Abstract

Environmental Pollution is one of the main problems faced by people all over the world, especially Indonesia, if there is environmental pollution, the community can complain about it to the competent court. In this study, a problem arose regarding the authority of the State Administrative Court in adjudicating environmental case disputes (DECISION 42/G/LH/2020/PTUN.MDN). The research method used is normative juridical. The findings show that Article 47 of Law Number 5 of 1986 as amended by Law Number 9 of 2004 outlines the absolute competence of the State Administrative Court in the Indonesian justice system, including its role in assessing, deciding and resolving state problems. Administrative disputes in the case of the Medan State Administrative Court certainly have absolute and relative authority in their decisions on these disputes.

Abstract

ABSTRACT:The increasingly advanced industrial sector in Indonesia makes several things including the environment negatively affected. The destruction of nature by human activities is caused by over-exploration and exploitation activities. The negative impact that is usually caused by the mining sector for the surrounding environment is the occurrence of water pollution by heavy metals, especially Mercury. In this case, there is an International convention that regulates Mercury, namely the Minamata Convention on Mercury. Pollution of Buyat Bay by Mercury and Arsenic is caused by mining activities from PT. Newmont Minahasa Raya which started in 1996 using normative method research methods. This normative or literature research examines the study of relevant documents in writing this scientific paper to find out the 2013 Minamata Convention agreement and its implementation in the case of mercury and arsenic pollution in Buyat Bay. The United Nations Environmental Programme (UNEP) conducted a study in 2001 on mercury and mercury compounds related to aspects of mercury health impacts, sources, transportation, circulation and trade, and mercury prevention and control technologies. UNEP concluded that an international effort is needed to reduce the risk of mercury impacts on human health and environmental safety. The Minamata Convention was signed by 92 countries of the world at a diplomatic conference in Minamata, Kumamoto Province, Japan on October 10, 2013. In the case of Buyat Bay pollution, the government concluded that, the gold mining company PT Newmont Minahasa Raya had polluted the environment in Buyat Bay, Minahasa, North Sulawesi. As a form of implementation because Indonesia ratified the Minamata Convention, Indonesia established a special Technical Team in mercury management. This technical team was created to compile and publish a National Action Plan (RAN) based on the annex to the Minamata Convention, namely the elimination of the use of mercury in gold processing.  Keywords : Minamata Convention, Mercury, Buyat Bay, Environmental Pollution.

Abstract

The Welfare State and Public Services are closely connected in the implementation of an independent economic system. The Welfare State ensures basic needs are met through government management of tax revenue. In Indonesia, Public Services are regulated by Law Number 30 of 2014. The case study of fictitious positive involves PT Griya Martua Tomorindah, the Regent of Morowali, and the Governor of Central Sulawesi. The court ruled in favor of the respondent, rejecting the petitioner's request. The resolution of fictitious positive disputes is governed by Supreme Court Regulation Number 8 of 2017. The objects of dispute included missing mining permit documents and lack of response to work plan and budget approval. The Court rejected the request due to a missed application deadline. The Administrative Court (PTUN) has jurisdiction over fictitious positive disputes in public administration. However, the objects in this case did not meet the criteria as they didn't exceed the time limit. The Court accepted the respondent's error in persona exception regarding the second object. The author agrees with the Court's verdict in this case as it was appropriate.

Abstract

Public financial supervision carried out by the community is one form of good governance in Indonesia, the existence of public participation is one indicator of good governance. Public participation in a country, especially related to the supervision of state financial management, is urgent, this is because it is a form of check and recheck of the government in a democratic country. So researchers feel it is important to examine the role of public participation in the supervision of state financial management. The research method used is normative juridical. The results of this study are that the main responsibilities in public participation include: a) Participation in decision making b) Implementation Participation, c) Participation in utilization d) Participation in Evaluation. Public participation in the National PK Strategy consists of public participation in the formulation, implementation, monitoring, evaluation, and reporting of strategies. Participation in the implementation of national strategies can be achieved through various means, such as participation in forums, monitoring, evaluation, and creation of financial ownership databases. The community can contribute by ensuring sustainable political engagement, good governance, and simple procedures. This goal can be achieved faster if the community actively assumes responsibility in dealing with state institutions. The community has the highest sovereignty, so the quality of a government is also influenced by the community that elects state representatives. The community also plays a preventive role when proactive action is needed to instill the values of honesty and hatred of corruption through ethical messages and moral education as early as possible.

Abstract

Panjang Island is one of the islands in Banten Regency, which has problems related to plastic waste. Plastic waste is also a major problem in environmental pollution in Indonesia and the world, so there is a need for a way or method that can reduce plastic waste in the region. One effort or method that can be done to deal with plastic waste is with ecobricks or environmentally friendly bricks. Ecobrick comes from the words ecology which means ecology and brick which means brick or can also be called environmentally friendly brick. The method used is Ecobrick Training and Training, this activity was carried out on August 5 2023 in Pulau Panjang Village, Pulau Ampel District, Serang Regency. The Ecobrick training was attended by representatives of young people from the Panjang Island Village Youth Organization. This training activity was carried out in 2 steps, namely presentation of material on the negative impacts of plastic waste and practice of making ecobricks. This activity is carried out in several stages, namely preparation, implementation and post-training. The aim of the ecobrick making training activity is to provide education and assistance regarding environmentally friendly plastic waste processing. Based on the results of training activities and Ecobrick Training, it is known that young people from Karang Taruna are able to manage plastic waste using the ecobrick method. It is hoped that Karang Taruna youth will not only be able to process plastic waste into ecobricks but can also use it as a field for creativity.
