Abstract

Criminal liability by corporations is a legal consequence of environmental pollution caused by the activities of the corporation itself. This research is a normative juridical research that combines statutory and comparative approaches through processing of primary, secondary, and tertiary legal materials with descriptive analysis methods. The purpose of this study is to determine the development of the paradigm and corporate criminal liability in cases of environmental pollution. The results of this study found that corporate criminal liability related to environmental pollution cases is at least regulated in Law Number 32 of 2009 (UUPPLH), the Omnibus Law, and the New Penal Code which will soon come into effect. There are differences in the provision of criminal sanctions in each law. But in general, it can be concluded that environmental pollution by corporations is a legal act that must be dealt with legally so as not to create a greater adverse impact on the environment and society.

Abstract

The concept of regional autonomy is explicitly regulated in Article 18 of the 1945 Constitution and several related laws and regulations which essentially provide authority and flexibility for provincial, district and city governments to regulate and manage their own government affairs according to the principles of autonomy and assignment tasks including the implementation of regional head elections carried out democratically. In the implementation of regional government, elected regional heads must also be able to realize the principles of democracy and must be able to run effective and responsive regional government to the needs of the community, must not deviate from moral norms and deviate from democratic principles. The problem in this study is How is the Legitimacy of Regional Heads in the Implementation of Regional Government in Accordance with the Principles of Democracy. This study uses an empirical legal method, namely in addition to reviewing data through literature, it also reviews data on events that actually occur through observation activities and so on. The purpose of this study is to analyze legislation and examine cases that have occurred in Indonesia regarding the legitimacy of regional heads in the implementation of regional government in accordance with democratic principles. The conclusion of this study is that based on the analysis of several laws regarding regional heads in the implementation of regional government and based on the analysis of cases of regional heads in leading regional government, they are not yet legitimate and are not in accordance with the principles of democracy

Abstract

Allah SWT created humans as the most perfect beings and in pairs, instilling affection within the bonds of marriage to achieve the ultimate goal of attaining His pleasure. However, marriage is not without challenges, and one significant issue is domestic violence, where women are often the primary victims. Such occurrences highlight a disregard for women's rights, which are an integral part of human rights. This study aims to explore the position and rights of women as human rights in Islam and examine the legal protections available in cases of domestic violence. Using a normative research method with a statutory approach, this study relies on secondary data collected through literature review and analyzed qualitatively for descriptive presentation. The findings reveal that Islam accords women a high and equal status with men, granting them rights that are fundamental to their humanity. Domestic violence against women is a clear violation of the principles outlined in the Qur'an, As-Sunnah, and Indonesia’s positive law.

Abstract

Hadhanah is an act that must be carried out by their parents, because without hadhanah it will result in the child becoming abandoned and his life will be wasted. Fiqh scholars agree that the principle of caring and educating is an obligation for parents, because if children are still young, it will have a damaging effect on the child and their future can even threaten the existence of their soul. This study aims to investigate and analyze the protection of hadhanah rights in three countries, namely Saudi Arabia, Turkey, and Indonesia. This research will use normative research methods. The results of this research are hadhanah rights in Islam in Saudi Arabia, Turkey, and Indonesia. Saudi Arabia, with its legal system based on the Hambali madhhab, emphasizes the protection, education, and custody of children supervised by Islamic authorities. Turkey, with its more moderate civil law, ensures the fulfillment of children's rights in divorce decisions, with attention to the protection, care, and education of children. In Indonesia, the Marriage Law and the Compilation of Islamic Law affirm the protection and maintenance of children in accordance with the principle of Islamic hadhanah rights. Turkey is considered more responsive to the changing times by integrating modern values in the protection of children's rights, followed by Indonesia's progressive adaptation. The contribution of this research is that this analysis is expected to provide in-depth insights into the development and implementation of Islamic family law in various countries with different backgrounds.

Abstract

Perkawinan anak usia dini pada zaman modern ini telah menjadi tren dalam  kalangan masyarakat yang semakin tahun mengalami peningkatan. Sehingga dalam upaya mencegah perkawinan anak usia dini pemerintah mengeluarkan Undang-Undang Nomor 16 Tahun 2019 Tentang  Perkawinan. penelitian ini menggunakan metode pendekatan yuridis-empiris dengan memadukan bahan-bahan hukum baik primer maupun sekunder dengan data primer yang diperoleh di lapangan. Implementasi Undang Nomor 16 Tahun 2019 Tentang  Perkawinan dalam mencegah perkawinan anak usia dini di Kabupaten Karanganyar pelaksanaannya belum berjalan dengan baik, karena masih banyaknya kasus perkawinan anak usia dini dan adanya peningkatan permohonan dispesasi kawin yang terjadi di Kabupaten Karanganyar. Upaya DP3APPKB Kabupaten Karanganyar dalam mencegah perkawinan anak usia dini dilakukan melalui upaya preventif, kuratif, dan penguatan lembaga. Namun upaya ini belum berjalan secara maksimal, karena masih banyak hambatan serta belum didukung dengan adanya regulasi hukum yang mengatur pencegahan perkawinan anak usia dini di Kabupaten Karanganyar, saran rekomendasi yang dapat diberikan bahwa perlu adanya sinkronisasi peraturan-peraturan yang ada dan perlunya aturan pelaksana bagi setiap bidang, sehingga perkawinan usia dini dapat dicegah.

Abstract

This article aims to analyze the division of inheritance carried out by the royal family of the Surakarta Sunanate in Central Java Province. Data were collected through interviews and observations involving six royal families. The findings show that the descendants of the Surakarta Sunanate royal family divide inheritance based on agreements reached withing the family. Within the royal family, there are two types of inheritance. The first is the king’s personal property, which is divided according to Paugeran (royal customary law), using a ratio of 2:1 between sons and daughters, unless the king has left a testament. The king’s testament, known as sabda pandita ratu, is considered absolute. If the king issues a testament that removes the inheritance rights of a family member, that person’s rights are annulled. This stands in contrast to Islamic law, which limits the scope of a testament to one-third of the estate and prohibits the disinheritance of a rightful heir. The second type of inheritance is palace property, which may only be inherited by the son or heir who succeeds the late king. These practices illustrate the (dis)harmony between Islamic inheritance law and royal customary inheritance law in specific contexts. [Artikel ini bertujuan untuk menganalisis pembagian harta warisan yang dilakukan oleh keluarga kerajaan Kasunanan Surakarta Provinsi Jawa Tengah, Indonesia. Pengumpulan data dilakukan dengan metode wawancara dan observasi terhadap enam keluarga kerajaan keturunan Kasunanan Surakarta. Hasil penelitian menunjukkan bahwa keturunan keluarga kerajaan Kasunanan Surakarta membagi harta warisan berdasarkan kesepakatan yang dilakukan melalui musyawarah keluarga. Dalam keluarga raja, terdapat dua jenis warisan, yaitu harta pribadi raja, yang dibagi berdasarkan Paugeran (hukum adat) dengan perbandingan 2:1 bagi anak laki dan perempuan. Hal ini berlaku kecuali jika raja berwasiat. Wasiat raja yang disebut sabda pandita ratu bersifat mutlak, dimana jika ia menentukan pembagian rata, maka warisan akan dibagi rata. Atau, jika ia berwasiat menghapus hak waris salah satu anggota keluarga, maka akan terhapus. Di dalam hukum Islam, seorang pewaris hanya dapat wasiat maksimal 1/3 dari hartanya dan tidak bisa menghapus ahli waris. Jenis harta kedua adalah harta keraton yang tidak bisa diwariskan secara pribadi kepada semua keluarga raja, namun hanya akan diberikan kepada satu saja ahli waris yang menggantikan mendiang raja. Praktik-praktik ini menggambarkan adanya (ketidak)selarasan antara hukum waris Islam dan hukum waris adat kerajaan dalam konteks tertentu.]

Abstract

This study examines the value of Javanese customary heritage in inheritance distribution in the Jatinom community, Klaten, focusing on applying customary law and its conformity with Islamic heritage law. The research analyzes the “Sapikul Sagendhongan” inheritance system and explores social and cultural factors affecting inheritance distribution. This study utilized a socio-legal approach and employed qualitative analysis through in-depth interviews with four respondents and examination of related legal documents. Results show that the Jatinom community consistently implements an inheritance distribution system that gives a more significant portion to male heirs than women, with a 2:1 ratio, primarily due to the perception that men have greater family responsibilities. While Javanese customary law remains dominant, there is an adaptation to Islamic law principles in inheritance distribution. Cultural factors, such as family values and cooperation traditions, play a significant role. The Jatinom community is committed to maintaining cultural values while respecting religious provisions. This study provides new insights into the interaction between local traditions and broader legal norms in Javanese society, confirming that Javanese customary law and Islamic law can operate harmoniously in inheritance distribution, ensuring cultural preservation without violating religious principles. The research contributes to understanding the complex dynamics of inheritance practices in Indonesia, highlighting the importance of considering local customs in legal frameworks.

Abstract

Indonesia has passed Law No. 27 of 2022 on Personal Data Protection. However, this regulation is less effective in its implementation because it is hampered by supervisory institutions that have yet to be formed and will automatically impact the sanctioning mechanism. With the vulnerability of personal data theft that occurs in Indonesia, the urgency of this service is to provide insight into the protection of personal data and legal efforts made when personal data theft occurs to Indonesian Migrant Workers (PMI) in Hong Kong. The purpose of this community service is to increase legal awareness for workers because the condition of workers who have not returned to Indonesia for a long time may not understand the vulnerability of storing personal data in Indonesia because they are used to using personal data protection laws in Hong Kong which are robust and have been formed for a long time so that they are likely to experience culture shock when they return to Indonesia. The method used in this community service has two stages. The first stage is legal counseling for migrant workers in Hong Kong. The second stage is assisting with creating crisis centers both offline and online to assist PMI who intend to obtain information about personal data protection and victims who experience personal data theft.

Abstract

This paper will discuss women, namely the rights of the wife, in consideration of the judge who gave permission for polygamy in Decision No. 1167/Pdt.G/2022/PA.Kra. The decision issued by the Karanganyar Religious Court provides several considerations related to the condition of the wife and husband and the continuity of the household after polygamy. This article was written with the aim of knowing how to fulfill women's rights in the judge's consideration in decision number 1167/Pdt.G/2022/PA.Kra. The approach method used is the normative-juridical method. Based on the results of the discussion, it can be seen that the judge in Decision Number 1167/Pdt.G/2022/PA.Kra has considered several aspects of fulfilling the rights of wives and husbands and maintaining the continuity of the household by minimizing disputes in the future by determining mutual assets and has considered the financial capabilities of the husband, even though the decision has not shown clarity on the amount of income that the first wife will receive as a guarantee that the husband can act fairly. and in his consideration, the judge set aside several facts that had been submitted in the application and proved that there was an application for a polygamy permit, namely that the prospective second wife was already pregnant. The novelty of this paper is that the author sees several aspects of judges' considerations in granting permission for polygamy.

Abstract

Purpose of the study: This article aims to find out how the divorce conditions in the Kangean Islands are and to see how the factors that influence it and the legal reasoning used by the judge in deciding the divorce case. Methods: the method used in this study is a normative juridical method with a decision approach, the data used is secondary data, namely the decisions of the religious courts in 2020-2022, which every year 30% of the decisions are taken, the data are analyzed descriptively Results: From the research conducted, it was found that the majority of divorces in Kangean Island were carried out by a contested divorce mechanism, while the factors behind the majority were due to disputes, then followed by economic factors, legal reasoning judges were divided into empathy, namely the use of legal norms, conformity between facts and norms. , interpretation of problems and norms, as well as the use of the rules of Islamic law in its legal opinion Applications of this study: This article is useful to support research on divorce and legal opinions, especially on Kangean Island and Indonesia in general Novelty: The novelty of this research is that there are still very few people doing research on the Kangean Islands, as well as the discovery of several legal reasoning concepts for judges at the Kangean Religious Court.   ABSTRAK   Tujuan Penelitian: Artikel ini bertujuan untuk mengetahui bagaimana kondisi perceraian di Kepulauan Kangean dan melihat bagaimana faktor-faktor yang mempengaruhinya serta alasan hukum yang digunakan hakim dalam memutus perkara perceraian. Metode : Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan pendekatan putusan, data yang digunakan adalah data sekunder yaitu putusan pengadilan agama tahun 2020-2022 yang setiap tahun diambil 30% putusannya, data tersebut dianalisis secara deskriptif Hasil: Dari penelitian yang dilakukan diketahui bahwa mayoritas perceraian di Pulau Kangean dilakukan dengan mekanisme cerai gugat, sedangkan faktor penyebab mayoritas adalah karena perselisihan, kemudian disusul faktor ekonomi, pertimbangan hukum hakim terbagi menjadi empati, yaitu penggunaan norma hukum, kesesuaian antara fakta dan norma. , interpretasi masalah dan norma, serta penggunaan aturan hukum Islam dalam opini hukumnya Aplikasi penelitian ini: Artikel ini bermanfaat untuk mendukung penelitian tentang perceraian dan opini hukum khususnya di Pulau Kangean dan Indonesia pada umumnya Kebaruan: Kebaruan dari penelitian ini adalah masih sedikitnya orang yang melakukan penelitian di Kepulauan Kangean, serta ditemukannya beberapa konsep penalaran hukum bagi hakim di Pengadilan Agama Kangean.
