juridical results.

Abstract

Overclaim occurs when business actors convey excessive or factual information in product promotions, thus misleading consumers and violating the principles of transparency and honesty in trade. In the skincare industry on e-commerce platforms, this practice is increasingly widespread along with high market competition. Consumers are often disadvantaged because they do not have adequate ability to verify the truth of product claims. This study aims to examine the form of legal protection provided to consumers, as well as to examine the responsibilities of business actors based on the provisions of Law Number 8 of 1999 concerning Consumer Protection. The method used is qualitative with a normative legal approach, which focuses on literature studies and analysis of relevant laws and regulations. The findings in this study indicate the need to strengthen the legal protection system, both preventively through advertising monitoring mechanisms, and repressively through the application of strict legal sanctions. The active involvement of e-commerce platforms is also key to creating effective consumer protection in the digital space.

Abstract

Indonesia's Basic Agrarian Law (UUPA) sets out the requirements for the conversion of verponding eigendom land, regulating the rights of Westerners to be included in the applicable land law system. Based on the UUPA, land rights must be converted until September 24 1980. However, there are still frequent claims of land ownership resulting from eigendom disputes that have not been legally resolved, which causes land disputes. Case of verponding eigendom land dispute between the heirs of the Muller Family, PT. Dago Inti Graha versus Dago Elos residents is a clear example of the complexity that can occur in land ownership issues. Since it started in 2016, this dispute has been decided four times, one of which was at the PK level with Case Register Number 109 PK/Pdt/2022. Normative juridical and analytical descriptive approaches, in legal studies and relevant legal cases are analyzed. Result: According to the provisions of UUPA and its implementing regulations, as well as Government Regulation no. 24 of 1997, if there is no land eigendom verponding convention, the land then becomes state property. Through the trial, the Panel of Judges considered that the heirs of the Muller Family had succeeded in proving that they were the legal holders of land rights, compared to the claims of Dago Elos Residents who did not have proof of ownership and that the Muller Family heirs had more complete and valid supporting documents than the Residents. Dago Elos. Based on these considerations, the judge decided that the heirs of the Muller family had stronger and more legal rights to the disputed land than the Dago Elos residents. Therefore, the legal consequences for control of disputed land are that the heirs of the Muller family have the right to register the land and obtain legal recognition of ownership of the disputed land.

Abstract

The implementation of leasing village treasury land is a common practice in Indonesia. However, in practice there are legal problems that often arise related to the protection of the rights of the parties involved in it. The implementation of this lease activity is related to the construction of the Subang Smartpolitan Industrial Estate by a private company that has obtained an Industrial Estate Business License (IUKI) in Subang Regency. One of the villages affected by the development of industrial estates has assets in the form of village treasury land that will be changed in function through the ruilslag or exchange process. To regulate the use of land during the ruilslag administrative process, it is considered necessary to first carry out a lease agreement. This legal event highlights the importance of regulating land use changes in a transparent manner and in accordance with applicable regulations. This research uses the Normative Juridical approach method, which is a form of scientific activity, which is based on certain methods, systematics, and thoughts, aiming to study one or several specific legal phenomena. The implementation of the lease agreement for village treasury land is linked to the Regulation of the Minister of Home Affairs Number 3 of 2024 concerning Amendments to the Regulation of the Minister of Home Affairs Number 1 of 2016 concerning Village Asset Management. Several legal aspects that need to be considered in a lease agreement such as Legal Basis, Village Authority, Lease Agreement, Transparency and Openness, Coordination, Protection of Village Rights, Alignment with Development, Supervision and Accountability, Legal Education, Public Supervision. Legal consequences for the parties involved, namely Binding Agreement, Rights and Obligations of the Parties, Duration of Rent, Rent Payment, Land Use, Maintenance and Repair, Transfer of Lease Rights, Sanctions and Fines, Dispute Resolution and Restoration of Village Rights.

Abstract

A pawn agreement is an agreement between the creditor and the debtor, where the creditor obtains collateral for the goods provided by the debtor, and the debtor obtains collateral for the goods bound by him in the form of a money loan. The goods used as collateral or bound by a pawn agreement must be goods that belong to the debtor. The problem that can be discussed in this paper is the legal consequences of a pawn agreement with a pawn object that does not belong to the debtor as collateral and the judge's consideration in Decision Number 170/Pdt.G/2018/PN Skt. related to the object of pawn collateral. This paper uses normative juridical research methods. The conclusion of this research is that a pawn agreement held as collateral for a pawn object that does not belong to the debtor can make the pawn agreement null and void in accordance with Article 1320 of the Civil Code and analogous to the provisions of Article 1471 and the judge's consideration is correct and in accordance with applicable regulations. The verdict decided that The Joe An had legally committed a tort against PT Pegadaian and stated that the evidence which was also the object of the pawn collateral in this case must be returned to Koentjahjono Tanto as the owner of the gold shop.
