Abstract

The dispute case between Gakoptas and PT Torus Ganda caused problems. PT Torganda illegally controlled Gakoptas land which caused a conflict, as a result a farmer was injured. This study aims to determine the causal factors and resolution strategies in the dispute case between Gakoptas and PT Torganda. This study uses a normative juridical method with the sources of materials used in the form of secondary, primary and tertiary sources. The results of this study state that the causal factors of the conflict are due to the land administration system, inequality in the distribution of land ownership, legality of land ownership and economic motives. The resolution strategy can be carried out by executing the Supreme Court's decision, land redistribution through agrarian reform, land controlled by PT Torganda is returned to Gakoptas, economic recovery and sanctions.

Abstract

Emergency Services are medical actions needed by emergency patients immediately to save lives and prevent disability. The problems in this study include how the legal relationship between doctors and patients in the Emergency Installation medical services according to health law in Indonesia, how the implementation of medical services to patients in the Emergency Room of the Porsea Regional General Hospital, and what form of legal protection regarding the actions of doctors in providing patient services in the Emergency Room of the Porsea Regional General Hospital. This study uses an empirical legal method with a descriptive analysis approach. Data were obtained through interviews, observations, and legal document studies. The legal relationship between medical and health personnel and patients in medical services in the emergency installation of a hospital according to health law in Indonesia is based on the principle that informed consent must be obtained before medical action is taken, especially in an emergency. The implementation of medical services for patients in the Emergency Room of Porsea Regional General Hospital has generally referred to a well-structured SOP, starting from the triage process to assess the patient's level of emergency to medical and administrative treatment. The form of legal protection for the actions of doctors in providing patient services in the Emergency Room (IGD) of Porsea Regional General Hospital focuses on the doctor's obligation to act quickly and appropriately in emergency situations, even though the patient cannot provide direct consent. Porsea Regional General Hospital also provides legal protection through the socialization of medical ethics and law, legal assistance for medical personnel in the event of a medical dispute, and a good documentation system to ensure that all medical actions are in accordance with applicable operational standards and procedures. Researchers recommend improving understanding of health law and therapeutic communication by medical personnel, periodic evaluation of SOPs by hospitals, and routine training on legal and ethical aspects of medicine, especially regarding the handling of emergency patients without consent to improve the quality and protection of services.

Abstract

Trade secrets are an important part of Intellectual Property Rights (IPR) that play a strategic role in maintaining a company's competitive advantage. Protecting information that is not generally known, has economic value, and is kept confidential is very important, especially in the midst of globalization and technological advances that increase the risk of information leakage. Law No. 30 of 2000 concerning Trade Secrets is the main legal basis in Indonesia, in line with international agreements such as WTO/TRIPS. This research uses normative juridical methods to analyze trade secret legal protection, including based on property rights theory, contract theory, and tort theory. In addition, the role of employment contract clauses that regulate obligations to maintain confidentiality and prohibitions on working for competing companies after termination are discussed as preventive strategies. This research confirms the importance of awareness and concrete legal steps from business owners to protect their trade secrets effectively.

Abstract

This study examines the legal aspects and implementation of employment contracts in Indonesia in the context of changes in labor regulations. The study analyzes the legal framework underlying employment contracts, worker rights protection, employer obligations, and implementation challenges in the field. Using a qualitative approach and legal document analysis, this study identifies several key issues related to employment contracts, including imbalance in bargaining power, unclear clauses, and compliance with the latest regulations. The results of the study show that although there has been progress in legal protection through labor laws, implementation in the field still faces various challenges. This study provides recommendations for improving policies and practices related to employment contracts that are more balanced, transparent, and in line with the principle of fairness for all parties.

Abstract

Determination of custody of children under the age of 12 after divorce is usually guided by Article 105 of the Compilation of Islamic Law (KHI), which normatively mandates that child custody be granted to the mother. This research focuses on examining two main issues: the legal factors that influence the determination of child custody rights to the plaintiff, and how the court considers these legal factors in issuing a child custody decision. This research was conducted using a normative legal perspective using qualitative methods, based on an analysis of Decision No. 155/Pdt.G/2024/PA.Bji. The results show that the panel of judges did not adhere strictly to the literal meaning of Article 105 of the KHI, and preferred a more adaptive interpretation, adapting it to concrete conditions in the field. Although both parents are considered capable of caring for the children, the author argues that full custody should still be granted to the mother, considering that the children are still very young and emotionally closer to the mother in their daily lives.

Abstract

Informed consent sebagai persetujuan tindakan kedokteran yang akan dilakukan terhadap pasien. Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan hukum mengenai kewajiban informed consent dalam pelayanan pencabutan gigi, tanggung jawab dokter gigi terhadap pasien dalam penyampaian Informed Consent pada kasus pencabutan gigi dan perlindungan hukum terhadap dokter gigi dalam menangani pasien kasus pencabutan gigi tanpa informed consent pada berbagai tempat praktik mandiri dokter gigi di Pematangsiantar. Metode dalam penelitian ini menggunakan penelitian yuridis empiris bersifat deskriptif analitis. Sumber data yang diperoleh menggunakan data primer dan data sekunder. Teknik pengumpulan data yang digunakan adalah studi kepustakaan. Pengaturan hukum mengenai kewajiban informed consent dalam pelayanan pencabutan gigi oleh dokter gigi di Indonesia telah diatur dalam UU No. 36 Tahun 2009 Tentang Kesehatan, UU No. 44 Tahun 2009 Tentang Rumah Sakit, KUH Perdata dan UU No. 17 Tahun 2023 tentang Kesehatan. Tanggung jawab dokter gigi terhadap pasien dalam penyampaian Informed Consent pada kasus pencabutan gigi dimulai sebelum melakukan tindakan, seperti alat dan bahan steril, memeriksa riwayat medis pasien,  melanjutkan dengan tindakan pencabutan sesuai SOP dan mempertimbangkan kompetensi dokter, serta penatalaksanaan pencabutan gigi. Perlindungan hukum terhadap dokter gigi dalam menangani pasien kasus pencabutan gigi tanpa informed consent pada berbagai tempat praktik mandiri dokter gigi di Pematangsiantar menunjukkan kesadaran pembuatan informed consent dalam setiap tindakan. Adapun 2 prinsip perlindungan dalam UU Nomor 17 Tahun 2023 Tentang Kesehatan, berupa: a). Perlindungan hukum preventif dan b). Perlindungan hukum represif. Dari segi perdata, diperlukan peningkatan kepatuhan terhadap proses informed consent yang menyatakan setiap dokter gigi harus memastikan proses dilakukan secara menyeluruh. Dari segi pidana, diperlukan peningkatan pengawasan dan audit terhadap praktik dokter gigi secara berkala. Peneliti menyarankan agar setiap dokter gigi harus menyediakan informed consent dalam menangani pasien.

Abstract

The enforcement of fair and transparent justice requires a firm guarantee of the principles of fair trial and open justice within the judicial system. These two principles are fundamental to the protection of human rights and serve as essential mechanisms to ensure the accountability of judges as executors of judicial power. This study aims to analyze the implementation of fair trial and open justice principles in judicial oversight practices through the instruments of legal memorandum and public examination (eksaminasi). This research employs a normative method with a statutory and document-based approach. The findings indicate that although not formally regulated as part of Indonesia’s judicial oversight system, legal memoranda and examinations play a significant role in enabling public participation and control over judicial independence and integrity. Strengthening these instruments can serve as an effective strategy to realize an accountable, transparent judiciary that upholds procedural justice.

Abstract

Article 409 paragraph (4) of Law Number 17 of 2023 concerning Health states that the Regional Government allocates the Health budget from the APBD in accordance with regional Health needs. However, the budget allocation still includes expenditure for health sector personnel, not fully for promotive, preventive, curative and rehabilitative purposes. In North Aceh Regency, the APBD allocation for PBI is crucial in ensuring the sustainability and success of the JKN program, especially in the long term. To find out the legal arrangements for APBD contributions to Recipients of Contribution Assistance (PBI) in the National Health Insurance (JKN) program, the implementation of APBD contributions to Recipients of Contribution Assistance (PBI) in the National Health Insurance (JKN) program in Kab. North Aceh, and obstacles and solutions to the implementation of APBD contributions for Contribution Assistance Recipients (PBI) in the National Health Insurance (JKN) program in the District. North Aceh. The research method used is normative legal research through library research or document study. This research also uses an empirical/sociological juridical approach through field studies. The research results show that the legal regulation of Regional Revenue and Expenditure Budget (APBD) contributions for Contribution Assistance Recipients (PBI) in the National Health Insurance Program (JKN) is an important part of the government's efforts to realize universal health coverage in Indonesia. Implementation of Regional Revenue and Expenditure Budget (APBD) contributions for Contribution Assistance Recipients (PBI) in the National Health Insurance Program (JKN) in North Aceh Regency is a crucial component in the regional government's efforts to guarantee access to health services for all its citizens, especially those in the community unable. Even though it is faced with various obstacles such as budget limitations, difficulties in identifying and verifying beneficiaries, challenges in inter-agency coordination, as well as administrative and bureaucratic complications, North Aceh District is trying to optimize the use of APBD funds to support the sustainability and effectiveness of the JKN program. Obstacles in implementing Regional Revenue and Expenditure Budget (APBD) contributions to Recipients of Contribution Assistance (PBI) in the National Health Insurance Program (JKN) in North Aceh Regency include budget limitations, difficulties in identifying and verifying beneficiaries, challenges in coordination between institutions, as well as complications administration and bureaucracy. Solutions to overcome these obstacles involve optimizing regional financial resources, using information technology to update and verify beneficiary data efficiently, increasing coordination and communication between institutions through the establishment of coordination forums, as well as reforming administrative and bureaucratic procedures to speed up the process of allocation and distribution of funds.

Abstract

The distribution of inheritance in Indonesia is not the same between one community group and another. This difference arises because the inheritance distribution system according to customary law rules is closely related to the family system that applies to each community group itself. Division of inheritance often results in sDisputes can be caused by various factors, including differences of opinion or disagreements between one party and another, and can also be caused by the dominance of the oldest heir or male children who get more of the inheritance. In fact, many cases and disputes over inheritance of inheritance between fellow heirs have reached court and have even been decided by the court. This research usesnormative juridical research methods, using a qualitative approach.The type of data in this research was collected by applying the library research method with secondary data sources and enriched with primary data resulting from interviews with a Nias traditional community leader.Based on the research, the results showed that the Nias traditional community in dividing inheritance property draws on the male lineage, where in this case sons and daughters follow the father's lineage or a system of paternal descent (Patrilineal) is applied, which is based on blood ties according to father's line, so that only sons are heirs, because daughters are considered to have left their father's family, if they are married. Land status in dispute case no. 84/Pdt.g/2021/PB Gst is the land inherited from the late. Badukhali Zega bint Sarinata.The results of the research show that the judge's considerations which caused the lawsuit to be rejected in its entirety were because the Plaintiffs were unable to prove the arguments for their lawsuit with valid arguments, whereas on the other hand the Defendants had succeeded in proving their objections, so the Plaintiffs' lawsuit was appropriate and had legal grounds to be rejected in its entirety.

Abstract

Electronic medical records (RME) are important for increasing efficiency and accuracy in health services and facilitating the resolution of medical disputes by providing comprehensive and easily accessible documentation. However, the implementation of RME in Indonesia faces unclear regulatory challenges and data security issues. There is a need for harmonization of regulations to support the effective and safe implementation of RME, which can speed up the process of resolving medical disputes in a fair and transparent manner. This study aims to evaluate the regulations governing the use of electronic medical records (RME) in the health care system in Indonesia and assess their application in resolving medical disputes. Another aim is to identify the advantages and disadvantages of using RME in resolving medical disputes from a legal perspective. This research method uses a normative legal approach to analyze legal regulations related to electronic medical records and medical dispute resolution. Secondary data from various sources such as journals, books and legal articles are used for descriptive-analytical analysis. The research results show that regulations for the use of electronic medical records (RME) in Indonesia do not fully accommodate developments in RME technology, focus more on conventional medical records, and do not regulate aspects of data security, accessibility and interoperability of RME. Other challenges include data security and limited technological infrastructure in some areas. Compared with developed countries such as the United States (HITECH Act) and Europe (GDPR), Indonesia needs to update and harmonize regulations to support a more effective and safe implementation of RME in resolving medical disputes
