Abstract

Inclusive education is a form of school where children with disabilities have the opportunity to learn together with other normal children. Inclusive education has become a new facility for children with disabilities or children who have extraordinary intelligence to increase their potential without having to be separated from normal society in general. Basically, they are also Indonesian citizens who also have the same opportunity to obtain education. The presence of inclusive education brings a new color to the world of education. One way that can be taken to accommodate inclusive students in understanding the material is through inclusive education. Research with a qualitative approach aims to understand the main focus of the title on the role of inclusive education as a forum for educational equality. The main focus of this research is qualitative so that the author and readers provide a lot of learning and are also able to think carefully regarding the main points in the title and discussion presented. The government has taken various strategies to develop inclusive education. However, it cannot be denied that there are still many problems regarding the role of inclusive education as a means of equalizing education in this country. The lack of role and activity from certain parties creates problematic differences between regular or normal schools compared to schools with special needs. There are many questions and statements that need to be discussed and deliberated on in the context of education in this country. Inclusive education should also be a pillar in developing the quality of a country's education as a forum that continues to be able to develop and guide children in terms of education. Potential children's characters also have a wide variety of creativity and skills, talents that they use as a momentum for their arguments in competition.

Abstract

Based on Law Number 40 of 2007 concerning Limited Liability Companies Jo. Law Number 8 of 2010 Concerning the Prevention and Eradication of Money Laundering Jo. Regulation of the Indonesian Republic of Indonesia Court of Justice Number 13 of 2016 concerning Procedures for Handling Criminal Cases by Corporations provides space for criminalizing corporations as subjects who are being held liable for criminal acts of money laundering. However, in practice, law enforcement officers rarely place corporations as subjects for criminal responsibility in money laundering cases, even though corporations play an important role in the occurrence of money laundering crimes. This was proven by the handling of the money laundering case handled by the Corruption Eradication Commission, which for the first time made PT Putra Ramadhan a corporation that was asked to be held responsible for criminal acts of money laundering.

Abstract

Halal certificate existence is a legal certainty particularly for Muslim consumers on product halal assurance. However, many entrepreneurs in Pasirjambu Village, Bandung Regency, have not applied for halal certification due to difficulties and limited knowledge. Therefore, PKM Team from Universitas Islam Jakarta provided training and assistance in registering halal certificates for entrepreneurs who are members of the SEMABU MSME group. This activity uses the Rapid Rural Appraisal (RRA) method to understand the local situation through direct observation and interviews with the target community. In implementing the program, the PKM Team carried out several activities: Counseling, Training, Assistance, Monitoring and Evaluation. The activity results show an increase in the number of products of the SEMABU MSME group that are halal-certified, from only 13 products to 31 halal-certified products. This activity has succeeded in helping business actors in providing halal assurance for the products they sell.Keywords: Halal certification; legal certainty; MSME product. Abstrak: Keberadaan sertifikat halal merupakan salah satu legal certainty khususnya bagi konsumen muslim terhadap jaminan halal produk. Namun banyak pelaku usaha di Desa Pasirjambu Kabupaten Bandung yang tidak mengajukan sertifikasi halal karena kesulitan dan keterbatasan pengetahuan. Oleh karena itu, Tim Pelaksana PKM dari Universitas Islam Jakarta memberikan pelatihan dan pendampingan pendaftaran sertifikat halal untuk para pelaku usaha yang tergabung dalam kelompok UMKM SEMABU. Kegiatan ini menggunakan metode Rapid Rural Appraisal (RRA) untuk memahami situasi setempat melalui observasi dan wawancara langsung kepada masyarakat sasaran. Dalam pelaksanaan program, Tim PKM melaksanakan beberapa tahapan kegiatan sebagai berikut: Penyuluhan, Pelatihan, Pendampingan, Monitoring dan Evaluasi. Hasil kegiatan menunjukkan adanya peningkatan jumlah produk kelompok UMKM SEMABU yang tersertifikasi halal, yaitu yang semula hanya 13 produk meningkat menjadi 31 produk tersertifikasi halal. Kegiatan ini telah berhasil membantu para pelaku usaha dalam memberikan jaminan halal produk yang diperjualbelikan.Kata kunci: Kepastian hukum; produk UMKM; sertifikat halal

Abstract

Often criminal acts occur in human life and that includes their problems. usually this is because of something like their lust that wants a crime. Crimes that can be committed include various kinds of acts of harassment, obscenity and sexual violence. Types of crimes whose actions are in the category of sexual violence such as obscenity have a lot of impact on the victims. The victims besides being harmed they will also experience trauma and high shame. The study that will be carried out uses normative juridical, namely the method used in conducting research in the field of law with steps. This method works by analyzing legal sources in writing and available in the literature. The materials used in this research are laws, research journals, and books that are still relevant to the prevailing problems. This research uses a descriptive approach. where research is based on written rules as they are. Legal research on child abuse has basically been stated in article 76 E of Law no. 35 of 2014 regarding changes to Law NO. 3 of 2002 which deals with child protection. It is clearly stated in article 76 E which reads "Every person is prohibited from committing violence or threats of violence, forcing, deceiving, committing a series of lies, or persuading children to commit or allow obscene acts to be carried out". This case is also listed in the Lubuk Basung Court Decision No. 49/pid.sus/2019/PN LBB which received the result of the decision because the law had reported that the defendant was stating that the defendant was legally proven guilty of carrying out a crime in the form of intercourse with a minor. This violates Article 76 D in conjunction with Article 81 paragraph 1 UURI Number 35 of 2014 regarding changes to Law no. 23 of 2002 regarding child protection.

Abstract

Di dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia Nomor 7 Tahun 2022 Tentang Syarat dan Tata Cara Pemberian Remisi, Asimilasi, Cuti Mengunjungi Keluarga, Pembebasan Bersyarat, Cuti Menjelang Bebas dan Cuti Bersyarat telah diatur di dalam Pasal 6, Pasal 7, Pasal 10, Pasal 12, Pasal 45, Pasal 46, dan Pasal 115 yang pada intinya terhadap pasal tersebut merupakan syarat dan tata cara pemberian remisi, asimilasi, pembebasan bersyarat kepada Narapidana yang melakukan Tindak Pidana Korupsi yang mana diwajibkan untuk memenuhi persyaratan yaitu telah membayar lunas denda dan uang pengganti sesuai dengan putusan pengadilan.Penelitian ini menggunakan metode penelitian normatif yakni suatu proses menemukan suatu aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi. Menggunakan pendekatan perundang-undangan dan pendekatan konseptual, pendekatan perundang-undangan. Hak-hak narapidana telah diatur di dalam Undang-Undang Nomor 22 tahun 2022 tentang Pemasyarakatan. Narapidana korupsi tanpa perlu mengganti kerugian keuangan negara yang dilakukannya dikarenakan berlakunya Undang-undang Nomor 22 Tahun 2022 tentang Pemasyarakatan dalam Pasal 10 yang memberikan hak remisi, asimilasi, cuti mengunjungi atau dikunjungi keluarga, cuti bersyarat, cuti menjelang bebas, pembebasan bersyarat dengan tanpa terkecuali dengan telah memenuhi syarat yakni berkelakuan baik, aktif mengikuti program pembinaan, telah menunjukkan penurunan tingkat risiko, dan telah menjalani masa pidana paling singkat 2/3 atau paling sedikit 9 bulan dari masa pidana.

Abstract

The leadership of the school principal has a very important role in implementing policies. In facing the complex challenges faced by the current education system, effective leadership is the key to achieving the goal of improving the quality of education. In acting as a leader, to be able to influence his elements, the principal must be able to provide an impact that must be respected by the educational implementing components within the educational institution. Therefore, the principal must be able to master the existing competencies of the principal. With this, the research method used is descriptive research, this research is used to be able to obtain a description of the role of the principal in implementing policies at MTS Hifzhil Quran which includes the role of the principal as a policy maker, teachers and students as implementers of the policy results provided by headmaster. In carrying out the duties of the school principal as the highest leader in an educational institution, the school principal does not only play his own role in making decisions or providing policies that will be implemented in the educational institution. With this, the school principal has several member components in determining the policies that will be implemented. Facilitation techniques used to help groups achieve common goals. The facilitator is responsible for building a conducive discussion process so that the group can reach a mutually beneficial agreement. In creating consensus or agreement, holding deliberations to obtain agreement through maintaining character is an important strategy in building consensus because the impact of officials who are able to maintain their own credibility will gain a place in the hearts of the community, the sense of admiration and sympathy shown by the community is the main key to creating agreement.

Abstract

Land acquisition procedures carried out in the context of the construction of the Tapin Dam are qualified as part of land acquisition for the public interest, as referred to in laws and regulations. This qualification is in line with the provisions of 65 of 2006 concerning to Presidential Regulation.36i of 2005, which states that infrastructure development for the benefit of water resources, including dams, is a form of development for the public interest. In this context, the Kalimantan II River Regional Center held land acquisition activities for the construction of the Tapin Dam through the formation of a land acquisition committee as stipulated in the Presidential Regulation. Proof in the Crime of Corruption of land acquisition for the Construction of the Tapin Dam is by proving criminal acts (elements of the article charged), the ability to be responsible, mistakes in the form of intentionality or forgetfulness and the absence of a reason for criminal removal. As for the criminal liability, that the defendant had received land change money from the community that the defendant used for the benefit of his family, so that the defendant was punished criminally and fined. The judge's consideration in Decision No. 10/PID. SUS-TPK/2023/PT BJM regarding the crime of corruption in land acquisition for the construction of the Tapin Dam stated that the defendant was proven to have committed an unlawful act as stipulated in Article 12 letter e of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes, which has been amended and supplemented by Law Number 20 of 2001, so that the verdict is considered appropriate. the defendant had made an agreement with the witness Sogianor Bin Ilar (deceased) as the Head of Pipitak Jaya Village and a member of the Land Acquisition Team in the Implementation of Land Acquisition for the Construction of the Tapin Dam as a state administrator, and the defendant as a participant in the investigation, so that the crime occurred.
