Abstract

Guardianship in marriage law has an important position as one of the conditions for the validity of marriage in the perspective of Islamic law and also received recognition in the Indonesian national legal system. However, the application of guardianship principles in the context of positive law often raises debates, especially regarding the authority of the guardian, the position of women, and the limits of state intervention. This study aims to examine the principles of guardianship in the Indonesian marriage law system and its relevance to the values of justice and legal protection. This research uses a normative juridical approach with a literature study method. Sources of data are obtained from legislation, legal doctrine, and relevant court decisions. The analysis is done descriptively-qualitatively by tracing the concepts of guardianship in Islamic law, the Compilation of Islamic Law (KHI), and Law Number 1 Year 1974 on Marriage. The results show that the principle of guardianship in the Indonesian marriage legal system is based on the strong influence of Islamic law, especially in KHI. The marriage guardian is considered as a representation of honor and protection of women. However, there is also ambiguity in guardianship arrangements between the national legal system and social religious practices, which can lead to legal uncertainty. There is a need for harmonization between religious principles and human rights principles in marriage law, especially regarding women's autonomy in choosing a life partner. Revisions to regulations relating to guardianship are also needed to emphasize the position of women as independent and protected legal subjects.

Abstract

This study tries to explain the efforts to retrace the position of Islamic science in the formulation of laws and regulations in Indonesia. As part of the implementation of Islamic law and the national legal sub-system, the position of sharia is particularly  strategic and significant. The existence and position of sharia science lie not only in theoretical development through academic studies but also in practical terms which can provide its own colour in the formulation of laws and regulations in Indonesia. The implementation of sharia in life is not only an individual normative obligation, but also a collective responsibility that involves academics, legal practitioners, and the government. The position of sharia in forming laws and regulations theoretically and practically can be seen from three aspects, including substance, structure, and culture.   Penelitian ini mencoba menjelaskan tentang upaya pelacakan kembali posisi ilmu syariah dalam pembentukan peraturan perundangan-undangan di Indonesia. Sebagai bagian dari implementasi hukum Islam dan sub-sistem hukum nasional, posisi ilmu syari’ah sangat strategis dan signifikan. Keberadaan dan posisi ilmu syariah bukan hanya terletak pada pengembangan teoritis melalui kajian akademik, tetapi juga secara praktis dapat memberikan warna tersendiri dalam pembentukan peraturan perundangan-undangan di Indonesia.  Implementasi ilmu syariah dalam kehidupan, bukan hanya kewajiban individual yang bersifat normative saja, tetapi juga menjadi kewajiban kolektif yang melibatkan akademisi, praktisi hukum, maupun pemerintah. Dengan menggunakan metode deskiptif tekstual-interpretatif, penelitian ini menunjukkan bahwa secara teoritis dan praktis, posisi ilmu syariah dalam pembentukan peraturan perundang-undangan dapat dilihat dari tiga aspek, antara lain: substansi, struktur, dan kultur

Abstract

Sexual violence crime (TPKS) is a crucial issue in Indonesia, which received a significant response through the enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS). This research aims to critically and deeply compare the concept of TPKS in Indonesian Positive Law (UU TPKS) and Islamic Law (Fiqh Jinayah), reinforced by the foundation of Islamic Social History. Positive Law, through the UU TPKS, adopts a progressive and victim-centered framework, expanding the definition of offense to include non-physical harassment and sexual exploitation, and emphasizing the principle of lack of consent. This Law guarantees the rights to recovery, restitution, and assistance, although its implementation still faces structural and cultural obstacles, including the risk of secondary victimization and issues in proof. Meanwhile, Fiqh Jinayah classifies sexual violence into several categories: Jarimah Hudud (such as zina or fornication, though the victim of rape is exempted from the hadd punishment due to coercion), Ightishab (rape) which can be equated with Hirabah (brigandage), and Jarimah Ta’zir (for broader offenses). Although the standard of proof for zina in classical view is very strict (four witnesses), modern scholars tend to accept non-traditional evidence for ightishab (such as medical examination/visum and victim's testimony) to impose a firm ta’zir punishment. The analysis of Islamic Social History affirms that Islamic legal norms regarding sexual protection are dynamic, stemming from efforts to eliminate pre-Islamic patriarchal practices, and are oriented towards the protection of honor (hifz al-‘ird). The harmonization of these two systems is possible through the integration of the principle of Maqashid Syariah (the objectives of Sharia), which provides theological legitimacy for the contemporary efforts to combat TPKS. By optimizing the flexible Ta’zir punishment, Islamic Law can accommodate a more adaptive model of proof and victim recovery, aligned with the spirit of contemporary restorative justice.

Abstract

Purpose  –  This research aims to analyze the position and function of al-‘urf and al-‘ādah al-muḥakkamah as a methodology for Islamic legal istinbāṭ, particularly in the context of the development of Sharia Economic Law that is responsive to contemporary social dynamics and economic practices. This research begins with the epistemological question of the extent to which social customs can obtain sharia legitimacy in establishing modern muamalah law. Method –  The method used is qualitative research through library research with normative-juridical, philosophical, and comparative approaches to Islamic schools. Data are analyzed thematically against classical and contemporary sources of ushul fiqh, as well as Sharia economic law literature, to map the position of al-‘urf within the framework of the ijtihad methodology. Result – The results show that authentic al-‘urf has legal legitimacy if it meets the criteria of conformity with the maqāṣid al-syarīah, does not conflict with the qath’i texts, and is generally applicable and consistent in muamalah practices. A comparative study of Islamic schools of thought reveals that despite differences in the intensity of its acceptance, all Islamic schools of thought recognize al-‘urf as a valid instrument of ijtihad. In the realm of Islamic Economic Law, al-‘urf and al-‘ādah al-muḥakkamah have proven to play a strategic role in responding to contract practices, market customs, and modern transaction innovations. Implication – The implications of this research emphasize the importance of strengthening al-‘urf  as a methodology for legal istinbāṭ, not merely as a supplementary argument, to ensure that Islamic economic law remains adaptive, contextual, and oriented toward the welfare of the people.

Abstract

The growing number of petitions for marriage annulment and divorce raises a complex legal challenge, as each is grounded in different legal purposes and carries distinct implications. This issue has emerged in several cases before the Religious Courts within the DKI Jakarta High Religious Court jurisdiction, notably Case Number 3000/Pdt.G/2023/PA.JS, where both claims were filed simultaneously. This study aims to analyze the legal construction and judicial reasoning of judges in deciding cumulative applications for annulment of marriage and divorce lawsuits in the Religious Court within the jurisdiction of the DKI Jakarta High Religious Court. This study adopts a descriptive–analytical socio-legal method, drawing on legal construction theory, judicial reasoning, law enforcement principles, and the doctrine of maslahah mursalah to critically analyze judges’ legal reasoning and judicial outcomes. Data were analyzed through normative legal analysis supported by case law. The findings reveal that the legal construction applied by judges in handling the accumulation of annulment and divorce claims prioritizes justice, legal certainty, and human rights protection by harmonizing procedural law with substantive Islamic legal principles. The novelty of this research lies in formulating a coherent legal solution that legitimizes the selective acceptance of claims, enabling courts to resolve procedural conflicts while safeguarding the legal status and post-divorce rights of wives and children. This approach offers a workable judicial framework for adjudicating comparable cases within the Religious Courts.

Abstract

Konsep pembelaan diri (self-defense) merupakan bagian fundamental dalam hukum pidana Islam yang berakar pada perlindungan hak hidup (ḥaqq al-ḥayāh) dan tujuan syariat untuk menjaga jiwa (ḥifẓ al-nafs) sebagaimana dirumuskan dalam Maqāṣid al-Syarī‘ah. Latar belakang penelitian ini berangkat dari minimnya kajian komprehensif yang menempatkan pembelaan diri tidak hanya sebagai alasan pemaaf pidana, tetapi sebagai konsep normatif yang memiliki dimensi teologis, historis, dan filosofis dalam hukum Islam. Penelitian ini bertujuan mengkaji sejarah sosial dan landasan normatif konsep pembelaan diri dalam hukum pidana Islam, dengan menelusuri perkembangannya sejak masa Nabi Muhammad SAW hingga era kodifikasi hukum Ottoman melalui Mecelle. Metodologi yang digunakan adalah penelitian kualitatif dengan pendekatan sejarah sosial dan analisis normatif terhadap sumber primer berupa al-Qur’an, hadis, serta literatur fiqh jināyah klasik, dan sumber sekunder berupa kajian hukum positif serta pemikiran hukum Islam kontemporer. Hasil dan pembahasan menunjukkan bahwa konsep pembelaan diri dalam Islam berlandaskan prinsip keadilan, proporsionalitas, dan pencegahan, sebagaimana tercermin dalam QS. al-Baqarah [2]: 190–193, al-Ḥajj [22]: 39–40, dan al-Anfāl [8]: 60, yang menegaskan karakter defensif dan preventif dalam menjaga keselamatan jiwa. Secara historis, konsep ini mengalami perkembangan dari legitimasi tindakan individual menjadi tanggung jawab negara dalam menjamin keamanan publik. Kebaruan penelitian ini terletak pada analisis integratif antara dimensi teologis, historis, dan filosofis pembelaan diri melalui perspektif maqāṣid al-syarī‘ah. Kontribusi penelitian ini diharapkan memperkaya diskursus hukum pidana Islam serta memberikan kerangka konseptual bagi pengembangan doktrin pembelaan diri yang relevan dengan konteks hukum modern.

Abstract

Penemuan hukum Islam pada konteks kontemporer menuntut kerangka metodologis yang mampu menjembatani nilai normatif syariah dengan dinamika sosial yang terus berubah. Kondisi tersebut mendorong perlunya pendekatan epistemologis yang tidak hanya tekstual, tetapi juga berorientasi pada tujuan hukum. Penelitian ini bertujuan menganalisis maqāṣid al-syarī‘ah sebagai fondasi istinbāṭ hukum modern dengan menitikberatkan pada fungsi tipologi maslahah dalam proses perumusan hukum. Penelitian menggunakan metode hukum normatif melalui pendekatan konseptual dan analisis kualitatif terhadap literatur klasik dan kontemporer dalam bidang usul fiqh, dengan teknik pengumpulan data berupa studi kepustakaan dan analisis isi. Hasil kajian menunjukkan bahwa maslahah mu‘tabarah berfungsi sebagai dasar legitimasi normatif karena memiliki dukungan nash atau ijma‘, sementara maslahah mulghah berperan sebagai instrumen pembatas agar pertimbangan kemaslahatan tidak menyimpang dari prinsip syariah. Maslahah mursalah memberikan ruang adaptif bagi penetapan hukum terhadap persoalan baru yang belum diatur secara eksplisit, selama sejalan dengan maqāṣid al-syarī‘ah. Integrasi ketiga tipologi tersebut membentuk pola penalaran hukum yang sistematis, proporsional, dan kontekstual. Penelitian ini menyimpulkan bahwa pendekatan maqāṣid berbasis maslahah memperkuat metodologi usul fiqh modern serta relevan bagi praktik istinbāṭ pada lembaga fatwa dalam merespons tantangan hukum kontemporer.

Abstract

Perkembangan pesat industri keuangan syariah di Indonesia melahirkan beragam produk dan transaksi ekonomi kontemporer yang memerlukan kepastian serta legitimasi hukum syariah yang kuat. Kondisi ini mendorong perlunya pengkajian terhadap metode ijtihad yang digunakan dalam merespons dinamika hukum ekonomi syariah. Penelitian ini bertujuan menganalisis implementasi qiyas sebagai metode penemuan hukum dalam pengembangan hukum ekonomi syariah di Indonesia. Penelitian menggunakan pendekatan kualitatif dengan metode hukum normatif melalui studi kepustakaan dan analisis konten terhadap fatwa-fatwa Dewan Syariah Nasional–Majelis Ulama Indonesia (DSN-MUI) serta regulasi terkait ekonomi syariah. Teknik pengumpulan data dilakukan melalui dokumentasi, sedangkan analisis data menggunakan metode istinbāṭ hukum dan analisis komparatif untuk mengidentifikasi pola penerapan qiyas pada berbagai sektor ekonomi syariah. Hasil penelitian menunjukkan bahwa qiyas diterapkan secara signifikan dalam perumusan hukum produk perbankan syariah, asuransi, pasar modal, dan financial technology syariah melalui proses penentuan ‘illat dari transaksi klasik yang dianalogikan dengan produk kontemporer. Namun demikian, penerapan qiyas menghadapi tantangan berupa kompleksitas transaksi modern dan perbedaan penetapan ‘illat di kalangan ulama. Penelitian ini menyimpulkan bahwa qiyas tetap relevan sebagai metode ijtihad, tetapi memerlukan integrasi dengan metode lain agar mampu memberikan solusi hukum yang lebih komprehensif terhadap perkembangan ekonomi syariah kontemporer.

Abstract

Strengthening the normative foundation and maqāṣid orientation of Indonesia’s religious court system allows it to render fair judgments for the parties while safeguarding the future of children. While Islamic family law is often studied normatively, limited attention is given to its lived application in plural legal settings. Using a descriptive qualitative approach with socio-legal and phenomenological methods, data were collected through purposive sampling of 20 participants, including traditional leaders, religious figures, and village officials. Field observations and the analysis of local documents, including customary manuscripts, sermons, and marriage records, serve to complement the data. The findings reveal that family resilience emerges from a dynamic interplay between Islamic and customary norms, particularly in areas like inheritance, marriage, and gender roles. Integration of maqāṣid al-sharī‘ah occurs through contextual reinterpretation aligned with communal structures and values. Differences between the communities are notable in the role of traditional authority, the interpretation of qiwāmah, and dispute resolution mechanisms. This study contributes to the discourse on Islamic legal pluralism by presenting a contextual model of normative integration. It highlights the potential of a culturally grounded and adaptive Islamic legal framework to strengthen sustainable family systems across diverse local contexts.

Abstract

This research addresses the high divorce rate in three districts and cities, highlighting the lack of household harmony and integrity. The study focuses on the role and function of the Marriage Guidance and Preservation Advisory Board (BP4) in consultation and mediation. The objectives of the research are: 1) To identify the role of BP4 in fostering household harmony, 2) To examine the implications of Family Law in BP4’s role, and 3) To analyze BP4’s contribution to household harmony in East Priangan. The research employs a sociological juridical approach, examining the law based on norms and regulations while assessing its empirical application in community life. The research adopts qualitative methods. The findings show that: 1) BP4's role in maintaining household harmony is functioning normatively and functionally through non-litigation counseling and mediation, but its implementation remains uneven and reactive, preventing optimal development of the preventive function. 2) BP4’s legal implications are strong as a pre-litigation mechanism, but its limited authority and minimal integration with the judicial system hinder its effectiveness. 3) Barriers to BP4’s assistance include low participation, limited legal authority, a litigative culture, and weak institutional capacity.
