Abstract

Article 66 of Law Number 32 of 2009 concerning Environmental Protection and Management provides legal protection for environmental defenders from criminal prosecution and civil lawsuits. However, its implementation still faces challenges in law enforcement practices. This study discusses the effectiveness of Article 66 of the Environmental Protection and Management Law in the case of the arrest of two environmental activists in Semarang in November 2025. The research uses a normative legal method with statutory and case approaches. The results show that legal protection for environmental defenders has not been fully effective because law enforcement officials tend to focus on criminal allegations without considering the context of environmental advocacy. Therefore, a more consistent implementation of the Anti-SLAPP principle is needed to ensure effective legal protection for environmental defenders.

Abstract

Penelitian ini mengkaji hak waris anak beda agama terhadap harta orang tua berdasarkan analisis Putusan Nomor 4/Pdt.P/2013/PA.Bdg ditinjau dari perspektif Kitab Undang-Undang Hukum Perdata (KUHPerdata). Permasalahan utama yang diangkat berawal dari adanya benturan prinsip kewarisan di Indonesia, di mana hukum Islam memandang perbedaan agama sebagai penghalang waris, sementara KUHPerdata menitikberatkan pewarisan semata-mata pada hubungan darah. Menggunakan metode yuridis normatif dengan pendekatan deskriptif kualitatif, penelitian ini menganalisis bahan hukum primer dan sekunder. Hasil penelitian menunjukkan tiga hal utama. Pertama, dalam sistem KUHPerdata, perbedaan agama sama sekali tidak menjadi penghalang untuk memperoleh hak waris. Kedua, dalam memutus perkara No. 4/Pdt.P/2013/PA.Bdg, hakim melakukan penemuan hukum (rechtsvinding) dengan menetapkan anak beragama Islam tetap menjadi ahli waris sah dari ibu yang telah beralih agama ke Hindu, serta memberikan porsi hak ekonomi kepada anak yang beragama Hindu melalui mekanisme wasiat wajibah. Ketiga, substansi putusan pengadilan agama tersebut terbukti sejalan dengan prinsip-prinsip KUHPerdata yang mengakui hubungan keperdataan sedarah tanpa diskriminasi keyakinan. Hal ini menunjukkan bahwa penyelesaian sengketa waris beda agama di Indonesia dapat dilakukan dengan menjembatani kepastian hukum normatif dan keadilan substantif yang hidup di masyarakat.

Abstract

This study aims to analyze the dialectic between affinity (due to marriage) and consanguinity (blood relationship) in civil inheritance law in Indonesia, particularly regarding the position of children in a second marriage after divorce. The research method used is normative juridical with a regulatory and contextual approach, supported by primary, secondary, and tertiary legal materials through literature review. The results of the study indicate that in the inheritance system based on the Civil Code, consanguinity is the main basis for determining heirs, as regulated in Article 832 and Article 852 of the Civil Code, while affinity is only recognized to a limited extent by the longest surviving husband or wife. As a result, stepchildren in a second marriage do not have the status of heirs ab intestato because they do not have a blood relationship with the testator. However, stepchildren are still allowed to obtain a share of the property through other legal mechanisms such as gifts or wills while still paying attention to the provisions of legitime portie. Thus, there is tension between the social reality that recognizes kinship in stepfamilies and legal provisions that emphasize biological relationships, necessitating preventive legal measures to provide certainty and justice in inheritance distribution.

Abstract

With the advancement of digital technology, digital assets with economic value have emerged, including YouTube accounts that generate income. This raises legal questions within the context of Indonesian inheritance law, as Indonesian inheritance law still focuses on tangible property based on the Civil Code (KUHPerdata). The objective of this study is to analyze the status of YouTube accounts as digital assets, as well as their legal certainty as objects of inheritance. The method employed is a normative legal approach, based on an analysis of statutory texts and a literature review. The results of this study indicate that YouTube accounts can be classified as intangible assets, as they possess economic value and are manageable. From a legal perspective, based on Articles 830 and 833 of the Civil Code, a YouTube account can be part of an estate. However, due to the lack of clear regulations and challenges arising from contractual relationships with digital platforms, legal certainty remains low. Therefore, regulatory updates are needed to ensure legal certainty regarding the inheritance of digital assets.

Abstract

A Discussion on the Internalization of Substantive Justice in the Distribution of an Intestate Estate Between Biological Children and Children from a Second Marriage Through a Legal Analysis of the Pekanbaru District Court Decision No. 79/Pdt.G/2016/PN Pbr Using a Normative Legal Approach and a Literature Review. The occurrence of a second marriage does not diminish the rights of the first child to receive an inheritance from a decedent who has died intestate under the Civil Code. As long as there is a blood relationship with the decedent, both children from different marriages are entitled to receive the inheritance without exception. If this right is violated, the violating party may be sued and face sanctions. The state plays a crucial role in protecting inheritance rights to ensure they are fulfilled.

Abstract

The customary land inheritance dispute of the Konay family in Kupang City, East Nusa Tenggara, culminating in Supreme Court Decision Number 1505 K/Pdt/2020, represents a structural tension between state law and customary law as living law within Indonesia’s legal system. Employing a normative legal method through case and conceptual approaches, this study analyzes the construction of the judges’ ratio decidendi and examines the extent to which the decision accommodates the existence of customary law in determining inheritance subjects. The analysis reveals that the ratio decidendi was constructed upon three hierarchical pillars: proof of genealogical relations, validation of prior judgments dating to 1951, and affirmation that the plaintiff lacked a valid legal basis. This construction reflects the dominance of legal positivism, reducing customary law’s complexity to formal evidentiary standards, thereby producing a phenomenon of forced formalization of adat. The decision recognizes the land’s status as ancestral clan land only rhetorically, without transforming it into a substantive foundation of legal reasoning. The disharmony is structural in nature, reflecting the persistent gap between the normative recognition of customary law and its judicial implementation in Indonesian court practice.

Abstract

This study analyzes the legal dilemma between granting plantation permits and protecting the Sumatran Elephant corridor in the increasingly fragmented Bukit Tigapuluh Landscape. The main problem lies in the mismatch between environmental impact assessment (Amdal) data and wildlife migration routes, causing business permits to often be issued over critical ecosystems. The study results indicate that law enforcement remains administrative in nature and has not been able to compel companies to restore disrupted corridors. Therefore, integrating habitat maps into the permitting system and strengthening restorative sanctions are needed to ensure the conservation of elephants in Jambi Province.

Abstract

Children born out of wedlock often face limited rights under various legal systems, including both national and customary law. In the context of the Sabu indigenous community in East Sabu Subdistrict, Sabu Raijua Regency, there is a unique concept known as bui pa kepue, which literally means "a child who fell from a tree," referring to a child born outside a marriage recognized as valid under customary law. In contrast to the stigma commonly prevalent in broader society, Sabu customary law grants specific recognition to bui pa kepue children. This article aims to analyze the position of bui pa kepue children within the framework of Sabu customary law and its implications for inheritance rights. This study employs a normative legal methodology with conceptual, statutory, and anthropological approaches, supported by a literature review of relevant customary law and positive law sources. The results indicate that bui pa kepue children receive social recognition and inheritance rights through the maternal line; however, this recognition remains limited, as reflected in symbolic restrictions within customary rituals and the absence of a legal relationship with the paternal line. The Sabu customary system does not entirely discriminate against children born out of wedlock, but it does not yet fully guarantee equality of rights, particularly in the context of cross-lineage inheritance.

Abstract

This study examines gender disparities in inheritance distribution, contrasting practices under Indonesia's Compilation of Islamic Law (KHI) and Western civil law frameworks. Traditional KHI provisions allocate fixed shares typically half for daughters versus sons rooted in patriarchal interpretations, perpetuating economic inequality and limiting women's property rights. Western civil law, emphasizing equality, offers models like equal division or testamentary freedom, yet faces cultural resistance in pluralistic societies. Key barriers include socio-cultural norms, religious dogma, and legal harmonization challenges, exacerbating marginalization of female heirs. Drawing on comparative analysis and empirical cases from Indonesia, the research proposes reforms: progressive reinterpretation of Quranic principles, legislative amendments for gender-neutral shares, and hybrid models integrating equity with faith-based values. These strategies aim to foster inclusive inheritance systems, advancing human rights and sustainable family equity.

Abstract

This research analyzes the legal challenges of cryptocurrency inheritance in Indonesia, specifically the conflict between the principle of le mort saisit le vif in the Civil Code and the decentralized nature of blockchain based on private keys. Through a doctrinal approach, it is found that the private key functions as an essential accessory element for realizing inheritance rights, although it is not a standalone object (zaak). Technical hurdles such as blockchain pseudonymity create a gap between legal ownership and physical control of assets. This study concludes the need for legal reform through digital estate planning and specialized regulations to prevent inherited crypto assets from becoming lost assets.
