Abstract

Keberadaan serta kebiasan-kebiasaan yang hidup menjadi aturan hukum masyarakat adat dalam bingkai Negara Kesatuan Republik Indonesia hingga saat ini masih eksis dan mengalami perkembangan. Penelitian ini bertujuan untuk menganalisis mengenai proses penyelesaian tindak pidana berdasarkan adat suku moi (studi kasus di polres kota sorong). Penelitian ini menggunakan metode penelitian empiris yuridis. Teknik pengumpulan data dilakukan dengan cara melakukan studi lapangan (field reseach). Hasil penelitian ini menunjukan bahwa penegakkan hukum adat terhadap tindak pidana berdasarkan adat Moi dipengaruhi oleh penghormatan masyarakat adat Moi yang sangat menjunjung tinggi adat istiadat itu pedoman hidup. Sementara itu, penyebab digunakan adat Moi dalam proses penyelesaian masalah di adat Moi dianggap lebih adil dan mewakili suasana kebatinan masyarakat suku Moi, serta lebih memberikan efek jera pada pelaku, dan juga berkaitan dengan hukuman ghaib yang dipercaya akan dihadapi oleh pelaku.

Abstract

In the explanation of Law no. 1/PNPS/1965 stated that the recognized religions in Indonesia are Islam, Christianity, Catholicism, Hindu Buddhism, and Confucianism. As a result, other beliefs loses its legal standing and legal protection by the state. The issue of religious freedom is also influenced by the different interpretations of the terms "religion" and "belief" by the public and law enforcer. First, the terms "religion" and "belief" have different meanings. "Religion" refers to the religions adopted by Indonesian citizens, in accordance with the explanation in Law no. 1/PNPS/1965. While the term "belief" has no legal basis. Second, the terms "religion" and "belief" have identical meanings. If this opinion is recognized, then there will be generalization between "agama wahyu", and "agama budaya”. On the other hand, Article 29 paragraph (2) of the 1945 Constitution of the Republic of Indonesia does not yet have an adequate constitutional interpretation in resolving this issue.

Abstract

The Indonesian political atmosphere has recently been shocked by controversial issues regarding the postponement of the Indonesian elections in 2024 nationally. The reason for postponing the election is due to the unstable economic condition of the country after COVID-19 so that it is considered incapable of holding elections in 2024. This study aims to find out how the postponement of elections is regulated in Indonesia, as well as whether the postponement of elections is a constitutional action or for the interests of groups elite. The results of this study indicate that basically the Indonesian Election Law does not specifically regulate the postponement of elections. The postponement of elections in the provisions of election law in Indonesia only regulates regional election delays. Meanwhile, national election delays are not adequately regulated. Therefore, nationally postponing the election is considered a violation of the Indonesian constitution. In addition, it is seen that the postponement of the election is not an aspiration of the Indonesian people so that it is considered an attempt by the political elite to take political advantage in the 2024 election.

Abstract

This research highlights the background of Indonesia as a state of law, where state power is regulated by law to achieve legal order. However, the implementation of laws to protect women from violence still poses weaknesses that affect the sense of justice and impunity for perpetrators. As an alternative solution, the Restorative Justice approach is proposed to resolve acts of sexual violence by involving victims and perpetrators in dialogue and joint recovery, in accordance with the principle of consensus. This research uses the normative juridical method by analyzing relevant regulations and literature as well as conducting interviews at the Teluk Bitung District Police. It was found that the Restorative Justice approach can be a more inclusive and restorative alternative for victims and perpetrators of sexual violence. However, to implement it effectively, certain conditions need to be met, including admission of guilt, consent of the victim and perpetrator, and support from the police or prosecutor's office. The results show that this approach has the potential to provide a fairer resolution and have a positive impact on efforts to prevent and respond to violence against women in Indonesia.

Abstract

Abstrak Bullying di lingkungan sekolah telah menjadi fenomena yang meresap dan kompleks. Artikel ini membahas beragam aspek terkait bullying, termasuk definisi, faktor-faktor yang mendorong perilaku ini, dampaknya terhadap korban dan pelaku, serta langkah-langkah pencegahan yang dapat diambil. Bullying merupakan perilaku agresif yang merugikan, di mana individu yang lebih kuat secara fisik atau mental menyalahgunakan kekuasaannya untuk menyakiti individu yang lebih lemah secara berulang. Meningkatkan kesadaran tentang masalah bullying di kalangan guru dan siswa di SMA Averos Kota Sorong. Dengan memberikan informasi yang komprehensif tentang definisi, faktor-faktor pendorong, dan dampak dari perilaku bullying, diharapkan para peserta akan memiliki pemahaman yang lebih baik tentang kompleksitas masalah ini. Mitra pengabdian adalah SMA Averos Kota Sorong Papua Barat Daya dan dihadiri dengan 38 siswa/siswi. Metode penyuluhan atau sosialisasi merupakan pendekatan yang efektif untuk menyampaikan informasi dan membahas masalah tertentu serta cara mengatasi permasalahan yang sedang terjadi. Kegiatan pengabdian masyarakat yang terstruktur dengan baik dapat membantu dalam mengatasi masalah bullying di sekolah. Langkah-langkah seperti penyusunan materi edukasi, melibatkan konselor, dan pengukuran pengetahuan sebelum dan sesudah penyuluhan merupakan bagian penting dari pendekatan ini. Melalui kegiatan ini, diharapkan kesadaran dan pengetahuan tentang bullying dapat ditingkatkan di kalangan guru dan siswa, serta kontribusi signifikan dalam pencegahan bullying di SMA Averos Kota Sorong. Kata kunci: bullying SMA ; kota Sorong ; tindak pidana Abstract Bullying in school settings has become a pervasive and complex phenomenon. This article discusses various aspects of bullying, including the definition, factors that drive this behaviour, its impact on victims and perpetrators, and preventive measures that can be taken. Bullying is an aggressive, harmful behaviour in which a physically or mentally stronger individual abuses his or her power to repeatedly harm a weaker individual. Raising awareness about bullying issues among teachers and students at SMA Averos Sorong City. By providing comprehensive information on the definition, driving factors, and impact of bullying behaviour, it is expected that the participants will have a better understanding of the complexity of this issue. The service partner was SMA Averos Kota Sorong, Southwest Papua and was attended by 38 students. The extension or socialisation method is an effective approach to convey information and discuss certain problems and how to overcome the problems that are happening. Well-structured community service activities can help in overcoming the problem of bullying in schools. Steps such as developing educational materials, involving counsellors, and measuring knowledge before and after counselling are important parts of this approach. Through this activity, it is expected that awareness and knowledge about bullying can be increased among teachers and students, as well as a significant contribution in bullying prevention in SMA Averos Kota Sorong. Keywords: bullying ; high school ; Sorong city ; criminal offence

Abstract

This study aims to analyze the effectiveness of restorative approaches in resolving family conflicts through Alternative Dispute Resolution (ADR) mechanisms and to identify factors that support and hinder their implementation at the community level. The methods used in this research are empirical legal methods that combine primary data obtained through interviews with relevant parties such as mediators, community leaders, and families involved in disputes as well as secondary and tertiary data obtained through literature studies. All data are analyzed qualitatively using a deductive approach. The novelty of this research lies in the integration of justice-based restorative principles with Indonesian socio-cultural values, particularly the concept of deliberation to reach consensus as the basis for resolving family conflicts outside of court. The findings show that the restorative approach in ADR is able to provide a more humanistic alternative to resolution because it emphasizes relationship restoration, equal dialogue, and social balance. Processes such as mediation, negotiation, and conciliation have been proven to be in line with local cultural values and effective in reducing conflict escalation and the potential for violence within families. However, implementation in the field still faces a number of obstacles, including low public literacy regarding ADR, the influence of patriarchal culture that weakens the position of women, the limited number of professional mediators, and the complexity of emotional aspects and child protection. The conclusion is that the restorative approach through ADR has significant potential as a sustainable solution in resolving family conflicts. Its effectiveness depends on strengthening the capacity of community-based mediators, increasing public legal awareness, and drafting regulations that are more responsive to the needs of non-litigious family dispute resolution.
