Abstract

This article analyzes the phenomenon of "lag time" or the temporal gap in Indonesia's socio-legal transformation post-1998 Reformation. Lag time is defined as the misalignment between the progressive ambition of law as a tool of social engineering and the reality of adaptation and internalization at the level of societal legal culture. The study employs a juridical-sociological methodology to identify the determinant factors causing the slow acceptance of new regulations. The findings indicate that lag time manifests from the failure to synchronize the structural dimension and the cultural dimension of the legal system. Structural factors include the weak capacity of law enforcement, regulatory inconsistency, and the failure of top-down socialization. Meanwhile, cultural factors encompass the legacy of authoritarian legal culture based on fear, resistance from living law, and public pragmatism. The conclusion urges the necessity of systemic reform that focuses not only on improving the substance of the law but also on transforming the legal culture through participatory education to achieve compliance rooted in ethical awareness and justice. Abstract

This study analyzes the implementation of Law No. 23 of 2004 on the Elimination of Domestic Violence (PKDRT Law) in the context of efforts to transform domestic relations and increase gender legal awareness in Indonesia. Domestic violence (DV) is a multidimensional issue rooted in gender inequality and reinforced by a culture of silence, even though data from the National Commission on Violence Against Women shows a significant increase in reported cases (15,652 cases in the domestic sphere in 2023). Using a normative-empirical legal approach with a focus on analyzing court decisions, this study found a significant gap between the spirit of the law and its practice in the field. The PKDRT Law aims to transform DV from a private matter into a public criminal offense. However, its implementation faces strong cultural, social, and institutional challenges, including stigma against victims, pressure to reconcile for the sake of “family unity,” and a lack of holistic understanding of gender justice among law enforcement officials. Analysis of court decisions, such as Supreme Court Case No. 1583 K/Pid.Sus/2019 and Gresik District Court Case No. 139/Pid.Sus/2019/PN.Gsk, reveals a tendency for judges to impose minimal sentences or be influenced by social pressure, which ultimately distorts justice for victims and reduces the transformative power of the law. This study concludes that the existence of regulations alone is not enough; a shift in collective consciousness and gender-sensitive implementation are needed to realize equal domestic relations.

Abstract

Kedudukan wakil presiden dalam sistem pemerintahan presidensial selama ini masih mengalami ambiguitas, terutama di Indonesia. Meski diakui sebagai pembantu presiden dalam konstitusi, scope pekerjaan dan wewenang wakil presiden tidak dijabarkan secara konkret. Fenomena ini berbeda dengan Amerika Serikat di mana posisi wakil presiden memiliki peranan yang lebih terstruktur melalui konstitusi yang lebih detail. Penelitian ini bertujuan untuk menganalisis optimalisasi fungsi wakil presiden melalui kajian komparatif antara sistem pemerintahan Indonesia dan Amerika Serikat. Metode penelitian menggunakan pendekatan kualitatif dengan analisis dokumen konstitusional dan studi perbandingan hukum tata negara. Hasil penelitian menunjukkan bahwa terdapat perbedaan signifikan dalam pengaturan fungsi wakil presiden di kedua negara. Di Indonesia, posisi wakil presiden dibatasi pada peran pembantu dan penjaga kontinuitas pemerintahan, sementara di Amerika Serikat wakil presiden memiliki peran ganda sebagai ketua senat dan sebagai calon pengganti presiden dengan mekanisme yang lebih jelas. Temuan ini mengindikasikan perlunya reformasi konstitusional dan operasional untuk mengoptimalkan fungsi wakil presiden di Indonesia agar sistem checks and balances dapat berjalan lebih efektif. Penelitian ini berkontribusi pada pengembangan hukum tata negara komparatif dan memberikan rekomendasi praktis bagi penyempurnaan struktur pemerintahan Indonesia.

Abstract

The rapid expansion of digital communication in Indonesia, with 220 million internet users in 2025, has been accompanied by a surge in hoaxes and hate speech, including 103,000 negative contents during the 2024 election, prompting the need for adaptive criminal law as a tool of social engineering. This study examines Law No. 1 of 2024 as an instrument of social engineering in Roscoe Pound’s sense to shape digital communication behavior, using a normative legal method that integrates statutory analysis, conceptual theory, purposive cases, and comprehensive secondary data from court decisions and state reports. The findings show that revisions to key provisions of the ITE Law reduced hoaxes by 28 percent, increased verification behavior among 68 percent of users, and enabled the removal of 15,000 harmful contents, but persistent problems remain, including ambiguous norms, low digital literacy, enforcement disparities, and self-censorship. The study concludes that while the ITE Law is strategically important, it requires further reform to shift from a punitive to a transformative approach, and it recommends clearer norms, mandatory mediation, strengthened digital literacy, specialized cyber courts, and independent oversight to support a democratic and Pancasila-based digital ecosystem.

Abstract

The Indonesian Constitutional Court has undergone a transformation from a negative legislator to a positive legislator, particularly evident in Decision No. 90/PUU-XXI/2023, which not only annulled unconstitutional norms but also created new regulations regarding age requirements for presidential candidates. This study examines the implications of Constitutional Court decisions as a positive legislator on checks and balances, practices in the United States, Germany, and South Korea, and the reformulation of Constitutional Court authority. Employing normative legal research with statutory, conceptual, case, and comparative approaches, this study analyzes Constitutional Court decisions and practices in three countries. The findings indicate that Constitutional Court decisions acting as a positive legislator tend to shift the balance of power between the judicial, legislative, and executive branches, creating legal uncertainty and institutional conflicts. Practices in the US, Germany, and South Korea reveal that the positive legislator role requires institutional dialogue mechanisms and clear authority limitations. The implications emphasize the need for reformulating Constitutional Court authority through establishing objective criteria, strengthening checks and balances mechanisms, and developing constitutional dialogue among the Constitutional Court, Parliament, and President. This study contributes by examining comparative practices (US, Germany, South Korea) and formulating reformulation guidelines not previously developed in existing scholarship.
