Abstract

Environmental protection and improving industrial waste management, including slaughterhouses, are crucial to maintaining ecosystem balance and ensuring human health and welfare in the future. Good implementation of regulations and strict law enforcement are steps. The problem formulation in this research is: (1) What are the efforts of the Kupang City government in processing waste water at the Slaughterhouse in Kupang City? (2) What are the government's obstacles in enforcing criminal acts for perpetrators of waste water disposal at slaughterhouses in Kupang City? This research is Empirical Juridical Legal Research. This research uses data collection methods using interview techniques at the relevant department. The results of this research show: (1) Pollution due to waste water from slaughterhouses is a serious environmental problem in Kupang City. This article discusses the efforts made by the Kupang City government to overcome this problem. These efforts include routine monitoring and inspections to ensure compliance with regulations, strict law enforcement against violations, as well as education and outreach to the public about the importance of good waste management. (2) Law enforcement against perpetrators of waste water disposal at slaughterhouses is a complex challenge for the government. Apart from that, other challenges are less than optimal coordination between relevant agencies, as well as political and economic factors that influence law enforcement policies. By understanding these obstacles in depth, it is hoped that effective solutions can be found to increase the effectiveness of law enforcement against perpetrators of waste water disposal in slaughterhouses in order to maintain environmental sustainability.

Abstract

Pets are animals kept by humans that must be cared for, looked after and have their living needs met and have a proper place. Negligence or neglect in the care of pets by pet owners is a form of error in criminal law as a result of someone's lack of care, resulting in something accidentally happening. So the author conducted this research with the aim of: (1) To find out whether pet owners whose negligence in looking after their pets cause traffic accidents on public roads can be punished. (2) To find out how the law provides sanctions for pet owners who are negligent in looking after their pets, causing traffic accidents on public roads and causing injuries and even death. The type of research used by the author is normative legal research. In this research, the sources of legal materials used by the author are primary legal material sources, secondary legal material sources, and tertiary legal material sources. The technique for collecting legal materials uses library research and then analyzed qualitatively. The findings specifically show that the regulations governing improper care of pets which cause traffic accidents on public roads are still subject to vague norms, so regulations are needed that regulate in more detail by referring to existing rules. Then there is the concept of criminal liability norms for pet owners who must fulfill the elements that constitute a causal offense, so that criminal liability can be sought through restorative justice and litigation.

Abstract

Discipline in education is necessary for students to understand moral and social boundaries. The practice of disciplining (corporal punishment) against students is still debatable. Some people consider it a form of violence against children that contradicts the principles of child protection in Law Number 35 of 2014 concerning Child Protection. A dilemma arises regarding the limits of the teacher's authority in disciplining students and whether these actions can be categorized as criminal acts or are still included in the realm of education. Article 14 of Law No. 14/2005 on Teachers and Lecturers states that teachers have the right to impose sanctions on students who violate norms, rules, and academic ethics. This research is normative research. The results of this research are: (1) The provision of corporal punishment by teachers against students who violate religious norms, norms of decency, norms of politeness, written and unwritten rules set by teachers in the learning process cannot be categorized as acts against criminal law if the corporal punishment carried out by the teacher does not exceed the limits of reasonableness or punishment that is educational in nature in accordance with the teacher's code of ethics. (2) The application of mediation as a form of protection for teachers regulated in Article 4 paragraph 2 of Permendikbud Number 10 of 2017, where mediation is a form of implementation of restorative justice values creating a space for peaceful problem solving that considers the interests of students, teachers and students. Abstract

Illegal logging is a criminal act that occurs in the forestry sector which has become a national and international issue. Illegal logging is included in a special criminal offense. The legal basis governing the criminal act of illegal logging is Law of the Republic of Indonesia Number 18 of 2013 concerning the Prevention and Eradication of Forest Destruction. The formulation of the problem in this study: (1) What are the obstacles faced by law enforcement in enforcing the law against perpetrators (illegal logging) in Malacca Regency?, (2) What is the impact of regulating the function of the Civil Service Police on public order? This research is an empirical legal research that is descriptive. Research location in Upt. Malacca District Forest Management Unit, Malacca Regency Resort Police and Atambua District Court Class 1 B Belu Regency. Management The type of data used includes primary data and secondary data. The data collection techniques used include interviews and literature research in the form of books, laws and regulations, documents, and so on. Data analysis uses qualitative analysis with interactive models. There are also factors that become obstacles to law enforcement against illegal logging crimes, according to Soerjono Soekanto, that the effectiveness or failure of law enforcement is determined by five factors, namely the legal factors themselves (laws), law enforcement factors (parties who form or implement the law), factors of facilities or facilities that support law enforcement, community factors. The results of research in this thesis show that obstacles in law enforcement against illegal logging crimes are minimal legal awareness, inadequate supporting facilities or facilities, insufficient operational costs, no forest police personnel, forestry civil servant investigators. The efforts made by law enforcement are preemptive, preventive and repressive efforts. By cracking down on reports from the public. The researchers' suggestions for the results of this research need to increase legal counseling to the community, procurement of supporting facilities, submitting applications for forest rangers and civil servant investigators, conducting routine joint operations in forest areas, and law enforcement commitment.

Abstract

Sebagai Negara yang kaya akan sumber daya alam, Indonesia memiliki potensi sumber daya alam yang meliputi bumi, air ruang dan kekayaan yang terkadung didalamnya, seperti bahan tambang. Di Indonesia usaha pertambangan tersebar hampir diseluruh wilayah yang bergerak dalam bidang eksplorasi, eksploitasi, pengelolaan/ pemurnian dan pengangkatan mineral tambang. Nusa Tenggara Timur merupakan salah satunya tambang batu warna yang terletak di Pesisir Pantai Kolbano, Kecamatan Kolbano, Kabupaten Timor Tengah Selatan. Aktivitas tambang batu warna merupakan mata pencaharian masyarakat setempat yang turut membantu memenuhi kebutuhan masyarakat lebih dari itu juga menyebabkan adanya pengrusakkan lingkungan. Secara yuridis kegiatan pertambangan diatur dalam Undang –Undang No. 3 Tahun 2020 Tentang Perubahan Atas Undang –Undang No. 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara. Pada Pasal 35 Undang –Undang Minerba menjelaskan bahwasannya setiap kegiatan pertambangan dilaksanakan berdasarkan perizinan berusaha. Pada kenyataannya, masih ada masyarakat yang menambang tanpa izin. Oleh karena itu, penelitian ini dilakukan dengan tujuan untuk mengetahui dan menjelaskan pelaksanaan penegakan hukum terhadap masyarakat yang melakukan penambangan batu warna secara illegal di Pesisir Pantai Kolbano. Penelitian ini dilaksanakan dengan menggunakan metode penelitian hukum Empiris (Empirical Legal Research) dengan hasil penelitian menjelaskan bahwa penegakan hukum pidana terhadap kegiatan penambangan batu warna di Pesisir Pantai Kolbano di Kabupaten Timor Tengah Selatan masih lemah dikarenakan masih adanya masyarakat yang menambang tanpa izin. Dari hasil penelitian, peneliti menyimpulkan bahwa lemahnya penegakan hukum terhadap kegiatan penambangan batu warna di Pesisir Pantai Kolbano di Kabupaten Timor Tengah Selatan dikarenakan kurangnya koordinasi antara masyarakat dan aparat penegak hukum.

Abstract

The implementation of customary sanctions in Sikun Village, Malacca Regency makes customary sanctions a matter that invites pros and cons in the relationship of indigenous peoples because each perpetrator feels that the customary sanctions imposed on him are very detrimental. Researchers aim to determine the application of Ukun Badu customary law sanctions against perpetrators of theft in Sikun Village, as well as to find out the obstacles in applying Ukun Badu sanctions against perpetrators of theft in Sikun Village. The research method used is empirical juridical. This research approach is a case and conceptual approach. The results showed the application of Ukun Badu customary sanctions against perpetrators of timber theft in Sikun Village, through the process of determining the time of trial, identifying evidence based on witness reports, questions and answers with perpetrators, through customary deliberation, imposing decisions following fines under applicable customary law, handing over sanctions. What hinders the application of Ukun Badu customary sanctions on perpetrators of timber theft cases in the Sikun Village Protection Forest is that the perpetrators do not approve of the perpetrators not being present at the trial, the victims do not approve and lack of a sense of justice for the community, and obstacles on the part of traditional leaders in giving sanctions to perpetrators are not carried out properly. The author suggests that the community when experiencing a problem should be resolved first according to applicable customary law.

Abstract

In Indonesia, tofu is one of the most widely consumed foods by the Indonesian people with various variants circulating on the market such as tofu Sumedang, tofu content, tofu cakes and so on. This is what has resulted in the tofu industry experiencing significant development both from small and medium-scale industries Tofu processing will produce waste or there is waste that can be in the form of waste. Waste if not handled properly will cause pollution. In Indonesia, in fact, the development of the tofu industry is not followed by environmental awareness. The liquid waste is directly discharged into the riverbank so that it causes a decline and deterioration in the quality of river water, if the water is consumed it can cause health problems, because it creates a medium for the growth of disease germs or other germs that are detrimental to both the tofu product itself and the human body. Seeing this environmental phenomenon, legal awareness is the main highlight in it. Assessing a person's legal awareness, it is important to understand their knowledge, understanding, and acceptance of the law. A person's level of legal knowledge reflects their familiarity with legal principles and laws, while comprehension indicates their ability to interpret and apply this knowledge in practical situations. Additionally, acceptance indicates how well individuals accept legal norms and values in their social context. Together, these elements provide a comprehensive view of a person's legal awareness, influencing their behavior and interactions within the legal system.

Abstract

The arrest process carried out by National Police investigators against suspects who are strongly suspected of having committed a criminal act may experience errors or mistakes that originate from human error, namely errors made by investigators in practice in the field. Mistakes in the arrest process have quite big consequences because if these mistakes are not immediately corrected they will continue in the following stages. The aim of this research is to find out what the responsibilities of a National Police investigator are and the legal measures that can be taken by victims of wrongful arrest.The research method used is a Normative law research method where the researcher obtains data via the internet and processes the data in the IMAM CHAMBALI Supreme Court Decision No. 89 PK/PID/2008. The data collection technique uses a case approach and literature study in the form of books, statutory regulations and other materials related to the problem being studied. Data analysis uses qualitative data analysis. The results of this research show that: First, The responsibility of POLRI investigators in the event of an error in person based on the Indonesian Criminal Procedure Law system is contained in Law no. 2 of 2002 concerning the National Police of the Republic of Indonesia and the Code of Professional Ethics for the Police of the Republic of Indonesia in the National Police Chief Regulation no. Pol. : 7 of 2006. Second, the legal remedies that can be taken in the event of an error in person by POLRI investigators based on the Indonesian Criminal Procedure Law system are in the form of compensation, rehabilitation and extraordinary legal remedies, namely judicial review. A convict who is serving a sentence from a decision that has legal force still has the opportunity to take extraordinary legal action, namely a judicial review.

Abstract

The issuance of Law Number 6 of 2023 concerning Job Creation has had an impact on changes to a number of laws in Indonesia, including Law Number 19 of 2004 concerning Forestry and Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest. In addition, derivative regulations from the Job Creation Law, especially those relating to support for facilitating the development of National Strategic Projects, have been issued after the ratification of Law Number 11 of 2020 concerning Job Creation. The derivative regulations in question are Government Regulation Number 23 of 2021 concerning Forestry Implementation and Government Regulation Number 42 of 2021 concerning Facilitation of National Strategic Projects. The presence of the Job Creation Law is considered to be able to encourage economic growth, one of which is by accelerating the development of strategic infrastructure in the regions. The research method used is normative juridical. The results of this research show that the presence of the Job Creation Law has had an impact on simplifying and trimming a number of regulations to facilitate and support the accelerated development of National Strategic Projects including the Tefmo – Manikin Dam in Kupang Regency. On the one hand, the passing of Law Number 6 of 2023 concerning Job Creation has provided a guarantee of legal certainty, because so far the process has experienced pros and cons. However, in terms of legal benefits and environmental justice, it can result in disruption of environmental sustainability, especially forest areas because they are vulnerable to conversion of forest areas for the development of National Strategic Projects.
