Abstract

Usually the document showing this right is considered a land certificate. The aim of this research is to find out what drives people to make land title certificates in coastal areas and what the impact of these certificates is. A method called empirical legal research was used to conduct this research. Roger Cottrell said that empirical juridical research is a way of studying law that involves collecting and analyzing real-world information about legal issues, legal practices, and legal institutions. The goal is to learn how the law works in society and find better ways to solve legal problems. The research results show that there are legal problems in making land title certificates in coastal areas and that people who own them can be subject to sanctions by the government. These problems include not socializing with other people and the fact that the certificate can be revoked

Abstract

The purpose of this study is to ascertain the status of property ownership rights with reference to land certificates that Bank Danamon has put up for auction. In addition, the purpose of this study is to determine the degree of legal protection afforded to the owners of land rights that Bank Danamon has auctioned off. Using a statutory method, a comparison approach, and a case approach, the researcher employed a normative-empirical style of legal research to compile this study. The findings of this study demonstrate that the Bank disregarded the verbal agreement between the debtor and creditor and held the auction without a third summons, in violation of the auction regulations

Abstract

A production sharing agreement is one of the transactions for cultivating agricultural land. This agreement is based on the basis of mutual assistance and a feeling of kinship which is still very strong among the people whose implementation is still not in accordance with existing provisions. This research aims to find out how the agricultural land production sharing agreement process is in West Limehe Village, Kec. Tabongo, Gorontalo Regency. The approach that has been implemented in scientific research is the Sociological Research Approach, which actually progresses the study of science in an expert way by directly exploring its objects. The research results show that the implementation of production sharing agreements on agricultural land in West Limehe Village, Kec. Tabongo, Gorontalo Regency was made unwritten only in verbal form on the basis of trust and agreement between the land owner and the cultivator, it was not carried out in front of the Village Head and no written deed or contract was made from this legal act

Abstract

Marriage is the union of two people to form an eternal and happy family or household based on the Almighty God. Marriage is also an inner and outer bond between a man and a woman who become a husband and wife. The aim of this research is of course to find out the causes of non-reporting of marriages to the Population and Civil Registration Service. The type of research used is empirical research where the data source comes from facts in the field. The results of the research show that there are several things that cause marriages not to be reported, including negligence of the community itself, legal awareness and lack of socialization regarding marriage law and non-recording of marriage book registration numbers in the centralized SIAK system

Abstract

This research aims to determine the problems of protecting consumers of imported used clothing. This research uses empirical legal research methods with a case approach that occurs, then analyzed using descriptive analytical techniques. The research results show that basically consumer protection against the sale of imported used clothing in Gorontalo in terms of Law Number 8 of 1999 is carried out by providing guidance to the Non-Governmental Consumer Protection Institution (LPKSM). Carrying out law enforcement efforts through preventive actions such as raids and visiting sales centers, including checking procedures and business permits, especially buying and selling clothes and site construction permits. Apart from that, it provides warnings to business actors who then take action with confiscation and provide sanctions for perpetrators who are still unaware. However, even though there are regulations that prohibit imported used clothing, this business tends to still have a lot of interest. This law enforcement effort is carried out by coordinating with Civil Servant Investigator Supervisors (PPNS) for Consumer Protection from Regency and City to the Police, as well as goods and services supervisors. The problem of providing protection to consumers of imported used clothing in Gorontalo City is that there is a strong desire that arises in sellers and buyers; New law enforcement is limited to socialization and appeals, without confiscation and imposing sanctions; There are no regional regulations in the form of regional regulations; and Lack of Public Awareness.

Abstract

This research aims to find out the implications of polyandrous marriages for efforts to fulfill children's rights in Botupingge District.  This research uses sociological juridical research methods.  Sociological juridical research has as its object the study of community behavior.  The community behavior studied is behavior that arises as a result of interacting with the existing norm system, namely the perpetrators of the practice of polyandrous marriage in the Botupingge sub-district.  The results of this research show that the implications of polyandrous marriages for efforts to fulfill children's rights in the Botupingge sub-district hinder the realization of children's rights, both in terms of providing identity on a child's birth certificate which is only recorded as the mother's child, causing harm to interests,  threatens the fulfillment, protection and enforcement of children's rights both regarding family law and children's psychology

Abstract

ABSTRACT Domestic violence is a serious problem that needs to be dealt with firmly, because acts of violence committed by husbands against wives result in physical, sexual, psychological, and even death. This study aims to determine the factors that cause domestic violence against wives and police efforts in reducing / overcoming criminal acts of domestic violence against wives. This research uses empirical research methods, by analyzing data obtained from the object of research and conducting interviews. Based on the results of this study, it shows that the factors that cause domestic violence against wives are infidelity factors, economic factors, alcoholic beverage factors and police efforts in reducing / overcoming criminal acts of domestic violence against wives are carried out by preventive efforts, namely socialization related to the Law on the Elimination of Domestic Violence, conducting coaching, and repressive efforts, namely taking action.

Abstract

Pengabdian ini bertujuan meningkatkan pemahaman UMKM terhadap pengelolaan keuangan modern menghadapi tantangan dalam pengelolaan keuangan yang sesuai dengan regulasi hukum yang berlaku, terutama terkait kewajiban pajak, pencatatan keuangan, perbankan, ketenagakerjaan, perlindungan konsumen, dan pengelolaan kontrak bisnis. Namun, rendahnya literasi hukum di kalangan pelaku UMKM menghambat pemahaman mereka terhadap pentingnya aspek hukum dalam menjalankan usaha. Penelitian ini bertujuan untuk meningkatkan literasi hukum pelaku UMKM dalam pengelolaan keuangan melalui strategi edukasi yang tepat. Metode yang digunakan adalah penyuluhan hukum, pendampingan hukum berkelanjutan, serta monitoring dan evaluasi. Hasil pelaksanaan menunjukkan adanya peningkatan pemahaman pelaku UMKM tentang kewajiban hukum dalam pengelolaan keuangan, dengan melihat paparan data dan antusias peserta dalam program edukasi. Program ini juga berhasil mengidentifikasi kebutuhan spesifik pelaku UMKM, seperti pemahaman terkait pajak dan pencatatan keuangan, kontrak bisnis, perbankan dan lembaga pembiayaan, perlindungan konsumen, serta aspek ketenagakerjaan. Meskipun demikian, beberapa hambatan seperti keterbatasan waktu dan pemahaman terhadap terminologi hukum masih ditemukan. Oleh karena itu, diperlukan pengembangan materi edukasi yang lebih sederhana dan dapat diakses secara fleksibel. Dengan peningkatan literasi hukum ini, pelaku UMKM dapat lebih taat hukum, mengurangi risiko hukum, dan meningkatkan daya saing usaha mereka. Penelitian ini menyimpulkan bahwa strategi edukasi yang terintegrasi dan berkelanjutan memiliki peran penting dalam membentuk UMKM yang lebih profesional dan berkelanjutan dalam pengelolaan keuangan.

Abstract

This study aims to examine the roles of PPNS investigators, BPOM, and the Indonesian National Police (Polri) in addressing the crime of illegal cosmetic distribution in Gorontalo, as well as the challenges faced by PPNS BPOM and Polri investigators in handling such cases. This research is an empirical legal study conducted at the Balai Besar Pengawas Obat dan Makanan (BPOM) office in Gorontalo and the Gorontalo City Police Station (Polresta Gorontalo Kota). The data sources for this study include both primary and secondary data. Data collection techniques involved interviews and data gathering. The collected data were then analyzed descriptively using qualitative methods. The research findings indicate that, firstly, the role of PPNS BPOM, particularly within the BPOM agency, encompasses the authority to conduct investigations and inquiries into cosmetic-related violations. However, they do not possess the authority to carry out arrests. In contrast, Polri investigators are responsible for executing legal actions such as arrests, detentions, searches, and the seizure of evidence. Additionally, they serve as coordinators in the investigation of specific cases. Secondly, the challenges faced by PPNS BPOM include a shortage of investigators, with only two personnel available, which hinders the investigative process. Meanwhile, Polri investigators encounter limitations due to inadequate laboratory facilities, which impede investigations that require laboratory-verified evidence.

Abstract

This research aims For discussing the application of diversion for children who are perpetrators of the crime of distributing pornographic videos from the perspective of legal protection against children's rights as victims and causal factors . The method used in the research is legal empirical with qualitative descriptive data analysis that describes and explains data and field facts. The results of the study show that the application of diversion to children who are perpetrators of the crime of distributing pornographic videos, viewed from the legal protection of children as victims in Gorontalo, is basically to protect children as perpetrators of crimes and provide them with the opportunity to improve themselves and not affect their future. This is also one of the legal policies in the context of protecting children as perpetrators of pornography crimes. However, the implementation of diversion still has an impact on the existence of mental/psychological and physical pressure on children as victims. Therefore, from the aspect of protection for victims, the implementation of diversion in cases of the distribution of pornographic videos does not pay enough attention to the rights and mentality of the victim, because the perpetrator continues to distribute the video to his friends during the mediation process. However, the PPA unit of the Gorontalo Regional Police prioritizes the resolution of children's cases outside the court through this diversion and is the main choice in its resolution, on the grounds that there is no deviation from the requirements of diversion, namely criminal acts with a threat of less than 7 years and not a repetition of the crime. The factors that influence the implementation of diversion against children who are perpetrators of the crime of distributing pornographic videos at the Gorontalo Regional Police are the Intention of the Perpetrator and Family and economic capacity limitations; Lack of public understanding; and The absence of LPSK in Gorontalo thus hindering and influencing the provision of decisions on compensation that must be received by families and victims of the distribution of pornographic content in Gorontalo.
