Abstract

Divorce is a final path that must be taken in resolving household disputes and turmoil. If the cracks in the household can no longer be reconciled, it is feared that it will cause division between the two families. The objectives of this study are to understand the law of divorce in religious courts and outside of them, the factors causing divorce outside the religious courts, and to identify the impacts of divorce outside the religious court on the social life of the communities in Aceh Utara and Aceh Barat. This research uses a qualitative method, where the researcher thoroughly examines the facts found in the research locations according to the problem focus directly, then presents and discusses the analysis results. To obtain accurate and reliable data, data collection was carried out through observation, interviews, and documentation. The results show: (1) in Islamic law, divorce performed outside the religious court is valid, while the law of divorce outside the religious court is not valid under Indonesian law and the Marriage Law as well as the Compilation of Islamic Law; (2) the factors causing the community to divorce outside the religious court are due to adhering to the opinions of the Imam Mazhab and local ulama, due to customs, economic conditions, ignorance/lack of understanding of regulations, laziness in processing, and indifference to divorce laws; and (3) the impacts felt by the community after divorcing outside the religious court are not receiving the iddah rights, difficulty in remarrying. After all, they do not have a divorce certificate, as the KUA does not permit because they are still considered the wife of the first husband. Furthermore, they cannot claim joint property, hadhonah, and child support. This is consistent with what has happened to the people of Aceh Utara and Aceh Barat. Additionally, problems arising from divorce outside the religious court are related to children and their education, lack of legal certainty, asset distribution, inheritance, creating priority for the husband over the wife, the husband being arbitrary towards the wife, and child custody.

Abstract

Family harmony is a state where family members are united, each member fulfills their rights and obligations, affection is fostered, and mutual understanding, dialogue, and cooperation are well established, resulting in physical and spiritual well-being. This study aims to understand communication patterns in creating a harmonious household, analyze communication aspects influencing household harmony, and identify obstacles in creating a harmonious household. This research uses qualitative methods, where the researcher comprehensively examines the facts in the field according to the focus of the problem. The data obtained is then analyzed, presented, and discussed. Accurate and reliable data were collected through observation, interviews, and documentation techniques. The results of the study indicate that (1) communication patterns that can create household harmony include interpersonal communication, mutual trust and understanding, direct communication, and gentle communication; (2) communication aspects affecting household harmony include communication patterns and adjustments, the busyness of both spouses, financial issues, poor parenting, and lack of mutual trust. On the other hand, poor and ineffective communication results in household disharmony, as communication within the household is the main element for expressing all household life issues, and everything must be communicated openly and transparently. (3) obstacles to creating a harmonious household include poor communication, family aspects, economic aspects, infidelity, and lack of cooperation in nurturing, caring for, and guiding children. The responsibility for children is entirely handed over to the wife. At the same time, the husband only focuses on earning a living, thinking he must provide financially without assisting with household affairs. However, in maintaining a household, cooperation in all matters is essential.

Abstract

This paper aims to see how far BP4 Pariaman City has a role in strengthening human psycho-social in the field of social welfare; services for alumni of post-marriage couples need to be followed up with a balanced program. The lack of psycho-social understanding of pre-marital post-marriage course graduates will have great potential to add to the long line of early marriage ages in Pariaman City. The fundamental problem that is most troubling is their ignorance of the responsibilities, rights and obligations of husband and wife in the household. To overcome this solution, the service team identified the problem of spaciousness. It mapped the problem to be treated (treatment) for the subject of service through two stages: family psychology guidance and Islamic family counseling. The first stage is pre-activity in the form of a Focus Discussion Group (FGD) presenting lecturers as participants to provide input for the mentoring action plan to be carried out. The second stage is action activities, including psychological skill assistance in family psychology and group counseling. This activity has generally received appreciation from stakeholders (BP4 Pariaman City management, pre-marital course alumni) because this program has offered various alternatives for their self-development in elaborating their knowledge to be applied in household life. The results of the reflection and evaluation of the program offered by the service conclude that they understand that a sakinah mawaddah wa rahmah household life is not achieved by material wealth but by the ability to accept oneself and have a correct understanding of an Islamic household. They understand that household problems cannot be measured only by logic. However, it includes religious and spiritual matters the human mind cannot reach. Therefore, they understand that household responsibilities are worldly matters and matters of the afterlife, which are related to God.
