Abstract

Introduction: A corporation with strong capital support from its company, with its core business seeking as much profit as possible, is very vulnerable to carrying out activities that violate the law even though economically or financially these activities are correct.Purposes of the Research: The purpose is to find a wedge, where the location of economic activities that violate the law is interpreted as violating the law, because economic or financial crimes are closely related to legal reasoning. Methods of the Research: The type of research is normative juridical with analysis using legal documents in the form of primary legal materials, secondary legal materials, and tertiary legal materials. Results of the Research: The analysis show that the business expansion activities carried out by PT Jiwasraya are business activities that are justified by the economy or finance. However, because one of these activities involves state finances, it fulfills one of the elements of a criminal act of corruption. Activities that are justified in business are still getting attention by law because the nature of the crime is corporate crime, namely corporate crime which is carried out solely for the benefit of the corporation. Corporate crime will have the power to suppress society, so that the culture of the community will in some ways change and will indirectly threaten the concept of the rule of law in Indonesia.

Abstract

An authentic deed made by a notary has certain requirements that need to be fulfilled. The making of a notarial deed refers to Law Number 30 of 2004 as amended by Law Number 2 of 2014 concerning the Notary Occupation (UUJN). One of the requirements that shall be fulfilled in order that an authentic deed drawn up by a notary has perfect evidentiary power is the affixing of a signature by the appearer, this has also been regulated in Article 44 UUJN. Not affixing a signature can reduce the evidentiary power of the deed. The notary also has the responsibility of conducting the precautionary principle when assisting appearer without fingerprints in giving valid legal approval in addition to affixing signatures and fingerprints. According to interviews and legal data analyzed by the author, the affixing of the signature and fingerprint stamp can be replaced by surrogate. Surrogate is a sentence written at the end of the deed to clearly explain the reasons for not being able to affix a signature. This is also in line with Article 44 paragraph (2) UUJN. The notary also has the responsibility to apply the precautionary principle in making the surrogacy/surrogate by using clear sentence formulations and supported by a doctor's certificate from the appearer which strengthens the reasons for using the surrogate.

Abstract

Abstract  The State Civil Apparatus (ASN) is a profession in government agencies responsible for providing public services based on good governance principles. However, the actual delivery of these services may not always meet public expectations. Maladministration, including negligence, abuse of authority, and neglect of legal obligations, can create opportunities for criminal acts, such as forgery of letters. This research focuses on the correlation between ASN negligence and the crime of letter forgery in the issuance of certificates of ownership. Through a qualitative approach and case study, the study reveals that deviations from the principles of good governance by ASN could be contributing factors to document forgery. Document forgery reflects the elements of an unlawful act and malicious intent. Despite the availability of legal measures in Indonesia, weak supervision and integrity of human resources hinder prevention and prosecution. The study also examines criminal law in India and the Netherlands to assess the Indonesian legal system. Keywords: Maladministration, Forgery, Comparative Criminal Law

Abstract

The nursing education process was implemented through clinical practice in hospitals. However, the heavy workload of nurses and clinical instructors often hindered the optimal provision of guidance to students. Therefore, efforts were necessary to enhance the competencies of nursing educators and clinical instructors. The development of these competencies required support from both formal and non-formal education. One form of non-formal education was the implementation of preceptorship and mentorship training programs. These programs were expected to strengthen the quality of student guidance in clinical settings. The methods employed included lectures, role-playing, and hands-on application in inpatient care units. The training outcomes indicated a significant improvement in the clinical instructors’ ability to effectively carry out preceptorship and mentorship roles.

Abstract

Salak seeds are an agricultural waste that has the potential to be converted into magnetic activated carbon (MAC). The resulting MAC can be utilized for wastewater treatment, particularly in the adsorption of heavy metals. This study develops a method for producing MAC by forming activated carbon using a chemical activator without physical activation, chosen to reduce energy consumption. The activated carbon is then modified with Fe3O4 composite to render it magnetic and reusable. The objectives of this study are to 1) determine the optimal chemical activator concentration, 2) characterize magnetic activated carbon, 3) evaluate the adsorption capacity of MAC for Cd(II) in wastewater, 4) obtain an adsorption isotherm model of MAC for Cd(II) using the Langmuir and Freundlich models, and 5) analyze the surface morphology and elemental composition of MAC. Chemical activation was performed using an HCl-H3PO4 mixture with equal concentrations in a 1:1 volume ratio, with variable concentrations of 0.55, 1.05, 1.55, 2.05, and 2.55 M. MAC's characteristics and adsorption capacity were analyzed using proximate analysis, BET, SEM-EDX, and AAS. The results showed that: 1) the optimal HCl-H3PO4 concentration was 2.05 M, 2) MAC contained 1% moisture, 21.88% volatile matter, 38% ash, 39.13% fixed carbon, iodine number of 1218.24 mg/g, surface area of 175.604 m2/g, and an average pore volume of 26.8093 cc/g, 3) MAC adsorbed Cd(II) from wastewater with an efficiency of 80.12 – 87.75%, 4) the Langmuir isotherm model yielded R2 = 0.9847, qm = 35.0877 mg/g, and b = 0.0285 L/mg, whereas the Freundlich model yielded R2 = 0.9729, n = 1.5881, and kf = 7.6701 mg/g, and 5) MAC exhibited evenly distributed pores and contained dominant elements Fe (30.26%), C (29.08%), O (24.59%), Na (11.27%), with traces of Mg, Al, Mo, and Cl.

Abstract

Amandement to the Law on money laundry was based on weakness of law enforcement effectiveness resulting from the unsinergitas  (disharmony)  between  the  law  enforcement agencies.  Does  not  given  the  authority  to  the  conduct investigations  and  inquiries  to  INTRAC,  do  not  reduces  the central role as the leader of INTRAC agent in the eradication of money laundry. Additional powers to the INTRAC as authority 'more' is the INTRAC can request information on the progress of  investigation  and  the  inquiries  by  criminal  investigators  of origin and / or money laundering. The more authority is run for the benefit of: Handling money laundering effective; Preparation typology  and  strategic  analysis  on  money  laundering  and predicate  offenses;  preparation  of  consolidated  progress  in implementing  anti-money  laundering  regime  in  the  context  of accountability, and/or the preparation of a report for a meeting National  Coordinating  Committee  for  the  Prevention  and Suppression  of  Money  Laundering.  The  realization  of  the implementation these activities, INTRAC can be assistance and request  for  discussion  or  presentation,  and  a  criminal investigation of origin and/or money laundering shall fulfill the information  request.  Thus,  there  is  a  relationship  that  is normative complementarity between investigators with INTRAC within  the framework  of  the  creation  of  a  harmonized enforcement of money laundering.

Abstract

Renewal of the Wetboek van Koophandel (KUHD) is a Dutch colonial products a lot of problems. Although it has been stated in the National Legislation Program (Prolegnas) 2009 - 2014, but the number of regulations that have been removed from the KUHD, make arrangements of commercial law substance of overlapping, contradictory and there’s a double substance. Therefore, to use renewal by the compilation method will be very ineffective, because when done harmonization, the many provisions that will be removed for united. When using the compilation method,  will be in trouble to do the grouping of the material. Other methods are consolidated with Civil Code (KUHPerdata) Book III, to unify the principles and legal principles of legal trade into the agreements of law.
