Abstract

Tulisan ini bertujuan untuk mengetahui tentang bagaimana hukum keluarga Islam di Indonesia, bagaimana kontribusi Hukum Keluarga Islam Terhadap Pembangunan Hukum Nasional. Penelitian ini merupakan penelitian yuridis normatif oleh karena itu penelitian ini bersifat pada penelitian data skunder yang meliputi dari bahan primer yaitu bahan hukum yang mengikat yang terdiri dari peraturan perundang-undangan, bahan skunder yang memberikan penjelasan mengenai bahan hukum primer serta bahan tersier yaitu bahan hukum yang memberikan penjelasan terhadap bahan hukum primer dan skunder, antara lain seperti, media elektronik, kamus dan sebagainya. Hasil penelitian ini menunjukkan bahwa adanya kontribusi hukum Keluarga Islam dalam perkembangan Hukum Nasional di Indonesia berupa Pencatatan Perkawinan, Batas Usia Perkawinan dan lain sebagainya.

Abstract

Tulisan ini bertujuan untuk mengetahui bagaimana sejarah hukum keluarga Islam di Indonesia, dan bagaimana urgensi pentingnya tranfomasi hukum keluarga Islam terhadap hukum positif di Indonesia. Penelitian ini menggunakan Teknik studi kepustakaan (library resecarh). Sumber informasi primer diperoleh dengan membaca litelatur yang terhubung dengan pembahasan sejarah hukum keluarga Islam dalam sistem hukum nasional tersebut. Hasil penelitian menunjukkan bahwa sebelum kemerdekaan Indonesia, hukum islam itu sendiri sudah ada dari zaman kerajaan dan berjalan di tengah masyarakat Indonesia termasuk hukum keluarga Islam itu sendiri. Hukum keluarga Islam di Indonesia memilki sejarah yang panjang baik sebelum masa penjajahan, masa kemerdekaan dan hingga saat ini. Transformasi hukum keluarga Islam kedalam hukum nasional itu sangat penting, agar status hukumnya jelas dan dapat dilasksanakan oleh aparat penegak hukum maupun oleh masyarakat.

Abstract

Madrasahs in Langkat Regency continue to face various institutional management challenges that affect their effectiveness and sustainability. The main problems lie in weak managerial functions and the suboptimal integration of spiritual values into madrasah management practices. This study aims to analyze the influence of Islamic Spiritual Entrepreneurship based management on madrasah governance. The research focuses on examining the contributions of Islamic values, the concept of work as worship, orientation toward the blessings of Allah SWT, honest behavior, and gratitude behavior to madrasah management. The study involved 300 madrasah administrators in Langkat Regency, including principals, teachers, and administrative staff. Data were collected through closed-ended questionnaires and limited interviews and were subsequently analyzed using structural modeling to examine the relationships among variables simultaneously. The findings indicate that honest behavior, the concept of work as worship, and orientation toward the blessings of Allah SWT have a positive and significant effect on madrasah management, whereas normative Islamic values and gratitude behavior do not show a significant influence. These results imply the importance of strengthening operational spiritual values that are internalized in managerial practices to support the sustainability of madrasah management.

Abstract

This article examines the methodology of discovering and developing Islamic law, starting from the premise that Islamic law has two dimensions: divine law on the one hand, and human-made law on the other. The relationship between text (nash), reason, and social reality is mapped into two paradigms, namely the structural paradigm, which places text as the dominant structure, and the functional paradigm, which emphasizes dynamic and diait dsignificanceetween the three entities. This article shows that the methodology of legal discovery in the ushul al-fiqh tradition (bayānī, ta‘līlī, and istiṣlāḥī) is generally rooted in the structural paradigm, with naṣh as the main normative (structural) source. This paradigm experienced a crisis when confronted with modern social reality. It is in this context that a model of Islamic legal reform emerged, moving within a functional paradigm. This reform is articulated in two forms. First, religious utilitarianism, which focuses on the development of lawad on maslahah thenstudy'sasid al-shariah. Second, religious liberalism, which emphasizes rationality, social context, and ethical-historical dimensions in the reading of texts. Neither of these two schools of thought negates the authority of the text, but rather presents a productive dialectic model between revelation, reason, and reality, in order to produce more responsive laws.

Abstract

This study examines child protection in families affected by parental narcotics addiction from the perspective of Islamic law and its implementation in Langkat Regency, Indonesia. Using a normative-empirical legal approach, the research combines analysis of statutory regulations, classical Islamic jurisprudence, and the Compilation of Islamic Law with field data obtained through interviews, observation, and documentation. The findings reveal that Islamic law regards children as a divine trust (amanah) whose protection aligns with the maqâṣid al-syarîʿah, particularly the preservation of life, intellect, and lineage. Parents addicted to narcotics violate both moral and legal obligations, endangering their children’s welfare. Indonesian legislation—particularly Law No. 35 of 2014 on Child Protection and Law No. 35 of 2009 on Narcotics—reflects similar principles, yet implementation in Langkat remains weak due to limited institutional capacity, poor coordination, and social stigma. Consequently, many children experience neglect and insufficient state protection. However, religious leaders and community organizations play a positive role in supporting affected families through preventive and rehabilitative programs. The study concludes that effective child protection requires integrating theological imperatives with national legal frameworks and strengthening community-based implementation. This research contributes to the discourse on harmonizing Islamic jurisprudence and national law to protect vulnerable children within Indonesia’s social and legal context. Penelitian ini mengkaji perlindungan anak dalam keluarga yang terdampak kecanduan narkotika oleh orang tua, ditinjau dari perspektif hukum Islam dan implementasinya di Kabupaten Langkat, Indonesia. Dengan menggunakan pendekatan hukum yuridis-empiris, penelitian ini memadukan analisis terhadap peraturan perundang-undangan, literatur fikih klasik, serta Kompilasi Hukum Islam dengan data lapangan yang diperoleh melalui wawancara, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa hukum Islam memandang anak sebagai amanah ilahi (amanah) yang wajib dilindungi sesuai dengan prinsip maqâṣid al-syarîʿah, khususnya pemeliharaan jiwa, akal, dan keturunan. Orang tua pecandu narkotika telah melanggar tanggung jawab moral dan hukum, sehingga mengancam kesejahteraan anak. Peraturan perundang-undangan Indonesia—terutama Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika—mencerminkan prinsip serupa, namun implementasinya di Langkat masih lemah akibat keterbatasan kapasitas kelembagaan, koordinasi yang kurang, dan stigma sosial. Akibatnya, banyak anak mengalami penelantaran dan minim perlindungan negara. Meskipun demikian, tokoh agama dan lembaga masyarakat memiliki peran positif dalam mendukung keluarga terdampak melalui program pencegahan dan rehabilitasi. Penelitian ini menyimpulkan bahwa perlindungan anak yang efektif memerlukan integrasi antara imperatif teologis dan kerangka hukum nasional, serta penguatan implementasi berbasis komunitas. Kajian ini berkontribusi pada upaya harmonisasi hukum Islam dan hukum nasional dalam melindungi anak-anak rentan di konteks sosial-hukum Indonesia.

Abstract

This study analyzes the relationship between political configuration and law formation as a political product, as well as its implications for the development of Islamic law in Indonesia’s national legal system. Departing from the view that law is autonomous and neutral, this study proposes a political reading of law that positions Islamic law in a structural relationship with state power. Using a qualitative juridical-normative approach and political-legal analysis, this study examines how power structures, political orientations of the regime, and legislative dynamics influence the character and substance of institutionalized law. The findings show that changes in political configuration, whether democratic, authoritarian, or religiously ideological, correlate directly with the level of accommodation and restriction of Sharia norms in national law. The main contribution of this research lies in asserting that the institutionalization of Islamic law in Indonesia is not solely determined by religious normative legitimacy, but rather by political configurations that operate through legislative mechanisms and legal institutionalization. A normative comparison with the practices of other Muslim countries reveals a general pattern of political-legal relations in Islam, highlighting political-legal analysis as an essential theoretical framework for understanding the direction and future of Islamic law in Indonesia.
