Abstract

Amil zakah (zakah manager/distributor) is one of supporting pillars to the success of zakah management. From juridical view, it is related to Islamic law, but politically it is close to the state policy especially the zakah management policy. The involvement of the state in zakah management depends on the fundamental issue that makes zakah as part of qad}a>’i> and diya>ni> law. Islamic law that has diya>ni> attribute is very dependent on the religious awareness of Islamic society itself. While the qad}a>’i> law involves certain institutions that have legal power to impose and ensure the enforcement of Islamic law in the society. Therefore, zakah managers require strong authority, because they will deal with the community with various level of faith. It is concluded that the success of zakah management should be supported by three aspects, namely substance, structural, and legal awareness.

Abstract

This article examines the dynamics of family law in the Islamic Republic of Iran where there are upheavals and struggles between the secular elites and ulama from 1927 to the present day. This study applied a library research by digging up information related to the theme of the study. The results of this study indicate that the Islamic Republic of Iran is dominantly Shia Imamiyyah (Jafari) but it also accommodates the Hanafi (Sunni) School in the field of marriage law. Iranian family law has gone through many changes. Since 1928 the issue of divorce and marriage which was originally regulated in Irans Qanun Madani came into force in 1930, the Marriage Law was then enacted in 1931. After three decades, in 1967 there was a reformation, the Marriage Law was replaced by the Family Protection act, then it was replaced with the Protection of Family in 1975. These laws are a combination of Islamic Law and French civil Jurisprudence, though they seem more secular. However, since the Iranian Revolution in 1979, these laws have been abolished and all laws in Iran have been returned to sharia law. As a result, the laws become repressive against women, except in the field of inheritance which provides gender equality. While there have been many highly educated women in Iran, since 2006 many women have filed for divorce. On the other hand, the practice of mutah marriage has begun to be abandoned and polygamy is opposed by the community.

Abstract

Based on category, this program leads to three social issues. First, public awareness about the significance of the view of life that is more tolerant, open and more pluralis amid development of industrialization. Industrialization that developed in centers of growth (growth poles), which prominently still holdsrural-agrarian values, has given rise to what is called the proletarian farmers. "Proletarisation" was preceded by transition process of the function of farmland into industrial land, thus causing economic activity became more intense and integrated into industrial capitalism. This leads to the occurrence of an identity crisis that led to theopposition attitude in most communities, especially those who associated with the existence of other religions. Second, these changes have an impact on the emergence of community with radical attitude by carrying the religious themes. The construction of houses of worship, which is actually the "House of God" for any religions, considering the dangers may threaten the existence of the community and other faiths. The value system was formed, as a society oppressed became one of the motivators and catalysts for the inception of religious radicalism at the low level community. Third, the Government's policy regarding the construction of a harmony is among believers. This last part is related to the concept of good governance. As an institutional approach, the concept of good governance (good governance) is defined as the interaction between the organizers of the State (Government) and groups in the community. According to the World Bank, there are at least four important dimensions of good governance, i.e. example, effective legal framework, information that is in line with the transparency (accountability or Government) and the availability of well-educated workforce. In this context, the position of District Government of Bekasi becomes one of the institutions, which is responsible for the running of the relationship between the Government, employers or investors, religious figures, and the public as the three interest groups that cannot be separated in developing awareness of pluralism in religious life in the community.

Abstract

Abstract: The goal of matrimony is the establishment of a lasting and harmonious family according to both legal and religious norms. On the other hand, if there are factors that can disrupt this union, then the marriage can be annulled according to the law. In essence, by nature, Allah SWT has created humans in pairs, between men and women, to build a family and procreate offspring. However, in some cases, there are individuals who contravene His rules by engaging in same-sex attraction, commonly referred to as LGBT (lesbian, gay, bisexual, and transgender). The following will further discuss LGBT as grounds for annulment of marriage according to both the Law and the Compilation of Islamic Law (KHI).

Abstract

Family case settlement in the religious court often does not run effectively and efficiently due to some judicial constraints in the level of absolute competence, event law, and material law. This paper seeks to describe some notes related to divorce settlement due to the domestic violence in the religious court. The data was collected through the observation of the trial and the reading of the verdicts on several divorce cases of domestic violence in metro religious court in 2016-2018. The findings suggest that justice for women could only be gained at a formal legal level, while the desired substantive justice has not yet been achieved. The constraints occur in such stages as submission, case handling, and the verdict. The gender perspective of justice case handling and the judges’ courage of the religious court to deliver ultra petitum verdicts are a legal breakthrough in order to realize substantive justice in resolving family conflicts. Abstract

This journal aims to investigate the dynamics of dispute resolution in the realm of Islamic family law based on legislation in Indonesia as well as its comparison in the legal system in Thailand, focusing on the comparison between the two countries in revealing the differences in the legal frameworks used, practices and procedures for dispute resolution, as well as what are the real challenges in their implementation, then looking at which points are the similarities as well as the differences between these two Asian countries. The research utilizes qualitative analysis with a normative or doctrinal examination of legal norms, with the provisional hypothesis highlighting that Indonesia has a systematic and nationally applicable Islamic family law system, while Thailand only implements Islamic family law in four specific southern provinces. The findings also indicate that despite efforts to expand out-of-court enforcement of Islamic family law, challenges such as lack of clarity in the law and uncertainty of enforcement remain obstacles. Thus, this study suggests the need to improve the Islamic justice system to ensure the resolution of Islamic family disputesKeywords : Dipute Resolution, Indonesia, Islamic, Thailand. ABSTRAKJurnal ini hendak menginvestigasi dinamika penyelesaian sengketa dalam ranah hukum keluarga Islam berdasarkan perundang-undangan di Indonesia juga komprasinya dalam sistem hukum di Thailand, dengan fokus pada perbandingan antara kedua negara dalam mengungkap perbedaan kerangka hukum yang digunakan, praktik dan prosedur penyelesaian sengketa, serta apa yang menjadi realitas tantangan dalam implementasinya, selanjutnya melihat titik mana yang menjadi persamaan juga pembeda dua negara Asia ini. Penelitian menggunakan analisis kualitatif dengan pendalaman norma hukum (normatif atau doctrinal), dengan hipotesa sementara menyoroti bahwa Indonesia memiliki sistem hukum keluarga Islam yang sistematis dan berlaku secara nasional, sedangkan Thailand hanya menerapkan undang-undang keluarga Islam di empat provinsi selatan tertentu. Temuan juga mengindikasikan bahwa meskipun terdapat upaya untuk memperluas penegakan hukum keluarga Islam di luar pengadilan, tantangan seperti kurangnya klaritas dalam undang-undang dan ketidakpastian penegakan hukum tetap menjadi hambatan. Demikian penelitian ini menyarankan perlunya  peningkatan sistem peradilan Islam guna memastikan penyelesaian sengketa keluarga Islam.Kata Kunci: Indonesia, Islam, Penyelesaian Sengketa, Thailand.

Abstract

Sebagai salah satu pelaksana Kekuasaan Kehakiman, keberadaan Badan Peradilan Agama mengalami perubahan, baik dari sisi peraturan perundang-undangan maupun dari sisi implementasinya dalam menegakan hukum dan keadilan. Ia berdampak berdampak signifikan terhadap substansi, struktur, dan kultur hukum di lingkungan Peradilan Agama, terutama setelah diundangkannya UU No.50 Tahun 2009. Diantara faktor perubahannya adalah sistem politik yang berkembang pada saat itu dan berdampak pada sistem hukum Indonesia. Dalam konteks sistem hukum, undang-undang tersebut dituntut untuk serasi dengan peraturan perundang-undangan baik yang sejajar maupun yang lebih tinggi. Abstract

Law enforcement of child support obligations of fathers as Civil Servants (PNS) after divorce often encounters obstacles, such as non-compliance in implementing Religious Court rulings. This study focuses on the Bengkulu High Religious Court (Pengadilan Tinggi Agama, PTA), which has implemented an execution system to ensure the financial rights of women and children after divorce.The primary objective of this research is to analyze the factors contributing to non-compliance among fathers with civil servant status, assess the implementation process of court decisions, evaluate the execution model employed by the PTA of Bengkulu, and explore avenues for its improvement. The study is grounded in the theories of the supremacy of law, law enforcement, and legal execution, employing a normative-empirical approach with descriptive methods. Data collection techniques included observation, interviews, and document analysis. The findings reveal that several factors, including economic constraints and limited legal awareness, contribute to the non-compliance of civil servant fathers in fulfilling child support obligations. The execution process is largely similar to the procedures for enforcing monetary payments. The PTA of Bengkulu has innovatively introduced the E-Mosi Caper application to monitor compliance and track the implementation of child support orders. To enhance the effectiveness of this execution model, the study proposes regulatory harmonization, the establishment of a dedicated implementation team, and heightened public awareness campaigns. These measures aim to support the development of a more robust and efficient system for ensuring compliance with child support obligations, ultimately advancing the protection of women’s and children’s financial rights after divorce. Penegakan hukum terhadap kewajiban nafkah anak oleh ayah berstatus Pegawai Negeri Sipil (PNS) pasca perceraian sering kali menghadapi kendala, seperti ketidakpatuhan dalam melaksanakan putusan Pengadilan Agama. Penelitian ini berfokus pada Pengadilan Tinggi Agama (PTA) Bengkulu, yang telah menerapkan sistem eksekusi untuk menjamin hak-hak finansial perempuan dan anak setelah perceraian. Tujuan utama dari penelitian ini adalah menganalisis faktor-faktor yang menyebabkan ketidakpatuhan ayah berstatus PNS, menilai proses pelaksanaan putusan pengadilan, mengevaluasi model eksekusi yang diterapkan oleh PTA Bengkulu, serta mengeksplorasi cara-cara untuk meningkatkan efektivitas sistem tersebut. Penelitian ini didasarkan pada teori supremasi hukum, penegakan hukum, dan eksekusi hukum, dengan pendekatan normatif-empiris menggunakan metode deskriptif. Teknik pengumpulan data meliputi observasi, wawancara, dan analisis dokumen. Hasil penelitian menunjukkan bahwa beberapa faktor, seperti keterbatasan ekonomi dan rendahnya kesadaran hukum, berkontribusi pada ketidakpatuhan ayah PNS dalam memenuhi kewajiban nafkah anak. Proses eksekusi menyerupai pelaksanaan pembayaran uang. PTA Bengkulu memanfaatkan aplikasi E-Mosi Caper untuk memantau kepatuhan dan melacak pelaksanaan perintah nafkah anak. Untuk meningkatkan efektivitas model eksekusi ini, penelitian ini mengusulkan harmonisasi regulasi, pembentukan tim pelaksana khusus, dan kampanye peningkatan kesadaran publik. Langkah-langkah ini bertujuan untuk mendukung pengembangan sistem yang lebih kuat dan efisien dalam menjamin kepatuhan terhadap kewajiban nafkah anak, sehingga pada akhirnya memperkuat perlindungan hak-hak finansial perempuan dan anak setelah perceraian.

Abstract

This study explores the philosophy of wasiat wajibah (obligatory bequest) within the Islamic inheritance law system in Indonesia, by examining its philosophical, normative, and practical foundations in the context of national law. Wasiat wajibah is a legal institution that grants a mandatory inheritance share to heirs who are otherwise excluded from inheritance rights, such as grandchildren whose parent (the child of the deceased) has passed away before the testator. The purpose of this study is to examine the philosophical foundations of wasiat wajibah, its relevance to the Islamic principle of justice, and its integration into Indonesia's positive legal system. This research adopts a qualitative approach with a normative-philosophical method. Data were collected through literature review of both primary and secondary sources, including classical Islamic jurisprudence texts, Indonesian legal regulations (such as the Compilation of Islamic Law), and philosophical writings on Islamic legal thought. The data were analyzed interpretively and reflectively through textual and conceptual analysis. The findings indicate that wasiat wajibah is grounded in strong philosophical principles of justice, compassion, and protection of vulnerable groups. In the Indonesian context, this concept has been incorporated into the Compilation of Islamic Law, particularly in Article 209, as a form of legal adaptation to the complex and plural realities of modern society. However, its implementation still faces challenges due to differing scholarly opinions among Islamic schools of thought and limited awareness among legal practitioners. In conclusion, wasiat wajibah serves as a bridge between Islamic moral values and a responsive positive legal system. A philosophical approach to wasiat wajibah reinforces the urgency of reconstructing the Islamic inheritance system in Indonesia to be more just, adaptive, and contextually relevant.
