Abstract

PT Amartha Micro Fintech comes with the aim of increasing UMKMthrough a group of underprivileged women by providing financing services aimedat business capital. The financing provided by Amartha to the underprivilagedwoman’s group uses sharia principles with a mudharabah. In Beringin MakmurVillage, especially the Amartha Beringin assembly, only 5 out of 30 customerscarry out their obligations using financing for business capital, even though thisprovision has been stated in Article 1 paragraph (4) of the Funding Agreement –Special Requirements of PT Amartha Micro Fintech, Article 1paragraph (11) ofLaw Number 20 of 2008 Concerning Mikro, Small, and Medium Enterprises, andNational Sharia Council Fatwa on Mudharabah (Qiradh).This type of research is empirical juridical research, while the pupulationand sample are PT Amartha Micro Fintech Pangkalan Kuras Branch and thecustomers of the Amartha Beringin assembly in Beringin Makmur Village. Thepurpose of this research is to find out the obligation of customers to use thefinancing received as business capital which aim to increase Micro, Small, andMedium Enterprises (UMKM).The conclusion of this research is the obligation of PT Amartha MicroFintech customers, especially the Amartha Beringin assembly, has not beenmaximizes due to several factors from the customer’s side as well as from the sideof field officers. The weak economic situation of customers is one of the obstaclesfor customers to establish a business through capital loans given and the largetarget that must be achieved by field officers also result in giving loans tocustomers even though they do not meet their obligations optimally. The author’sadvice for customers is given socialization related to rights and obliggations aswell as literacy to improve the business that is being run and balanced withregular monitoring of customers after the disbursement of financing.Keywords: Model – Mudharabah Financing – Application – Capital Loan.

Abstract

In the jurisdiction of the Dumai City Religious Court there are several divorce caseswhose decisions also decide on the father's obligation to provide child support rights. In caseNumber 399/Pdt.G/2018/PA.Dum, regarding the fulfillment of child maintenance rights by theDumai City Religious Court in its decision imposed the obligation to provide maintenance ofchildren to the father with the provisions as stated in the decision. Ironically, theimplementation of this decision cannot be carried out optimally. In fact, the father does notgive the right to provide for the child at all as has been decided by the Judge at the ReligiousCourt on the grounds that he cannot afford the amount of maintenance that must be given permonth, thus causing the child not to get the comfort and protection as the rights he has. Thepurpose of writing this thesis: First, to find out the Mediation Process for Fulfilling Post-Divorce Children's Livelihoods at the Dumai City Women and Children EmpowermentIntegrated Service Center.Second, to find out the Dispute Resolution of the Fulfillment of Post-Divorce Children'sLivelihoods through Mediation at the Dumai City Women and Children EmpowermentIntegrated Service Center.The type of research used in this legal research is sociological legal research. Analysisof the data used is the author to analyze data qualitatively. In drawing conclusions the authoruses the deductive thinking method, namely a way of thinking that draws conclusions from ageneral statement or argument into a specific statement.From the research results, there are two main things that can be concluded. First, themediation process at the Dumai City Integrated Service Center for Women and Children hasgone well, it's just that the results of the agreement did not work as it should. Ironically, theimplementation of this decision cannot be carried out optimally. Second, the handling ofchildcare cases at the Integrated Service Center for the Empowerment of Women and Childrenin the City of Dumai is an activity carried out in an effort so that children who are victims oftheir parents' divorce, have their rights fully fulfilled without prejudice to justice for bothparents. The handling of child rearing cases is handled by mediation, namely by bringingtogether the two parties, namely ex-husbands and ex-wives accompanied by the Institution.Keywords: Dispute resolution - Children and women - Divorce

Abstract

 Dalam perkara Nomor 04/KPPU-L/2020 dan perkara Nomor 30/KPPU-I/2019 terdapat perbedaan penafsiran majelis KPPU mengenai pemenuhan unsur mengatur dan atau menentukan pemenang tender padahal dengan kronologi kasus yang hampir sama dan beberapa terlapor dari masing-masing perkara juga sama-sama telah gugur di tahap evaluasi administrasi akan tetapi hanya 4 terlapor pada perkara Nomor 04/KPPU-L/2020 yang dibebaskan dari segala tuntutan sedangkan 2 terlapor dari Nomor 30/KPPU-I/2019 malah dihukum oleh majelis KPPU.  Dari itu perlu diperdebatkan tentang bagaimana kriteria pemenuhan unsur unsur mengatur dan/atau menentukan pemenang tender dari Pasal 22 Undang-Undang Nomor 5 Tahun 1999 dan berakibat pada kesenjangan putusan yang dilahirkan oleh majelis KPPU.Jenis penelitian yang digunakan dalam penelitian ini yaitu menggunakan jenis penelitian hukum  normatif, dengan teknik pengumpulan data melalui studi pustaka,  analisis  data yang akan digunakan yaitu analisis data kualitatif, hasil dari penelitian dijelaskan dalam bentuk deskriptif dan menarik kesimpulan menggunakan  metode berpikir deduktif.Dari hasil penelitian yang telah lakukan, mengenai kriteria Tindakan yang mmenuhi unsur mengatur dan atau menentukan pemenang tender berdasarkan Undang-Undang Nomor 5 Tahun 1999, tidak ada di jelaskan secara pasti baik dari penjelasan majelis maupun di semua peraturan perundang-undangan yang ada tentang kriteria Tindakan yang menjadi ukuran tepenuhinya unsur tersebut. Perbandingan Putusan Nomr 04/KPPU-L/2020 dan Putusan Nomor 30/KPPU-I/2019 menunjukan bahwa pendekatan yang seharunya digunakan dari ke dua putusan tersebut adalah pendekatan ruleofreason, hal ini otomatis membuat penggunaan pendekatan per seillegal yang digunakan majelis KPPU pada Putusan Nomor 30/KPPU-I/2019 dirasa kurang tepat.Kesimpulan dari penelitian ini yaitu, pertama kriteria pemenuhan unsur mengatur dan atau menentukan pemenang tender tidak ada di jelaskan secara pasti  di dalam UU NO 5 Tahun 1999. Kedua pendekatan yang seharunya digunakan dari ke dua putusan tersebut adalah pendekatan ruleofreason, hal ini otomatis membuat penggunaan pendekatan per seillegal yang digunakan majelis KPPU pada Putusan Nomor 30/KPPU-I/2019 dirasa kurang tepat.Kata Kunci: Pemenuhan unsur-Pendekatan KPPU-Tender.

Abstract

Along with the rapid development of science and technology in the modern era, it hasresulted in increasing public demand for services providing goods/services consumed by thepublic. This creates many opportunities for business actors to meet demand for these goodsand services. Buying and selling in this modern era is not only limited to in person but can bedone online, which makes it easier for many business people to run their business.However, in reality, many business actors engaged in online buying and selling do not carryout their rights and obligations properly, which puts consumers in a weak and disadvantagedposition. One of them is the business actor @booming_market which is engaged in buyingand selling netfix accounts. @booming-market business actors carry out ambiguous andmisleading promotions in order to reap maximum profits by not being honest and transparentwith their consumers. the aim of this thesis research is first, to analyze the responsibility of@booming-market business actors towards consumers who are harmed by misleadingpromotions. Second, analyze the forms of legal action that can be taken by @booming-market consumers who are harmed by misleading promotions.From the research results it can be concluded that. First, as regulated in Article 19 UUPK,@booming-market business actors are responsible for providing compensation for consumerlosses. Second, there are 2 legal remedies that can be taken by consumers, namely throughlitigation and non-litigation, but in this case there is a risk that the agreement can be canceledby law because it does not meet the objective requirements for the validity of an agreementbecause the Netflix company has prohibited it from selling. buy back the netflix account. Theauthor's advice is: First, consumers should understand more about consumer rights so thatthey can make careful considerations before deciding to consume a good/service. Second,business actors who promote a product must provide correct information about the product.The advertising content must not contain misleading information or make uncertain promises.You should comply with statutory regulations and not shy away from your responsibilities asa business actor.

Abstract

Car rental agreements are often used by the community to fulfill theirneeds, so that the implementation often creates a problem, where the tenantdefaults on the contents of the lease agreement that has been made by the partythat rents out. So that in the end there was a dispute between the two parties. Thepurpose of this study is to find out the process of implementing the agreement, andto know legal safeguards against car rental companies when tenants default.The research method used is a sociological juridical approach that is amethod or method used in legal research conducted directly to the field(interview). Then the results of the study will be analyzed descriptively bycombining data from the results of literature / literature studies and field studies.Based on the results of the study it can be concluded that first, the leasingagreement process carried out by AutoBridal Rent Car rental is a type of writtenagreement between the two parties and is in accordance with Article 1548 of theCivil Code. Second, when the tenant defaults, the company has made severalRepressive efforts in resolving the defaults made by the tenants. One such effort isthrough non-litigation or deliberation / consensus. It is suggested to thegovernment that the arrangement of the leasing agreement be specifically andclearly regulated regarding legal protection for business actors, so that theinterests of business actors can also be protected. To the public to carefully readin advance about the contents of the agreement before signing it, and to theleasing party it is recommended that in making a written agreement not tooburdensome to the tenants.Keywords: Legal Protection, Agreement, Rent a Car

Abstract

The Regional Regulation of North Sumatra Number 5 in 2018 concerning the North Sumatra TourismDevelopment Master Plan from 2017-2025, in clause 17 letter b says that Sigapiton Village is one of thetourism development areas of North Sumatra. And in 2017 the State represented by the RegionalGovernment of Toba Regency built a tourist area called The Kaldera Toba on the Customary Land ofSigapiton Village. The government said that their customary land had been transferred by the ancestors ofSigapiton Village in 1952 to the State and had become State land in that year. The people of SigapitonVillage asked for documents on the transfer of their customary land but the Regional Government of TobaRegency could not show the documents on the transfer of their customary land to the State. The purpose ofthis research is to resolve the problem of the transfer customary land with the state, where the Sigapitonvillage community wants their rights of their Customary land back so they could manage it and staterecognizes the existence of their customary land so there is no more disputes between the Sigapiton villagecommunity to state and state to another village community.The method that used in this research is Sociological can be research that could see the correlationbetween law and society, so as to reveal the effectiveness of the enactment of law in society and identifyunwritten laws that apply to society. This research was conducted in Sigapiton Village, Toba Regency. Thesources of data that used are primary data and secondary data, with data collection techniques in this studyare observation, questionnaires, interviews and literature review.The result of the author's research is that the Sigapiton Village Community had negotiated with thegovernment. In terms of the first negotiation and second did not produce any results. And in the thirdnegotiation, the government promised to gave back the Customary Land of the Sigapiton Village Community ofabout 400ha. The approximately 400ha should be returned in a clear legal status that had certificate ofreturned land with clear boundaries by National Land Agency (BPN).Keyword: Transition, Customary Land, Dispute Settlement.

Abstract

The norms in consumer protection law are the consumer protection lawsystem as an "umbrella law" which becomes the criteria for measuringallegations of violations of consumer rights, which were originally expected byall parties to be able to provide solutions for resolving cases that arise. as theimplementation of the law. It turned out that in its application there was animbalance and caused confusion for the parties involved in the implementationprocess, especially when the role of the court was entered in examining objectioncases to the Consumer Dispute Settlement decision which experienced manyobstacles caused by aspects related to the Civil Procedure Code. It must beadmitted that the regulation on Consumer Dispute Settlement authority is stillnot well-organized because it is still here and there and causes problems bothfrom a theoretical and implementation perspective in the field.This type of research can be classified as normative legal research,because the research is conducted by examining library materials or secondarydata. The data sources used are primary data, secondary data, tertiary data,data collection techniques in this study are normative law, data analysis usingdescriptive analysis.The results of the research conducted by the author are the authority of theConsumer Dispute Settlement Agency based on Law Number 8 of 1999concerning Consumer Protection, namely handling and resolving consumerdisputes which are carried out by means of mediation, consulation andarbitration. Decision of the Supreme Court Number 523 K/Pdt.Sus-BPSK/2020reviewed based on Law Number 8 of 1999 concerning Consumer Protection isthat the Consumer Dispute Settlement Agency as an institution mandated toresolve consumer disputes outside the court does not carry out its duties andauthorities properly based on Law Number 8 of 1999 concerning ConsumerProtection because what is under the authority of the Consumer DisputeSettlement Agency is an unlawful act, not a civil dispute.Keywords: Juridical Review, Consumer Protection, BPSK Authority

Abstract

In the implementation of the use of land in Indonesia regulated in Article 33paragraph (3) of the 1945 Law, the article explains that everything regarding naturalresources including land that is within the territory of Indonesia means that it is controlled,regulated, managed and distributed by the state or government with all its managinginstitutions to be used for the prosperity or welfare of the Indonesian people as a whole.The research method used in this study is the Sociological method. The research wasconducted in Silam Village, Kuok sub-district, Kampar Regency and the Kampar RegencyNational Land Agency Office which were the objects of this research case. Then thepopulation and sample are several parties related to the problem under study, as well as datasources used primary data and secondary data. Data collection techniques in this study wereinterviews and literature review.The conclusions obtained from the results of this study are First, based on the factorscausing the delay in compensation costs on the land title Certificate No. 00471 for thePekanbaru-Pangkalan toll road project, it is hoped that the National Land Agency is theagency authorized for land acquisition, so checking and determining the location must becarried out with accuracy regarding the data so as not to cause problems. Second, it is hopedthat in land acquisitions by determining for the public interest, including the interests of thenation and the state as well as the common interests of the people, land rights can berevoked, by providing appropriate compensation according to the manner regulated by law.Keywords: Dispute Resolution, Compensation, Non Litigation.
