Abstract

Fishermen are jobs that have a high level of risk, such as bad weather changes and problems that can occur when fishing, and spending money to meet the needs of daily life. The purpose of this study was to study the guarantee of safety for small fishermen through independent fishermen insurance, find out the rights and obligations between the guarantor and small fishermen in obtaining Safety. Fisherman insurance is regulated in the Law on Insurance Number 40 of 2014. Specific regulations on fisheries insurance concerning Law Number 7 of 2016 concerning Protection and Empowerment of Fishermen Insurance for Fishers, Fish Farmers, and Salt Farmers. This study specifically discusses fisherman insurance for small fishing communities. Entering a fisheries insurance agreement is carried out with premium payments paid by small fishermen, without government subsidies / assistance.The research carried out is a sociological legal research that is research that starts with the process of revealing the truth using basic concepts in sociology known as science, and taken from secondary data by processing data from primary legal materials, secondary legal materials, and legal materials tertiary. Research location in Bengkalis Regency, Riau Province. The recommendations used are juridical-sociological, namely research conducted on real situations in the Department of Maritime Affairs and Fisheries (DKP) and local fishermen in the Bengkalis Regency fisheries area.The results of this study regarding the research work agreement by PT Asuransi Jasa Indonesia (Jasindo) Pekanbaru Branch. Implementation of the rights of fishermen in obtaining safety here is less than the awareness and knowledge of the people in Bengkalis Regency to improve the clauses in the policy the Insurer does not give an understanding to small fishermen about things that are excluded in insurance coverage. To the PT Asuransi Jasindo Pekanbaru Branch to explain things that are excluded in the independent fisheries insurance policy, so that the rights of small fishermen can be accounted for according to the Law.Keywords: Fishermen Insurance, PT Asuransi Jasindo, Small Fishermen

Abstract

The dispute is basically a problem that often occurs in the global era of society atthe present moment either the individual dispute vertically, also the individualhorizontally as well as the existing groups within the community, therefore every issue ordispute of course have a way of settling either through litigation and non litigation.By way of mediation, it is expected that the settlement of a dispute becomescontrolled and does not harm any party to produce an agreed agreement that isunderstood and executed by the parties, in the settlement of this land case involving thegroup in the form of Foundation with the Village Government which is the organizer ofthe government in the village a phenomenon, which raises an important question as towhether using the mediation path can result in an effective resolution perceived by bothparties even more so if the dispute occurs between the public and the ruler vertically.The purpose of this study is to determine whether the obstacles in theimplementation of mediation between the Foundation with the Village Government andhow the effectiveness of the implementation of Mediation between Mu'adz Bin JabalFoundation with the Village Government of Kampar north Kampar districtThe data used in this study consisted of primary data and secondary dataobtained from field research results through interviews with resource persons fromMu'adz Bin Jabal Foundation and Village Government, and conducted literature studyon primary, secondary and tertiary legal materials related to theme research. Based onthe results of the above research, it can be concluded that the constraints in theimplementation of such mediation is sourced from the internal factors of the disputedparties, the object of the disputed object and external factors originating from partiesoutside the disputed parties. Abstract

Brokerage is a business entity that carries out the activities as intermediary for the sale and sale of futures and on the command / message of a third party (the customer) and the right to a deposit (margin) for each of these transactions in Compliance with the regulations. The interest in protecting their clients, futures brokers, must know the state of the ability of its clients, both in terms of financing (financial), customer knowledge on trade in futures and also ensuring its customers no Action contrary to regulation.The problem in this document is the exemption from the investment agreement between the customer and the company Broker and legal protection for clients who get injured from IBs called in this case the Broker Broker Penganturan is not independent of the Law No. 10 Year 2011 regarding Commodity Futures Trading as well as Act No. 32 of 1997 on Commodity Futures Trading.Normative study of the research is to compare the principles of the agreement, can be seen a few things. First of all, the agreement that is in the Broker's violation and in violation of the 2011 Law No 11 of the Futures Trading Komooditi contained elements of an exemption clause defined as liberating your responsibilities as a result of legal effects that occur Due to the lack of performance of liability obligations required by law. Abstract

The liquidation of a bank will have an impact on customer confidence, especially if the bank is unable to pay its obligations to its customers, it will eliminate the customer confidence in the banking institutions. Deposit Insurance Agency (LPS) is an independent organization that works to implement the deposit guarantee and participate actively maintaining banking stability. This study aims to discuss issues about the shape of the legal protection of depositors in the bank liquidated if savings exceed the amount guaranteed by LPS and what the legal consequences according to Law No. 24 of 2004 concerning the Deposit Insurance Agency.This study uses normative law research. Data collection techniques used literature study method or documentary studies. Source of data used are secondary data consists of primary legal materials, secondary law and tertiary legal materials. Data were analyzed using qualitative data analysis with descriptive parse.From the results of this study concluded that the form of legal protection for depositors due to the liquidation of the bank before the establishment of the Law No. 24 of 2004 concerning the Deposit Insurance Agency (LPS) is very weak because only through implicit protection. After the birth of the LPS Act provide protection and legal certainty for depositors both directly and indirectly. The legal consequences of the liquidation of a bank to depositors with funds in excess of LPS will receive payment from the sale of bank assets in the liquidation process, in accordance with the provisions of Article 54 Paragraph 1 of the Law of LPS, as well as for the deposit is not guaranteed as eligible contained in Article 19 may submit an objection to LPS or file a lawsuit to court. If the sale of bank assets are insufficient to repay depositors deposits, depositors may file a lawsuit to existing shareholders or parties proved to cause the bank to a bank failure by the District Court.Keywords : Customer Protection - Deposit Insurance Agency – Liquidation Bank

Abstract

Consumer protection against the campaign conducted in the District Sail Shop Alfamart need for supervision, it is caused because so many business do promotion on a particular item. But often once the promotion is done in a manner that is false or misleading consumers, so the promotion is done by business often result in a loss for consumers. A result of the improper promotion, businesses should be held responsible for damages suffered by consumers. Alfamart District Shop of Sail is found that many of these promotions were misleading the public, so that many consumers feel very aggrieved. Abstract

Kabupaten Pelalawan pada umumnya merupakan masyarakat dengan sistem kekerabatan parental, yakni garis keturunan yang ditarik dari pihak ayah dan juga pihak ibu, yang mana berarti pewarisan dilakukan secara rata, baik perempuan maupun laki-laki memiliki porsi yang sama. Penelitian ini dilakukan di Kecamatan Langgam untuk mengetahui penerapan sistem waris pada masyarakat Adat Melayu di Kabupaten Pelalawan dan bentuk perpaduan antara hukum adat dan hukum Islam dalam masalah hukum waris pada masyarakat Melayu Riau di Kabupaten Pelalawan.

Abstract

The crime of embezzlement of fiduciary collateral often occurs inIndonesia, especially the city of Pekanbaru. Meanwhile, fiduciary guarantees as aform of engagement regulated in Law Number 42 of 1999 concerning FiduciaryGuarantees are routine activities in lending transactions because the loadingprocess is considered simple, easy and fast. Fiduciary is the transfer of ownershiprights to an object on the basis of trust provided that the object whose ownershiprights are transferred remains in the control of the owner of the object. The rise ofembezzlement crimes against fiduciary guarantees cannot be separated from therole of law enforcement, including at the level of the investigation process. Themain problem in this study is the lack of security for creditors who pledge theirvaluables to debtors. In this study, the authors wanted to know how theinvestigation process was carried out by the Pekanbaru Police and wanted to findout what obstacles occurred in the investigation process against the crime ofembezzlement of fiduciary guarantees in the city of Pekanbaru.This type of research can be classified in the type of Sociological researchbecause in this study the author directly conducts research at the location orplace under study in order to provide a complete and clear picture of the problembeing studied. This research is sourced from primary data, secondary data andtertiary data, while the population and sample are the Pekanbaru Policeinvestigators who handle cases of embezzlement of fiduciary guarantees in thePekanbaru Police jurisdiction.The results of the study indicate that in terms of the investigation process,it turns out that the Pekanbaru Police are not optimal in carrying out lawenforcement as evidenced by the 20 cases that have been submitted from 2018 to2022, only 5 cases have been sentenced to court while 15 cases have beeninvestigated, this is due to the investigation process. What is done tends to chargethe reporter to prove his report without any effort or the role of law enforcementis passive while in criminal law the investigator has the authority to activelyprove a criminal act.Keywords: Crime – Embezzlement – Fiduciary

Abstract

The independent palm orchard is one of the manufacturers in theproduction of palm oil other the plasma gardener and palm company in Tualangoxford, Siak municipality, Riau, the independent palm farmers have helpedcoountries to improve economic development in Indonesia but in the case, theindependent palm farmer did not properly receive the price of fresh fruit 11% to48% of the price hikes cut by palm oil producer have caused the independentpalm farmers to suffer losses in palm production activities, this results in adecline in the production due to the lack of the ability of the independent palmorchard to care for and plant cultivation, the independent palm orchard thing isthiking steps to increase the coprative production of palm oil rather than quality,by expending the land of palm plantations, which of course can have a negativeimpact on the environment in Tualang oxford, Siak municipality, Riau.As for the problem that the writer is making the basis of I this study, howdoes the price of fresh palm fruit go to the independent palm orchard in Tualangoxford, Siak municipality, Riau, and are independent palm gardens in Tualangoxford, Siak municipality, Riau obtaining protection in the sale of fresh fruitplants under Indonesia’s minister of agriculture no. 01/PERMENTAN/KB.120/1/2018 regarding guidelines for the purchase of fresh crop and fresh fruit from thefarmers’ production palm, and 2020 governor Riau rules No.77 of the policy ofpurchasing fresh fruit from palm oil production in the province of Riau.The kind of study used by the author is a sociological law study, alsoreferred to as the study of doctrinal law, from this sociological study of law theauthors conducted the study using the systemic criteria of the law, plants underIndonesia’s minister of agriculture no. 01/PERMENTAN/KB.120/1/2018regarding guidelines for the purchase of fresh crop and fresh fruit from thefarmers’ production palm article 2 mentions that the ministry’s rule is to provideprotection to the gardeners in obtaining fair prices of fresh fruit and avoidingunhealthy competition between plantatin companies, chapter 10 verse (10) cand2020 governor Riau rules No.77 of the policy of purchasing fresh fruit from palmoil production in the province of Riau.Keywords: Palm, Independent gardeners, TBS

Abstract

This study discusses the cooperation agreement between the transportcompany and the courier (case study of the cooperation agreement No.230/PM/MAS/III/2022)”. An agreement is an act whereby one or more personsbind themselves to one or more other persons. Based on Article 1338 of the CivilCode which reads: "All legal agreements are law for those who make them".These agreements may not be revoked except with the consent of both parties, orfor reasons sufficient by law. The purpose of writing this thesis is; First, to findout the fulfillment of the transport company's rights and obligations with thecourier in the cooperation agreement on the basis of good faith; Second, seekefforts to resolve disputes about the rights and obligations of the carrier with thecarrier in a cooperation principle of good faith. The type of legal research theauthor uses is normative legal research or library law research.This type of research can be classified into the sociological researchtype because in this research the author conducts research directly at theresearch site or place to get a complete and clear picture of the problem underinvestigation. This survey was conducted by PT Satria Antaran Prima (SAP)Pekanbaru City, while the population and sample are all parties related to theissues examined in this survey, the data sources used, primary data and secondarydata, and tertiary data, data collection techniques in this study throughobservation and interviews.From the results of this research, the author concludes that the legalprotection of the rights and obligations of carriers with couriers based oncooperation agreements has not been fully implemented properly. The content ofthe cooperation agreement is determined unilaterally in relation to the carrier'sobligations. Couriers do not have the right to convey considerations about thecooperation agreement so that it is less profitable for the parties, especially thecourier. So that the rights and obligations under the partnership agreement arenot met. Settlement of disputes about the rights and obligations of the carrier withthe carrier in the first cooperation agreement through consultation and thesecond through mediation. Dispute settlement through consultation has notachieved the maximum result in practice, so that the parties to the dispute havenot been given proportionate rights and obligations.Keywords: Courier, Transport company, Cooperation agreement.
