Abstract

Criminal conspiracy in narcotics offenses represents a form of organized crime that poses a serious threat to society and the state. This research aims to analyze the criminal liability of the defendant involved in a conspiracy to possess Class I non-plant-based narcotics, as examined in the High Court Decision No. 247/Pid.Sus/2024/PT Tjk. This study uses a normative juridical and empirical juridical approach. The normative juridical method is based on the review of relevant legal sources, particularly Law No. 35 of 2009 on Narcotics. The empirical juridical method includes interviews with law enforcement officers to understand the application of the law in practice. The results show that the defendant was proven legally and convincingly to have engaged in a criminal conspiracy to unlawfully possess Class I narcotics, specifically methamphetamine (sabu). The judge applied Article 112 paragraph (1) in conjunction with Article 132 paragraph (1) of the Narcotics Law, sentencing the defendant to 7 years of imprisonment and a fine of IDR 1,000,000,000 with a subsidiary of 3 months of detention. This ruling reflects an integrated criminal justice process—investigation, prosecution, and sentencing—that prioritizes fairness and legal certainty. This research recommends that law enforcement officials improve professionalism, independence, and consistency in applying conspiracy provisions to enhance deterrence and combat narcotics distribution more effectively.

Abstract

This study examines the criminal liability of perpetrators of illegal mining activities from the perspective of environmental criminal law in Indonesia, with a specific focus on the Decision of the Kalianda District Court Number 150/Pid.Sus/2025/PN Kla. Illegal mining remains a serious and persistent problem due to its significant negative impacts on environmental sustainability, state revenue, and social order. Unlicensed mining activities often lead to environmental degradation, pollution, and long-term ecological damage, which undermine the constitutional mandate of sustainable natural resource management. This research aims to analyze the fulfillment of criminal offense elements in illegal mining cases, the form of criminal liability imposed on offenders, and the effectiveness of environmental criminal law enforcement in practice. The study employs a normative juridical research method using statutory and case approaches. Legal materials consist of primary legal sources such as legislation and court decisions, as well as secondary and tertiary legal materials in the form of legal doctrines and scholarly works. All materials are analyzed qualitatively through legal interpretation and systematic analysis. The findings indicate that the defendants’ actions fulfilled all elements of illegal mining offenses as regulated under Law Number 3 of 2020 concerning Mineral and Coal Mining. Criminal liability was imposed in the form of imprisonment and fines, reflecting the role of criminal law as a repressive instrument for environmental protection. Nevertheless, law enforcement still encounters various obstacles, including weak supervision, limited institutional coordination, and low public legal awareness. Therefore, strengthening preventive measures and ensuring consistent law enforcement are essential to achieve sustainable environmental protection.

Abstract

Abstract : Indonesia has a reflection or picture of the personality of the nation which is commonly referred to as "Customary Law" which is the embodiment of the soul of a nation from one century to another. The law regarding customary law has been contained in Article 18B paragraph (2). Customary marriage is one of several sections of customary law that is still implemented in several regions to this day. Traditional marriages are carried out in the same way as other customary rules, namely following the procedures and rules of the previous ancestors. Traditional marriages are carried out depending on the customs and culture created in the area. Even though it is not the same as the procedures for traditional marriages and traditions from other regions, traditional marriages do not affect how the beliefs or religions are believed by each person who undergoes them. In modern life like today, there are still many who use the customs of their ancestors which are used as a condition for a marriage. One of the traditional marriages that is currently still being carried out by couples from the city of Pariaman, West Sumatra is the Bajapuik and Uang Hilang.  Abtsrak : Indonesia memiliki sebuah pencerminan atau gambaran dari kepribadian bangsa yang biasa disebut dengan “Hukum Adat” yang adalah penerapan dari jiwa suatu negara tersebut dari suatu zaman ke zaman. Undang-Undang mengenai hukum adat telah tertuang dalam Pasal 18B ayat (2). Perkawinan adat adalah suatu bagian hukum adat yang masih terlaksana di beberapa daerah sampai saat ini. Perkawinan adat dilaksanakan sama dengan aturan adat lain, yaitu mengikuti tata cara dan aturan nenek moyang terdahulu. Perkawinan adat dilakukan tergantung dengan adat dan budaya yang tercipta pada daerah tersebut. Walaupun tidak sama seperti tata cara dari perkawinan adat dan tradisi dari daerah lain, perkawinan adat tidak mempengaruhi bagaimana kepercayaan atau agama yang dipercayai masing-masing orang yang menjalaninya. Dalam kehidupan yang modern seperti saat ini, masih banyak yang menggunakan adat istiadat dari nenek moyang yang dijadikan syarat adanya sebuah pernikahan. Salah satu perkawinan adat yang saat ini masih banyak dilakukan oleh pasangan yang berasal dari kota Pariaman, Sumatera Barat adalah adat Bajapuik dan Uang Hilang.

Abstract

This study examines the role of the Village Consultative Body (BPD) in carrying out its supervisory function based on South Lampung Regency Regulation No. 2 of 2023 concerning Village Government, with a case study in Kerawang Sari Village, Natar District. The main problem in this study is the suboptimal involvement of the BPD in supervising village administration and the existence of various structural and operational obstacles that hamper the performance of this institution. The purpose of this study is to analyze the effectiveness of the BPD's role in supervision and to identify the obstacles faced in the implementation of the Perda. The research method used is a juridical-empirical approach. Primary data was obtained through observation and interviews with the Village Head and the Chair of the Kerawang Sari Village Council, while secondary data was obtained through a literature study of relevant regulations. Data analysis was conducted qualitatively with deductive conclusions. The results of the study show that the role of the Kerawang Sari Village Council in its supervisory function has not been maximized in accordance with the mandate of Local Regulation No. 2 of 2023. The main obstacles identified include low quality human resources, minimal understanding of regulations, and less than harmonious working relationships with village heads. The conclusion of this study emphasizes the need to improve human resource capacity through ongoing training and strengthened coordination between the BPD and village government.

Abstract

Penelitian ini membahas permasalahan okupasi tanah tanpa izin dalam sistem hukum Indonesia, dengan fokus pada konsekuensi hukum yang ditimbulkan dari perbuatan tersebut. Okupasi tanah tanpa izin adalah tindakan menguasai tanah tanpa hak atau izin yang sah, yang dapat mengarah pada perbuatan melawan hukum. Tujuan dari penelitian ini adalah untuk menganalisis definisi dan konsep okupasi tanah tanpa izin, serta untuk mengevaluasi implikasi hukum dari tindakan tersebut dalam perspektif hukum perdata, pidana, dan administrasi negara. Penelitian ini menggunakan pendekatan studi pustaka dengan menganalisis dokumen hukum, literatur ilmiah, dan yurisprudensi terkait. Hasil penelitian menunjukkan bahwa okupasi tanah tanpa izin dapat dikategorikan sebagai perbuatan melawan hukum yang merugikan pemilik sah tanah dan menciptakan ketidakpastian hukum. Penegakan hukum terhadap kasus ini menghadapi kendala terkait pengawasan, koordinasi antar lembaga, dan pemahaman hukum masyarakat. Oleh karena itu, diperlukan pembaruan dalam administrasi pertanahan, penguatan kapasitas aparat penegak hukum, dan edukasi hukum kepada masyarakat untuk mengurangi kasus okupasi tanah tanpa izin.
