Abstract

The verdict of the Kepahiang Religious Court, Case Number 01/Pdt.G.S/2021/PA.Kph, reflects a tension between the formalistic application of positive law and the values of maqāṣid al-sharīʿah, which emphasize justice and preventive benefit in resolving Islamic economic disputes. This study aims to analyze the legal considerations and the construction of maqāṣid al-sharīʿah in a murābaḥah contract default case by examining the consistency between the judge’s legal reasoning and the principles of maqāṣid al-sharīʿah, namely ḥifẓ al-māl (protection of wealth), ḥifẓ al-‘aqd (protection of contract), and ḥifẓ al-‘adl (protection of justice). Employing a normative-juridical method with a case-conceptual approach and content analysis of the Compilation of Sharia Economic Law (KHES), the Indonesian Civil Code (KUHPerdata), and DSN-MUI Fatwas, the study finds that the judge adopted systematic and grammatical interpretation through legal logic techniques such as subsumption, exclusion, derogation, and non-contradiction. However, the ruling remains curative and mechanistic in nature, as it primarily focuses on punitive measures for contractual breach. These findings reveal an epistemic disparity between the formal rationality of positive law and the preventive, benefit-oriented rationality of sharīʿah. This research contributes by proposing a maqāṣidic legal reasoning framework as an integrative paradigm to reconcile the rationality of positive law with the ethical rationality of maqāṣid al-sharīʿah in the practice of Islamic economic adjudication in Indonesia.

Abstract

Tujuan penelitian ini adalah untuk mengetahui tinjauan ekonomi hukum terhadap pertimbangan Mahkamah Agung dalam Putusan No. 1555.K/PID.SUS/2019 dan tinjauan ekonomi hukum terhadap perbuatan hukum pejabat publik yang beririsan dengan hukum perdata atau administrasi negara dihubungkan dengan kebijakan penegakan hukum pemberantasan tindak pidana korupsi. Penelitian ini merupakan kajian filosofis terhadap kebijakan penegakan hukum yang dilakukan melalui pendekatan studi kasus dan pendekatan konseptual.  Hasil penelitian menunjukkan bahwa berdasarkan analisis ekonomi hukum putusan Mahkamah Agung tersebut dapat dibenarkan karena penerbitan SKL berdasarkan dilakukan berdasarkan perjanjian MSAA dan Akta notaris. Model penafsiran yang digunakan Mahkamah Agung dalam memutus perkara ini adalah perpaduan model logike deontologis yang berbasis mazhab hukum positivsitk dengan logika utilitarian yang bercorak teleologis Pertimbangan hukum Mahkamah Agung tersebut di atas menjelaskan adanya pergeseran perspektif terkait dengan adanya irisan antara hukum pidana, perdata dan administrasi negara. Menurut Mahkamah Agung penerbitan SKL adalah ranah administrasi negara dan hukum perdata sehingga kesalahan dalam penerbitan SKL tidak dapat dikualifikasikan sebagai tindak pidana.Kata Kunci: Etika utilitarian; Ekonomi hukum; PenafsiranAbstract:The purpose of this study is to find out the legal, economic review of the Supreme Court's considerations in Decision No. 1555.K / PID.SUS / 2019 and legal, financial analysis of the legal actions of public officials that intersect with civil law and administration law when connected with enforcement policies to eradicate corruption. This research is a philosophical study of law enforcement policies carried out through a case study approach and conceptual approach. The results showed that based on legal, economic analysis of the Supreme Court decision could be justified because SKL issued was based on an MSAA and notarial deed. The interpretation model used by the Supreme Court in deciding this case is a mix of a deontological model based on positive schools of law with teleological-style form utilitarian logic. The Supreme Court's legal considerations above explain the shift in perspective related to the incision between criminal law, civil law, and state administration. According to the Supreme Court, SKL issued is the domain of administrative law or public law, so a fault in publishing SKL cannot be qualified as criminal acts.Keywords: Interpretation; Legal economy; Utilitarian ethics

Abstract

The objective of this study is to evaluate the effectiveness of existing protection measures in safeguarding indigenous land rights in Sepaku and Samboja, East Kalimantan, within the context of the capital city of Indonesia. This study employs a comprehensive methodology, including a literature review, legal analysis, and field investigations. It examines the legal framework, institutional coordination, and impact of land use policies on indigenous communities. The data were collected via interviews and document analysis. This study reveals a pressing need to strengthen regulatory design and law enforcement to protect indigenous land tenure rights. This text highlights the challenges faced by indigenous peoples due to deforestation, land disputes, and the transformation of land for urban development. The research underscores the necessity of improved cross-sectoral authority and coordination within the Ministry of Environment and Forestry. This study provides valuable insights into the complex issues surrounding land tenure rights and indigenous communities in the context of the capital city of Nusantara. The text contributes to the ongoing discourse on environmental protection, indigenous rights, and the sustainability of land use policies in Indonesia. The findings provide practical recommendations for enhancing legal protection and mitigating deforestation in high-demand land areas, ultimately benefiting both the environment and local communities.
