Abstract

This research aims to identify the impact of the change in legal policy on the protection of human rights and gender equality. This research analyzes the relationship between the aspects influencing legal changes regarding the legal age of marriage in Indonesia from a gender perspective and the SDGs. This study employed a qualitative approach that is based on library research to identify the impact of changes in legal policy. This study also used a juridical approach to capture an overview of Indonesian family law policies as stipulated in the Law Number 16 of 2019 with maslahah theory and Philipus M. Hadjon’s theory of legal protection as the analytical framework. The research results: First, it was found that the issue of the minimum legal age of marriage is part of the legal discovery area, which resulted in the emergence of Law Number 16 of 2019. Second, the gender movement in Indonesia has played a significant role in changing the paradigm of family law towards a more progressive view and a more protective to women’s rights. The integration of Hadjon’s theory of legal protection strengthens the analysis of the impact of changing legal policies on individual rights and gender equality.

Abstract

This research is motivated by the existence of a gap between Muzakki's beliefs and zakat management organizations. This study aims to find out how to analyze accountability, transparency, and quality of service on Muzakki's trust in zakat management organizations at Baznas, Indramayu Regency. Collecting data by distributing questionnaires on muzakki's trust in Bazna, the sampling technique used is non-probability sampling with accidental sampling. This study uses a descriptive verification method, and the analytical method uses multiple regression analysis. This study shows that accountability has a positive and significant effect on muzakki's trust, transparency has a positive and significant effect on muzakki's trust, also service quality has a positive and significant effect on muzakki's trust.

Abstract

Abstract: This article captures the implementation of cooperative legal entities that are still conventional toward digital transformation, considering significant changes in the world. This study aims to describe how to strengthen the role of cooperatives as a pillar of the Indonesian economy, the legal basis for digital transformation, and the digital transformation of legal entity cooperatives in Indonesia. The findings show that transforming the cooperative business model into a digital basis is necessary. Cooperatives can obtain a vast market share by using tools such as website companies, social media, marketplace, and paid online advertising. The legal basis for business transformation from conventional to electronic-based models already exists. Cooperative legal entities can conduct business activities by utilizing digital technology for various activities such as administration, marketing via internet media, advertising using third parties such as Facebook Ads or Google Ads, selling products through online stores, analyzing business trends in the community, building relationships with more parties through social media, member meetings using video call applications, and many more that can be utilized. With the G20 forum, opportunities to expand business to various countries need to be used optimally by cooperatives in Indonesia. Keywords: Digital, Legal Entities, and Cooperatives.

Abstract

The aim of this research is to determine: 1) the influence of financial literacy on the consumptive behavior of Shopee paylater users. 2) the influence of lifestyle on the consumptive behavior of Shopee paylater users. 3) the influence of financial literacy and lifestyle on the consumer behavior of Shopee paylater users. This research uses quantitative research methods with a survey approach and uses primary data sources through questionnaires. The sampling technique used purposive sampling with a total of 97 respondents obtained using the Slovin formula. Data were collected using a questionnaire via a Google form which was distributed to respondents online. Data were analyzed using the SPSS 23.0 program. which analyzes research instrument tests, classical assumption tests, multiple linear regression analysis tests, and hypothesis tests. The findings from this research show that: 1) there is a negative and significant influence between financial literacy and the consumptive behavior of Shopee paylater users. 2) there is a positive and significant influence of lifestyle on the consumer behavior of Shopee paylater users. 3) there is a positive and significant influence of financial literacy and lifestyle together or simultaneously on the consumptive behavior of Shopee paylater users.

Abstract

This research aims to identify the criminal law challenges faced by cooperatives in Cirebon in maintaining dignified justice and to provide legal protection recommendations for cooperative members in the digital era. It examines how digital technology impacts the justice principles within cooperatives and highlights the gap between cooperative theory and criminal law practices, which often struggle to address the complexities of violations in digital cooperatives. The study offers novel insights by integrating criminal law analysis with digital cooperative management, focusing on technology misuse threats. Using a qualitative approach, this research employs literature review, normative juridical analysis, and case studies to explore criminal law applications in digital cooperatives. Findings reveal that digital-era cooperatives face significant risks, including data breaches, fraud, and technology misuse by administrators or members. The study underscores the urgency of regulatory updates and stricter criminal law enforcement to safeguard cooperative members' rights and uphold justice. Keywords: digital era; criminal law; dignified justices; cooperatives; technology misuse

Abstract

Slaughter is a halal condition that can be consumed by land animals. That is, these animals are not halal without the slaughter process. Some broiler chicken owners still ignore the slaughtering process in accordance with Islamic sharia. This research is a field research, namely research conducted at the location that is the object of research, namely Cigasong Traditional Market, Majalengka Regency. In this research the method used is interview.From the research, it was concluded that: slaughtering by Rabani Slaughter House in the Cigasong traditional market, which was slaughtered by Mr. Lalan's employees, the slaughtering process was in accordance with MUI Fatwa number 12 of 2009 concerning Halal Slaughter Certification Certification Standards. Regarding slaughtering of slaughtered chickens, the implementation of slaughtering carried out at Rabani Chicken slaughterhouses in the Cigasong traditional market has all been met with Halal Slaughtering Certification Standards. Then it is suggested: The owner of the slaughterhouse at the Cigasong traditional market must pay attention and ensure the slaughter, For the Majalengka Ulema Council should pay regular visits to the place of broiler sellers in the Cigasong traditional market against Halal Slaughter Certification Standards. Is it already running, implemented and implemented by every owner of the Chicken House.

Abstract

Kondisi ekonomi yang tidak stabil membuat NAB Reksa Dana syariah naik turun dalam 5 tahun terakhir. Namun hal ini tidak berlaku bagi PT Bahana TCW Investment Management yang mampu menjaga predikat “Best Overall Asset & Fund Manager” di tengah kondisi ekonomi yang tidak stabil. Oleh karena itu penelitian ini bertujuan untuk mengetahui faktor-faktor yang mempengaruhi NAB Reksa Dana Syariah Bahana USD Global Sharia Equities periode 2018-2022. Metode yang digunakan untuk penelitian ini adalah metode kuantitatif dengan teknik analisis data Partial Least Square (PLS) dengan memanfaatkan software SmartPLS 4. Hasil penelitian menunjukkan bahwa nilai tukar rupiah secara langsung berpengaruh signifikan pada inflasi, JUB secara langsung berpengaruh signifikan pada inflasi, nilai tukar rupiah secara langsung tidak berpengaruh signifikan pada NAB reksa dana syariah, JUB secara langsung berpengaruh signifikan pada NAB reksa dana syariah, inflasi secara langsung berpengaruh signifikan pada NAB reksa dana syariah, kemudian nilai tukar rupiah secara tidak langsung berpengaruh signifikan pada NAB reksa dana syariah melalui inflasi dan JUB secara tidak langsung berpengaruh signifikan terhadap NAB reksa dana syariah.

Abstract

The implementation of the provision of legal aid to the underprivileged at the Legal Aid Institute (LBH) plays a very important role in providing legal assistance to underprivileged people who are seeking justice. To obtain legal assistance, submit a written application containing the identity of the applicant (KK or KTP), attach an SKTM (certificate of incapacity) and briefly describe the case, submit case documents, and survey the location of the house. The duties and powers of the Legal Aid Institute (LBH) provide legal assistance through litigation and non-litigation to people who can't afford it. The inhibiting factors in providing legal aid are that not all people know about legal aid institutions and lack of legal education. The view of Islamic law on the provision of legal aid to the poor in the Legal Aid Institute (LBH) has become an order from Allah SWT in upholding Islamic law with the principles of justice, equality, and mutual assistance, that is, everyone has the right to their rights and everyone has the same position before the law. Implementation of the provision of legal aid to people who cannot afford it is the application of the principle of mutual help in terms of kindness and piety. This act is a worship relationship between fellow beings to benefit the people.

Abstract

Smart contracts are an innovation that emerged along with the development of blockchain technology, offering automation in the implementation of agreements without third-party intervention. However, the existence and application of smart contracts in the context of civil law still raises various questions regarding their validity and enforcement. This study aims to explore the legal challenges faced by smart contracts, as well as how civil law can accommodate and enforce agreements made in digital form. The research methodology used is qualitative analysis through literature studies and interviews with legal experts and industry practitioners. The results of the study show that although smart contracts offer efficiency and transparency, there are concerns regarding validity, legal recognition, and potential disputes. The novelty of this study lies in the integration of positive law and technology perspectives in understanding the dynamics between smart contracts and civil law. The social implications of this study include the need to develop adaptive regulations to regulate smart contracts, as well as increasing public understanding of the risks and benefits of using technology in legal transactions.

Abstract

Introduction: Restorative justice (RJ) is an alternative approach to criminal justice that focuses on victim recovery, offender rehabilitation and community reintegration. In the context of domestic and child violence, this approach offers the potential for more inclusive and sustainable solutions than traditional retributive approaches. However, there is debate about the effectiveness of RJ in cases of violence that have profound psychological and physical impacts on victims. The issue is whether RJ can provide adequate justice without compromising legal protections for victims. This research offers novelty by examining the application of RJ in cases of domestic and child violence in Indonesia and Fnland, where RJ laws and policies are still developing.Purposes of the Research:  The purpose of the study was to identify the challenges and opportunities for the application of RJ in such cases and evaluate the extent to which this approach is able to create restorative justice for victims and perpetrators in Indonesia and Finland.Methods of the Research: The research used qualitative methods with case studies of several domestic and child violence cases resolved through RJ in different regions.Results / Main Findings / Novelty/Originality of the Research: Findings suggest that RJ can be effective in facilitating victim recovery, but its implementation requires strong support structures, including professional counsellors and clear legal protections in Indonesia and Finland. The conclusions of this study confirm that RJ has great potential in resolving domestic violence cases, but its implementation must be done carefully to ensure justice and protection for victims. Consequently, this research encourages policymakers to design a more comprehensive and inclusive RJ framework for domestic violence.
