Abstract

Low legal awareness of the community in household in Household waste management is a long-stunding issue in Ruteng City, in 2017-2018, it was once one of the dirties cities in Indonesia according to the Ministry of Environment and Forestry. The main problem in this research is the Legal Awarness of Ruteng City Community and the Implementationof Sanction againts Waste Managemnet Actors. The study is an empirical legal research that examines all legal events that occur in society through case and statute approaches. Data collection was conducted through three methods: interview, observations, and document study. The result show that low legal awarness of the community is influenced by law factors, law enforcement, infrastructure, community, and culturals.The impelemntation of criminal sanction is not yet firm and so far only warning sanction have been applied. Therefore, the recommendatons for this research are to increase legal awarness through government community implementing sanction firmly to enhance law enforcement.

Abstract

This study aims to find out and analyze the victimology of child rape victims in the city of Atambua. The research method used in this writing is empirical legal research obtained through interviews and document studies. The results of the study showed: (1) The form of protection of rights for child victims of rape which includes: the form of protection of victims' rights, law enforcement and response of the Women's Empowerment and Rights Protection Office of Belu Regency regarding rape cases in Tulamalae, Atambua, Belu. (2) Efforts Made in Overcoming Child Rape Cases in Atambua City which include: Efforts and Assistance Provided by Safe Homes and Responses and Actions of the Belu Regency Women's Empowerment and Rights Protection Office Outside the Protection House/Safe House. Abstract

The aim of this research is to analyze the legal protection of farmers who have expertise in plant breeding. This research method uses legal research with normative research type, which is a type of doctrinal legal research which in certain contexts is known as literature study or document study. The results of this study are that legal protection for plant breeders in Indonesia is still inconsistent, especially in Law Number 12 of 1992 tends to favor large companies with financial and technological resources, while Law Number 29 of 2000 does not provide special treatment for small farmers who face procedural obstacles and high registration costs. Law No. 4/2006 has also not provided special protection to plant breeding farmers. Norm making to protect farmers in plant breeding is faced with several inhibiting factors. These factors include the lack of clear regulations on protecting the rights of traditional farmers, limited access to their participation in the rule-making process, and limited resources and legal knowledge. In addition, the dominance of industrial interests, slow bureaucracy, and lack of communication and socialization of regulations further exacerbate the gap, while favoring modern farmers ignores small and traditional farmers.

Abstract

Fishing using toxic hazardous materials is a criminal offense of "illegal fishing", which violates the provisions of Law Number 45 of 2009 concerning Amendments to Law Number 31 of 2004 concerning Fisheries. This was also carried out by the Defendant with the initials JLLF based on the Decision of the Kupang District Court Class 1A with case number: 239/Pid.Sus/2020/PN Kpg. This research is a normative juridical research, so the data sources used are primary data sources, secondary data, and tertiary data. Primary data is obtained from several legal rules such as the Criminal Code (Criminal Code), Law Number 45 of 2009 concerning Fisheries and Court Decisions, secondary data is obtained from libraries, journals, and the internet, and tertiary data is obtained from dictionaries, wikipedia, and encyclopedias. The data were analyzed in a descriptive-qualitative manner. The results of this study show that (1) Criminal liability for fishing perpetrators using toxic hazardous materials in Article 84 paragraph (1) of Law of the Republic of Indonesia Number 45 of 2009 concerning Amendments to Law of the Republic of Indonesia Number 31 of 2004 concerning Fisheries is in accordance with the elements contained in the formulation of the article. (2) Basis for Judge's Consideration in the Request for Criminal Liability for the Crime of Fishing with Toxic Hazardous Materials in Decision Number: 239/Pid.Sus/2020/PN Kpg. Judging from the elements contained in the articles of indictment as well as aggravating and mitigating matters.

Abstract

Pengelolaan tambang di Kabupaten Alor harus diatur sesuai dengan ketentuan peraturan perundang-undangan agar tidak mencemari lingkungan dan menimbulkan akibat hukum. Penelitian ini menggunakan metode penelitian hukum normatif. Dalam penelitian ditemukan, pertama; pemberian izin pertambangan di Kabupaten Alor pada umumnya belum berjalan sesuai dengan peraturan perundang –undangan yang berlaku sehingga mengakibatkan adanya pelanggaran terhadap izin lingkungan khususnya pada izin eksplorasi, kedua; pelaksanaan pembinaan dan pengawasan sebagai bentuk penegakan hukum dari Pemerintah Daerah dalam hal ini instansi teknis terkait kepada pengusaha tambang belum dilakukan secara efektif sehingga belum mampu membanguan kesadaran hukum secara utuh. Saran yang diberikan, pertama; pemberian izin pengelolaan tambang dalam menunjang pembangunan berkelanjutan di kabupaten alor harus melibatkan dinas terkait untuk melakukan sosialisasi tentang hak dan kewajiban dan sanksi yang akan diberikan kepada perusahaan yang akan melakukan usaha tambang, kedua; harus dibuat Peraturan daerah khusus tentang pemberian Lingkungan Hidup.

Abstract

This study aims to find out and analyze the Court Decision on Law Enforcement Against Ordinary People Who Violate Medical Legal Norms based on the Study of Decision Number 195/Pid.Sus/2021/PN Kpg. This research was carried out using a normative juridical method with the technique of collecting legal materials, library research, then analyzed and compiled systematically. The results of the study show that the Defendant's Actions can be categorized as medical malpractice because they meet four key elements, namely liability, violation, causality, and loss. Given that the perpetrator is an ordinary person and not a medical professional, Article 360 of the Criminal Code is most appropriate to ensnare the perpetrator who is an ordinary person in the case of injury or health disorder because the relevance of Article 360 of the Criminal Code explicitly regulates negligence that causes injuries or health problems.

Abstract

East Nusa Tenggara Province in managing the Coastal area in East Nusa Tenggara in Community participation in environmental protection and management efforts in East Lembur Village, Lembur District is still relatively low because not all communities play a role in the planning, implementation, utilization and evaluation stages in the context of environmental protection and management efforts. that the management of coastal areas must have permission from the local government and if carried out illegally, it can be subject to strict sanctions. The research method used in this study is empirical juridic research. Empirical legal research that focuses on behaviors that are embraced or developed in society. This behavior is accepted and appreciated by the community because it is not prohibited by statute law, does not contradict the morals of the community (social ethics). The results of this study show that the Criminal Law Regulation Related to Sea Sand Mining Based on Law No. 32 of 2024 Jo. Law No. 5 of 1990 Law Number 32 of 2024 concerning Amendments to Law Number 5 of 1990 provides a stronger legal framework for the management and protection of natural resources, including sea sand mining. The Coastal Rights Law refers to regulations and policies that regulate the utilization, management, and protection of coastal areas and the rights of the people living around them. that the people in East Lembur Village have several factors that cause why they are still doing illegal sand mining. One of the negative aspects is the implementation of mining activities that are not in accordance with existing regulations, such as illegal or unlicensed mining. Both on a large and small scale, mining activities require official permits, because their implementation without a permit can result in legal consequences that need to be accounted for.

Abstract

This study aims to find out and analyze the criminal liability of corporations in Kupang City in supporting the implementation of Law No. 27 of 2007 concerning the Management of Coasts and Small Islands. This research is an empirical judicial research supported by an empirical and normative approach that uses primary data and secondary data collected using interview techniques and literature studies and then processed using editing and coding techniques and analyzed in a qualitative descriptive manner. The results of this study show that (1) Law Number 27 of 2007 concerning the Management of Coastal Areas and Small Islands has an important role in regulating the protection and utilization of coastal areas. However, the application of this law in criminal enforcement against the perpetrators of coastal ecosystem destruction still faces various obstacles (2) The legal arrangements in this Law aim to protect, manage, and utilize coastal areas in a sustainable manner. Law Number 27 of 2007 provides a legal basis for the planning, protection, and utilization of coastal ecosystems and involves community participation in the management of natural resources.

Abstract

This study examines is criminological review of acts of thuggery at Tenau Port, Kupang. This research uses empirical juridical research, or what is called field research, namely examining applicable legal provisions and what happens in reality in society.. The results of this research show: (1) The form of crime of thuggery referred to in the discussion and scope of this research is generally what is known as harassment committed by unscrupulous drivers against ship passengers with various modus operandi. The modus operandi in acts of thuggery that has been researched and occurred factually at Tenau Harbor in its scope and which occurs most often is threats carried out by several rental or car rental drivers by forcefully demanding money from ship passengers and drivers who threaten passengers asking for money. to get into his car. (2) The efforts of the Kupang City Police in dealing with acts of thuggery at Tenau Port, Kupang: Thugism, Modus Operandi, Countermeasures.

Abstract

This study aims to find out and analyze the legal protection of marine animals in Alor Regency from Law No. 05 of 1990 concerning the Conservation of Biological Natural Resources and Their Ecosystems. The type of research used in this study uses an empirical method or called field research, which is to examine the applicable legal provisions and what happens in reality in society. The results of the discussion in this study show that, (1) the factors that cause the taking of marine animals (akar bahar) are: weak community income, weak community legal awareness factors, motive factors of perpetrators, weak supervision factors, crime scene factors (crime scenes) are difficult to detect, (2) efforts made to protect marine animals (akar bahar) are: preemptive legal protection efforts, preventive legal protection efforts, efforts to protect the law in a repressive manner.
