Abstract

This study aims to analyze the survival strategies used by farmers in Margaluyu Village, Bandung Regency, in dealing with the uncertainty of agricultural commodity prices. The instability of agricultural product prices is one of the main challenges faced by farmers, which has an impact on their economic and social welfare. A qualitative descriptive approach was used in this study with data collection techniques through in-depth interviews, observation, and documentation. The results of the study indicate that farmers in Margaluyu Village developed several adaptive strategies, such as diversifying income sources by borrowing capital from dealers, using the Tumpang sari technique to overcome challenges arising from the uncertainty of agricultural commodity prices, and forming social networks between farmers. In addition, support from the government and local institutions also plays an important role in strengthening farmers' resilience to market price fluctuations. This study provides in-depth insight into effective survival mechanisms for farmers in dealing with economic uncertainty in the agricultural sector. These findings are expected to be the basis for policy makers in designing programs that support the sustainability of the agricultural sector.

Abstract

The plurality of society in Indonesia is one of the icons of Indonesia. With plurality, people are expected to respect differences in ethnicity, race, religion, and culture. However, plurality must be the basis of community tolerance, rarely causing conflicts due to differences. The emergence of conflicts that occur is one of the indicators that Indonesian people still do not fully understand the problem of multicultural internal conditions. Gus Dur's presence in advancing multicultural education emerged as part of a response to the phenomenon of ethnic, racial, religious, and cultural differences that often arise in the midst of a multicultural society. Gus Dur's concept of multicultural education emphasizes on cultivating a life of respect and tolerance for diversity that lives in a pluralistic society and fostering generations who are not only knowledgeable and skilled, but also able to live together in society as the nation's successor. This study uses literature research by reviewing several Gus Dur books. The results of the study show that there are differences in religion, race, and culture that do not conflict with each other and are not a source of division in society. So that multicultural Islamic education is a very urgent thing to be carried out to bring flexibility and openness to each other.

Abstract

The determination of additional punishment in the form of "replacement money" should ideally be equivalent or balanced with the state financial losses as a result of criminal acts of corruption. The formulation of the problem in writing this thesis is how to execute replacement money for criminal acts of corruption according to positive law and what is the legal certainty of execution in the form of payment of replacement money for corruption cases in the criminal criminal system. The research method used in this research is normative juridical, with a statutory, conceptual and case approach. The legal materials used are primary, secondary and tertiary legal materials and the analysis of legal materials is qualitative. The research results show that one of the elements of corruption in Article 2 and Article 3 of Law 31/1999 jo. Law 20/2001 is a loss to state finances. This element has the consequence that eradicating corruption does not only aim to deter corruptors through imposing heavy prison sentences, but also restore state finances due to corruption, as emphasized in the General Precautions and Explanation of Law 31/1999. By law, the instrument to restore state finances is included in the additional penalty in the form of payment of replacement money. The difference in the meaning of the criminal purpose of paying replacement money between what is intended in the explanation of the Law and the formulation of Article 18 paragraph (1) letter b causes the purpose of paying replacement money to be unclear. This ambiguity also has an impact on the dualism in the application of calculating the value of replacement money as seen in several Supreme Court (MA) decisions. The legal umbrella for execution in this case is Article 18 of Law 31/1999 and not the Supreme Court's fatwa. The execution of replacement money also does not require a separate lawsuit, because the additional crime of replacement money is a single criminal decision handed down by a panel of judges, where the authority to execute each criminal decision, both main and additional crimes, rests with the public prosecutor. The need for the Supreme Court's fatwa should not be for carrying out executions but as a legal umbrella for how long a substitute prison sentence will be served if the compensation money has been paid in part, which is currently not regulated in Law 31/1999 jo. Law 20/2001 and other derivative regulations.

Abstract

Early marriage is a social phenomenon that still occurs in many countries, including Indonesia. According to Adam A (2020), marriage is a ceremony carried out by two people to formalize a marriage bond based on religious, legal, and social norms. However, early marriage is often triggered by various factors such as cultural norms, poverty, and pregnancy out of wedlock. Law of the Republic of Indonesia No. 16 of 2019 concerning Marriage regulates the minimum age limit for marriage, which is 19 years for men and women, although early marriage is still taking place in some regions. This study uses a qualitative approach by examining various literature and statistical data related to early marriage. The results of the study show that early marriage can be at high risk to the reproductive, psychological, and quality of life of young couples. Negative impacts that often arise include pregnancy complications, divorce risks, and emotional disturbances for adolescents who are not ready to take on the role of husband or wife. On the other hand, some of the positive impacts found are the reduction of the family's economic burden and the learning of responsibility. To reduce the rate of early marriage, there needs to be increased education, socialization about its negative impacts, and stricter law enforcement. Therefore, there needs to be collaboration between the government, the community, and educational institutions to prevent early marriage in Indonesia.

Abstract

The DKI Jakarta Regional Government is evaluating a rail Public-Private Partnership (PPP) proposal for the Pulo Gebang-Joglo Light Rail Transit (LRT) under the Unsolicited Local Government and Business Entity Cooperation (KPDBU) scheme. This thesis examines the project's feasibility, focusing on financial and risk aspects. The proposal is currently under review by the DKI Jakarta Provincial Government. Passenger forecasts include pessimistic, moderate, and optimistic scenarios to estimate potential revenue. Investment costs (capex) and service revenue are calculated for a 30-year concession period. A financial feasibility study, assuming 4% inflation and a 9.15% benchmark interest rate, utilizes Net Present Value (NPV), Internal Rate of Return (IRR), Profitability Index (PI), and payback period metrics. The project is deemed financially viable under the Availability Payment (AP) scheme, yielding an NPV of Rp14.23 trillion, an IRR of 11.77%, and a PI of 1.035. The payback period is projected at twelve years, with annual AP payments of Rp1.94 trillion over the concession period. Risk analysis identified 16 risks across six categories, with 44% classified as very high, 38% high, and 19% medium. Financial aspects based on VAT Regulation No. 2 of 2020 scored 52.5%, the PPP aspect 41.7%, and government support/government guarantees 50%. Despite its financial feasibility, the unsolicited KPDBU proposal requires further refinement, particularly regarding AP financing and tariff revenue accountability. Separate audit mechanisms are needed to ensure transparency and alignment with government regulations.

Abstract

Gedog weaving in Tuban faces challenges in the modern era, with traditional fabrics often less favored by younger generations, seen as irrelevant to contemporary lifestyles and work settings. Despite this, Gedog woven fabrics hold significant potential for development into diverse fashion products. This research explores this potential by designing a women's workwear collection that merges the beauty of Gedog motifs with modern designs. The goal is to create workwear that is aesthetic, functional, and comfortable for both work and formal occasions, boosting wearer confidence. The research employs qualitative methods, including descriptive analysis. Primary data was gathered through in-depth interviews with Gedog artisans, career women, and fashion industry experts to understand trends, while secondary data was obtained from literature studies. The creative process involved observing and exploring design elements, developing conceptual designs, and crafting moodboards and early sketches embodying ethnic-style workwear. The resulting designs are well-received by career women and cultural enthusiasts, demonstrating Gedog weaving's potential to enhance appreciation for local heritage. This initiative highlights the importance of collaboration between artisans, designers, and industry players in fostering innovation and sustainability for traditional wastra. By integrating Gedog motifs into contemporary fashion, the research supports the creative industry and provides opportunities for wastra artisans to reach broader markets. Ultimately, this effort emphasizes the preservation of traditional fabric culture in the globalization era, showcasing how cultural heritage can inspire innovative, sustainable fashion solutions.

In this context, the Continental European Legal System is known to have a characteristic in the form of recognition of human rights. As a country of law based on Pancasila and democracy, Indonesia has a responsibility to protect these rights. The protection of human rights in a country of law must be regulated in the constitution and national law. This study uses a normative legal research method that aims to analyze legal regulations that are relevant to the issue under study, which focuses on conceptual and normative approaches that examine applicable laws and regulations, legal principles, and doctrines. This study concludes that Indonesia, as a legal country that refers to the legal system of Continental Europe, has comprehensively regulated the protection of human rights in the 1945 Constitution of the Republic of Indonesia, although challenges in the implementation and enforcement of the law still require more continuous attention.
