Abstract

Villages are stated to be the smallest government structure in Indonesia. A village is an area that has certain boundaries, as a legal community unit that has the right to regulate and manage the affairs of local communities based on their origins. Apart from that, the village government also has the authority to determine legislative products mentioned in village regulations. However, this form of legal regulation is not included in the hierarchy of legal regulations in Indonesia, and in practice it is rarely known by the public. Therefore, this research will focus on identifying the legality of the position of regulations in villages as part of the national legal and regulatory framework. The research method used is a normative legal research method which discusses the position and legality of regulations in the village based on applicable laws and regulations as primary legal material. Apart from that, the discussion is also complemented by secondary legal materials in the form of books and articles published in journals based on theories, concepts, as well as legal principles and adages. The research results show that the village government is the smallest unit in the government system in Indonesia. The village government, like other governments in the region, has the authority to regulate and manage its government affairs autonomously based on the division of affairs and rights according to the origins of the village. Regarding this authority, the village government has the authority to form village regulations and village head regulations. The status and legitimacy of village regulations and village head regulations are recognized as statutory regulations and have binding legal force as long as they are formed based on higher statutory regulations or based on their authority over the village's original rights.

Abstract

This article critically analyzes the implications of licensing simplification which has the impact of making business licensing easier. This raises the crucial question of whether the licensing simplification model has an impact on the industrialization of business licensing and the effect on the degradation of environmental wisdom? This research uses the methodQualitative research with data collected and analysis is more qualitative in nature. Qualitative analysis is used by adopting an investment model as a form of implementing business permits in environmental protection in France and Japan with the composition of France being a country without environmental wisdom and Japan having very strong environmental wisdom values. As a result, these two countries implemented a green investment model which emphasizes that economic growth must also pay attention to environmental protection. The environment is also positioned as a legal subject with the same rights as other legal subjects. The government has an important role in forming regulations that lead to a green economy so that every business activity places green investment as the foundation for implementing business activities.

Abstract

This study delves into the elements of patent rights and dispute resolution strategies in cases of patent infringement. The background of the research stems from the necessity to understand the legal framework surrounding patent protection and the mechanisms available for resolving disputes in the event of infringement. The primary objective is to identify the crucial components of patent rights and the various methods employed to address disputes arising from alleged patent violations. Employing a normative legal research approach, with both conceptual and statutory analyses, this study aims to provide a comprehensive overview of the subject matter. The findings underscore the significance of novelty as a fundamental criterion for patent acceptance, as defined by Law Number 13 of 2016 concerning Patents. Novelty, characterized by the absence of prior public disclosure, usage, or inclusion in existing knowledge standards, is essential for patent registration. The study reveals that patent disputes concerning novelty can be addressed through diverse legal avenues, including patent removal suits, trial proceedings, mediation, patent reexamination, out-of-court settlements, and appellate processes. Furthermore, alternative mechanisms such as arbitration offer additional pathways for resolving disputes. The implications of this research highlight the importance of adhering to novelty requirements during patent registration and understanding the array of dispute resolution mechanisms available to safeguard intellectual property rights.
