Abstract

Salah satu hak konstitusional masyarakat yang diatur dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 adalah kebebasan berkumpul dan berserikat, sebagaimana diatur dalam Pasal 28E ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Tujuan penelitian ini adalah ormas mempunyai anggota yang jelas, mempunyai kepengurusan terstruktur sesuai hierarki, kewenangan, dan tanggung jawab Masing-masing, di bidang/mengenai/perihal kemasyarakatan seperti pendidikan, kesehatan, keagamaan, kepemudaan, dan lain-lain dalam arti kemasyarakatan seluas-luasnya. Keberadaan Ormas di era sekarang sering menjadi perdebatan, terutama adanya sikap pemerintah melalui SKB Menteri dalam pembubaran Ormas. Untuk menjawab isu hukum tersebut, peneliti menggunakan metode penelitian normative, dengan menggunakan pendekatan peraturan perundang-undangan dan penafsiran yang digunakan adalah penafsiran gramatikal dan autentik. Aspek hukum yang akan dikaji adalah keberadaan SKB Menteri dalam pembubaran ormas dari aspek Hukum Administrasi Negara. Hal ini bukan tanpa alasan, karana sering ketetapan yang dikeluarkan pemerintah ada yang sifat mengatur (regeling) dan ada yang bersifat Penetapan (beseeching). Hasil yang dituju adalah adanya pembedaan yang jelas dalam SKB tersebut antara pengaturan dan penetapan.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis Investasi Pemerintah dalam Bentuk Pemberian Pinjaman di Masa Pandemi Covid-19. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan statute, conceptual dan case study. Bahan hukum dalam penelitian ini berupa bahan hukum primer dan bahan hukum sekunder, dengan cara identifikasi, inventrisasi, klasifikasi, dengan teknik analisis yang bersifat deduktif. Hasil dari penelitian ini menunjukkan bahwa pinjaman dapat dibagi menjadi pinjaman biasa dan pinjaman dalam rangka pemulihan ekonomi nasional (Pinjaman PEN), pinjaman biasa mengharuskan persetujuan dewan, sedangkan pinjaman PEN mengsyaratkan pemberitahuan, dan kedua pinjaman tersebut terkait dengan investasi.

Abstract

Pemerintah mencoba mengatasi permasalahan ekonomi di masa pandemi Covid-19 dengan mengambil kebijakan refocusing kegiatan dan realokasi anggaran. Pemerintah Daerah juga dituntut untuk melakukan refocusing kegiatan dan realokasi anggaran melalui perubahan APBD. Namun, tidak semua daerah bisa dengan segera melakukannya. Penelitian ini bertujuan untuk menganalisis, melihat tantangan, dan memberikan solusi perumusan kebijakan refocusing kegiatan dan realokasi anggaran Pemerintah Daerah di masa pandemi Covid-19. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perbandingan dan pendekatan peraturan perundang-undangan. Hasil penelitian menunjukkan adanya variasi perubahan APBD dalam melakukan refocusing kegiatan dan realokasi anggaran yang disebabkan karena beberapa hal, seperti perbedaan fleksibilitas keuangan daerah dan tidak adanya panduan yang jelas dalam melakukan refocusing kegiatan dan realokasi anggaran. Guna menghadapi permasalahan tersebut, solusi yang dapat dijalankan oleh Pemerintah Pusat sebagai pengarah kebijakan bagi Pemerintah Daerah dalam hal refocusing kegiatan dan realokasi anggaran adalah membuat semacam Standar Operasional Prosedur yang memuat batasan ruang lingkup anggaran dan kegiatan yang harus dikurangi, ditambah, maupun disesuaikan kembali.

Abstract

Technological advances on a transnational scale have had a considerable impact on all levels of Indonesian society. One of the technological advances is the existence of gadgets. Not only positive effects, but they also bring negative impacts. Furthermore, the existence of gadgets continues to grow with more transactions being carried out. Unfortunately, this can be a dispute. The purpose of this research is to propose the problems of Indonesian International Civil Law which have not regulated and provided guarantees to protect transnational e-Commerce interests and their solutions. The method used in this research is normative with a statutory and conceptual approach. The results of this study are the existence of Consumer Protection Law (UUPK), Electronic Information and Transactions Law (ITE Law), Money Supply Law (UUUP), and International Civil Law (HPI) of Indonesia have not provided a clear guarantee of protection related to the choice of law in transnational scale e-commerce contracts. Besides, they also have not been able to accommodate the interests of consumers. One of the solutions offered is concretizing the principle of the recipient country. It is a rule that allows end-users to apply the Consumer Protection Law of their country. This principle is excluded from consumer transactions. This also does not apply .e-commerce contracts. This principle is taken from the Rome and Brussels Convention which is incorporated into the Directive, namely the Law for the EEC community (Europe Union). To provide legal guarantees for consumers, thus the interests’s of consumers can be protected.

Abstract

Penggusuran lahan di Kawasan Mandalika berlangsung panjang, mulai dari rezim Orde Baru hingga sekarang. Mengapa penggusuran lahan yang dilakukan rezim otoriter, justru dilanjutkan oleh rezim yang dipilih secara demokratis? Jika rezim otoriter lebih menggunakan pendekatan kekerasan, maka rezim “demokratis” mengombinasikan dengan pendekatan hukum. Penggusuran lahan yang dilakukan dengan legitimasi hukum memang lebih canggih dibanding dengan kekerasan dan intimidasi semata. Warga masyarakat yang sebelumnya gigih mempertahankan tanah meski dengan intimidasi, akhirnya merubah orientasi perjuangannya dari mempertahankan tanah menjadi tuntutan ganti rugi. Bagaimana hukum didayagunakan sebagai instrumen yang sah dalam pembebasan lahan? Penelitian ini menggunakan pendekatan socio-legal. Peneliti melakukan wawancara pemilik lahan, bagaimana mereka tergusur dari kampung halamannya. Peneliti juga melakukan wawancara dengan pihak perusahaan, kepolisian, Badan Pertanahan Nasional yang aktif mengambil bagian dalam proses pembebasan lahan. Pendekatan hukum ternyata tidak bisa sepenuhnya menyembunyikan kekerasan dan pelanggaran Hak Asasi Manusia. Terlebih lagi di era digital yang semakin terbuka, penggusuran meski dibalut dengan pendekatan hukum, tetap mendapat sorotan internasional.

Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

Constitutional Court will be able to provide protection for constitutional rights which will produce institutions that are able to provide answers to reforms. The presence of the Constitutional Court third amendment to the 1945 Constitution of the Republic of Indonesia, which became the basis of Article 24C. The legitimacy of the Constitutional Court in a limited way is formulated, namely: to begin, to investigate legislation that violates the constitution, to adjudicate disputes over the power of state institutions vested with constitutional authority, and to adjudicate the dissolution of political parties and settlement, the four general election disputes. In the modern state administration discourse, it currently requires the Constitutional Court to expand the scope of its authority in relation to Constitutional Complaints or commonly referred to as Constitutional Complaints. The necessity of one of these powers can be seen in the number of state institutions that violate the constitutional rights of citizens through the actions of these institutions. However, the channel for this complaint still does not exist, only that currently exists in providing protection for the right of Constitutional Complaints to be protected through judicial review of the basic constitution as regulated in the constitution.

Abstract

Illegal, Unregulated, and Unreported (IUU) Fishing cases often occur in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels conducting fishing activities in Indonesia’s territorial waters, and exclusive economic zone (EEZ).  IUU fishing has caused huge losses to the country. One of the perpetrators engaged in this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters specifically in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around the area. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study delves deeper into whether the actions conducted by Silver Sea 2 Vessels violate Indonesian regulations and UNCLOS 1982. Additionally, it examines the compatibility of the Indonesian government’s legal enforcement of IUU Fishing with UNCLOS 1982. The results indicate that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982. Furthermore, the handling of this case by the Sabang District Court was deemed appropriate.

Abstract

The emergence of the Job Creation Act, one of the aims of creating employment opportunities. In general, the administrative licensing process in Indonesia is a barrier to business transformation. Many licensing processes do not have clear protocols, demanding, lack transparency, and costly. So that the fundamental transformation in the Job Creation Law is the transformation of the business licensing paradigm in Indonesia. Switch from the traditional license-based licensing approach to risk-based licensing. This research aims to reveal how risk-based licensing actually is and what problems can arise in licensing when risk-based licensing is applied. This is a doctrinal study that takes a conceptual and legal approach. The analysis is in the form of primary, secondary, and tertiary legal materials. The data and materials collected were analyzed qualitatively and described by descriptive analysis. This paper concludes that risk-based licensing relies more on a thorough risk analysis. In the implementation of risk-based licensing, the regulator assesses several factors such as business activities, business performance history, and the risk management system in place. Based on these matters, the regulator then places business actors into several groups, according to the level of risk. Risk-based licensing, on the other hand, has a couple of problems. The first issue is ambiguous risk assessment as a result of the omnibus legislative format. Second, the volatile risk hasn’t been taken into account. Third, neither cumulative nor systemic risks have been taken into account. Fourth, there are unanticipated implementation challenges. Finally, there is the possibility of regulatory capture.

Abstract

The limits of authority possessed by the Constitutional Court in deciding disputes regarding the results of general elections as stipulated in Article 24C paragraph (1) of the 1945 Constitution have given a narrow interpretation which is to assess the difference in the figures set by the KPU. The limited authority of the Constitutional Court has caused the decline in the quality of elections. The Constitutional Court does not dare to take on its broader authority even though its position as guardian of the constitution as well as the guardian of democracy. The wider authority of the Constitutional Court needs to be given that every election will always be followed by violations and fraud.
