Abstract

Pertambangan ilegal di Gunung Kuda, Kabupaten Cirebon, telah menimbulkan kerusakan lingkungan yang serius berupa deforestasi, ancaman longsor, dan terganggunya sumber air bersih. Meskipun kerangka hukum telah tersedia melalui Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta Undang-Undang No. 3 Tahun 2020 tentang Pertambangan Mineral dan Batubara, implementasinya masih menghadapi berbagai kendala. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan kasus (case approach), didukung data empiris berupa fakta lapangan serta literatur akademik terkait hukum lingkungan dan tata kelola pemerintahan. Hasil penelitian menunjukkan bahwa penegakan hukum lingkungan di Gunung Kuda belum efektif, ditandai oleh lemahnya koordinasi antara pemerintah pusat dan daerah, keterbatasan kapasitas pengawasan, serta kurangnya konsistensi aparat penegak hukum. Hal ini memperlihatkan kesenjangan antara das sollen (aturan hukum yang berlaku) dan das sein (praktik implementasi). Selain itu, tata kelola dan pengawasan pertambangan ilegal di Gunung Kuda belum sepenuhnya mencerminkan prinsip good governance sebagaimana menekankan transparansi, akuntabilitas, partisipasi, dan rule of law. Sentralisasi kewenangan pasca revisi UU Minerba 2020 justru melemahkan kontrol lokal, sehingga respons pemerintah bersifat reaktif dan tidak berkelanjutan. Dengan demikian, penelitian ini menegaskan bahwa kasus Gunung Kuda menjadi cerminan lemahnya efektivitas penegakan hukum lingkungan di Indonesia, sekaligus menunjukkan belum optimalnya tata kelola pertambangan dalam kerangka pembangunan berkelanjutan.

Abstract

Institusi praperadilan di Indonesia berfungsi sebagai instrumen kontrol yudisial untuk memastikan setiap penetapan tersangka oleh penyidik, termasuk Komisi Pemberantasan Korupsi (KPK), memenuhi ketentuan hukum acara pidana. Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 memperluas cakupan praperadilan hingga mencakup penetapan tersangka, sehingga setiap subjek yang mengajukan praperadilan dapat menilai aspek formil dan substantif bukti permulaan. Studi kasus Putusan Nomor 24/Pid.Pra/2025/PN Jakarta Selatan atas permohonan Hasto Kristiyanto menggambarkan dilema antara prosedur formal dan perlindungan hak asasi tersangka. Hakim praperadilan memeriksa kelengkapan Sprindik dan SPDP serta pemenuhan syarat minimal dua alat bukti sah, namun menolak menilai kualitas bukti permulaan dan relevansi materiil dugaan tindak pidana. Keputusan ini mencerminkan ketegangan antara pendekatan formalisme hukum dan perlindungan hak konstitusional, serta inkonsistensi putusan antar hakim. Studi ini menerapkan pendekatan yuridis normatif dengan metode studi kasus, menelaah norma KUHAP, Putusan MK, dan doktrin ahli guna menilai peran praperadilan sebagai sarana judicial review horizontal. Temuan menunjukkan bahwa meskipun praperadilan memiliki potensi strategis dalam mencegah penyalahgunaan wewenang, penerapannya kerap terbatasi oleh fokus yang berlebihan pada aspek formil. Oleh karena itu, rekomendasi penelitian menekankan perlunya penegakan praperadilan yang berimbang antara verifikasi prosedural dan penilaian substantif bukti permulaan guna memperkuat perlindungan hak asasi dan akuntabilitas penyidik.

Abstract

Land plays a strategic role not only as a place to live but also as a source of economic and social status. However, legal issues such as document forgery, duplicate certificates, and land grabbing still frequently occur. This study uses a normative juridical method to examine the cancellation of land certificates due to unlawful acts (PMH) based on Article 53 of the State Administrative Law and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency No. 11 of 2016. The principle of legal certainty in Article 19 of the UUPA is an important basis for resolving land disputes. The case study of the Karawang District Court Decision No. 58/Pdt.G/2020/PN.Kwg, which was upheld by the Bandung High Court No. 207/PDT/2021/PT.BDG, emphasizes the importance of caution by land officials and the application of the principle of ius curia novit and the social function of land as regulated in Article 6 of the UUPA.

Abstract

This study analyzes law enforcement in traffic accident cases resulting in fatalities, focusing on Article 310 paragraph (4) of Law Number 22 of 2009 concerning Road Traffic and Transportation. The main objective is to examine how the law is applied and how judges make considerations in handing down verdicts. Using a normative legal research method, this study analyzes Judgment No. 35/Pid.Sus/2022/PN.Pwk. The results show that the defendant, who was negligent and caused the victim's death, was indeed charged under this article, which carries a maximum sentence of six years in prison. However, an interesting finding from this study is the gap between the maximum penalty and the sentence imposed. Although the defendant's actions were proven to violate the article and cause death, the judge imposed a sentence of 4 years in prison, which is lighter than the maximum penalty. This decision was based on legal and non-legal considerations, including mitigating and aggravating factors. It is concluded that this lighter sentence than the maximum penalty is considered contrary to the spirit of Article 310(4) of the LLAJ Law.

Abstract

The distribution of alcoholic beverages without a permit in Karawang Regency has become a serious issue affecting public order and community health. To address this matter, the local government enacted Regional Regulation Number 10 of 2021 concerning the Control, Supervision, and Restriction of Unlicensed Alcoholic Beverages. This study aims to examine the regulation on the control, supervision, and restriction of unlicensed alcoholic beverages in Karawang Regency, as well as the law enforcement efforts by Civil Service Investigators (PPNS) of the Karawang Public Order Agency (Satpol PP), and the obstacles faced in implementing the regulation. This research uses a qualitative method with a descriptive approach. Data collection techniques include interviews and observations. The results of the study indicate that The regulation on the control, supervision, and restriction of unlicensed alcoholic beverages in Karawang Regency is governed by Regional Regulation Number 10 of 2021, which classifies alcoholic beverages into Group A, Group B, and Group C. It also stipulates administrative sanctions in Article 16, including written warnings, temporary business closures, business license revocations, and business closures. Criminal sanctions are regulated in Article 18, which states that violators may be fined up to IDR 50,000,000 (fifty million rupiahs) or face imprisonment for up to 3 (three) months. Law enforcement efforts by the Karawang Satpol PP against violations of Regional Regulation Number 10 of 2021 are carried out through field operations, confiscation of evidence, and the imposition of sanctions. In addition, PPNS officers prepare investigation reports and coordinate with the public prosecutor’s office for further legal proceedings. The challenges faced include the lack of authority to detain suspects by PPNS officers, lengthy investigation processes due to the need for coordination with the prosecutor’s office, and changes in administrative systems such as the implementation of the e-Berpadu application, which requires official letters for searches and seizures.

Abstract

The responsibility of a judge is not only to the State but also to God Almighty. The panel of judges in deciding a case always carries a message with the sentence “Justice is based on the one and only God.” The Surabaya District Court Judge acquitted the defendant in a murder case because he was not proven to have committed the crime charged by the public prosecutor, namely “Article 338 of the Criminal Code or both Articles 351 paragraph (3) of the Criminal Code or the first three Articles 359 of the Criminal Code and both Articles 351 paragraph (1) of the Criminal Code.” The public prosecutor filed an appeal to the Supreme Court. This study aims to analyze how the public prosecutor will file an appeal in a murder case that was acquitted by the Court and how the cassation judge considered it in decision Number 1446 K / Pid / 2024? This research was conducted normatively by examining library materials and applicable regulations. The stages or process of submitting a cassation by the public prosecutor to the Supreme Court are stated in “Article 244, Article 245, Article 246, Article 247 and Article 248 of the Criminal Procedure Code concerning cassation examination”. The main finding in the description of the judge's considerations, the actions carried out by the Defendant clearly fulfill the elements of a criminal act as stated in the alternative charge of the second combination of Article 351 paragraph (3) of the Criminal Code. Thus, the Defendant was found guilty legally and convincingly, and was sentenced to five years imprisonment.

Abstract

The increasing incidence of drug abuse among street children in Karawang Regency has become a serious social and legal concern. As a vulnerable group, street children often fall victim to drug exploitation due to the absence of family supervision and their exposure to high-risk environments. This study aims to analyze the victimological factors that make street children vulnerable to drug abuse and to interpret this phenomenon through the Lifestyle Exposure theory. Using an empirical juridical method, this research combines normative analysis of legal regulations with field studies through interviews with street children, law enforcement officials, the National Narcotics Agency of Karawang Regency, and social institutions. The findings reveal that economic hardship, social pressure, and a lack of legal awareness significantly contribute to children’s exposure to drugs. In the context of Lifestyle Exposure theory, their street-based lifestyle increases the likelihood of contact with perpetrators and risky situations. Legally, these children qualify as potential victims requiring special protection. Therefore, integrated efforts between government institutions, law enforcement, and the community are urgently needed to strengthen prevention, protection, and rehabilitation mechanisms for street children affected by drug abuse.

Abstract

Bangsa Indonesia merupakan bangsa yang majemuk karena terdiri atas berbagai suku bangsa, adat istiadat, bahasa daerah, serta agama yang berbedabeda. Keanekaragaman terdapat di berbagai wilayah yang tersebar dari Sabang sampai Merauke. Indonesia adalah negara yang melahirkan beragam suku bangsa dan dari suku-suku itulah yang membuat adanya ciri khas atau keunikan dari setiap suku yang berada di Indonesia. Bugis adalah salah satu etnik besar di Sulawesi Selatan. Kebudayaan Bugis-Makassar adalah kebudayaan dari suku bangsa Bugis Makassar yang mendiami jazirah selatan pulau Sulawesi. Suku Bugis sebagai salah satu suku terbesar di Sulawesi Selatan memiliki nilai kebudayaan tersendiri. Ada tiga wujud kebudayaan, yaitu sistem budaya, sistem sosial dan hasil nyata budaya yang satu sama lain berhubungan secara timbal balik dan saling berhubungan dengan struktur kebudayaan. Struktur kebudayaan yang dimaksud antara lain adalah sistem politik yang mengatur hubungan antara anggota masyarakat terutama yang barkaitan dengan pembagian tugas dan penyelenggaraan kekuasaan. Abstract

Public housing credit is a program aimed at addressing the housing backlog in Indonesia, yet its implementation faces various challenges. This research focuses on two main issues: (1) What happens to public housing loans when banks go bankrupt? (2) How can consumer issues be resolved when housing loans default? The study uses a normative judicial method. The findings reveal that while the People's Housing Credit (KPR) helps people acquire homes, significant risks arise if credit institutions go bankrupt or debtors default. In cases of default or bank bankruptcy, debtors must still fulfill their credit obligations. Consumer protection is outlined in the 1999 Consumer Law, which includes exit clauses in credit agreements. The government, through the Deposit Insurance Corporation (LPS), can rescue or liquidate banks according to Law No. 24 of 2004. Moreover, drafting fair contracts, offering credit restructuring, and providing insurance options can better protect debtors than asset auctions. Additionally, applying the principle of prudence in credit assessments, as per the Banking Law, is crucial to minimizing default risks. Stricter regulations and robust legal protections are essential for mortgages to effectively help people own homes while ensuring financial and legal stability.

Abstract

Early marriage in Indonesia has entered an alarming stage with the number of early marriages continuing to climb as poverty in Indonesia increases. For the poor, early marriage is a pragmatic effort to reduce the economic burden born from the obligation to take care of their children. However, this actually worsens the condition because children who marry early find it difficult to get out of structural poverty. With a normative juridical method, this research is intended to understand the legal dynamics in the context of preventing early marriage in society. From this study, it was found that there was a legal gap in the revision of the Marriage Law and the absence of legal products that function to prevent early marriage so that the number of early marriages continues to increase and responsible actors can avoid their responsibilities by taking advantage of existing legal loopholes
