Abstract

This article discusses a community service program focused on the management of legal libraries and documentation in higher education institutions within the DKI Jakarta area. The program aims to enhance the quality of legal library services by optimizing information and legal documentation management systems based on technology. This initiative is driven by the importance of legal libraries as resource centers that support education, research, and the development of legal studies.  The methods employed include training in modern library management, digitization of legal collections, and the implementation of legal reference management software. The program also involves improving the skills of librarians and administrative staff in systematically managing and organizing legal collections. Furthermore, the activities introduce the integration of digital legal information systems to facilitate access and data retrieval for students, lecturers, and researchers.  The results of this program show significant improvements in the effectiveness and efficiency of legal library management. Partner institutions in the program experienced benefits such as easier access to legal literature, more structured documentation systems, and enhanced librarian skills in managing legal data.

Abstract

This research elaborates on the power politics prevailing in Indonesia regarding women's leadership in the public sphere in Indonesia. Without realizing it, the patriarchal culture that lives in society makes women marginalized so that women are often neglected, including their rights in public leadership. This research utilizes a phenomenological approach to give meaning to the phenomenon of women's leadership in the public sphere. In addition, the legislative approach is also presented to capture and analyze regulations that open and close access for women in the public sphere. This article concludes that a woman is someone who has the right to organize and influence or organize society to achieve the goals of a country. The existence of several regulations in Indonesia that open space for women to take part in public leadership makes Indonesia an egalitarian country that provides equal and balanced rights for men and women to occupy strategic positions in the public sphere. This research found that women have the right to leadership in the public sphere just like men. Likewise, in the discourse of Islamic law, leadership is not monopolized by men but women can fill it as well as men. Penelitian ini mengelaborasi politik kekuasaan yang berlaku di Indonesia terkait kepemimpinan perempuan di ranah publik di Indonesia. Tanpa disadari, budaya patriarki yang hidup di masyarakat menjadikan perempuan termarginalkan sehingga perempuan seringkali terabaikan hak-haknya termasuk hak dalam kepemimpinan publik. Penelitian ini menginstrumentasikan pendekatan fenomenologi yang hendak memberikan makna terhadap fenomena kepemimpinan perempuan di ranah publik. Disamping itu, pendekatan perundang-undangan juga dihadirkan guna memotret dan menganalisis peraturan-peraturan yang membuka dan menutup akses bagi perempuan di ranah publik. Artikel ini menyimpulkan bahwa perempuan adalah seseorang yang berhak untuk mengatur dan mempengaruhi atau mengatur masyarakat untuk mencapai tujuan suatu negara. Adanya beberapa peraturan di Indonesia yang membuka ruang bagi perempuan untuk andil dalam kepemimpinan publik menjadikan Indonesia sebagai negara egaliter yang memberikan hak yang sama dan seimbang bagi laki-laki dan perempuan untuk menduduki posisi strategis di ranah publik. Penelitian ini menemukan bahwa perempuan memiliki hak kepemimpinan di ruang publik seperti halnya laki-laki. Begitupun dalam diskursus hukum Islam, kepemimpinan tidak dimonopoli kaum laki-laki namun perempuan bisa mengisinya juga sebaimana laki-laki.

Abstract

Masalah perusakan hutan masih menjadi isu nasional yang memerlukan penanganan serius dari semua pihak. Meningkatnya pelanggaran terkait perusakan hutan dengan mudah diketahui oleh masyarakat tidak saja melalui pemberitaan di massa media, baik cetak maupun elektronik, tetapi juga dari berbagai data yang dikeluarkan oleh berbagai institusi, baik swasta maupun pemerintah. Sumber data yang digunakan dalam penelitian ini adalah data sekunder. Metode analisis data yang digunakan adalah yuridis normatif kualitatif sementara metode pendekatan menggunakan metode pendekatan undang-undang. Hasil penelitian menunjukkan bahwa Penerapan Pasal 83 ayat (1) huruf b, Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan Dan Pemberantasan Perusakan Hutan sebagai upaya penegakan hukum dikatakan sudah ditegakkan dengan cukup baik sesuai dengan aturan yang berlaku yang dilakukan oleh aparat penegak hukum seperti Dinas Kehutanan, Polisi Hutan, Kepolisian, Kejaksaan Negeri, dan Pengadilan Negeri yang tergabung dalam suatu tim khusus untuk memberantas pelaku penebangan liar. Dimana tahap-tahap penegakan hukumnya dari proses penyelidikan, penyidikan, penangkapan, penahanan, penuntutan, dan pemeriksaan di pengadilan berjalan dengan baik sesuai prosedur yang ada. Sementara Hambatan yang terjadi dalam penegakan hukum jika dilakukan secara progresif adalah salah satunya bersumber dari hukum itu sendiri yaitu dari peraturan perundang-undangan terkait kehutanan, peraturan perundang-undangan yang dikeluarkan dianggap mengabaikan hukum adat, terjadinya insinkronisasi antara peraturan pemerintah dengan keputusan menteri, serta terdapat ketentuan saling bertentangan satu sama lain.

Abstract

Pertanggungjawaban pidana merupakan penerapan hukum terhadap pelaku tindak pidana atas suatu perbuatan yang bertentangan dengan aturan hukum yang berlaku. Pencemaran nama baik sendiri merupakan kejahatan terhadap kehormatan seseorang karena berkaitan dengan penghinaan yang mengakibatkan tercemarnya nama orang lain. penulisan ini bertujuan untuk mengetahui pertanggungjawabanpidana terhadap pelaku tindak pidana pencemaran nama baik di social media ditinjau dari hukum pidana dan untuk mengetahui pengaturan pertanggungjawaban pidana terhadap pelaku pencemaran nama baik di social media ditinjau dari hukum pidana. Penelitian ini menggunakan metode yuridis normatif, yang merupakan penelitian hukum yang menggunakan data sekunder yang terdiri dari bahan-bahan hukum yang meliputi bahan hukum primer, sekunder, dan tersier. Hasil dari penelitian ini adalah: Dalam konsep teori hukum pidana yang sering diperbincangkan yaitu tentang Tindak pidana, Pertanggungjawaban pidana dan pemidanaanPertanggungjawaban tindak pidana pencemaran nama baik melalui media sosial dapat diterapkan dengan sanksi pidana penjara maupun denda sesuai dengan ketentuan undang-undang yang berlaku. Pertanggungjawaban tersebut dibebankan sesuai dengan unsur pidana yang telah ditinjau dari syarat-syarat pertanggungjawaban pidana, sehingga pelaku tindak pidana pencemaran nama baik melalui media sosial dapat dipertanggungjawabkan perbuatannya seperti yang telah diputuskan dalam pengadilanPeraturan perundang-undangan di Indoensia yang mengatur mengenai tindak pidana pencemaran nama baik  melalui  media social Berdasarkan ketentuan yang diatur dalam KUHP dan UU ITE merupakan Lex Specialis dari KUHP.

Abstract

Pembicaraan tentang anak dan perlindungannya tidak akan pernah berhenti sepanjang sejarah kehidupan, karena anak adalah generasi penerus bangsa dan penerus pembangunan, yaitu generasi yang dipersiapkan sebagai subjek pelaksana pembangunan yang berkelanjutan dan pemegang kendali masa depan suatu negara, tidak terkecuali di Indonesia. Perlindungan anak di Indonesia berarti melindungi potensi sumber daya insani dan membangun manusia Indonesia seutuhnya, menuju masyarakat yang adil dan makmur, materil spiritual berdasarkan Pancasila dan UUD 1945.Dalam hukum positif di Indonesia, masalah anak di bawah umur yang mengenai apabila mereka melakukan perbuatan melawan hukum tersebut, tidak begitu tegas diatur; apa yang seharusnya diperlakukan bagi mereka, dan bagaimana sistem penahanan dan sistem penyidikan yang diberikan kepada mereka juga belum ada diatur dalam hukum.

Abstract

The government issued a Government Regulation on the Implementation of Mineral and Coal Mining Business Activities, which regulates the offering of Special Mining Business Permit Areas on a priority basis to business entities owned by religious community organizations. The method used is normative juridical supported by empirical data, a case approach based on developing news media. Data collection techniques through secondary data, with qualitative juridical analysis. The results of this study are first, the legal policy of granting mining business permits to religious community organizations based on the Government Regulation on the Implementation of Mining Business Activities has contradicted the Mineral and Coal Mining Law. The priority offer in the law is addressed to BUMN and BUMD, while in the government regulation it is addressed to religious community organizations, which is a constitutional problem; second, the existence of guarantees in environmental management for religious community organizations as holders of mining business permits requires compliance with these business entities with environmental management instruments. In addition, it will test the consistency of religious organizations' understanding of the concept of environmental preservation in practice or business actors carrying out mining activities.

Abstract

This study addresses two primary research questions: first, what monitoring mechanisms has the government implemented for business actors regarding spatial use in Jakarta? Second, how is law enforcement concerning spatial planning violations in Jakarta oriented toward environmental sustainability? The objective of this research is to analyze both the supervisory mechanisms and the enforcement practices related to spatial planning violations, aiming to balance investment interests with environmental sustainability in Jakarta. The methodology employed includes normative and empirical juridical research, involving an inventory of relevant regulations and an examination of their enforcement in practice. Data collection is conducted through a sociolegal approach, involving interviews with local government officials and employing qualitative descriptive analysis. The findings reveal that the government’s monitoring mechanisms for business actors in Jakarta involve both active and passive supervision. Passive supervision includes responding to public complaints and reviewing issued permits, such as Environmental Impact Analyses (Analisis Mengenai Dampak Lingkungan, AMDAL). Additionally, preventive measures are implemented through AMDAL and other environmental permits, alongside ongoing environmental monitoring efforts. Active supervision involves field inspections based on a random sampling system of various business activities. Regarding law enforcement for spatial planning violations oriented towards environmental sustainability, the study finds that administrative sanctions are applied, including written warnings, building seizures, demolitions, and the closure of water channels. These sanctions are administered progressively, and law enforcement also integrates community participation.

Abstract

Criminal law policy essentially contains state policies in regulating and limiting power. In anticipating efforts to tackle the crime of Illegal Logging , it is very important to carry out a criminal law policy, especially legislative policy (formulation policy), namely how to formulate an act that is considered a criminal act of illegal logging. The research method used is the normative juridical method.crimes illegal logging according to Law Number 41 of 1999 concerning Forestry is listed in Article 50 while the criminal provisions are listed in Article 78. The criminal law policy in tackling the crime of illegal logging at this time is by carrying out a formulation policy against theCriminal illegal logging, Code, Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems, Law Number 41 of 1999 as amended by Law Number 19 of 2004 concerning Stipulation of Government Regulation in Lieu of Law Number 1 of 2004 concerning Amendment to Law Number 41 of 1999 concerning Forestry into Law and Law Number 18 of 2013 concerning Prevention and Eradication Forest Destruction.

Abstract

Climate change is driven by a combination of natural fluctuations and human activities, particularly the widespread use of fossil fuels (such as coal, oil, and natural gas) and alterations in land use practices such as logging, farming, and clearing land for agriculture. This global phenomenon encompasses various end-of-use activities, including agriculture, forestry, and consumerism. An inherent challenge in the global carbon dioxide (CO2) trading landscape lies in the competition between developed and developing countries, stemming from inconsistent CO2 prices. This competition manifests in three primary areas. Firstly, in the context of internationally transmitted mitigation outcomes, involving international trade aimed at surpassing Nationally Determined Contributions (NDC) targets. Secondly, it pertains to sustainable development mechanisms, specifically the use of carbon offsets derived from projects implemented by both public and private entities worldwide. The third aspect revolves around non-market approaches, encompassing emission reduction through mitigation and adaptation efforts, financial support, technology transfer, and capacity building, which may involve tools like carbon taxes and Carbon Border Adjustment Mechanism (CBAM). This research adopts a legal norm perspective, delving into methods that investigate, describe, synthesize, interpret, evaluate, and analyze positive approaches. The findings signify a paradigm shift aligning with the "polluter pays principle," recognizing that entities and individuals responsible for environmental pollution should bear the associated costs. In the quest for a new paradigm of sustainable development, a carbon market ecosystem assumes a pivotal role. This ecosystem contributes to enhancing sustainability by curbing greenhouse gas emissions and offering economic incentives to address climate change. It acts as a cornerstone in constructing a fresh paradigm for potential development.

Abstract

This article critically explores the potential of environmental use rights as a legal mechanism to advance a more inclusive and sustainable Environmental, Social, and Governance (ESG) framework. Traditionally limited to physical access or utility purposes, use rights have yet to realize their ecological and social functions within environmental governance. Using a normative legal and conceptual approach, this study argues that environmental use rights can enhance landowner accountability for ecological integrity while institutionalizing ESG principles of stewardship, transparency, and responsibility. Positioned as a hybrid construct between private property rights and public environmental interests, these rights offer a transformative legal pathway toward ecological justice and participatory land governance. Recognizing their normative and ecological value can empower communities to monitor land use, mitigate spatial conflicts, and embed environmental considerations into ESG assessment structures.
