Abstract

Desa Kedis, yang terletak di Kecamatan Busungbiu, Kabupaten Buleleng, Bali, memiliki kekayaan alam dan tradisi yang unik, termasuk sistem hukum adat yang diwariskan secara turun-temurun. Penelitian ini bertujuan untuk menganalisis Prasasti Jaka Tebel Kedis sebagai sumber hukum tertulis kuno yang berfungsi sebagai "kompas" atau tolok ukur bagi pemahaman dan implementasi aturan desa (awig-awig) di Desa Kedis. Metode penelitian yang digunakan adalah hukum normatif, dengan fokus pada analisis isi Prasasti Jaka Tebel Kedis sebagai bahan hukum primer, serta literatur hukum adat dan penelitian terkait sebagai bahan hukum sekunder. Hasil penelitian mengidentifikasi norma-norma hukum yang tercantum dalam prasasti, termasuk ketentuan mengenai kepemimpinan desa, pembagian tugas dalam upacara adat, dan tata cara pelaksanaan ritual keagamaan. Analisis komparatif antara norma dalam prasasti dan awig-awig modern Desa Kedis mengungkapkan adanya kesinambungan dan adaptasi nilai-nilai hukum seiring dengan perkembangan zaman. Penelitian ini menyimpulkan bahwa Prasasti Jaka Tebel Kedis tidak hanya merupakan catatan sejarah, tetapi juga mengandung prinsip-prinsip hukum mendasar yang relevan untuk memahami akar tradisi hukum adat Desa Kedis dan berpotensi untuk revitalisasi nilai-nilai luhur dalam menghadapi dinamika masyarakat kontemporer

Abstract

Praktek ibu pengganti (surrogacy) di Indonesia masih menjadi isu yang kompleks dan belum memiliki regulasi yang jelas. Jurnal ini bertujuan untuk membahas berbagai aspek hukum terkait ibu pengganti, ditinjau dari aspek hak asasi manusia, aspek hukum kesehatan, analisis berdasarkan hukum perjanjian, dan tinjauan dari perspektif moral dan etika. Penelitian ini merupakan penelitian hukum normatif, menggunakan pendekatan peraturan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Sebagai pisau analisis menggunakan teori hak asasi manusia dan teori utilitas dari Jeremy Bentham bahwa hukum harus memberi kebahagiaan bagi umat manusia. Bahwa Praktik surrogate mother di Indonesia menimbulkan dilema hukum, etika dan moral untuk itu dibutuhkan kajian yang mendalam agar dapat menghasilkan regulasi yang jelas dan komprehensif untuk melindungi hak dan kepentingan semua pihak yang terlibat surrogate mother. Regulasi tersebut harus mempertimbangkan aspek hukum, etika, moral dan sosial terhadap praktik surrogate mother.

Abstract

The relativity in applying mitigating factors in corruption case verdicts often leads to legal uncertainty and inconsistency with the principles of substantive justice. This study aims to analyze how mitigating factors influence substantive justice by employing John Rawls’ theory of justice and to evaluate judicial legal reasoning through Neil MacCormick’s theory. Employing a normative juridical approach, this research conducts an in-depth analysis of legal literature and relevant theories. The results reveal that the variable application of mitigating factors may lead to inconsistencies between judicial rulings and the principles of substantive justice, especially when social impacts are overlooked. Moreover, the absence of structured standards leads to variations in judicial reasoning, causing public dissatisfaction with the judicial system. This study recommends the development of more stringent and measurable guidelines, as well as enhanced knowledge and training for judges to integrate substantive justice theories and legal reasoning into practice, thereby improving transparency, consistency, and the legitimacy of court rulings.

Abstract

Land registration through the substantiation of prior rights may be conducted on the basis of physical possession for 20 years or more, as evidenced by a sporadic statement letter and witnessed by at least two witnesses. However, this provision creates an opportunity for the use of testimonium de auditu, namely testimony based on hearsay that cannot be materially verified. In practice, the assessment of proof of prior rights as regulated under Article 24 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration contains the phrases “degree of truth” and “deemed sufficient” without clear parameters, thereby giving rise to legal uncertainty. This normative juridical research employs the theory of legal certainty and the theory of evidence to analyze two principal issues: the regulation of land registration in Indonesia and the evidentiary strength of de auditu testimony. The findings indicate that de auditu testimony does not meet the criteria of valid witness evidence and fails to provide legal certainty, while the ambiguity of the norm necessitates further regulatory clarification.

Abstract

This article discusses the functional erosion of law, which has shifted from being a protector of justice (regula iuris) to an instrument of power (instrumentum regni) through rigid formalism. This dysfunction erodes substantive justice, creates a moral vacuum in society, and results in ethical degradation, weakened communal responsibility, and a loss of public trust. This article uses normative legal research, specifically tracing the direct causal relationship between the weakening of legal effectiveness and public moral decay, a correlation that is rarely discussed comprehensively in the literature. Through a deconstruction of the crisis of legal legitimacy within the framework of Thomas Aquinas, this article identifies that contemporary legal problems stem from the disconnection of lex humana (positive law) from lex naturalis (natural law) and lex aeterna (eternal law). Law that ignores Aquinas' morality is degraded into lex iniusta (unjust law), losing its validity and moral binding force. The novelty of this article lies in its systematic emphasis on the causal mechanism between the loss of the instrumental power of law and the moral collapse of society. As a solution, this article emphasizes the urgency of restoring the teleological function of law as a guardian of morality and a pillar of civilization. This requires the re-integration of the principle of lex naturalis into the substance and implementation of positive law, making law a moral orthodoxy based on substantive justice and bonum commune. Implementation strategies include the internalization of morality in legislation, the strengthening of legal ethics education, the reconstitution of the legitimacy of legal institutions through accountability and transparency, and the stimulation of morality-based public participation. The revitalization of lex humana as a guardian of morality is a philosophical and practical imperative, requiring collective synergy to revive the moral consciousness of society so that the law authentically reflects universal justice

Abstract

This study examines the role and application of circumstantial evidence in Indonesia’s criminal justice system and its alignment with restorative justice principles. Using a normative juridical approach with statutory, comparative, and conceptual methods, the research reveals that circumstantial evidence plays a vital role when direct proof is unavailable. However, its application often challenges substantive and restorative justice due to potential bias and unclear legal guidelines. The study highlights, first the critical importance of applying circumstantial evidence within Indonesia’s criminal justice system as a form of indicatory evidence that can strengthen law enforcement. Although circumstantial evidence holds significant potential in supporting the proof of criminal cases, its application must be conducted with utmost caution to ensure that the principles of restorative justice are upheld. The analysis demonstrates that, when applied correctly, circumstantial evidence can make a substantial contribution to achieving substantive justice, provided that evidentiary standards are reinforced, and its use is supported by other evidence that is causally linked and relevant to the offense in question. Second, the application of circumstantial evidence requires careful consideration due to the risks of bias and injustice, which may undermine the integrity of the judicial process. Aligning Indonesia’s criminal justice system more closely with restorative justice principles allows the system not only to focus on punishment but also on restoration and rehabilitation for all parties involved. While circumstantial evidence plays a pivotal role in proving criminal cases, its success in achieving substantive justice depends on prudent, careful, and principled application consistent with the core tenets of restorative justice.
