Abstract

This study aims to juridically analyze the settlement of inheritance disputes through a deed of settlement at the Central Jakarta District Court based on Decision Number 582/Pdt.G/2025/PN Jkt.Pst. Inheritance disputes are one of the civil disputes that frequently occur, particularly regarding the distribution of inheritance assets. In this case, the parties chose mediation, which was then formalized in a deed of settlement that is final and legally binding. This research employs a normative juridical approach using statutory and case study methods. The findings indicate that dispute resolution through a deed of settlement provides legal certainty, procedural efficiency, and upholds the principle of family consensus. Based on the decision, the parties agreed to divide the inheritance object in the form of land and buildings equally, with executorial force equivalent to a final and binding court judgment. The legal basis includes Article 130 HIR, Article 1338 of the Civil Code, and Article 27 paragraph (4) of Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Court.

Abstract

This research analyzes the legal protection of the absolute right (Legitime Portie) of Category I heirs in inheritance disputes, focusing on Court Decision Number 345/Pdt.G/2025/PN Jkt.Pst. The primary issue examined is the tension between the principle of freedom of testation (testamentaire vrijheid) and the legal obligation to protect the rights of forced heirs (legitimaris) under Article 913 of the Indonesian Civil Code (KUHPerdata). The research method employed is normative legal research using statutory, conceptual, and case approaches. The results indicate that biological children, as Category I heirs, hold the status of legitimacy who are entitled to a minimum portion of the inheritance that cannot be eliminated by the testator. In the analyzed decision, the Panel of Judges rejected the annulment of the will deed because the plaintiff failed to overturn the perfect evidentiary strength of the authentic deed. The judges reasoned that the application of the substitution vulgaris doctrine in the will did not directly violate the absolute right but merely postponed its execution to ensure the welfare of the surviving spouse. The protection of the absolute right is implemented through the recognition of the plaintiff's legal status as a legitimate heir, even though the execution of their economic rights is subject to the gradual distribution mechanism regulated in the will.

Abstract

The advancement of digital technology has given rise to new forms of wealth  including digital platforms, cryptocurrencies, Non-Fungible Tokens (NFTs), and digital wallets  that hold significant economic value yet lack explicit recognition under Indonesian civil law. This study aims to analyze the legal standing of digital assets within Indonesia's property law framework and to identify the legal problems arising from the indivisibility of digital assets in the context of inheritance, particularly the technical and conceptual obstacles stemming from the absence of comprehensive legal regulation. The research employs a normative juridical method with statutory, conceptual approaches, and comparative approach with different statute and judicial decision. The findings indicate that digital assets may be classified as intangible property (onlichamelijke zaken) under Article 503 of the Civil Code and are therefore inheritable in principle. However, the inherent indivisibility of certain digital assets creates structural challenges for estate distribution, as the Civil Code provides no mechanism for dividing intangible assets that are technically indivisible. The absence of specific regulation generates a legal vacuum (vacuum iuris) that risks prejudicing the rights of heirs.

Abstract

Protection of the inheritance rights of illegitimate children is a crucial issue in the development of family law in Indonesia, particularly following the Constitutional Court's decision that strengthened the recognition of children's civil relationship with their biological fathers. This article aims to analyze the legal protection of illegitimate children's inheritance rights following the Constitutional Court's decision and to examine the judges' considerations in Decision Number 239/Pdt.G/2015/PN Jkt.Pst. This research uses a normative juridical method with a regulatory and case-based approach. The results show that the Constitutional Court's decision has provided a stronger legal basis for illegitimate children to obtain inheritance rights, generally demonstrating a blood relationship with their biological father. However, in judicial practice, differences in judges' interpretations regarding the status and distribution of illegitimate children's inheritance rights remain. In Decision Numbe r239/Pdt.G/2015/PN Jkt.Pst., judges consider aspects of justice, legal certainty, and evidence of biological relationships in determining inheritance rights, although this does not yet fully reflect uniform application of the norm. Therefore, consistency in law enforcement and strengthening of regulations are needed to ensure optimal protection of the rights of illegitimate children.

Abstract

Indonesia adheres to a plural inheritance law system, namely the Civil Code (Western inheritance law), customary law, and the Compilation of Islamic Law (KHI). This pluralism creates complex problems when the testator and heirs have different religious backgrounds. Decision of the Central Jakarta District Court Number 239/Pdt.G/2015/PN.JKT.PST is a clear example of the complexity of cross-religious inheritance issues in Indonesian judicial practice. This study aims to analyze the legal considerations of the judge in the decision and evaluate them from the aspects of legal certainty and justice. The method used is normative juridical legal research with a case study approach, supported by interviews with judges and legal academics. The results of the analysis show that the judge erroneously applied Western inheritance law (Civil Code) in a case that should have been subject to the Compilation of Islamic Law, given that both the testator and his third wife as the first plaintiff were Muslim. This error resulted in a decision that did not meet the standard of legal certainty and did not reflect justice for the first plaintiff. The lawsuit should have been filed with the Religious Court, not the District Court.

Abstract

Issues regarding the distribution of inheritance based on private wills still frequently cause tension in society. This occurs because wills are not made through authorized officials, so their legal validity is often questioned, especially during the evidentiary process in court. This study aims to determine the validity of private wills in the distribution of inheritance and analyze the judge's considerations in providing legal certainty in Decision Number 425/Pdt.G/2021/PN Jkt.Pst. This research uses a normative legal method with a statutory regulatory approach and a case study approach.The results indicate that private wills can still be used as a basis for the distribution of inheritance if they meet applicable legal requirements and do not conflict with inheritance provisions. However, their evidentiary strength is not as convincing as authentic wills, potentially leading to disagreements among other heirs. In Decision Number 425/Pdt.G/2021/PN Jkt.Pst, the judge assessed the consistency between the contents of the will, supporting evidence, and the testator's wishes before deciding the case. The judge's considerations are crucial in creating legal certainty and protecting the rights of disputing parties. Therefore, legal certainty regarding the distribution of inheritance based on a private will is greatly influenced by the strength of the evidence and the judge's assessment during the trial.
