Abstract

Increasingly advanced technology does not always have a positive impact, sometimes it has a negative impact. This is like a widespread case because of the development of the Shopee marketplace which provides Cash On Delivery services) which, instead of benefiting the seller, is detrimental. This loss is not the responsibility of Shopee, but the seller itself. However, there is relevance to positive laws and regulations in Indonesia that can resolve this case. This study's goal is to determine the type of legal protection available to seller viewed from the Consumer Protection Act, the ITE Law, and the Civil Code and to find out Shopee's responsibility in protecting sellers who lose money because of the COD service. A technique to study called normative juridical is applied. The approach used is the legal approach. The data collection technique used is literature study. The data and data sources used come from secondary data, namely research journals, laws, and electronic sources that can be accounted for. The results and analysis of this study are that the regulations contain Law no. 8 of 1999 concerning Consumer Protection Articles 5, 6, 7, 34 and 45; Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions Article 45A; and the Civil Code Articles 1513, 1514, 1517, 1243, and 1267. Then, efforts to resolve this case can be done either through or outside the court and the seller activates the shipping insurance provided by Shopee.

Abstract

The Indonesian Constitutional Court has undergone a transformation from a negative legislator to a positive legislator, particularly evident in Decision No. 90/PUU-XXI/2023, which not only annulled unconstitutional norms but also created new regulations regarding age requirements for presidential candidates. This study examines the implications of Constitutional Court decisions as a positive legislator on checks and balances, practices in the United States, Germany, and South Korea, and the reformulation of Constitutional Court authority. Employing normative legal research with statutory, conceptual, case, and comparative approaches, this study analyzes Constitutional Court decisions and practices in three countries. The findings indicate that Constitutional Court decisions acting as a positive legislator tend to shift the balance of power between the judicial, legislative, and executive branches, creating legal uncertainty and institutional conflicts. Practices in the US, Germany, and South Korea reveal that the positive legislator role requires institutional dialogue mechanisms and clear authority limitations. The implications emphasize the need for reformulating Constitutional Court authority through establishing objective criteria, strengthening checks and balances mechanisms, and developing constitutional dialogue among the Constitutional Court, Parliament, and President. This study contributes by examining comparative practices (US, Germany, South Korea) and formulating reformulation guidelines not previously developed in existing scholarship.

Abstract

The digital transformation of government through the implementation of e-government has become an inevitable necessity in the era of the industrial revolution 4.0. This study aims to analyze the application of e-government principles in digital public administration in Indonesia, identify regulatory challenges, and examine the forms of legal protection for citizens. This research employs a normative juridical method with statutory and conceptual approaches, supported by case studies of digital government platforms. The findings indicate that the implementation of e-government in Indonesia has been carried out through the Electronic-Based Government System (SPBE), yet it remains partial and not fully integrated. Major challenges include regulatory disharmony, legal gaps, data protection issues, limited infrastructure, and sectoral ego among government institutions. Furthermore, legal protection for citizens has not been fully effective, particularly in ensuring privacy rights and administrative accountability. Therefore, comprehensive regulatory reform, strengthened personal data protection, and institutional capacity building are necessary to achieve a fair and citizen-oriented digital governance system.

Abstract

Tradisi lisan berbalas pantun merupakan salah satu bentuk ekspresi budaya Melayu yang masih dipertahankan dalam upacara pernikahan adat masyarakat Melayu khususnya Siak Sri Indrapura. Penelitian ini bertujuan untuk menganalisis peran tradisi berbalas pantun dalam pembentukan konsep diri individu yang terlibat sebagai pelaku adat dan anggota masyarakat. Penelitian menggunakan pendekatan kualitatif dengan metode wawancara mendalam terhadap pelaku pantun adat dan tokoh lembaga adat, yang diperkuat dengan narasumber tambahan sebagai representasi pelaku lintas generasi. Analisis data dilakukan secara tematik dengan merujuk pada teori konsep diri Carl Rogers. Hasil penelitian menunjukkan bahwa keterlibatan dalam tradisi berbalas pantun berkontribusi pada pembentukan konsep diri positif melalui internalisasi nilai tanggung jawab, kesopanan, amanah, dan identitas budaya. Tradisi ini juga berfungsi sebagai medium penerimaan sosial (positive regard) yang memperkuat harga diri dan konsistensi antara diri aktual dan diri ideal. Penelitian ini menegaskan bahwa tradisi lisan tidak hanya berfungsi sebagai warisan budaya, tetapi juga sebagai mekanisme psikososial dalam pembentukan jati diri masyarakat Melayu.

Abstract

Impeachment is an important constitutional mechanism to maintain checks and balances in the presidential system. Indonesia and the United States, as countries that adopt presidentialism, have different constitutional frameworks in regulating the impeachment of presidents. This paper aims to provide a comparative analysis of the impeachment models in Indonesia and the United States. This study employs a normative juridical method with a comparative constitutional approach. The findings show that the Indonesian model emphasizes the juridical dimension through the Constitutional Court’s involvement as a legal filter, whereas the American model highlights the political aspect by granting Congress dominant authority. The Indonesian system guarantees due process of law but is procedurally complex, while the American system is simpler but vulnerable to politicization. These differences demonstrate that institutional design significantly shapes the balance of power in each country.
