Abstract

Cases of women who become pregnant out of wedlock and their children certainly have various impacts resulting in abortion. The Criminal Code prohibits abortion, but Law no. 36 of 2009 concerning Health allows abortion but by providing the conditions contained in Article 76 of the Health Law. If the abortion does not comply with the requirements in Article 76 of the Health Law, then the child rape victim who undergoes an abortion may be subject to a crime under Article 194 of the Health Law. This research focuses on legal protection for children who are pregnant out of wedlock and undergo abortions. This research discusses Decision Number: Number 5/Pid.SusAnak/2018/PN.Mbn. In this case, it was stated that the child defendant had an abortion under the influence of coercion from her biological mother. Victims have the right to receive protection both materially and psychologically in the form of providing victims' rights during the case resolution process in accordance with the provisions contained in Article 7a of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims ( LPSK Law). Based on the provisions contained in the LPSK Law, victims of criminal acts are entitled to receive restitution in the form of: a. compensation for loss of wealth or income; b. compensation for losses incurred as a result of suffering directly related to criminal acts; and/or c. reimbursement for medical and/or psychological care. However, in this decision the victim has not received his rights

Abstract

Dalam menunjang kepariwisataan Bali, hotel sebagai usaha sarana pariwisata di bidang penyediaan akomodasi tentunya menjadi faktor penunjang yang sangat penting. Namun dari data yang diperoleh Dinas Pariwisata Provinsi Bali, tingkat hunian hotel berbintang dari tahun 2013 sampai 2017 tidak mengalami kenaikan yang menggembirakan, bahkan cenderung stagnan. Hal tersebut menyebabkan munculnya inovasi yang “kebablasan” yang berakibat pada persaingan tidak sehat antara hotel dengan Biro Perjalanan Wisata. Banyak hotel menjalankan paket perjalanan wisata yang lazim menjadi ‘market” Biro Perjalanan Wisata. Padahal hotel sudah jelas porsinya, yang berhak jual paket tour itu adalah Biro Perjalanan Wisata. Hal ini dapat mengakibatkan kerugian bagi pihak Biro Perjalanan Wisata, dan yang lebih bahaya lagi jika di biarkan terus terjadi maka dapat menimbulkan ketidakseimbangan iklim usaha pariwisata yang dapat mengakibatkan terjadinya “ tourism kills tourism”. Hotel yang menjalankan paket perjalanan wisata secara langsung maupun tidak langsung merebut dan mengurangi “market” bagi pelaku usaha Biro Perjalanan Wisata sehingga mengakibatkan kerugian baik materiil maupun immaterial dan perbuatan pihak hotel tersebut merupakan pelanggaran hukum yang berlaku. Kejadian ini merupakan peristiwa hukum yang terkait Perbuatan Melawan Hukum oleh pihak hotel karena menjalankan usaha paket perjalanan wisata yang seharusnya menjadi lingkup usaha pihak Biro Perjalanan Wisata. Dimana masalah ini dapat diselesaikan melalui jalur hukum berupa gugatan perdata oleh pihak yang dirugikan, dalam hal ini pihak Biro Perjalanan Wisata atas Perbuatan Melawan Hukum yang berdampak kerugian, yang dilakukan oleh pihak hotel.

Abstract

Welcoming the era of Society 5.0, through the program "Merdeka Belajar Kampus Merdeka," universities are expected to transform the higher education system as the driving force for creating superior human resources for the nation's future. This study aims to explain the dynamics of the independent learning program activities at the independent campus across seven faculties at Bhayangkara University, Jakarta. The research adopts a post-positivist paradigm with a case study approach, involving 25 informants and five key informants. Secondary data were obtained from the Sistem Pembelajaran Daring - Kementerian Riset, Teknologi, dan Pendidikan Tinggi (SPADA DIKTI), which includes a compilation of data from students, lecturers, and education staff. Primary data were collected through interviews, observations, and documentation studies related to the implementation of the Merdeka Belajar Kampus Merdeka program. The data were analyzed descriptively using manual data analysis procedures. The results indicate that most faculties and study programs have not yet optimally explained the flow, program procedures, and complete infrastructure used in implementing the program. However, most students and lecturers acknowledge that the program is highly beneficial and critical for developing quality human resources for the future.

Abstract

Perkawinan bagi masyarakat Indonesia dilakukan dengan itikad baik untuk membangun keluarga sepanjang hidup. Perjanjian kawin dikenal oleh masyarakat barat untuk mengatur harta warisan dan hak-hak individu, termasuk dalam perencanaan keuangan dan perlindungan aset. Sesuai perkembangan zaman, kondisi perjanjian perkawinan pun mulai dikenal oleh masyarakat Indonesia. Perjanjian kawin yang dilakukan oleh pasangan di Indonesia saat ini merupakan bentuk dari kesepakatan sosial, bahkan ada yang menganggap perjanjian kawin adalah hal yang tidak lazim dilakukan. Selain itu kerangka hukum terkait perjanjian kawin di Indonesia belum memiliki kekuatan hukum yang kuat dan dianggap tidak wajar melakukan perjanjian perkawinan.  Pada dasarnya perjanjian kawin memiliki potensi besar untuk melindungi hak-hak perempuan dalam perkawinan. Namun, keberhasilannya sangat tergantung pada kesadaran masyarakat, kesetaraan gender, dan dukungan hukum yang kuat. Perjanjian kawin akan sangat menguntungkan pada saat terjadinya perceraian, namun dalam hal terjadinya perceraian karena kematian maka perjanjian kawin tersebut menjadi harta waris bagi keluarga yang ditinggalkan. Penelitian ini fokus pada perjanjian kawin yang berdampak pada harta waris. Mengunakan  metode penelitian normative, penelitian ini melakukan analisis terhadap undang-undang perkawinan, KUH Perdata, Kompilasi Hukum Islam dan peraturan perundangan lainnya yang relevan.  Penelitian ini juga melakukan konsistensi dasar hukum perjanjian dalam hukum perkawinan di Indonesia.

Abstract

Introduction: The involvement of members of the army of the Republic of Indonesia and The Police of the Republic of Indonesia became a special obstacle in the handling of human trafficking cases. The difficulties are due to the existence of special regulations governing the courts applicable to members of the Indonesian army who commit criminal acts.Purposes of the Research:  The case may be dealt with in conjunction with a criminal offense of trafficking in persons, given that the offense has fulfilled the element of involvement (also, deelneming) or jointly (mede dader) between a civilian and a person with military status in the criminal offense of trafficking.Methods of the Research: The research used normative jurisprudence, focusing on primary legal material such as Act No. 21 of 2007 on Punishment of Trafficking in Persons, Law No. 31 of 1997 on Military Justice, and Law No. 2 of 2002 on the State Police of the Republic of Indonesia. The research was descriptive-analytical, interpreting the law according to its context and analyzing its results in a qualitative, descriptive manner. Secondary legal material included publications on human rights protection, particularly those relating to women and children. The fact approach was used to study human trafficking facts and provide critical analysis. Library documents, books, and journals were also analyzed. Data analysis involved document study techniques and qualitative analysis, with the results and author's analysis of relevant theories.Results of the Research: The article addresses the Indonesian Army and Police's involvement in human trafficking offenses, emphasizing the intricacies and problems of prosecuting such instances. The author believes that the judicial system must promote justice and openness in such circumstances. The Indonesian legal system recognizes both military and civilian jurisdiction over crimes committed by military personnel, but implementation gaps cause uncertainty and delays in judicial processes. Handling crimes involving several institutions necessitates close teamwork, particularly among the Indonesian army and police. The mechanism to facilitate collaborative processing of human trafficking cases is connectedness justice, which decides which court has the authority to punish members of the Indonesian army for human trafficking.

Abstract

The recent escalation of tensions between Russia and Ukraine has caught the world’s attention. Tensions are characterized by the leadership of hundreds of thousands of Russian troops on Ukraine’s borders and the response of many NATO members, including the United States, to Russian pressure. NATO threats against Russia have played a role in increasing tensions on the Russia-Ukraine border. This article analyzes the nature of Russian-Ukrainian relations, the background to rising tensions between the two countries, and the international reaction to the situation. The international community must continue to seek peaceful solutions to avoid the threat of another world war. The ongoing conflict will ultimately harm many parties not only in European countries but also in other regions.

Abstract

There seems to be something different from the results of Transparency International Indonesia (TII) including sextortion or sexual extortion in the Global Corruption Barometer Asia 2020. This is extortion in the form of violence or sexual harassment. Generally a form of abuse of power. Sextortion is different from the corruption we know in a legal context. In terms of regulations and institutions, the practice of sextortion or sextortion is a case that occurs quite a lot but is not yet known in corruption eradication institutions in Indonesia. Sextortion is a new area that opens everyone's eyes to the fact that corruption is not only about money. This study uses a qualitative approach to answer how the form of legal protection for victims of sextortion is rife lately in the educational environment. The conclusions of this study indicate that the form of legal protection for victims of sextortion in the educational environment is in the form of assistance, protection and recovery of victims by strengthening the legal aspect in the form of SOPs for Handling Sexual Violence in each educational institution as well as the installation of detection devices. The novelty of this research can be used for extensive interpretation of legal findings by judges to protect victims of sextortion. And the importance of education on strong self-protection awareness, boldly rejecting or saying no.

Abstract

The population of Indonesia according to the Central Statistics Agency (BPS) in mid 2023 is 278 million people. In spite of this, women still need to make up ground in a number of developmental fields, impacting national productivity. Globally, women face similar challenges in development, prompting the United Nations to prioritize sustainable development goals (SDGs) and strive for gender equality by 2030. This research is based on the theory of transformational leadership, where transformational female leaders empower villages, create inclusivity, and advance sustainable economics Leadership issues, particularly concerning women, remain a pertinent topic. In Indonesia, where women's participation in culture is limited, the Village-Owned Enterprises (BUMDes) program emerged as a pivotal initiative by the Ministry of Villages, Development of Disadvantaged Regions, and Transmigration. BUMDes, which was established in 2014, aims to enhance community welfare by establishing legal entities managed by villages. With an important focus on women's leadership, the program has acquired prominence and has contributed significantly to the success of BUMDes, as well as to the acceleration of village towards autonomy the nation.

Abstract

The West Java Child Special Penitentiary (LPKA) noted that in 2020 there were 241 juvenile detainees and 429 juvenile prisoners. Criminal behaviour in children is related to low social control such as attachment, responsibility, involvement, and the belief that the higher the social control, the lower the possibility of a child violating the law. The main issue in the settlement of juvenile criminal cases is the criminal justice system that does not take sides with children because the handling in this system has not implemented a restorative justice policy. Children who commit crimes ideally need to be returned to their original condition, not just punished for their actions. In fact, data on juvenile detainees and juvenile prisoners show an indication of suboptimal restorative justice policies. The purpose of this study was to determine the role of social control over children as perpetrators of criminal acts and to determine the policy of restorative justice in the process of resolving cases. This research is a descriptive study, using qualitative data analysis techniques with normative and empirical juridical approaches. The research subjects were 22 juvenile prisoners and detainees in one of the Penitentiaries of the West Java region. The results of the study indicate that social control plays a role in children as perpetrators of criminal acts, as well as the settlement of child criminal cases based on restorative justice policies, is not optimal. There are many diversion failures and a fairly high percentage of prison sentences that should be a last resort. There is also a large public stigma against the statement that children who violate the law should be imprisoned. On the other hand, trauma due to the examination process, prison life, and stereotypes as ex-convicts will greatly affect the psychological function of children. This can lead to low self-confidence, feeling worthless, and becoming the cause of recidivists because they feel unforgivable even though they have served their sentence.

Abstract

Women with disabilities are a minority group vulnerable to various forms of violence and discrimination, including physical, psychological, and exploitation. This vulnerability is exacerbated by stigma and the assumption of inability to defend oneself, especially for those with mental and intellectual disabilities. Women with disabilities also face discrimination in the investigation and judicial processes, as well as difficulties in accessing information, legal services, and disability-friendly judicial facilities. Although the 1945 Constitution guarantees equality before the law and Law No. 8 of 2016 recognizes the legal capacity of persons with disabilities, its implementation has not been optimal, including in procedural law. The research method used is the normative juridical method, which refers to Law Number 8 of 2016 concerning Persons with Disabilities and Government Regulation No. 39 of 2020 concerning Reasonable Accommodation for Persons with Disabilities in the Judicial Process. The high rate of violence against disabled groups is exacerbated by systemic barriers such as the lack of physical accessibility, information, and inclusive judicial procedures; discrimination and negative stereotypes; and the limited understanding of law enforcement officials. Even though there are laws at both international and national levels, the protection for people with disabilities hasn't been very effective because of inconsistent rules and the way Government Regulation No. 39/2020 focuses too little on inclusive procedural law.
