Abstract

The form of legal protection for third parties for evidence declared forfeited to the state is in the form of being able to submit an Objection Request to the Court that decided the corruption crime case as the main case and as a condition for third parties to obtain legal protection in the form of filing an objection request is that it must be based on good faith, namely the Third Party where the evidence is really his property that does not originate or has nothing to do with the criminal act of corruption committed by the Defendant. On the decision of the Objection Petition handed down by the Court against the Objection Petition, there is only a legal remedy of Cassation that can be filed by the Third Party as the Objection Petitioner and the Public Prosecutor as the Objection Respondent and the Cassation legal remedy can only be filed once and there is also no legal remedy of Reconsideration allowed.  In the arrangement, there is no balance between the state's right to recover state financial losses that can be carried out by the Public Prosecutor and the Third Party in good faith for the return of his property, where the Public Prosecutor is provided with legal remedies in the form of being able to file a civil lawsuit through the State Attorney based on Article 32 of Law Number. 31 of 1999 concerning the Eradication of Corruption, in an effort to optimize the recovery of state financial losses. On the other hand, third parties are not provided with legal remedies if the objection filed by them on their evidence confiscated for the state in corruption crimes if the objection filed at the cassation level is rejected. The results of this study aim to provide legal protection to third parties who are in good faith over their property which is used as evidence of tipikor cases that do not belong to the defendant and are seized for the state, so that human rights in the form of property rights over third party property can be sought to be restored by being given proportional legal remedies balanced between the state through the State Attorney and third parties as citizens in a state of law.

Abstract

This research aims to analyse the role of the Fogg Behaviour Model in bridging the gap between purchase intention and behaviour on sustainable consumption of bottled drinking water. The research design/plan used is based on hypothesis testing. This research is quantitative and non-experimental. It is based on a questionnaire sent to 228 respondents. The survey was conducted in July 2024, and respondents were consumers of bottled water. Using SPSS and SmartPLS to process and analyse data. The results of the research show that there is a positive and significant influence of green purchase intention on motivation, ability and urge to buy bottled drinking water. Motivation, ability and prompting have been shown to act as a complete mediator to close the gap between green purchase intention and green purchase behaviour. The mediating effects of motivation, ability and prompting can lead to a stronger green purchasing behaviour. There are limitations to this research, including the fact that it is quantitative and conducted over a relatively short period of time, and that it only looks at sustainable purchasing behaviour for bottled water, which is relatively affordable.

Abstract

Climate change has emerged as a pressing global issue, significantly impacting various aspects of human life and the environment. In the context of the shipping industry, a crucial pillar of international trade, the effects of climate change are both direct and profound. By 2025, the repercussions of climate change are expected to become increasingly evident, with rising sea levels, predicted to reach between 0.3 to 1 meter by the end of the century, altering existing port topographies and shipping routes. The frequency and intensity of extreme weather events, such as tropical storms and high waves, are anticipated to rise, posing risks to vessels and potentially leading to port closures and disruptions in established shipping routes. Additionally, the melting Arctic ice is opening new shipping lanes, such as the Northern Sea Route, which, while offering faster transit between Europe and Asia, also presents significant navigational and environmental challenges. This article aims to explore these impacts in depth, focusing on how climate change will affect global shipping routes in 2025. Through the analysis of current data and case studies, it seeks to provide insights into the challenges and opportunities faced by the shipping industry in addressing the urgent issue of climate change. A better understanding of these issues is essential for stakeholders to take necessary steps to adapt and mitigate negative impacts on the environment and economy.

Abstract

Every child has unique characteristics, especially the middle child. Middle children bring their own challenges, they have to balance the desire to be noticed with the role as a mediator. The researcher examines more deeply the communication dynamics of middle children in the movie “Jalan yang Jauh Jangan Lupa Pulang” (A Long Way To Come Home). This research aims to reveal the communication dynamics of middle children in families, friendships, and couples using Roland Barthes' semiotic approach. Through qualitative methods involving observation and interviews, this research reveals the denotation, connotation, and mythical meanings related to the role of middle children in the family. The results of the analysis show that good family communication is essential for building the middle child's self-confidence, while a lack of attention can lead to feelings of alienation and emotional conflict. In addition, this study also explores the communication dynamics of friendship and couple relationships, emphasizing that jealousy and distrust can damage interpersonal relationships. The importance of even-handed attention from the family to prevent negative impacts on the emotional development of the middle child, as well as the importance of effective communication in all aspects of the relationship, are discussed

Abstract

The dynamics of the application of Article 97 of the Compilation of Islamic Law in the distribution of joint property after divorce shows the phenomenon of contra legem carried out by judges to achieve substantive justice. This study analyzes the philosophical construction of Article 97 of the Compilation of Islamic Law and the judge's decision that deviates from the provisions of the 50:50 division through the perspective of Maqasid Shariah. The research method uses normative juridical with a qualitative approach, analyzing the Supreme Court Decision Number 266K/AG/2010 and the Decision of the Jakarta High Court of Religion Number 126/Pdt.G/2013/PTA. JK as primary data. The results showed that judges applied distributive justice by taking into account the factual contributions of each party, resulting in a proportional division of 75:25 and 67:33 that deviated from the normative provisions. The findings reveal that the approach of Maqasid Syariah through the principles of hifdz al-mal and hifdz al-nafs provides theological legitimacy for deviations for the sake of substantive justice. The research concludes the need for a reformulation of Article 97 of the KHI by integrating the principle of proportionality of contribution to create a legal framework that is more adaptive to contemporary social realities without sacrificing legal certainty.

Abstract

This study seeks to examine the influence of competence, work discipline, and motivation on employee performance. The study was conducted at the State Polytechnic of Malang, East Java, Indonesia with a sample of 208 contract employees. The reason for choosing this sample is because contract employees for performance assessment are regulated, assessed and evaluated by the leaders at the State Polytechnic of Malang. Unlike employees with civil servant status, who are assessed by the ministry. The data analysis method uses the Structural Equation Model (SEM) with Variance Based SEM with smartPLS 3.3.0 Software. Questionnaires distributed through Google Forms were used to collect the data. The study's outcomes show that both competence and work discipline play a significant role in shaping employee performance. Likewise, motivation succeeded in becoming an mediating factor for assessing the relationship between competence, work discipline, and employee performance, although its value was not greater than its direct influence. The data reveal that competence, work discipline and motivation remain considerations from time to time to achieve optimal employee performance.

Abstract

This quantitative research aims to examine the influence of job boredom, cyberloafing, and perceived organizational justice on employee performance of generation Z, with mediating role of organizational commitment, in the logistics sector of warehousing and land transportation in Indonesia. The cross-sectional approach was used in data collection by distributing questionnaires to employees working in 8 logistics companies in Jakarta during October until November 2024, with 391 respondents involved. Data analysis is using Structural Equation Modelling with software AMOS version 23. The results of the hypothesis test show there is negative effect of job boredom and positive effect of perceived organizational justice on employee performance, and there is mediating role of organizational commitment. However, cyberloafing does not affect employee performance and organizational commitment. Companies need to strive on increasing organizational commitment to mitigating the negative impact of job boredom and increase the positive influence of perceived organizational justice on employee performance.

Abstract

This study aims to determine how the application of the exemplary method in shaping the morals and character of grade VII students at SMP IT Ar Rojaq. The research method used is descriptive qualitative, with data collection techniques in the form of observation, interviews, and documentation. The results of the study indicate that teachers at SMP IT Ar Rojaq actively apply the exemplary method in the educational process, both through attitudes, speech, and real actions in everyday life in the school environment. The exemplary behavior shown by teachers includes aspects of discipline, honesty, responsibility, politeness, and social concern. From the results of statements given to students as many as 50 respondents, it was found that exemplary behavior had a very good effect of up to 90%. The impact of implementing this method can be seen in changes in student behavior that are better in terms of morals and character. Supporting factors for the success of implementing this exemplary method include teacher commitment, a conducive school environment, and ongoing character development. Thus, the exemplary method has proven to be effective as a strategy in shaping students' morals and character, and can be used as the main approach in education based on Islamic values

Abstract

The choice of fines as an alternative punishment in a criminal act regulated in legislation, but rather an inseparable part of the substance or material of the legislation itself, where judges rarely impose fines on defendants, even though fines are also a solution for the application of criminal law, this has been regulated in Article 10 of the Criminal Code, one of which mentions fines as part of a criminal act. The problem in this study is how the judge's considerations in deciding criminal fines contained in criminal cases, and how to apply criminal sanctions to perpetrators of criminal acts contained in the decision of criminal case Number: 826 / Pid.C / 2024 / PN.Rap., and the method in this study is normative juridical, with a case study approach, by drawing deductive conclusions. The results of this study are the judge's considerations in deciding criminal cases of fines contained in criminal cases, in fact the judge in making a decision has carried out legal considerations, so the judge will first draw the trial facts and is a cumulative conclusion from the statements of witnesses, the defendant's statement, and evidence submitted and examined in court, which is oriented to the dimensions of the locus and tempus delicti of the crime committed, after the trial facts are stated, in the decision the judge will consider the elements (bestenddelen) of the crime that has been charged by the prosecutor or public prosecutor which has a correlation between the facts of the crime charged and the elements of the defendant's guilt that will be sentenced to a fine, and the judge in imposing a fine through his considerations is very limited by the rules of punishment, because the judge has the freedom to determine the type of punishment as contained in Article 10 of the Criminal Code, be it imprisonment, confinement and or a fine. and the application of criminal sanctions for the defendants as in the decision of case Number: 826 / Pid.C / 2024 / PN.Rap. where the judge sentenced the defendant by applying Article 364 of the Criminal Code by adjusting to Perma Number 02 of 2012 concerning the limits of criminal law adjusted in the Criminal Code so that in fact the judge found the defendant had legally and convincingly committed the crime of minor theft as referred to in the Perma and other laws so as to impose a fine on the defendant in the form of a fine in the form of money amounting to Rp. 200,000.00 (two hundred thousand rupiah) with the provision that if the defendants cannot pay it, it will be replaced with imprisonment for 7 (seven) days since the decision was read and has permanent legal force.

Abstract

The existence of Jendela Sastra provides a great opportunity for writers and readers to be more connected and collaborate in creating literary works, creating a more active community, and exploring new monetization potential that is more sustainable. The purpose of this research is to describe the existence of the Jendela Sastra platform as an online literary publication media for writers. The method used in this research is descriptive analysis method. The results of this study consist of four parts, namely: (1) the role of Jendela Sastra in the dissemination of literary works, including (a) wider accessibility, (b) diversity of literary genres and styles, (c) use of technology in the delivery of literature, (2) interaction between writers and readers, including (a) creative dialog, and (b) active participation of readers, (3) challenges in digital literary media, including (a) quality issues and content curators, (b) copyright infringement, and (c) monetization and sustainability, and (3) opportunities for the development of digital literary media, including (a) increased access to literature to the international community, and (b) collaboration between writers and readers.
