Abstract

The distribution of inheritance in Indonesia is not the same between one community group and another. This difference arises because the inheritance distribution system according to customary law rules is closely related to the family system that applies to each community group itself. Division of inheritance often results in sDisputes can be caused by various factors, including differences of opinion or disagreements between one party and another, and can also be caused by the dominance of the oldest heir or male children who get more of the inheritance. In fact, many cases and disputes over inheritance of inheritance between fellow heirs have reached court and have even been decided by the court. This research usesnormative juridical research methods, using a qualitative approach.The type of data in this research was collected by applying the library research method with secondary data sources and enriched with primary data resulting from interviews with a Nias traditional community leader.Based on the research, the results showed that the Nias traditional community in dividing inheritance property draws on the male lineage, where in this case sons and daughters follow the father's lineage or a system of paternal descent (Patrilineal) is applied, which is based on blood ties according to father's line, so that only sons are heirs, because daughters are considered to have left their father's family, if they are married. Land status in dispute case no. 84/Pdt.g/2021/PB Gst is the land inherited from the late. Badukhali Zega bint Sarinata.The results of the research show that the judge's considerations which caused the lawsuit to be rejected in its entirety were because the Plaintiffs were unable to prove the arguments for their lawsuit with valid arguments, whereas on the other hand the Defendants had succeeded in proving their objections, so the Plaintiffs' lawsuit was appropriate and had legal grounds to be rejected in its entirety.

Abstract

Electronic medical records (RME) are important for increasing efficiency and accuracy in health services and facilitating the resolution of medical disputes by providing comprehensive and easily accessible documentation. However, the implementation of RME in Indonesia faces unclear regulatory challenges and data security issues. There is a need for harmonization of regulations to support the effective and safe implementation of RME, which can speed up the process of resolving medical disputes in a fair and transparent manner. This study aims to evaluate the regulations governing the use of electronic medical records (RME) in the health care system in Indonesia and assess their application in resolving medical disputes. Another aim is to identify the advantages and disadvantages of using RME in resolving medical disputes from a legal perspective. This research method uses a normative legal approach to analyze legal regulations related to electronic medical records and medical dispute resolution. Secondary data from various sources such as journals, books and legal articles are used for descriptive-analytical analysis. The research results show that regulations for the use of electronic medical records (RME) in Indonesia do not fully accommodate developments in RME technology, focus more on conventional medical records, and do not regulate aspects of data security, accessibility and interoperability of RME. Other challenges include data security and limited technological infrastructure in some areas. Compared with developed countries such as the United States (HITECH Act) and Europe (GDPR), Indonesia needs to update and harmonize regulations to support a more effective and safe implementation of RME in resolving medical disputes

Abstract

The profession as a dentist is not easy because many dentists in the world often commit malpractice acts. Law Number 17 of 2023 concerning Health regulates the qualifications and types of dental malpractice acts. Problems include how negligence by dentists in carrying out their duties is categorized as malpractice and is a criminal act, factors that cause dentists to be negligent in carrying out their duties and how criminal liability for dentist negligence which causes injuries to patients is reviewed from Law Number 17 of 2023 About health. The type of research used in this research is normative legal research. The nature of the research used in this research is descriptive. A dentist's negligence in carrying out their duties which results in injury to a patient can be categorized as malpractice and a criminal act. This occurs when dentists do not comply with professional standards, standard operating procedures, or applicable codes of ethics, which harms patients. The factors that cause dentists to be negligent in carrying out their duties include several important aspects, namely the negligence factor (culpa), the deliberate factor, the misunderstanding factor (dwaling), the error of judgment factor, the contributory negligence factor and the infrastructure factors. Criminal liability for a dentist's negligence which causes injury to a patient is reviewed by Law Number 17 of 2023 Health, regulated in Article 440 of the Law, punishable by a maximum imprisonment of 3 years or a maximum fine of IDR 250,000,000. If the negligence causes death, the sentence can increase to a maximum prison term. 5 years or a maximum fine of IDR 500,000,000. Researchers recommend that dentists regularly participate in training and education regarding professional standards, standard operating procedures (SOP). So that dentists increase awareness regarding the responsibility for negligence which can result in injury to patients..

Abstract

This study aims to determine and analyze legal regulations regarding the obligation of informed consent in tooth extraction services, the responsibility of dentists towards patients in providing informed consent in cases of tooth extraction and legal protection for dentists in handling patients in cases of tooth extraction without informed consent in various places. Independent practice of dentist in Pematangsiantar. The method in this research uses descriptive analytical empirical juridical research. The data sources obtained used primary data and secondary data. The data collection technique used is library research. The results of this research reveal that legal regulations regarding the obligation of informed consent in tooth extraction services by dentists in Indonesia have been regulated in various laws, including Law no. 36 of 2009 concerning Health, Law no. 44 of 2009 concerning Hospitals and now Law no. 17 of 2023 concerning Health. The dentist's responsibilities include providing sterile tools and materials, examining the patient's medical history, and carrying out extractions according to SOP and competency. Legal protection for dentists in cases of extractions without informed consent in Pematangsiantar reflects awareness of the importance of informed consent. UU no. 17 of 2023 emphasizes two principles of legal protection: preventive and repressive. If the dentist does not carry out the obligation to carry out informed consent, there could be civil and criminal consequences. This study recommends that every dentist provide informed consent in treating patients.

Abstract

Healthcare services include all attempts to preserve and enhance a person's health, stop and treat illnesses, and recover their condition. The purpose of this study is to investigate Pidie Jaya Regional Hospital's legal aspects of healthcare services. The study concentrates on the way patients' rights and obligations are carried out and points up the challenges to this process. One used a descriptive method in an empirical study approach. Using both primary and secondary data, data were gathered by observations, interviews, and literary reviews. The results show that Law Number 17 of 2023 on Health rules several areas of healthcare services, including legality, balance, timeliness, good faith, prudence, transparency, autonomy, non-maleficence, beneficence, justice, confidentiality, honesty, and adherence. Patients' rights and obligations are enforced at the Pidie Jaya Regional Hospital by means of processes intended to guarantee that service standards are satisfied and that patients' rights are most respectfully respected. Obstacles such as a lack of knowledge and awareness, problems with facilities and human resources, and administrative and regulatory barriers, however, prevent the full realization of patients' rights and obligations. Notwithstanding these difficulties, Pidie Jaya Regional Hospital has responded to patient complaints by making sure their rights are respected in line with the hospital's dedication and operation as a public health agent. This paper comes to the conclusion that improving service quality depends critically on knowledge and application of pertinent legal components in healthcare services as well as awareness-raising and resource management. It also provides ideas on how satisfying patient rights and enhancing administrative effectiveness in regional hospitals would help to improve healthcare facilities.

Abstract

Perubahan sistem hukum pidana nasional melalui pengesahan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP) menandai babak baru dalam pembangunan hukum di Indonesia. Salah satu aspek penting yang mengalami transformasi adalah peran dan fungsi penemuan hukum (rechtsvinding) dalam sistem hukum nasional. Penemuan hukum bukan sekadar kegiatan teknis hakim dalam mengisi kekosongan hukum, tetapi juga merupakan proses intelektual yang melibatkan penalaran yuridis dan pertimbangan moral untuk mewujudkan keadilan substantif. Kajian ini bertujuan untuk menganalisis perkembangan teori penemuan hukum dalam konteks sistem hukum Indonesia serta menelaah bagaimana prinsip-prinsip tersebut direfleksikan dalam KUHP Baru. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menelaah sumber hukum primer seperti peraturan perundang-undangan dan yurisprudensi, serta sumber hukum sekunder berupa literatur dan karya ilmiah hukum. Hasil kajian menunjukkan bahwa KUHP Baru memberikan ruang yang lebih luas bagi hakim untuk melakukan penemuan hukum secara kreatif dan berorientasi pada nilai-nilai keadilan sosial, terutama melalui pengakuan terhadap hukum yang hidup di masyarakat (living law). Dengan demikian, teori penemuan hukum yang semula berorientasi pada positivisme hukum kini bergeser menuju paradigma hukum progresif yang menempatkan hakim sebagai agen moral dalam menegakkan hukum yang berkeadilan.

Abstract

Penelitian ini bertujuan untuk menganalisis kecakapan hukum debitur di bawah usia 21 tahun dalam pelaksanaan akad kredit menurut hukum perdata Indonesia. Berdasarkan ketentuan Pasal 1320 dan Pasal 1330 Kitab Undang-Undang Hukum Perdata (KUHPerdata), salah satu syarat sahnya perjanjian adalah adanya kecakapan hukum para pihak. Pasal 330 KUHPerdata menentukan bahwa seseorang baru dianggap dewasa apabila telah mencapai usia 21 tahun atau telah menikah. Dengan demikian, debitur di bawah usia 21 tahun yang belum menikah dianggap belum cakap hukum untuk melakukan perbuatan hukum, termasuk akad kredit. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa perjanjian kredit yang dilakukan oleh debitur di bawah usia 21 tahun tanpa persetujuan orang tua atau wali hanya memiliki kekuatan hukum bersyarat, yakni dapat dibatalkan oleh pihak yang berwenang. Temuan ini menunjukkan pentingnya prinsip kehati-hatian (prudential principle) bagi lembaga keuangan dalam proses penyaluran kredit untuk menjamin kepastian dan perlindungan hukum bagi para pihak.

Abstract

Penelitian ini bertujuan untuk menganalisis penafsiran hukum oleh Mahkamah Konstitusi dalam Putusan Nomor 90/PUU-XXI/2023 mengenai ketentuan usia minimal calon presiden dan wakil presiden dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Permohonan perkara tersebut berfokus pada frasa “berusia paling rendah 40 tahun” dalam Pasal 169 huruf q Undang - Undang Pemilu yang dinilai diskriminatif dan membatasi hak konstitusional warga negara berusia di bawah 40 tahun yang memiliki pengalaman sebagai kepala daerah. Analisis ini menggunakan pendekatan normatif melalui telaah terhadap putusan MK serta kajian literatur terkait teori penafsiran hukum, hak konstitusional warga negara, dan prinsip non-diskriminasi dalam hukum pemilu. Hasil penelitian menemukan bahwa hakim MK melakukan penafsiran bersyarat dengan memperluas makna syarat usia yang dimaksud, sehingga membuka peluang bagi calon presiden/wakil presiden yang belum berusia 40 tahun tetapi memiliki pengalaman sebagai kepala daerah. Penafsiran ini dinilai berdampak pada dinamika perkembangan demokrasi dan konstitusionalisme di Indonesia, karena memberi ruang kepada representasi generasi muda dalam kontestasi politik nasional.
