Abstract

Kewarganegaraan adalah bentuk identitas yang memungkinkan individu-individu merasakan makna kepemilikan, hak dan kewajiban sosial dalam komunitas politik (negara). Deklarasi Universal Hak Asasi Manusia (DUHAM) menegaskan bahwa setiap orang berhak atas suatu kewarganegaraan. Dengan demikian, Deklarasi ini mengakui pentingnya kewarganegaraan secara hukum dan praktis untuk pemenuhan hak-hak asasi manusia. Hak Asasi Manusia (HAM) adalah hak-hak dasar atau hak pokok manusia yang dibawa sejak lahir sebagai anugerah Tuhan Yang Maha Esa bukan pemberian manusia atau penguasa. Hak ini bersifat mendasar bagi kehidupan manusia. Pelaksanaan pemberian HAM tersebut harus diberikan tanpa adanya diskriminasi baik berdasarkan agama, ras, warna kulit, pendapat politik, kebangsaan dan pembeda lainnya. Berdasarkan ketentuan di atas, seharusnya setiap orang memiliki kewarganegaraan tanpa terkecuali. Namun nyatanya masih banyak suku bangsa yang tidak memiliki kewarganegaraan, diantaranya Etnis Rohingya di Myanmar dan Etnis Kurdi di Suriah.Tujuan penulisan skripsi ini yaitu untuk mengetahui pengaturan Hukum Internasional terhadap seseorang yang tidak memiliki kewarganegaraan dan untuk mengetahui implementasi Hukum Internasional terhadap etnis Rohingya di Myanmar dan etnis Kurdi di Suriah.Hukum Internasional telah memberi aturan terhadap seseorang yang tidak memiliki kewarganegaraan diantaranya yaitu Deklarasi Universal Hak Asasi Manusia, Konvensi Genewa 1954 Tentang Status Orang-orang Tanpa Kewarganegaraan dan konvensi Genewa 1961 Tentang Pengurangan Keadaan Tanpa Kewarganegaraan. Hukum Internasional telah memberikan pengaturan yang jelas dalam menyelesaikan permasalahan keadaan tanpa kewarganegaraan. Namun etnis Rohingya di Myanmar dan etnis Kurdi di Suriah masih belum menikmati hak berkewarganegaraan. Peran serta pemerintah kedua negara sangat diperlukan dalam menanggulangi hal tersebut.Kata Kunci : Kewarganegaraan, Keadaan Tanpa Kewarganegaraan, Orang-orang Tanpa Kewarganegaraan.

Abstract

Under Indonesian law has very clearly set on traffic behavior, but in fact what is happening today in the field do not match those in the aspired legislation. Based on this fact, there are three formulation of the problem in writing this essay, namely: First What is the enforcement of traffic law violations against the driver of the motorcycle based on Law No. 22 of 2009 on Road Traffic and Road Transport in the jurisdiction of Police Sector ?, second Kandis Any obstacles law enforcement of traffic violations against the motorcycle driver based on Law No. 22 of 2009 on Road Traffic and Road Transport in the jurisdiction of Police Sector ?, Kandis third, How is the effort made by the police in overcoming obstacles law enforcement of traffic violations against the motorcycle driver based on Law No. 22 of 2009 on Road Traffic and Road Transport Sector in the jurisdiction of Police Kandis?The research method in this study is a qualitative research method with empirical juridical or sociological law research. Data sources supported by primary and secondary data sources. Data collection techniques used were interviews, questionnaires and review of the literature. After the data collected then analyzed qualitatively, and draw conclusions with a deductive method of thinking is to analyze the problems of the general form into special shapes. From the results of research and discussion, it can be concluded that, Enforcement hukm against pelanngaran traffic offender is to crack down directly with menilang and hold the perpetrators of wild races of motor vehicles and must follow the court proceedings. Not only is it for offenders who do not have the equipment in the compulsory motor menglengkapinya prior motor vehicle freed. The constraints are the lack of professional law enforcement of local police officers, lack of understanding of the law as well masyarakata minimya public awareness for memetuhi applicable law. Then made several attempts to overcome these obstacles by way pemeberikan legal counseling in high schools performed in the first through high school and to disseminate to the general public, as well as increasing the capacity of the police in the implementation of laws and legislation. Abstract

Act Number. 35 of 2009 on Narcotics as legal basis the statutory provisions governing the drug problem has been conceived and implemented, however, this drug related crime has not abated. It is precisely in the fact that the perpetrators of the crime is increasing, and the convict is not a deterrent and there is a tendency to repeat it again. It can be caused by the factors of sentences by a judge who does not give effect ataudeterrent impact against the perpetrators. Sentences by judges tend to be more emphasis on criminal sanctions commensurate with the deeds which if the offender. This paradigm is certainly not in accordance with the drug abuse problem, because not only is the drug addict criminals, but also as a victim.Therefore, Act Number. 35 of 2009 gives authority to judge drug addicts to examine cases in question may decide to undergo treatment and / or care. This study aimed to describe the legal provisions on sanctions for drug addicts as well as to determine the consideration the judge ruled the crime of drug addicts (study decision number: 187 / Pid.Sus / 2012 / PN. PLW). This study uses a literature review (libraryre search) by testing or examination of the products of the judiciary (court decision), namely Decision Number. 187/ Pid.Sus / 2013 / PN. PLW The analysis was conducted using qualitative research with normative approach. The use of methods and approaches are intended to obtain accurate data on the consideration of the judge ruled on the crime of drug addicts. From these results it can be concluded that the legal provisions on sanctions for drug addicts in Law Number. 35 of 2009 on Narcotics consists of two kinds of sanctions, ie sanctions and criminal sanctions measures (double track system). Criminal sanctions for drug addicts consists of the death penalty, imprisonment, and criminal penalties contained in the provisions of Article 116, Article 121, and Article 127.Keywords : Narcotics –– Case - Crime

Abstract

Indonesia is a state based on law (rechtstaat), where one of the existing arrangements in Indonesia is the code of Criminal Procedure (Criminal Procedure Code) as codification and univfikasi law. Under the provisions of Article 184 paragraph (1) of the law on Criminal Proceedings (Criminal Procedure Code) provides that in criminal proceedings, there is valid evidence, namely: witness testimony, expert testimony, letters, instructions and testimony of the defendant. Evidence from expert testimonies have an important role in making light of a criminal case in finding the material truth. In article 229 paragraph (1) Criminal Procedure Code mentioned the right to a replacement cost of a witness or expert who summons to appear in court, but in practice it is not uncommon these rights are ignored and not optimal to run. The purpose of this thesis are: first, to know the idea of reimbursement expert testified at the trial by the Criminal Procedure Code Indonesia. Second, to determine the mechanism of submission of an expert witness in criminal justice according to the Criminal Procedure Law of Indonesia.This research is a normative juridical or normative legal research. The data source is secondary data consisting of primary legal materials, secondary law and tertiary legal materials. Data collection techniques in this study is a review of literature and documentary studies and data analysis used teknik ie deduktive method.From the results of research can be concluded, first implementation of the right to a replacement cost for the expert still are not running optimally according to Article 229 of the Code of Criminal Procedure (Criminal Procedure Code). Second, under of Article 180 paragraph (1) of the Law on Criminal Proceedings (Criminal Procedure Code) provides that the presiding judge may request expert session. If the presiding judge or court hearing the request for information is not expert each party as well as the prosecution alleged, then it can guarantee the impatiality of experts in ensuring the rights of the accused and the prosecution are common cosam judges in finding the material truth. Advice writer, first, to reinforce the responsibility of the state to compensate the experts were called in any court process as outlined in the Code of Criminal Procedure (Criminal Procedure Code). The second, more detailed evidence on when the expert testimony may be required in order to guarantee the rights of each institution to call an expert without ignoring the rights of suspects and defendants.Keywords: Replacement Cost – Expert – In Trial

Abstract

Regulation of the Minister of Transportation PM 15 of 2019 concerning the Implementation of Transportation of People with Public Motorized Vehicles on Routes. states that, every driver and public transportation company that operates the transportation of people by public motorized vehicles on routes is obliged to comply with the provisions concerning the license to carry out person transportation on the route, and the technical and other requirements for motorized roads. However, what can be seen in the field is that there are still many people who do not have a route permit. Therefore, it needs to be studied in a stimulant first, the implementation of the supervision of the permit for the transportation route for people between cities in one province in Riau Province based on the Regulation of the Minister of Transportation Number 15 of 2019 concerning the Implementation of Public Motorized Vehicles in Routes, secondly, the Inhibiting Factors for Granting Transport Routes Permits Person, third, efforts made to overcome obstacles in granting route permits in Riau Province. This research is a sociological legal research, because it is based on field research, namely by collecting data from interviews, questionnaires, and literature reviews that are related to the problems to be studied assisted by primary, secondary and tertiary data. Abstract

Law of the Republic of Indonesia Number 2 of 2011 concerning Political Parties regulates the implementation of political education that must be carried out continuously by political parties. But in fact, the level of voter participation in the city of Pekanbaru is very low and the function of political parties is only carried out by members who wish to become legislative candidates or executive candidates in general elections. Based on this problem, the identification of problems in this thesis are: first, how is the implementation of political education for the community by political parties? Second, what are the obstacles and efforts in carrying out political education for the people by political parties?This research is a sociological and descriptive legal research. This research is located in the Regional Representative Office of the Functional Party in Pekanbaru, the Prosperous Justice Party Regional Representative Office in Pekanbaru, the Office of the Indonesian Democratic Party of Struggle's Branch Office in Pekanbaru, the Office of the Greater Indonesian Party Movement Branch Office in Pekanbaru, and the Office of the Leadership Council Branch of the People's Democratic Party in Pekanbaru. The data used consists of primary data and secondary data. Technical data were collected by field studies (interviews and questions and literature studies). Then analyzed qualitatively and make conclusions with deductive thinking methods.Based on this research, as a result we know that political parties do not have specific rules in carrying out political education and political parties have not been effective in carrying out their functions as organizers of political education. There are many challenges such as lack of public participation and the emergence of negative thoughts towards the party. The effort made is to build good relations with NGOs and educate the public mind.Key Word : Political Education – Community – Political Party

Abstract

The misuse and illicit trafficking of narcotics in Indonesia has spread throughout the country andhas been spread in various living environments, both the educational environment, the work environment,and the residential environment, and the law enforcement environment. One law enforcement agency that isalso not free from drug abuse and illicit trafficking is a penitentiary. Correctional Institution is a place tocarry out the formation of prisoners and correctional students based on the penal system. As a regulationfor the implementation of the Penal Act, a Minister of Law and Human Rights Regulation No. 6/2013 wasissued concerning the Standing Orders of State Correctional Institutions and Detention Centers Article 4letter (g) The Ministerial Regulation prohibits every prisoner or detainee from storing, making, carrying,distributing, and / or consuming narcotics and / or narcotics precursors and other dangerous drugs. Thepurpose of writing this thesis, namely: First, to determine the efforts of prison officials in preventingNarcotics circulation in Class II B correctional facilities in Bangkinang. Second, to find out the obstacles ofcorrectional institutions in preventing Narcotics circulation in Class II B correctional facilities inBangkinang.This type of research can be classified as a type of sociological legal research, because in thisstudy the authors directly conduct research on the location or places that are studied to provide a completeand clear picture of the problem under study. This research was conducted at Class II B Penitentiary inBangkinang, while the population and sample were all sections related to this study, data sources usedwere, among others, primary data, secondary data, and tertiary data, data collection techniques namelyinterview and study literature.From the results of research and discussion it can be concluded that, First, the efforts ofcorrectional institutions in preventing Narcotics circulation in prison are to maximize searches by carryingout luggage checks and data collection conducted on visitors and taking action for all people enteringPenitentiary Class II B Bangkinang without exception. . Secondly, the inhibiting factor of the efforts ofprison officials in preventing Narcotics circulation in Bangkinang Class II B Penitentiary is inadequatefacilities and infrastructure, lack of female prison wardens, lack of prison staff knowledge about narcotics.Keywords: Circulation - Narcotics – Penitentiary

Abstract

In the development of the current society, along with the increasing development of technology, transport, information and communication so that the impact on the patterns of people's lives. One of the negative effects inflicted as the abusive narcotics and illicit narcotics. It is necessary for the relevant agencies such as the Agency's Narcotics district (BNK) in order to prevent the occurrence of the circulation of narcotic drugs that are common in the environment of the community. The purpose of this thesis writing i.e. to know the role of Agency Narcotics district (BNK) Kampar in preventing the circulation of narcotics in district of Kampar Regency Tapung and to know the obstacles the Agency Narcotics district (BNK) Kampar in preventing the circulation of narcotic drugs in an effort to find out as well as Tapung Agency Narcotics district (BNK) Kampar overcoming obstacles in preventing the circulation of narcotics in district of Kampar Regency Tapung.This type of research can be classified in types of juridical sociological research, because in this study the authors direct research on the location or place that is examined in order to give a complete and clear picture of the problems examined. This research was conducted in district of Kampar Regency Tapung, while population and the sample is the entire parties relating to issues that are examined in this study, the data source used, the primary data and secondary data, techniques of collecting data in this study with interviews and research librarianship.From the results of research that the author do can be summed up, first the role of Agency Narcotics district (BNK) Kampar sub-district Tapung i.e. prevent the occurrence by carrying out socialization danger drugs and rehabilitate all users of narcotics by working with parents. The second obstacle the Agency Narcotics district (BNK) Kampar in preventing circulation in district Tapung i.e. lack of Agency budgets Narcotics district (BNK) Kampar, the lack of attention of parents towards children and the lack of cooperation between the society with the Agency Narcotics district (BNK) Kampar in terms of information occurrence of illicit narcotics in the subdistrict of Kampar Regency Tapung. The third attempt by the Narcotics district (BNK) Kampar overcoming obstacles in preventing the circulation of narcotics in district Tapung i.e. do prevention early to the rest of the community in the form of socializing and doing rehab to all users in the Subdistrict tapung and partners with the police in the form of Kampar Resort provides information in order to follow up the illicit happening in Tapung district of Kampar Regency.

Abstract

Terrorism act in various form, keep growing and expand to numerous country after the occupancy of global coalision. According to Romli Atmasasmita, in its progress it can cause jurisdiction conflict to the nations relationship among the countries who has interest in solving dangerous criminal cases that crosses territories. Criminal terrorism act is no longer just a national safety issues, also embrace defence and soveregnty of a nation, so as it need an extraordinary and multidimentional law enforcement in act and institution involvement in it. That effort can implemented by the involvement of TNI in handling criminal terrorism act. Indipendent and collaborative with POLRI. TNI involvement in handling criminal terrorism act meant as involvement to optimised Police role (Badan Nasional Penanggulangan Terorisme) in solving criminal terrorism prevention act in indonesian, which is by status and function to face obstacle in implementation of its duty and the fungction of preventing the criminal terrorist act.The purpose of writing this thesis, namely: First, to figure out the authority of Indonesian National Army (Tentara Nasional Indonesia) in preventing the criminal terrorism act in indonesian. Second, to figure out the involvement of Indonesian National Army (Tentara Nasional Indonesia) in preventing the terrorist in Indonesian.From the results of the study, based on two problem formulations can be concluded. First, TNI’s authority in preventing Criminal terrorism act in Indonesian law number 34 year 2004, law number 3 year 2002 about national defence article 7 section(2), and law number 5 year 2018 letter I section (3)about President as the highest man in charge in running the nation defence which helped by national defence as president’s advisor in establishing the policy of national defence. To face the terrorism threat , President in charge to assign TNI with DPR approvement. Second, TNI need to involved prevent criminal terrorism act in Indonesian because TNI has capability in inteligence, teritorial, combat and safety. TNI intelligence network can support and inform crutial information and detect terrorism network and activity in indonesian to TNI anti terrorisst force or other law enforcement.
