Abstract

The criminal acts within the scope of household neglect criminal offense of domestic violence is classified as psychological domestic violence that can lead to mental burden for victims of perpetrators of domestic violence. Domestic violence belong to a specific criminal offense. In the High Court there are disparities Pekanbaru 3 criminal assault household negligence. First, the decision No. 219 / pid.sus / 2013 / ptr, Second, decision No. 45 / pid.sus / 2014 / ptr, Third, decision No. 150 / pid.sus / 2016 / pt.pbr.Based on the description in the background of the above problems, then formulate the problem as follows: First, Do the factors that cause the disparity perpetrators of neglect of household decision based on Law No. 23 of 2004 on the elimination of domestic violence in the city of Pekanbaru ?. Second, whether the judge has been performing its role in accordance with fairness, certainty and effectiveness in deciding criminal assault household negligence in Pekanbaru?.This type of research is classified dala kind of normative legal research. Penellitian type is descriptive analysis. The data used was obtained through three (3) legal materials is the primary legal materials, secondary, and tertiary. The data collection techniques were performed using methods, namely the study of literature.From the results of research and discussion can be concluded that the First, the main factors being 3 An appeal disparities in the criminal act of neglect of households in the High Court Pekanbaru are: problems of philosophy; sentencing guidelines; criminal benchmark issues; factor that comes from self-judge alone. Second, the judge has been carrying out its role in accordance with certainty in deciding criminal assault household negligence In the city of Pekanbaru. But viewed from the aspect of justice and expediency judges not done it, can be seen from the 3 three decision in the District Court Rengat and Pekanbaru an appeal, in because the defendant does not feel fair share of the verdict. Suggestions in this study is the first, then to minimize the negative impact of the disparity of criminal needs be a rule or rules which can be a guide judges in the administration of the criminal verdict to the defendant. Second, Providing information that is very clear to the public on the causes of the disparity criminal, the cases that concern people who are indirectly giving legal education to society should need to be improved to increase public knowledge about the judicial process and the law itself.Keywords: Disparity - Decision - Criminal Act - Domestic Neglect

Abstract

Election of regional heads (Pilkada) is one way in the democratic system to elect regional heads in a particular region. The Regional Head Election aims to find qualified regional leaders in peaceful, honest and fair ways. Election of Regional Head is carried out by adopting the principle of direct, general, free, confidential, honest, and fair in accordance with Article 2 of Law Number 1 of 2015 concerning the Establishment of Government Regulations in lieu of Law Number 1 of 2014 concerning Election of Governors, Regents and Mayors to Become Constitution.This research is a type of normative juridical research or normative legal research. Normative juridical research or normative legal research is research that discusses legal principles, namely the legal principles contained in Act Number 1 of 2015 concerning Establishment of Government Regulations in lieu of Law Number 1 of 2014 concerning Election of Governors, Regents and the Mayor Becomes a Law.From the results of the research that the author did, it can be concluded that the reason for the expiration of regional head elections in terms of reporting is limited by the short time compared to criminal acts in general because there are several cases of reports that have not been completed, thus disrupting the process in the election for determine the winner in the election. If no deadline is set for reporting, it can be used as a loophole for one party to hinder the electoral process, and can also cause government vacancies as in previous cases. Second, the reporting deadline is in accordance with Article 134 paragraph (4) of Law Number 1 of 2015 concerning the Establishment of Government Regulations in lieu of Law Number 1 of 2014 concerning the Election of Governors, Regents and Mayors into Laws which stipulate the reporting deadline of only 7 days are considered too fast and ineffective because many cases are killed because of these deadlines.Keywords : Juridical Review - Article 134 Paragraph (4) -Law number 1 of 2015

Abstract

The existence of human rights and its arrangements is really important because without human rights, human cannot develop their talents and fulfill their needs. In addition to regulating human rights in general, there are also human rights arrangements held for indigenous peoples. Indigenous peoples are communities that live on the basis of ancestral ancestry over a customary territory, which has sovereignty over land and natural resources, socio-cultural life governed by customary law and traditional institutions that manage the sustainability of community life.The purpose of this thesis is to find out how international human rights law protect the rights of indigenous peoples and to find out how the protection of tenure rights of indigenous peoples in Indonesia and the protection of tenure rights of indigenous peoples in Kenya and the comparison of the protection on the both states.From the result of the research it is found that All states include Indonesia and Kenya have an obligation to uphold the rights possessed by indigenous peoples, especially their tenure rights. Even though the state has not ratified UNDRIP, ILO No.169 or does not regulate other regulations on the protection of the rights of the indigenous people, the state still have to protect their people and use any other regulation such as the Universal Declaration of Human Rights, ICCPR, ICESCR, etc as their legal based. The state has the duty to effectively protect the rights held by indigenous peoples as governed by international human rights law, regional regulations of their territories and also its national regulations. It is not permissible for the state to violate the rights possessed by indigenous peoples simply because their identities are different from the people in the country in general, or displace nor relocating them even under the pretext of conservation without their consent

Abstract

Mewujudkan ketertiban dan keadilan di bidang perdagangan internasional, memerlukan aturan-aturan yang mampu menjaga hak-hak dan kewajiban para pelaku perdagangan internasional ini. Aturan-aturan di dalam hubungan perdagangan internasional tersebut seringkali menimbulkan dampak negatif dan berpotensi mengancam ekonomi suatu Negara. Tuduhan melakukan dumping baik yang terbukti atau tidak yang kemudian dibawa ke mekanisme penyelesaian sengketa ke WTO sering menyulitkan Negara berkembang dan terbelakang.Tujuan penulisan skripsi ini yaitu, untuk mengetahui implikasi kebijakan anti-dumping dalam hubungan perdagangan internasional antara Indonesia dan Uni Eropa (European Union) dan untuk mengetahui faktor yang mempengaruhi diterapkannya kebijakan anti-dumping dalam hubungan perdagangan antara Indonesia dan Uni Eropa (European Union).Implikasi diterapkannnya kebijakan anti-dumping bagi hubungan perdagangan antara Indonesia dan Uni Eropa akan menimbulkan rusaknya solidaritas antara para pihak dalam hubungan perdagangan internasionalnya. Ketika mempersoalkan penerapan langkah-langkah anti-dumping, Negara-negara maju harus memberikan perhatian khusus terhadap situasi khusus Negara-negara berkembang. Tiga faktor mengenai peningkatan penggunaan anti-dumping yang mengkhawatirkan, yaitu interpretasi peraturan anti-dumping nasional sangat luas sehingga banyak kasus yang masuk dalam kategori untuk melakukan anti-dumping, proses penyelidikannya sendiri sudah cukup mengganggu dan bahkan memberhentikan ekspor, hampir setengah dari tindakan anti-dumping tidak pernah diselesaikan secara tuntas karena didahului dengan negosiasi untuk melakukan penurunan ekspor secara sukarela oleh pengekspor (voluntary export restraint – VER).Kata Kunci: Hukum Perdagangan Internasional-Antidumping-WTO-Negara Berkembang

Abstract

Crime in the field of pornography is one of the fast growing criminal activity due to the developments in technology and information. Various things have been done to reduce the occurrence of criminal acts in the field of brands ranging from the establishment of Law No.44 Year 2008 on Pornography. However, in the field of pornography is a crime still existed in society, even predictable crimes against counterfeiting in this brand though it was addressed, will continue to increase.Based on these reasons underlying the author's interest to write a thesis with issues such how law enforcement in criminal acts memperjualbelikan compatc video disc / VCD porn under article 29 of Law No. 44 of 2008 concerning the setting pornography. This thesis is empirical juridical case studies jurisdictions Pekanbaru City Police Sector. In Indonesia alone, the problem of pornography is not new. Where in the Criminal Code concerning pornography has been set in Article 281, 282, 283, and Article 533 of the Criminal Code. Besides the problem of Pornography also set in the Broadcasting Law, the Law of Film, Press Law, the Telecommunications Act, Act ITE. However, because the Indonesian government feels that the existing provisions in the Act that have been there was less strong binding of the perpetrators, the government then sought a ban on pornography that has been set out in a regulation of pornography, namely Law No. 44 Year 2008 on Pornography. Abstract

Narcotics criminal case number : 778/PID/B/2011/PN.PBR in Pekanbaru District Court complaint originated from one society to Br . Mastur that the defendant often buy narcotics Category I ( one ) of dry marijuana , then witness Mastur and Rahmat Hasbi who is a member of the police directorate Riau regional police drug detectives raided the defendant's home and found 1 ( one ) package of dried marijuana leaves wrapped in newspaper and in inside is a 1 ( one ) package of dried marijuana leaves small . Based on the examination of the defendant be examined and investigated by the investigator and the Riau Police Narcotics Investigation Directorate , and was charged by the public prosecutor on charges of violating the provisions of Section 114 and punishable Paragraph ( 1 ) Jo Article 111 Paragraph ( 1 ) of Law No. 35 of 2009 on Narcotics . This case has also been examined and decided by the judges at the Court of Pekanbaru acquittal . In conducting this study the authors chose the subject matter , namely : How the BAP witnesses during the investigation that resulted in acquittal in the criminal case of pure narcotic Number : 778/PID/B/2011/PN.PBR and What accounts free judge in the case dropped this . The purpose of this thesis , namely ; First , the validity of the dossier Knowing witnesses that resulted in a verdict with narcotics criminal case number : 778/PID/B/2011/PN.PBR , Second , Knowing the judge's decision is based on consideration of the minutes of the examination of witnesses in criminal case narcotics Number: 778 / PID/B/2011/PN.PBR .The method used in this study were classified its kind when viewed from the normative legal research. Abstract

Extortion is a criminal offense that is often done by a thug who is usually a disease of society. The criminal act of extortion should be prevented and eradicated because of it is impacts makes comfort and disturbed public tranquility. Police as a state apparatus that perform the function of law enforcement, custodians, security, and public order and the protection, shelter, and serve the community. The police on duty to prevent and combat the crime of extortion. The purpose of this thesis, that is: first, the role of municipal the city police of Pekanbaru in preventing criminal acts of extortion committed by thugs, second, obstacles faced by the city police of Pekanbaru in preventing criminal acts of extortion committed by thugs, third, the efforts of the municipal the city police of Pekanbaru in prevent the crime of extortion carried out by thugs pliers.This research is a sociological study, this study was conducted in eleven police of Pekanbaru sector, while the overall population and the sample is related to the overall problems examined in this study. Source of data used is primary data, secondary data, and tertiary data. Data collection techniques in this study were interviews, questionnaire and literature study and data analysis technique used is by a qualitative way.Out of the results of research can be concluded, first, the role the police city of Pekanbaru in preventing the crime of extortion committed by a thug with first requests that preventive action (non-penal), pre-emptive, and repressive. Second, barriers, faced the police city of Pekanbaru in preventing the crime of extortion committed by thugs in the police city of Pekanbaru include: a lack of information from the public, the lack of human resources Polri, lack of public awareness, victims who did no report. Third, the efforts of the police city of Pekanbaru sector to prevent acts of thuggery and extortion committed by thugs include: providing information and knowledge to the public to danger of acts thuggery and extortion committed by thugs, the efforts of police to foster good relationship to the society. Advice writer, first, the police city of Pekanbaru sector in realizing it is role as the prevention and eradication of the crime of extortion should be more consistent in carrying out it is role both in action, preventive, pre-emptive, repressive. Second, to overcome barriers to the prevention and eradication of the crime of extortion need to collaborate and embrace the community, improve facilities and infrastructure. Abstract

In addition to checking, hearing and deciding the case in court, the judge also has the task of monitoring and observation coaching inmates at the Correctional Institution. The judge in charge of overseeing and observing the inmates called the Supervisor and Observer Judge contained in the Code of Criminal Procedure Article 277-283. But this time, the judge was only carrying out its mission in the Court, then later handed over to the inmates of correctional Institution. Supervision and observation of prisoners conducted so far have not been going well. The purpose of this thesis, namely: First, Implementation Role Supervisor and Observer Judge Against Development of Prisoners in Penitentiary Class IIa Pekanbaru, Second, Obstacles Faced By Supervisor and Observer Judge In Supervise and watching inmates at the Correctional Institution Class IIa Pekanbaru, Third, efforts ducted by Supervisor and observer Judge To Improve Monitoring and Observation Prisoners in Penitentiary Class IIa Pekanbaru.This type of research can be classified in this type of sociological juridical research, because this research author directly conduct research on the location or point examined in order to provide a complete and clear picture of the issues examined. This research was conducted in the District Court of Pekanbaru and at the Correctional Institution Class IIa Pekanbaru, while the sample population is a whole party with regard to the problems examined, the data source used, primary data, secondary data and data tertiary, data collection techniques in this study with interviews and literature study.From the research of this problem has three main things that can be inferred. First, the role of Supervisor and Observer Judge not run well in Class IIa Pekanbaru Penitentiary. Second, the constraints faced by the Supervisor and Observer Judge that the busy schedule of judges in the courts, the number of Supervisor and Observer Judge only 1 (one), the absence of the auxiliary staff of the judges, the absence of a given budget. Abstract

Refugee is a stranger who has no valid travel documents, Thus violating the provisions of Law Number 6 of 2011 on immigration. Further guidelines for refugees from other countries in Indonesia are not in accordance with the provisions of the law can be found in article 2 paragraph (1) The Director General of the Immigration Service Regulation Number IMI.1489.UM.08.05 of 2010 on the treatment of illegal immigrants is currently known in Indonesia imposed measures immigration. So that, Immigrants originating from these countries should be checked so that no things that are not desirable and feared can harm themselves and the local community. The research purpose of this dissertation, namely: First, to determine the immigration surveillance against illegal immigrants in Pekanbaru City. Second, to know what is the limiting factor in combating illegal immigrants in Pekanbaru City. Third, to find out what efforts can be made to keep an eye on illegal immigrants in Pekanbaru City.This type of research is a sociological or empirical research is the research in the field, This research was conducted at Immigration Office Class I Pekanbaru and RUDENIM Pekanbaru City. While the population and sample are all parties related to the problem studied in this study.The data sources used, the primary data, secondary data and data tertiary data collection techniques in this study were interviews, Questionnaire and literature study.The research has three key conclusions. First, Immigration control of legal immigrants in Pekanbaru City by the First Class Immigration Office of Pekanbaru has been under way, But the supervision of immigration in the field and the existence and activities of immigrants in the work area of the First Class Immigration Office of Pekanbaru still not effective. Second, The inhibiting factor in the supervision of illegal immigrants in Pekanbaru City is that there are internal factors and external factors. Third, Efforts that can be done to supervise illegal immigrants in Pekanbaru City such as forming a team of supervision and action of immigration, Forming an immigration security team, placing it into temporary shelter in immigration detention rooms and looking for translators. advies auteur, first, In order for the supervision to run, Then it can increase the quantity of Human Resources. Second, To UNHCR as an international patron who guarantees the honor of basic rights for refugees, Including the right as an asylum seeker to immediately follow up the illegal refugee status to Pekanbaru for immediate determination of its status or to deportation to a third country or to the country of origin of the immigrant if it is deemed safe. Abstract

Corruption is (from latin: corruption, bribery corruptore meaning ruin) symptoms in which the officials of the State bodies, misusing authority with the occurrence of bribery, counterfeiting, as well as other irregularities.
