Abstract

Civil servants have the rights of protection, maintenance and welfare. Civil Servants pension security and Old Age Security are given as protection for the continuity of old-age income, as a right and as a reward for the service of civil servants given in the national social security program. When a civil servant dies, and the event that their widow/widower has also died, it will be given to his children. Thus, it can be seen that the heirs of retired civil servants who are entitled to civil servant insurance are limited to widows/widowers or their children. This writing aims to examine and resolve confusion arising from the ambiguity of the definition of children who are entitled to receive pension insurance from their parents who are retired civil servants when their parents have died. This study uses normative legal research methods to analyze the vague norms. The ambiguity of the definition of children in the law Number 11 of 1969 will cause problems in determining the position of children as heirs of pension rights for Civil Servants pensioners. After doing research, it is known that the position of adopted children is only entitled to an adopted child allowance. Meanwhile, children as recipients of the rights of pension are only legitimate biological children or legalized biological children.

Abstract

Villages are stated to be the smallest government structure in Indonesia. A village is an area that has certain boundaries, as a legal community unit that has the right to regulate and manage the affairs of local communities based on their origins. Apart from that, the village government also has the authority to determine legislative products mentioned in village regulations. However, this form of legal regulation is not included in the hierarchy of legal regulations in Indonesia, and in practice it is rarely known by the public. Therefore, this research will focus on identifying the legality of the position of regulations in villages as part of the national legal and regulatory framework. The research method used is a normative legal research method which discusses the position and legality of regulations in the village based on applicable laws and regulations as primary legal material. Apart from that, the discussion is also complemented by secondary legal materials in the form of books and articles published in journals based on theories, concepts, as well as legal principles and adages. The research results show that the village government is the smallest unit in the government system in Indonesia. The village government, like other governments in the region, has the authority to regulate and manage its government affairs autonomously based on the division of affairs and rights according to the origins of the village. Regarding this authority, the village government has the authority to form village regulations and village head regulations. The status and legitimacy of village regulations and village head regulations are recognized as statutory regulations and have binding legal force as long as they are formed based on higher statutory regulations or based on their authority over the village's original rights.

Abstract

This article critically analyzes the implications of licensing simplification which has the impact of making business licensing easier. This raises the crucial question of whether the licensing simplification model has an impact on the industrialization of business licensing and the effect on the degradation of environmental wisdom? This research uses the methodQualitative research with data collected and analysis is more qualitative in nature. Qualitative analysis is used by adopting an investment model as a form of implementing business permits in environmental protection in France and Japan with the composition of France being a country without environmental wisdom and Japan having very strong environmental wisdom values. As a result, these two countries implemented a green investment model which emphasizes that economic growth must also pay attention to environmental protection. The environment is also positioned as a legal subject with the same rights as other legal subjects. The government has an important role in forming regulations that lead to a green economy so that every business activity places green investment as the foundation for implementing business activities.

Abstract

Tujuan penelitian ini, mengkaji dan menganalisis pembacaan serta akibat hukumnya jika notaris tidak membacakan akta notaris yang sudah diterjemahkan dalam bahasa asing, seperti bahasa Mandarin, Rusia, dan Arab. Tidaklah mudah untuk mempelajari bahasa asing, apalagi yang menggunakan aksara dalam tulisannya. Notaris yang sudah memiliki keahlian dalam membuat akta akan ada kendala ketika kliennya adalah orang asing yang meminta agar aktanya dibuatkan dalam bahasa asing. Penerjemah memiliki fungsi menerjemahkan bahasa. Namun, terdapat konflik norma tentang pembuatan akta antara notaris dan penerjemah resmi pada Pasal 43 ayat (1) dengan ayat (3) UU Notariat. Konflik norma tentang kewajiban pembacaan akta, Pasal 16 ayat (1) huruf m dengan Pasal 43 ayat (5) UU Notariat. Penelitian ini, menggunakan metode penelitian hukum normatif. Hasil penelitian, menunjukkan bahwa notaris berwenang membuat serta wajib membaca akta notaris menggunakan bahasa Indonesia (minuta, salinan, dan kutipan). Penerjemah resmi menerjemahkan bahan dari salinan atau kutipan kedalam bahasa asing serta membacakan hasil terjemahan itu bersamaan dengan pembacaan akta bahasa Indonesia oleh notaris. Tidak ada akibat hukumnya, jika notaris tidak membacakan akta terjemahan bahasa asingnya. ABSTRACT The aim of this research is to examine and analyze the reading and legal consequences if notary does not read the notarial deed which has been translated into a foreign language, such as Mandarin, Russian and Arabic. It isn’t easy to learn a foreign language, especially one that uses characters in its writing. Notaries who already have expertise in making deeds will have problems when their clients are foreigners who request that their deeds be made in a foreign language. Translator has the function of translating languages. However, there is a conflict in norms regarding the making of deeds between notary and official translator in Article 43 paragraph (1) with paragraph (3) Notary Profession Statute. Conflict of norms regarding the obligation to read deeds, Article 16 paragraph (1) letter m with Article 43 paragraph (5) Notary Profession Statute. This research, uses normative legal research methods. The research results show, notary have the authority to make and are required to read notarial deed using Indonesian (the original, the official duplicate, and the extract). Official translator translates material from the official duplicate or the extract into a foreign language and reads the translation results simultaneously with the reading Indonesian deed by notary. There are no legal consequences, if notary doesn’t read the foreign language translation deed.
