Abstract

Notaries dom’t have guidelines and guidance to prevent the occurrence of money laundering crimes that are faced with various types and characteristics of their opponents. The ambiguity of the norms in Article 16 paragraph (1) letter a of the Notary Law should be able to state the obligations of Notaries in carrying out their duties, must act in a trustworthy, honest, fair, independent, impartial manner and protect the interests of the parties involved in legal acts. This type of research is normative juridical using 3 (three) types of approaches, namely the statutory approach, the conceptual approach and the comparative approach. Based on the results of the study, it can be concluded that Notaries are required to apply the Principle of Recognizing Service Users (PMPJ) as part of implementing the principle of prudence, at least including identification of Service Users, verification of Service Users and monitoring of Service User transactions. This application applies to Notaries in providing services when preparing and conducting transactions for the benefit of or for and on behalf of Service Users, regarding the purchase and sale of property, management of money, securities, and/or other financial service products, management of checking accounts, savings accounts, deposit accounts, and/or securities accounts, operation and management of companies and/or establishment, purchase, sale of legal entities. Notaries can implement applications such as Data Banks for their parties who will create PPJB Deeds and Powers of Attorney for Sale and Purchase that are in accordance with KTP and KK, so as to minimize the occurrence of money laundering. Especially related to land, the land ownership limit must not exceed 20 hectares + 5 hectares.

Abstract

Based on the development of theoretical discourse and reform of criminal law in various countries, there is a strong tendency for law enforcers to apply solutions outside the judicial process as a way to resolve problems in the field of criminal law. In general, settlements outside the judicial process are carried out in civil cases. Meanwhile, in the field of criminal law, settlement outside the judicial process is applied to the resolution of cases of children who are in conflict with the law which violates the rules of criminal law which refer to the Child Protection Justice System Law.The crime of sexual violence committed by children is one of the crimes where the case is resolved through a settlement outside the judicial process. In practice, law enforcement officials use different regulations based on each level in the examination process, both at the investigation, prosecution and court examination levels. The differences in written regulations that are used as a legal basis by the Police, Public Prosecutors, or Judges in implementing settlement policies outside the judicial process based on a restorative justice approach through diversion efforts which have implications for legal uncertainty require efforts to reformulate current legal regulations through criminal law policies.

Abstract

Pertanggungjawaban pidana dokter dalam pelayanan telemedisin seringkali menjadi sorotan utama dalam proses hukum, terutama ketika terjadi hal-hal yang tidak dikehendaki oleh pasien atau keluarganya, sementara ketidakakuratan informasi dari pasien terkadang tidak mendapat perhatian yang setara. Undang- Undang Nomor 17 Tahun 2023 tentang Kesehatan merupakan dasar kejelasan mengenai tindak pidana dan pertanggungjawaban pidana dokter dalam pelayanan telemedisin yang timbul dari faktor-faktor yang berada di luar kendali mereka, seperti keterbatasan teknologi, keterangan pasien, dan kesesuaian dokter dalam praktiknya. Tujuan penelitian ini untuk menentukan pelayanan telemedisin yang berakibat pada hal- hal yang tidak dikehendaki pasien atau keluarganya termasuk dalam tindak pidana serta dapat dipertanggungjawabkan menurut hukum. Metode penelitian yang digunakan adalah penelitian hukum dengan pendekatan undang-undang dan konseptual. Hasil penelitian menunjukkan bahwa ketidakpuasan pasien atas pelayanan atau kelalaian dokter dapat menimbulkan masalah hukum yang mengarah pada tindak pidana. Tindakan yang tergolong tindak pidana dalam telemedisin adalah perbuatan yang dilarang dan diancam sanksi sesuai UU Kesehatan. Pertanggungjawaban pidana dokter timbul apabila kesalahan terbukti berakibat serius, seperti diagnosis atau pengobatan yang dilakukan tanpa pemeriksaan fisik yang memadai, sehingga dokter dapat dikenakan sanksi pidana sesuai dengan ketentuan hukum yang berlaku.

Abstract

The cases of child sexual exploitation continue to rise in Indonesia. However, the legal system has yet to provide legal certainty for children as victims. This study aims to examine the positive legal framework regarding the protection of child victims of sexual exploitation, assess its implementation in providing legal certainty, and offer an ideal concept of legal protection for the future. The method used is normative juridical with statutory, case, and conceptual approaches. The results show that although legal instruments such as the Child Protection Law, the Sexual Violence Crime Law, and regulations related to restitution are in place, their implementation remains ineffective. Restitution rights are often not pursued due to victims’ lack of awareness and weaknesses in the legal system. This study recommends that restitution be granted automatically and that the role of law enforcement be strengthened to ensure the protection of children's rights.

Abstract

Exhibitionism is a deviant sexual fantasy by showing one’s genitals to other people. This behavior certainly violates the norms of decency and norms which causes unrest and disturbs the peace in the community. Therefore, legal norms must be enforced in order to maintain order and peace and provide legal certainty in social life. Talking about criminal acts cannot be separated from discussing the punishment of the perpetrators of the criminal acts themselves. It can be said that criminal impositions must pay attention to the purpose of punishment which is identical to the punishment that applies for violating a legal rule. In Decision Number 23/Pid.B/2022/PN Wat the defendant admitted to making videos/photos of himself that contained pornography. During the investigation process, the defendant was examined by a psychologist with the results of the examination showing that the defendant suffered from exhibitionism. The panel sentenced the defendant to 10 months imprisonment and a fine of Rp. 250,000,000.

Abstract

This study investigates the regulation of action sanctions through a restorative approach for children in conflict with the law (ABH) within the juvenile criminal justice system in Indonesia. The objective is to analyze the alignment of these regulations with the principles of child protection and restorative justice. Utilizing a normative juridical method that incorporates statutory and conceptual approaches, the findings indicate that Article 82 of the Juvenile Criminal Justice System Law (SPPA Law) embodies a restorative justice approach, striving to balance community protection with the rehabilitation of ABH. However, the implementation is suboptimal, and many ABH continue to receive prison sentences. This suggests that the principles of the best interests of the child, the right to development, and respect for children’s views have not been adequately upheld. There is a need for further refinement of action sanctions to better align with restorative justice and address the needs of ABH.

Abstract

Abortion can actually be carried out with various special provisions based on Law no. 36 of 2009 concerning Health (Health Law) and Government Regulation no. 61 of 2014 concerning Reproductive Health (PP Kespro). This study aims to find out the legal review regarding abortion in relation to the principle of protection for rape victims, as well as to study and formulate an appropriate and appropriate timeframe for carrying out an abortion based on the principle of protection for rape victims. This research is normative legal research by prioritizing conceptual and statutory approaches. The results of the study confirm that the legal ratio for setting the fetal age limit related to abortion for rape victims does not actually explain the reasons or the urgency why the 6 weeks and 40 (forty) days are calculated from the first day of the last menstrual period formulated by the formulators of laws and regulations and only refers to The principle of protecting victims is currently the main orientation of Indonesian criminal law. In the future, the regulation on the principle of protection for victims related to the fetal age limit related to abortion for victims of rape, namely: it is necessary to emphasize the principle of protection for victims in the Health Law. The recommendation of this research is the need for a revision of the Health Law and PP on Produce as based on WHO provisions and with relevant medical considerations.

Abstract

Penelitian ini bertujuan untuk mengevaluasi pengaruh teknologi pembelajaran terhadap motivasi belajar siswa di MI NU Al-Falah Tanjungrejo Kelas V. Penelitian ini menggunakan pendekatan kuantitatif deskriptif dengan menyebarkan kuesioner kepada 30 siswa. Teknik analisis data menggunakan uji statistik berupa analisis deskriptif, analisis linear sederhana, uji determinasi dan uji hipotesis. Hasil analisis menunjukkan bahwa nilai rata-rata untuk variabel Teknologi Pembelajaran adalah 18,93 dengan standar deviasi 2,363, sementara untuk variabel Motivasi Belajar adalah 18,57 dengan standar deviasi 2,344. Hasil regresi linear sederhana menunjukkan bahwa teknologi pembelajaran memiliki pengaruh signifikan terhadap motivasi belajar siswa, dengan persamaan regresi Y = 8.141 + 0.551X. Koefisien korelasi (R) sebesar 0.555 menunjukkan korelasi positif yang cukup kuat, dan nilai R Square sebesar 0.308 menunjukkan bahwa 30.8% variabilitas dalam motivasi belajar dapat dijelaskan oleh teknologi pembelajaran. Uji Anova menunjukkan nilai F sebesar 12.461 dengan nilai p sebesar 0.001, mengindikasikan signifikansi statistik yang tinggi. Dengan demikian terdapat hubungan yang signifikan antara teknologi pembelajaran dan motivasi belajar siswa. Temuan ini memberikan rekomendasi praktis bagi MI Al-Falah Tanjungrejo untuk mengoptimalkan penggunaan teknologi dalam proses belajar mengajar guna mencapai hasil belajar yang lebih baik.

Abstract

The development of information technology have an impact on cyber crimes such as identity theft, fraud, and misuse of personal data. One of the crimes, abuse of personal data is doxing. It was an illegal act to spreading action people's personal information or data without permission and creates dangerous situations, humiliation, harassment, or other adverse which can lead to spoilage of the victims. The act of doxing or disseminating personal data has recently increased, especially among journalists. Doxing is a transmission system of personal data conducted by journalists legally. The freedom of journalists who compose and develop news to encourage misuse of personal data. In this case, we are interested in studying the legal basis of doxing and personal data dissemination in Indonesia, with the objectives: first, does the regulation of distributing personal data (doxing) in the Electronic Information and Transaction Law encounter the doxing typology? second How is the reformulation of the criminal law policy on the act of spreading personal data (doxing) in fulfilling the doxing typology? This research adopted normative legal research and used a statutory approach, conceptual approach, and comparative approach. The results showed that the act of doxing in the ITE Law does not regulate it according to the doxing typology. Therefore, there is a need to reform criminal law policies in the ITE. It can also be through the Bill of Personal Data Protection. The government must compose a regulation on disseminating personal data or doxing in the Law concerning Electronic Information and transactions.

Abstract

This study discusses the policy of Guideline Number 18 of 2021 concerning the settlement of drug abuse cases through rehabilitation with a restorative justice approach as an implementation of the dominus litis principle by the Indonesian Attorney General's Office. The implementation of the drug abuse rehabilitation policy by the Indonesian Attorney General's Office based on the dominus litis principle is regulated in the Attorney General's Guideline Number 18 of 2021. This policy addresses the number of drug convicts that exceed capacity with a restorative justice approach. The dominus litis principle gives prosecutors great authority in controlling the legal process, including the decision to continue or stop prosecution based on sufficient evidence. In addition, this principle allows for the termination of prosecution if the perpetrator's actions are not considered a crime. This policy gives prosecutors the authority to determine legal settlements with rehabilitation, prioritizing the recovery of perpetrators and positive impacts on society. Rehabilitation focuses on changing the behavior of perpetrators through programs that help them overcome drug addiction and improve their social skills. In addition to providing legal protection and the rights of perpetrators, this approach also emphasizes the principle of fast, simple, and low-cost justice, and avoids complicated and expensive legal processes. The principle of restorative justice in this policy aims to improve the negative impacts of drug abuse, by emphasizing the physical, mental, social, and emotional recovery of perpetrators, so that they can return to being productive members of society.
