Abstract: "Tradition ('urf) as a Source of Islamic Law Reasoning; Study Paradigm Sunnah wal Jama'ah Experts in Developing Local Culture "One tradition ( 'urf) can be used as a source of Islamic law if it does not conflict with Personality', and not all traditions can be used as a source of Islamic law. Tradition itself is an activity that is repetitive, but does not violate the order of Shariah, the tradition is not sharia, but branches (furu ') in order to address or even develop Islamic teachings amaliyah (amaliy) or often called (bid’ah hasanah) .The ahlu sunnah wal jama'ah develop local culture such as tahlilan, yasinan, istighasah, tawashul or the like in the implementation of the (practice) there is no standard rules, but it is the implementation of more emphasis on reading tahlil (la ilaha ilallah), or yasinan namely reading yasin as the heart of a Qur'an, namely istighasah appeal help in Allah and not in others, and that is ihtiram tawashul to teachers as washilah in a prayer, and of course this is bid’ah hasanah not teaching out of Personality ' ,Keywords: Tradition, 'urf, Ahl Sunnah Wa al-Jama'ah

Abstract

Islam is a religion rahmatan lil'alamin, for that Islam can put the situation and conditions. Islam is the religion Hanīf, fairness and tolerance to their ikhtilaf (dissent). In terms of the causes and roots, there are two forms ikhtilaf (dispute), the deviation caused by the character and thought. Unjustified deviation is a deviation in aqidah matter of principle. Deviation is actually a little touch on the basic framework of worship. However, when the jurists began to enter the technical and operational principle that no deviation is irreversible appearance. Deviation can be justified is the deviation in trouble furu', and the issue is not the principle I'tiqad. Deviation different from the iftiraq, iftiraq according to the language comes from the word meaning mufarawah division and separation. Meanwhile, according to the terms of the scholars, iftiraq is out of the Sunnah and Jama'ah on one ushul (principal) of a judge actions ushul fundamental, both in aqidah or amaliyah.

Abstract

Tulisan dalam artikel ini membahas mengenai peranan pemerintah daerah terhadap pelaksanaan corporate social responsibility (CSR). Tujuannya untuk mengetahui bagaimana arah kebijakan dan pengaturan CSR di provinsi Lampung. Metode yang digunakan adalah kajian pustaka dengan menggunakan pendekatan yuridis. Berdasarkan Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mewajibkan setiap perusahaan untuk melaksanakan CSR. Peran pemerintah daerah Provinsi Lampung dalam pelaksanaan CSR yaitu dengan membentuk Peraturan Daerah Provinsi Lampung Nomor 16 Tahun 2012 tentang Tanggung Jawab Sosial Perusahaan dan Peraturan Gubernur Nomor 30 Tahun 2011 tentang Pedoman Pengelolaan CSR/PKBL. Peran pemerintah daerah dalam hal pelaksanaan CSR menurut Pergub No. 30 tahun 2011 yaitu, membentuk forum komunikasi dan tim fasilitasi. Kedua tim tersebut memiliki kewajiban mewadahi seluruh pihak yang terlibat pelaksanaan CSR, yaitu pemerintah, perusahaan dan masyarakat. Pergub No. 30/2011 juga mengatur pedoman mekanisme pengelolaan CSR dimulai dari; 1) perencanaan; 2) pelaksanaan; 3) pembinaan dan pendampingan; 4) pelaporan dan evaluasi. Berdasarkan hal tersebut secara khusus pemerintah kota Metro juga telah menerbitkan Peraturan Daerah Nomor 6 Tahun 2016 tentang Tanggung Jawab Sosial Perusahaan.

Abstract

“Khitan Perempuan antara Budaya Lokal dan Ajaran Agama” Khitan perempuan tidak harus dilakukan oleh setiap perempuan, khitan dapat dilakukan oleh perempuan yang memang memiliki libido seksual yang tinggi dan mendatangkan maslahat dan itu merupakan kehormatan, manun jika tidak mendatangkan manfaat, bahkan merusak organ perempuan dengan cara memotong, melukai dan menghilangkan sebagian dari alat vital yang terpenting dan terkait alat reproduksi perempuan. Dalam Kaidah, kalau suatu perbuatan mendatangkan banyak mudharat daripada kemaslahatan, maka perbuatan itu dinggap makruh dan harus ditinggalkan (la tharara wa la dhirara), berarti segala bentuk kemudharatan pada manusia termasuk (khitan perempuan) karena merupakan suatu tradisi dan bukan syari'ah Islam yang harus dipraktekkan kepada setiap perempuan.

Abstract

Tulisan ini merupakan kajian pustaka yang mengkaji fatwa pelarangan mahar hafalan al-Qur’an. Sebagai alat analisis teori al-urf sangat tepat digunakan untuk memadukan kesenjangan tradisi yang berkembang dengan fatwa pelarangan tradisi tersebut. Tulisan ini mengkritisi fatwa tersebut dan menyimpukan; Pertama, fatwa mengedepankan aspek teoritis dan kurang memperhatikan aspek praktis yang tengah terjadi pada masyarakat. Kedua, metodelogi istinbat dalam berfatwa yang dilakukan adalah mengutamakan dalil-dalil muttafaq serta menomerduakan dalil-dalil mukhtalaf, sedangkan al-urf terkategori pada mukhtalaf sehingga kurang diperhatikan. Ketiga, Penulisan teks fatwa yang ada dianggap sangat singkat dan memerlukan kajian lebih lanjut agar memperoleh pemahaman dari maksud dari fatwa tersebut, sehingga menimbulkan kegamangan dan berpotensi menimbulkan silang pendapat. Keempat, prinsip fatwa yang digulirkan adalah berlepas dari mazhab tertentu, hal ini dianggap tidak sejalan dengan apa yang direkomendasikan oleh fukaha dan jauh dari mengayomi, karena proses beragama suatu masyarakat hendaknya memulainya dengan mengikuti mazhab tertentu agar tidak salah arah, dan tetap di dalam koridor keislaman yang benar. [This paper criticizes the fatwa on the prohibition of memorizing the Qur'an. As an analysis tool, al-urf theory is very appropriate to be used to integrate the growing of tradition gap with the fatwa prohibiting that tradition. This paper concludes; First, the fatwa emphasizes the theoretical aspects and pays little attention to the practical aspects that are happening to the community. Second, istinbat methodology in performing the obedience carried out is to prioritize the arguments of muttafaq as well as to put forward the arguments of the mukhtalaf, while the al-urf is categorized in the mukhtalaf so that it is heedless. Third, the writing of the existing fatwa text is considered to be very high and requires further study in order to gain an understanding the purpose of the fatwa, thus causing confusion and the possibility of the conflict. Fourth, the fatwa principle that is rolled out is not depend on a certain schools, by contrast with the recommendation of the jurist, because the religious process of a community should start by following the certain schools in order to remain stay in the Islamic pathway].

Abstract

Currently, the problem of college failure, its on-time graduation, and the factors that cause it is still an interesting research topic (C. Marquez-Vera, C. Romero and S. Ventura, 2011). This study compares three data mining classification algorithms namely Naive Bayes, Decision Tree and K-Nearest Neighbor to predict graduation and dropout risk for students to improve the quality of higher education and the most accurate algorithms to use Prepare graduation and dropout prediction Student studies. The best algorithm for predicting graduation and dropout is the decision tree with the best accuracy value of 99.15% with a training data ratio of 30%. Keyword : Data Mining; Algoritma Naive Bayes; Decision Tree; K-Nearest Neighbor; Predict Graduation; Drop Out.

Abstract

There are differences of opinion among scholars regarding the issue of euthanasia. But the element of goodness makes a consideration, that preventing a disease is an obligation that must be done by every individual. While the difference is more depressed on how to apply euthanasia, namely on how to end the suffering of patients. In Islam, scientific and divine healing is known, while in medical science, only rational healing and emergency-based healing are known. In principle, the intentional killing of a sick person precedes fate. God has set the deadline for human life. By speeding up his death, the patient did not benefit from the test given by Allah to him.

Abstract

This article is the result of a study of the local wisdom values of the Lampung indigenous people (Pi`il Pusenggighi) in the ancient manuscripts of Kuntara Rajaniti and Jugulmuda. More specifically, this article wants to know the basic values of the social philosophy of the Lampung indigenous people are in the ancient text and how the content of Islamic teachings on the husband and wife rules. The research was conducted using a socio-philosophical approach and content analysis theory to answer this question. As a result, there are many Islamic values contained in the ancient manuscripts of Kuntara Rajaniti and Jugulmuda and the basic values of the social philosophy of the indigenous people of Lampung (Pi`il Pusenggighi). Another conclusion is that the basic values of the social philosophy of the Lampung indigenous people are full of Islamic values. Especially in the introduction to describe the Prophet Muhammad. Besides that, it also applies the analogy proposition similar to the Qiyâs proposition in Islam.Keywords: Pi`il Pusengighi, Social Philosophy, Lampung, Ancient manuscripts, Kuntara.

Abstract

Marriage is a bond between the inner and outer wanitasebagai a man with a husband and wife with the aim of forming a family (household) were happy and everlasting based on God. The scholars agreed that the wedding for pregnant women should be carried out again after giving birth. Reconstruction of the law relating to the validity of the marriage ceremony for a pregnant woman, in this case the Indonesian Islamic scholars consider the elements of sociological and psychological especially the local culture of Indonesian society, which is a compromise approach to customary law. Perkawinan ialah ikatan lahir batin antara seorang pria dengan seorang wanitasebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Para ulama sepakat bahwa pernikahan bagi wanita hamil haruslah dilaksanakan kembali setelah melahirkan. Rekonstruksi hukum terkait dengan keabsahan akad nikah bagi wanita hamil, dalam hal ini ulama Islam Indonesia mempertimbangkan unsur-unsur sosiologis dan psikologis khususnya budaya lokal masyarakat Indonesia, yang merupakan pendekatan kompromistis dengan hukum adat. Pengkompromian itu ditinjau dari segi kenyataan terjadinya ikhtilaf dalam ajaran fikih dihubungkan dengan faktor sosiologis dan psikologis. Tujuan utama azas kebolehan kawin hamil adalah untuk memberikan perlindungan hukum yang pasti kepada anak yang dalam kandungan, walaupun anak tersebut statusnya anak zina, walaupun Kompilasi Hukum Islam tersebut terkesan memperlihatkan sikap pemerintah yang sangat ambivalen/ambigu.

Abstract

Islam is a revelation to the Prophet Muhammad as a way of life in this world and hereafter, the religious mission is to liberate man from forms of anarchy and injustice, tolerance is an attitude of respect for others, in terms of cause and roots, there are two forms of difference, namely; 1) the difference tang caused by factors morals, arise because of the character is known by scholars and murabbi (builder) that takes into account various motivations of the various attitudes and events, 2) differences caused by factors in mind, arising from different points of view about a problem , either natural or problems amaliah problem. Al-Qur'an is basically the principle of justice, equality, democracy and social well do, if then occurs an injustice, it is not happening in Islam, but it may be precisely the interpretation of Islam itself weak, causing a lot of understanding.
