Abstract

The entrepreneurial spirit within Chinese-Indonesian families has long been recognized as a factor in their economic resilience, yet the educational patterns that transmit this spirit across generations remain underexplored. This study aims to examine how family-based education fosters entrepreneurial character among Chinese youth in Surakarta, focusing on the interplay of cultural values, practical immersion, and adaptive strategies. The central research question asks: How do educational practices within Chinese-Indonesian families contribute to cultivating entrepreneurial spirit in the next generation? This research employs a qualitative approach using thematic analysis to interpret data gathered through in-depth interviews, observations, and documentation. The findings reveal three major themes: first, practical immersion as pedagogy, where children are engaged in family business tasks from an early age to internalize perseverance, discipline, and interpersonal competence; second, familial trust and solidarity as social capital, where kinship bonds and moral values of honesty, responsibility, and integrity sustain intergenerational continuity; and third, the negotiation of formal education, experiential learning, and technology, where families balance schooling with hands-on practice and cautiously integrate digital tools as both opportunities and risks. The study concludes that entrepreneurial education in Chinese-Indonesian families is not merely an economic strategy, but a cultural and ethical practice embedded in family life. Theoretically, this study shows that entrepreneurial spirit is socially enacted within kinship structures rather than taught solely in schools. Practically, the findings suggest that entrepreneurship programs can be strengthened through family-based approaches that emphasize early immersion, trust, ethics, and guided use of technology.

Abstract

Human rights enforcement is often considered a classic issue that lacks appeal, particularly when violations are committed by political elites who attempt to justify their actions. However, discussing the past wrongdoings of a regime remains relevant and crucial as a preventive measure to avoid similar violations in the future. This research explores Nurcholish Madjid's interpretation of Human Rights enforcement from the perspective of Fiqh Siyasah Dauliyah. This study uses a qualitative phenomenological approach to examine Aceh's DOM (Military Operations Area) events from 1989 to 1998. Data were collected through interviews with Aceh community leaders and a thorough review of scholarly literature, including works by Nurcholish Madjid and related sources. The findings reveal the significant relevance of Fiqh Siyasah Dauliyah and human rights in analyzing international issues, particularly in conflict resolution contexts. Reports from the DOM Aceh period highlight extensive human rights abuses, underscoring the need for an effective judicial system to address violations and ensure victim restitution. Nurcholish Madjid advocates for conflict resolution through dialogue and peace, emphasizing the constant protection of civilians. Fiqh Siyasah Dauliyah promotes international dialogue and peace during peaceful times (Dar al-Islam), positioning war as a last resort only after all peaceful measures have failed. During wartime (Dar al-Harb), it insists on maintaining ethical conduct, permissible solely when peaceful alternatives have been exhausted. Islamic principles dictate that military engagements should not cause excessive suffering for civilians and should conclude with a surrender, peace treaty, or ceasefire.

Abstract

This study analyzes the changes to Law no. 16 of 2019 on Law No. 1 of 1974 concerning the age limit of marriage. There are various responses in society, socio-cultural clashes and even religion cannot be avoided, where this situation is increasingly difficult to achieve the goal of marriage. This raises the question, why is it necessary to rearrange the age limits for marriage, and what background causes it? This study uses the maqasid sharia approach with the System theory of Jasser Auda. This type of research is descriptive qualitative using the maqasid sharia approach. The object of study is Law no. 19 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage. This study uses secondary data from two sources. First, the primary source is taken from the text of the Law and the Decision of the Constitutional Court. Second, secondary sources such as books, journals, reports, magazines, newspapers, and so on. Then the data are interpreted and analyzed descriptively. The results of this study showed that the determination of changes to the law regarding the age limit for marriage can be classified into the interests of al-dharurriyah (primary), which are important and must be fulfilled to achieve the goals of sharia, namely safety. The analysis of maqasid sharia with six subsystem features explains that protected interests are closely related, which are related to one another, representing age differences in marriage, which is a form of discrimination. The scope of the provisions on the age limit for marriage is classified as maqasid ‘ammah, because it covers all the interests of women in Indonesia. Also, as maqasid khassah, legal protection from the fulfillment of basic rights and constitutional rights as citizens. The level of dharuriyah does not always have the implication of obligatory syar'i (causing sin) but only until obligatory hukm (must), because the legal provisions are explored by mujtahids and are based on the absence of qat'y texts on this issue.

Abstract

This study examines the implementation and challenges of mudharabah financing in Islamic banking through a systematic literature review. Mudharabah financing is an important Islamic financial instrument, but its implementation still faces various obstacles. Using thematic analysis of relevant articles, journals and books, this study aims to identify common challenges and best practices in the implementation of mudharabah. The results are expected to provide a comprehensive insight into the obstacles faced by Islamic banks in implementing mudharabah financing, as well as strategies that have proven effective in overcoming these challenges. The findings can serve as a reference for practitioners and policy makers in optimizing the role of mudharabah financing in the Islamic banking sector.

Abstract

Ulama di Aceh memiliki peran historis sebagai penasihat agama bagi penguasa, namun dalam konteks pemerintahan saat ini, tantangan utama yang dihadapi adalah bagaimana memastikan pengawasan syariat Islam tetap relevan dan efektif dalam sistem pemerintahan sekuler. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi lapangan, melalui wawancara dengan Ketua MPU Aceh Barat serta observasi langsung di kantor MPU. Teknik analisis data yang digunakan mengacu pada model Miles dan Huberman, yang mencakup tahap pengumpulan, reduksi dan verifikasi data. Hasil penelitian menunjukkan bahwa MPU Aceh Barat memiliki tiga komisi utama, yaitu Komisi Fatwa, Komisi Ekonomi, dan Komisi Dakwah, yang berperan dalam menjaga serta membimbing umat sesuai dengan prinsip-prinsip Islam. Namun, dalam pelaksanaannya, MPU menghadapi kendala seperti pluralitas masyarakat, perbedaan interpretasi ajaran Islam, serta koordinasi dengan pemerintah daerah. Oleh karena itu, diperlukan strategi adaptasi agar peran ulama tetap kuat dan pengawasan syariat Islam dapat berjalan secara efektif dalam sistem pemerintahan saat ini.

Abstract

This study explores the phenomenon of Rah Ulee and Peulheuh Kaoy rituals at the tomb of Habib Muda Seunagan in Nagan Raya, Aceh, as a manifestation of cultural and religious acculturation between Islam and local traditions. The research adopts a descriptive qualitative approach through library research and field observation. Data were collected from books, journals, local articles, and interviews with the caretakers and community members around the tomb. The findings indicate that the Rah Ulee ritual, which involves symbolic washing of the head with sanctified water, and Peulheuh Kaoy, the act of releasing vows (nazar), are understood by the local community as forms of tawassul—seeking blessings through righteous figures. These practices are not merely cultural but have been integrated into the spiritual and social fabric of Acehnese Islam. While some religious groups perceive these rituals as deviations from Islamic orthodoxy, many locals consider them expressions of reverence and continuity of spiritual heritage rooted in Sufism, particularly the Syattariyah order introduced by Habib Muda Seunagan. Thus, these rituals exemplify how Islamic teachings and Acehnese culture coexist harmoniously through a process of acculturation that strengthens community identity and religious devotion.

Abstract

This study examines the institutional structure and authority of the Aceh Syar’iyah Court in Indonesia and the Penang Shariah Court in Malaysia as two models of implementing Islamic law within different national legal systems. Previous studies on Sharia courts in Southeast Asia have largely focused on normative and institutional aspects, with limited attention to how constitutional design shapes the scope of judicial authority in a direct comparative framework. This study argues that the differences in the authority of Sharia courts in Aceh and Penang are fundamentally influenced by constitutional structure and the distribution of state power in each country. This research employs normative legal research with a comparative approach through the analysis of laws and regulations, Aceh qanun, Penang state enactments, and relevant scientific literature. The findings show that the Aceh Syar’iyah Court has broader authority, including in the field of Islamic criminal law (jinayah), as a consequence of Aceh’s status as a special autonomous region within a unitary state. In contrast, the Penang Shariah Court has more limited authority due to the constraints of the Malaysian federal system, particularly in the field of criminal jurisdiction. This study contributes theoretically by providing a constitutional-based comparative analysis that explains the relationship between state structure and the scope of Sharia court authority, thereby enriching the study of constitutional law and Islamic judiciary in Southeast Asia.

Abstract

Permasalahan independensi Dewan Pengawas Syariah (DPS) dalam menjalankan fungsi pengawasan perbankan syariah masih menjadi isu krusial. Hingga saat ini, DPS dinilai belum mampu menjalankan tugasnya secara optimal akibat berbagai kendala teknis dan struktural. Penelitian ini bertujuan menganalisis peran dan fungsi DPS dalam kerangka sentralisasi dan desentralisasi pengawasan. Penelitian ini merupakan studi kepustakaan dengan pendekatan Systematic Literature Review (SLR). Sebanyak 730 artikel teridentifikasi pada tahun 2018-2022, kemudian diseleksi menggunakan metode PRISMA hingga diperoleh 37 artikel yang relevan untuk dianalisis secara mendalam. Hasil penelitian menunjukkan bahwa dalam model desentralisasi, peran DPS belum signifikan dalam mendukung tata kelola kepatuhan syariah. Ketidakefektifan ini disebabkan oleh beberapa faktor utama, yaitu keterbatasan kompetensi sumber daya manusia DPS, lemahnya daya ikat regulasi terhadap lembaga perbankan syariah, serta minimnya dukungan fasilitas pengawasan. Selain itu, ketergantungan anggaran DPS pada institusi yang diawasi turut mereduksi independensinya. Temuan ini mengindikasikan bahwa model pengawasan terpusat lebih berpotensi meningkatkan efektivitas dan independensi DPS. Namun demikian, penerapan sentralisasi juga menuntut penguatan kapasitas sumber daya manusia serta penataan mekanisme perizinan dan pengawasan yang lebih komprehensif. Konsep pengawasan secara desentralistik tampaknya memberikan beban ganda pada institusi, disamping itu kompetensi DPS belum menunjukkan dampak yang berarti. Penelitian ini menawarkan kebaruan dengan menggunakan sistem pengawasan sentralistik untuk meminimalisir kondisi tersebut.

Abstract

This study aims to analyze the social relations between Muslims and non-Muslims in West Aceh and to examine the role of the Interfaith Harmony Forum (FKUB) in fostering religious harmony, tolerance, and character development within the community. This research employs a qualitative method with an ethnographic approach. It integrates a literature review, which serves as a reference source for moderation, with fieldwork conducted in West Aceh as the research site. One of the primary objectives of establishing FKUB in West Aceh is to promote and maintain interreligious harmony and to empower religious communities to develop sustainably. The role of FKUB in strengthening interfaith relations and contributing to societal character development is a shared responsibility of all citizens and governmental institutions. The scope of peace and order includes enhancing the achievement of religious harmony, coordinating activities among vertical institutions, strengthening mutual understanding, mutual respect, and tolerance among religious groups, as well as supporting the development of places of worship. In accordance with the mandate of FKUB in fostering community character, dialogue with religious leaders and community representatives is essential, taking into account the aspirations of various religious groups and society at large, and formulating these insights into actionable recommendations. Religious communities are expected to prioritize harmony. When religion is cultivated as a unifying force, it can contribute significantly to national stability and development. In carrying out their religious obligations, adherents must not interfere with or antagonize one another, and instead must uphold mutual respect. To create harmony in religious life, all believers should demonstrate mutual understanding, unity, cooperation, peace, and solidarity among members of society living together. The attainment of tranquility and interreligious harmony is crucial and beneficial across various aspects of life, ultimately fostering a community characterized by harmony, brotherhood, closeness, connectedness, kindness, and mutual respect.
