Abstract

The current position of housing consumers is weak compared to developers as business actors, oftendevelopers commit fraudulent practices to increase their business profits, from the incompatibility of brochureswith housing conditions, low quality of buildings, unavailability of adequate facilities and infrastructure, to lackof housing maintenance. which causes repeated flooding. This happened to the Perumahan Pesona HarapanIndah in Pekanbaru , the housing located on Cengkeh Street, Bukit Raya District experienced repeated floodingevery rainy season. Whereas in Law No. 1 of 2011 concerning Housing and Settlement Areas it is stated that itis forbidden for housing operators to build housing in locations that have the potential to pose a danger to people,thus creating an obligation for PT. Mandevilla as the Developer to provide compensation as stipulated in Article19 of Law No. 8 of 1999 concerning Consumer Protection. The purpose of writing this thesis, namely: First, toknow the responsibilities of PT. Mandevilla as a business actor for the loss of buying a house at PerumahanPesona Harapan Indah Pekanbaru, Second, knows the form of compensation for PT. Mandevilla for the loss ofconsumers of beautiful housing in Pekanbaru.This type of research can be classified in the type of Sociological research because in this study the authordirectly conducts research at the location or place under study in order to provide a complete and clear pictureof the problem being studied. This research is sourced from primary data, secondary data and tertiary data, whilethe population and sample are consumers who buy houses at Perumahan Pesona Harapan Indah and PT.Mandevilla as housing developers.The results of this study indicate, First, the application of the provisions for the acceleration of settlementof The results showed that there are 2 problems that can be concluded. First, the selection of flood-pronelocations and the unavailability of adequate facilities, facilities and infrastructure are factors that determine thatthe Perumahan Pesona Harapan Indah is a product with hidden defects, this results in the loss of security andcomfort for residents of housing in consuming the house as a product, so that PT. Mandevilla is obliged to carryout accountability by providing compensation and/or compensation as stipulated in Article 1365 of the CivilCode and Article 19 of Law No. 8 of 1999 concerning Consumer Protection. Second, PT. Mandevilla has notprovided compensation and/or compensation for the production error of the Perumahan Pesona Harapan Indahas its responsibility as a business actor for causing material and immaterial losses to housing residents. Author'sSuggestion, PT. Mandevilla should provide compensation and/or compensation as a liability for losses that befellthe residents of housing. Second, it is better if a clause for guaranteeing the condition of the house is included inthe sale and purchase agreement so that consumers have a strong basis in demanding accountability.Keywords : Developer – Unlawful Acts – Compensation

Abstract

The Daily laborers that worked at Samhana Indah Ltd, Pekanbaru branch, fromthe first time worked hasn’t the employment contract and this situation very posible tomake the industrial relations disputes. The main problem in this research is how toimplemented the working time for the laborers who work more than 20 days in amonth. This contrary to the article 10 Of Indonesian Government Regulation number25 of 2021 about the temporary contract, outsource, break time and the worktermination. Based on regulation the laborers can not work more than 20 days in amonth and if it still continued in 3 months they should become the parmanent workersby law. Because of the work terminnation, the researcher interested and purpose toget to know the solution of the industrial relations disputes between the two partiesand to get to know what are the obstacles while in the mediation process at the RiauProvince Manpower and Transmigration Office.This research can be classified in juridical research, in another term issociological because the researcher was directly conduct on location in order toprovide a complete and clear picture of this research. This research used thedescriptive qualitative method with primary data sources, secondary sources andtertiary sources while the population and sample are the laboures of Samhana IndahLtd, Pekanbaru branch, Riau Province Manpoer and Transmigration Office andIndonesian Legal Aid Foundation – Pekanbaru Legal Aid Institution (YLBHI-LBHPekanbaru). And the Data collection techniuqes are interviews and literature study.The research result show that the solution of industrial relations disputesbetween Samhana Indah Ltd, Pekanbaru branch and the laborers doe to thetermination of laborers are the first effort was resolve in bipartite manner. Next, bymediation to achieve the win-win solution between Samhana Indah Ltd, Pekanbarubranch and the laborers at the Riau Province Manpower and Transmigration Office,but the mediation process didn’t free from the internal laborers’s obstacles and fromthe external. The obstacles from the internal is the laborers still legally blind, meanslack of understanding of their rights and lack of the coordination. And the otherobstacle is lack of facilities and infrastructure while in the mediation process and theboth parties’s ego that unconciously didn’t want to solve the problems by family way.Keywords: Industrial Relations Dispute Resolution – Daily laborers - Mediation

Abstract

This research relates to legal protection of the rights of indigenouspeoples to environmental management in Sikalang Village, Talawi District,Sawahlunto City. Coal mining activities have an impact on environmental damageto customary law communities. Therefore it is necessary to examine first, legalprotection of the rights of the legal community to environmental management inSikalang Village, secondly the constraints on legal protection of the rights ofindigenous peoples to environmental management in Sikalang Village, thirdlyefforts in legal protection of the rights of indigenous peoples to managementenvironment in Sikalang Village.This research is a sociological legal research, because it is based on fieldresearch, namely by collecting data from observations, interviews, questionnaires,and literature studies that have to do with problems using qualitative dataanalysis, producing descriptive data, and concluded with a deductive thinkingmethod.From the results of the study, it was concluded that, first, the legalprotection of the rights of indigenous peoples to environmental management inSikalang Village, Talawi District, Sawahlunto City has not been maximized asexpected by Law Number 32 of 2009 concerning Environmental Protection andManagement. Second, the obstacle in legal protection of the legal community'srights to environmental management in Sikalang Village, Talawi District,Sawahlunto City is the position of indigenous peoples who are considered to bestill low in obtaining justice. The three efforts to obtain legal protection for thelegal community's rights to environmental management in Sikalang Village,Talawi District, Sawahlunto City continue to be pursued by both theenvironmental service and the local customary law community, especially inpreserving local wisdom.Keywords: Legal Protection – Indigenous Peoples - Environment

Abstract

Land acquisition for development in the public interest is an activity to acquire land, inthe context of fulfilling land needs for development in the public interest, as well as providingcompensation to land owners affected by the activity and releasing legal relations from landowners to other parties, namely the government. The purpose of land acquisition is to provideland for the implementation of development in order to improve the welfare and prosperity ofthe nation, state, and society while still guaranteeing the legal interests of the entitled parties.This research is a type of sociological or empirical research. Empirical legal research islegal research that serves to look at the law in a tangible sense and examine how the law worksin the community. This research was conducted in District IV Jurai. Then the population andsamples are parties related to land acquisition activities, with primary data sources, secondarydata, and tertiary data, as well as data collection techniques used, namely interviews andliterature studies.From the results of this study, it can be concluded that the first is that the implementationof land acquisition for development for the public interest in the perspective of law number 2 of2012 has not been fully implemented properly, then, the two factors inhibiting land acquisitionfor the public interest are people who do not agree with the compensation offered, and the lackof understanding of the community about the importance of development, and the government islacking in socializing to the community. Abstract

Humans as social beings are creatures that are very dependent on oneanother because they are bound by the norms and values that exist in social life. The mainissues in this study are: How is the binding force of the shop rental agreement verballybetween the parties in Benai Village; and how to resolve a dispute over a shop leaseagreement orally between the parties in Benai Village.In the case raised by researchers in the existence of an agreement made inwriting or by carrying out an agreement verbally located in Kuantan Singingi Regency. Asdescribed in the implementation of the verbal agreement, this occurred in the people of BenaiSubdistrict, who could be said to be not backward from the Kuantan Singingi area, but whathappened illustrated the rise of spontaneous community interaction that occurred and wascarried out with awareness.The results of this study are: The strength of binding the rental agreement torent a shop orally in Benai Village, Benai District, Kuantan Regency carries out the leaseagreement verbally (not in writing) and the parties are still bound by mutual trust so that manydisputes arise, so that disputes that occur in Kelurahan This benai. Verbal settlement of leaseagreement disputes in Benai Village is carried out on the basis of the agreement of the partiesthat dispute resolution chosen out of court on the grounds of seeking resolution of the problemby the disputing parties is connected by each representative or relative of both to act as amediator in finding solutions to problems in a deliberation between the two as mediation of theparties with the result of a settlement based only on oral (non-written) testimony betweenrepresentatives of relatives present at the deliberation so that there is still the potential fordisputes to arise from the results of the deliberation.The authors, involved in resolving the dispute over the rental agreement forshophouses in Benai Village will be able to put the results of the deliberations in writing sothat later the settlement involves other authorized parties in supervising or monitoring theresults of deliberations between parties so that it can become a new way of solving problems inBenai Village.Keywords: Disputes-Lease-Oral Agreement.

Abstract

The location of land boundaries can certainly lead to land disputes that arecontrary to regulations. It is clear that the Regulation of the State Minister for AgrarianAffairs/Head of BPN Number 3 of 1997 and the Implementation Provisions for GovernmentRegulation Number 24 of 1997 Concerning Land Registration states that land registration forthe first time, one of which must collect physical data and land juridical data and severalstages that must be carried out, where The collection and processing of land physical data iscarried out by measuring and mapping the determination of boundaries of land parcels by theNational Land Agency, but there are still individuals who collect and process physical dataunilaterally which results in disputes over land boundaries. The purpose of this study was tofind out the resolution of land boundary disputes in making land ownership certificatesthrough mediation at ATR/BPN in West Pasaman Regency. As well as to find out what thereasons for setting land boundaries in making certificates of ownership rights to land cancause disputes in West Pasaman Regency.The research method used in this study is the sociological method. This research wasconducted at ATR/BPN West Pasaman Regency which was the object of this research case.Then the population and sample are several parties related to the problem under study, aswell as data sources used primary data, secondary data and tertiary data. Data collectiontechniques in this study were interviews, observation and literature review.The conclusions obtained from the research results are First, the settlement of land boundarydisputes in making certificates of ownership rights to land is carried out by mediation 3(three) times carried out by the West Pasaman Regency Land Office as a mediator. Second,the factor causing land disputes in West Pasaman Regency, namely: (a) conflict of interest;(b) structural conflict; (c) value conflict; (d) relationship conflict; and (e) data conflict. Thesuggestions in this writing are First, the applicant for the certificate should be more thoroughand examine the truth about the location of the northern boundary of the land so that landdisputes do not occur with neighbors or residents who are next to our land. Abstract

Infrastructure development in this case the highway itself is still very much needed asa means of supporting land transportation to help the economy in the community. Theincreasing volume of commercial land transportation vehicles (motorbikes, cars), publictransportation (buses, minibuses) and freight transportation (trucks) certainly requires alot of land / land so that there is no overcrowding of vehicles, especially during peak hoursthat occur sustainably. In carrying out this infrastructure development, parties who needland can use the other party's land rights by seeking approval from the land rights holder.Parties who need land can be pursued through the transfer of rights in the form of buyingand selling, or the release of land rights by the holder by providing compensation by theparties who need the land to the holder of the land rights. To anticipate land disputes andconflicts that will occur, legal tools and a neat and orderly land administration system areneeded, so as to guarantee and be able to provide legal protection to land rights ownersand can regulate the ownership, transfer and allotment of land in a fair andcomprehensive manner.Research using a type of Empirical Juridical research or Legal Sociology research isan approach used to see something legal reality in society. The Sociology of Law approachis an approach used to look at legal aspects in social interaction in society and serves as asupport for identifying and clarifying findings of non-legal materials for the purposes oflegal research or writing.From the results of the first study, the implementation of the provision ofcompensation to land rights holders based on convoluted Consignment Decisions cannotbe proven due to misunderstandings starting from the preparation stage, implementation,to submission of results and the implementation of the compensation process has beencarried out in accordance with laws and regulations. The lack of public understanding andthe laws governing the reference point of land assessment make this compensation processtime-consuming and do not show transparency of justice in question. Secondly, Theimplementation of compensation is hampered because there are parties who refuse theamount of compensation offered by the land acquisition implementation team with theresults of calculations from an independent. Abstract

AbstractThe purpose of this study was to find out the efforts made by the Government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people and the obstacles faced by the government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people. One of the local wisdoms in Riau Province is the local wisdom of the indigenous people of Petalangan in Pelalawan Regency which has been passed down from generation to generation, such as traditional Belian medicine, zapin dance, oral literature of the Petalang people, manumbai sialang and potang mogang. For this reason, local wisdom needs to get legal protection. This type of research is empirical research. Based on the results of the research, the efforts made by the government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people are by making a Regional Regulation on indigenous peoples institutions, regularly holding local wisdom activities every year, and introducing local wisdom in Pelalawan Regency through domestic and regional events. abroad. The obstacle faced by the government of Pelalawan Regency in maintaining the local wisdom of the indigenous people of Petalangan is the erosion of local wisdom along with the development of technology which is followed by an increase in the process of adopting innovation and the diffusion of technology adoption. There is no local regulation that specifically provides protection for local wisdom in Pelalawan Regency, eliminated by style. a consumptive materialistic-hedonic life pursuing worldly pleasures, as well as the lack of funds from the Pelalawan Regency APBD in introducing local wisdom in Pelalawan Regency. AbstrakTujuan penelitian ini adalah untuk mengetahui upaya yang dilakukan oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan dan kendala yang dihadapi oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan. Salah satu kearifan lokal di Provinsi Riau adalah kearifan lokal masyarakat adat Petalangan di Kabupaten Pelalawan yang diwariskan secara turun-temurun, seperti pengobatan tradisional Belian, tari zapin, sastra lisan orang petalangan, manumbai sialang dan potang mogang. Untuk itu, kearifan lokal tersebut perlu mendapatkan perlindungan hukum. Jenis penelitian ini adalah penelitian empiris. Berdasarkan hasil penelitian, upaya yang dilakukan oleh Pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan adalah dengan membuat Peraturan Daerah (Perda) tentang kelembagaan masyarakat adat. Secara rutin setiap tahun mengadakan kegiatan kearifan lokal, serta mengenalkan kearifan lokal yang ada di Kabupaten Pelalawan melalui kegiatan dalam negeri maupun di luar negeri. Kendala yang dihadapi oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan adalah terkikisnya kearifan lokal seiring berkembangnya teknologi yang diikuti sehingga meningkatnya proses adopsi inovasi serta difusi adopsi teknologi, belum ada perda yang secara khusus memberikan perlindungan terhadap kearifan lokal di Kabupaten Pelalawan, tereliminasi oleh gaya hidup matrealistis-hedonis yang konsumtif mengejar kesenangan duniawi semata, serta kurangnya dana APBD Kabupaten Pelalawan dalam mengenalkan kearifan lokal yang ada di Kabupaten Pelalawan.

Abstract

Being in the correctional system, convicts have obligations that they must carry outand rights that must be fulfilled by the state. These rights and obligations are outlined in LawNumber 12 of 1995 concerning Corrections and Menkum HAM Regulation Number 6 of 2013concerning Rules of Correctional Institutions and State Detention Centers. This researchexamines the rights of an inmate as a worker in the Pekanbaru Class II A CorrectionalInstitution and the fulfillment of the rights of an inmate as a worker in the Pekanbaru Class IIA Correctional Institution.This type of research can be classified as sociological, because in this study theauthor directly conducts research at the location or place under study in order to provide acomplete and clear picture of the problem under study. This research was conducted at thePekanbaru Class II A Penitentiary, while the population and sample were all parties relatedto the problems studied in this study, the data sources used were primary data, secondarydata, and tertiary data, data collection techniques in this study were observation, interview,questionnaire, and literature study.From the results of the study, it can be concluded that the rights of convicts asworkers in Class II A Penitentiary in Pekanbaru have not been carried out optimally, one ofwhich is the absence of guarantees for work safety, because the work provided does not havea high risk and the tools used in work are safe . Nevertheless, convicts should have the rightto work safety guarantees. Second, convicts who take part in the apprenticeship do not get apremium. Even so, some of the rights of convicts as workers have been implemented.Furthermore, convicts working at the Pekanbaru Class II A Penitentiary already know whattheir rights are, so this is also one of the transparent information for convicts about the rightsthey should receive. Second, the suggestion according to the author is that the governmentshould stipulate regulations or laws that regulate in detail the large percentage of wages thatconvicts are entitled to receive as well as adding more tutors/guidance trainers so that theycan match the number of convicts attending training..Keywords: Rights, Prisoners, Workers

Abstract

Law 8 of 1999 on Consumer Protection has guaranteed legal certainty toprotect consumers. This research is related to legal protection for consumersagainst drinking water depots in Pekanbaru City. The development of drinkingwater depots has an impact on consumer concerns. Therefore, it is necessary tostudy first, legal protection for consumers of drinking water depots in PekanbaruCity, second, factors inhibiting legal protection for consumers of drinking waterdepots in Pekanbaru City.This research is sociological legal research, because it is based on fieldresearch by collecting data from interviews, questionnaires and literature studiesthat have a relationship with problems that use qualitative data analysis so as toproduce descriptive data and are concluded with deductive thinking methods.From the results of the study, it was concluded that, first, legal protectionfor consumers of drinking water depots in Pekanbaru city has not been maximizedas expected by the Consumer Protection Law Number 8 of 1999.
