Abstract

Man is a leader of the household, while the wife serves as the household manager. Generally, this paradigm is embedded in our society because men are always put as the main guard at the front while wives are always set in the limited area. Contextually, the problem is in the role of women which is no longer solely in the domestic sphere. Most of them also have a role outside the home to help husbands earn a living. The purpose of this study is to obtain a reconstruction of reciprocal fiqh (mubâdalah fiqh) principle in terms of rights and obligations of both husband and wife. This research is a literature review with a qualitative type using the reciprocal (mubâdalah) approach. The results of this study show that partners in realizing justice in the household, according to the mubadalah approach, are required to make mutual help through working together, such as mutual consultation, mutual democracy and mutual taking and giving in building harmonious relationship. الرجل هو رب الأسرة والزوجة ربة المنزل. هذا النموذج جزء لا يتجزأ من مجتمعنا بشكل عام، لأن الرجل هو الحارس الرئيسي وكان دائمًا في المقدمة بينما تكون الزوجات دائمًا في المنطقة المحدودة. وتكون المشكلة في أن دور المرأة لم يعد في المجال المنزلي فقط، بل معظمهن أيضًا لهن دور خارجَ المنزل لمساعدة الأزواج في كسب لقمة العيش. والسؤال كيف تتم حقوق وواجبات الزوج والزوجة في هذا السياق؟ الغرض من هذه الدراسة هو إعادة بناء الحقوق والالتزامات الجديدة التي تعكس مبادئ فقه المبادلة من حيث حقوق والتزامات الزوج والزوجة. هذا البحث عبارة عن مراجعة أدبية، ونوعي بمنهج التبادل (المبادلة). نتائج هذه الدراسة أن الشركة بين الرجل والمرأة في تحقيق العدالة في الأسرة يجب أن تكون مساعدة متبادلة في العمل معا مثل التشاور، والديمقراطية، والإحسان لبعضهم البعض في المعاملة

Abstract

Interfaith marriage is not a new problem in Indonesia, but a problem that often occurs in society, even though the laws and regulations on marriage have regulated it, in reality there are still such marriages in society. Like the marriage in Semarang, Central Java, which sparked a lot of debate among legal experts. What's interesting is how the interfaith marriage procession can be held solemnly, then what is the law, both legally and formally? The purpose of this study was to find scientific answers regarding interfaith marriages that occurred in Semarang, Central Java. This type of research is qualitative, by revealing the historical-philosophy of the socio-empirical reality that occurs in society with the form of normative studies. The results of this study indicate that the laws and regulations regarding marriage in Indonesia prohibit interfaith marriages, as well as the Compilation of Islamic Law (KHI) and MUI Fatwa Number: 4 /MUNAS/VII/MUI/8/2005 concerning Interfaith Marriage. The reality of marriages that have occurred so far, including in Semarang, Central Java, is that they are only registered in the Civil and Church Registry, but are not registered with the Marriage Registrar at the Office of Religious Affairs (KUA).

Abstract

Rural Banks are bank financial institutions, which accept deposits only in the form of time deposits, savings, and / or other equivalent forms and channel funds as an RB business. The People's Credit Institution originated in the Dutch colonial period in the 19th century, with the formation of the Village Lumbung, Village Bank (BD), Bank Tani (BT), and Bank Dagang Desa (BDD), with the aim of helping farmers, employees and laborers to releasing themselves from the trap of moneylenders (loan sharks) who are said to provide loans with high interest rates. With the issuance of Law no. 7 concerning Banking of 1992 (Law No. 7/1992 concerning Banking) provided a clear legal basis as a type of bank other than commercial banks. According to Law no. 7/1992 concerning Banking Non-bank financial institutions that have obtained a business license from the minister of finance may adjust their business activities as a bank.

Abstract

BMT (Baitul Maal Wat Tamwil) is a microfinance institution that serves as an intermediary between capital owners and recipients of capital. Therefore, the role of BMT needs to be further enhanced according to its function in collecting and distributing public funds, especially by paying more attention to financing to the productive economic sector, one of which is mudharabah financing. In this case, mudharabah financing is one of the financing used by BTM (Baitul Tamwil Muhammadiyah) Amanah Bangunrejo which is given to micro entrepreneurs in increasing their business. The problems discussed in this study are how is the mudharabah financing strategy in BTM Amanah Bangunrejo? And can the mudharabah financing strategy at BTM Amanah Bangunrejo empower businesses?. The purpose of this study is to describe and analyze the mudharabah financing strategy in empowering micro-enterprises. This research is descriptive qualitative, which describes and analyzes the problems raised. The data analysis technique in this study used descriptive qualitative data analysis. While the data collection techniques in this study used observation, interviews, and document retrieval. Based on the research, BTM Amanah Bangunrejo uses a business analysis strategy, a capital agreement and provision strategy, and a mentoring strategy. The mudharabah financing strategy has not been maximized in empowering micro-enterprises. Therefore, the researcher suggests that BTM Amanah Bangunrejo is more optimal in implementing the mudharabah financing strategy.

Abstract

Aurat is a part of the body that must be covered in Islamic teachings. The female genitalia are all parts of the body except the palms and the face. In the concept of Jama'ah Tablighi, burdah is a cloth to cover the face, like a veil. This study aims to examine in depth the concept of burdah which is an effort to cover the genitals in the perspective of the Tablighi Jama'ah. This research is a qualitative type in the form oflibrary research, with a historical-philosophical approach namely studying the concept of burdah historically and philosophically so as to find the correct meaning. The results of this study indicate that in the concept of Jama'ah Tablighi, burdah is an effort to cover the aurat for Muslim women, this is done because women are the ones who become the motivation for da'wah for their husbands, so that all things that are owned by the wife are only for her husband, including the beautiful face. is a source of slander if not guarded. Because the face is a source of slander, the face becomes aurat for women and must be protected by covering it.

Abstract

Kekerasan dalam masyarakat sebenarnya bukan suatu hal yang baru. Berbagi pendapat, persepsi, dan definisi mengenai kekerasan dalam rumah tangga berkembang dalam masyarakat Fakta-fakta sosial yang sering terjadi dalam kehidupan masyarakat adalah permasalahan yang terkait dengan anak yang berhadapan dengan hukum, akibat melakukan tindak pidana ataupun sebagai korban tindak pidana. Kekerasan terhadap perempuan dalam rumah tangga yang dimaksudkan mencakup segala bentuk perbuatan yang menyebabkan perasaan tidak enak (penderitaan), rasa sakit, luka, dan sengaja merusak kesehatan. setiap kekerasan ini adalah faktor ekonomi yang semakin lama dirasakan semakin sulit, sehingga ini memang akan menjadi sebuah ujian berat, Dengan kekerasan yang dialami perempuan dan anak berpeluang merusak optimalisasi pertumbuhan terutama gangguan kesehatan dan psikis, tentu peran perempuan dan anak dalam pembangunan bangsa dan negara akan sangat berkurang. Kekerasan baik yang dialami oleh isteri dan atau anak sebagia korban bentuk kekerasan dalam rumah tangga yakni: 1) Kekerasan fisik dan non fisik, yaitu: 2) Bentuk kekerasan seksual yang dialami oleh korban adalah berupa adanya pemaksaan atau pemerkosaan terhadap isteri. 3) Kekerasan psikologis bersifat sangat merendahkan, seperti: bodoh, tidak berguna dan sebagainya, 4) Kekerasan penelantaran keluarga terjadi ketika laki–laki atau suami tidak mempedulikan keluarga dalam rumah tangga; suami tidak memberikan nafkah kepada isteri dan anak. Secara konkrit pola penyelesaian menurut adat terkait. 1) Penyelesaiannya dengan adat yaitu pada umumnya pola penyelesaiannya dilakukan dengan mendahulukan wujud formal/acara (hukum formal. Maksudnya bahwa penyelesaiannya pada umumnya diselesaikan secara kekeluargaan, baik diselesaikan ditingkat intern keluarga. Sesungguhnya banyak kasus kekerasan dalam rumah tangga (KDRT) yang tidak dilaporkan atau tidak dicatat. 2) Penyelesaian menurut negara yaitu pola penyelesaian menurut negara terhadap kekerasan dalam rumah tangga secara hukum pelakunya hingga pengadilan menjatuhkan vonis

Abstract: Marriage prohibitions from fiqh perspective include eternal prohibition (ta'bíd) is a women forbidden to marry men at the longest because of nasab relationship, marriage relationship and mother’s milk relationship. Temporary prohibition (gairu ta'bíd) is women or men forbidden to marry for certain time because of amount, collection , slavery, heathen, ihrám, iddah, three times divorced, and matrimony. Until now, adultery and li'an vow are still disputed. Marriage act in Indonesia is the result of normative law legislation which not arranges the prohibition of marrying slaves. The controversial section is section 40 letter c; in that section clearly established that a Moslem is prohibited to marrying a non-Moslem. In fiqh, non-Moslems involve Musyrik/Kafir who forbidden to married by Moslems and Christians/Jews (ahlul kitab) who can be married by Moslems.Abstrak: Larangan perkawinan perspektif fikih mencakup larangan abadi (ta’bíd); perempuan dilarang kawin dengan laki-laki sepanjang masa dikarenakan hubungan nasab, perkawinan dan persusuan. larangan sementara (gairu ta’bíd) adalah wanita atau laki-laki yang haram kawin untuk masa tertentu dikarenakan bilangan, mengumpulkan, kehambaan, kafir, ihrám, iddah, talak tiga dan peristrian. Yang diperselisihkan adalah zina dan sumpah li’an. Undang-Undang Perkawinan di Indonesia adalah hasil legislasi hukum normatif (fikih) dan tidak mengatur tentang larangan menikahi budak, Pasal yang kontroversial, yaitu pasal 40 huruf c, dalam pasal tersebut ditentukan dengan jelas bahwa seorang laki-laki muslim dilarang melakukan perkawinan dengan wanita yang tidak beragama Islam. Dalam fikih, non muslim dibagi dua, yaitu musyrik/kafir adalah orang yang haram untuk dikawin sedangkan Nasrani/Yahudi yang disebut dengan ahlul kitab dapat di kawin.

Abstract

This article is the result of a study of the local wisdom values of the Lampung indigenous people (Pi`il Pusenggighi) in the ancient manuscripts of Kuntara Rajaniti and Jugulmuda. More specifically, this article wants to know the basic values of the social philosophy of the Lampung indigenous people are in the ancient text and how the content of Islamic teachings on the husband and wife rules. The research was conducted using a socio-philosophical approach and content analysis theory to answer this question. As a result, there are many Islamic values contained in the ancient manuscripts of Kuntara Rajaniti and Jugulmuda and the basic values of the social philosophy of the indigenous people of Lampung (Pi`il Pusenggighi). Another conclusion is that the basic values of the social philosophy of the Lampung indigenous people are full of Islamic values. Especially in the introduction to describe the Prophet Muhammad. Besides that, it also applies the analogy proposition similar to the Qiyâs proposition in Islam.Keywords: Pi`il Pusengighi, Social Philosophy, Lampung, Ancient manuscripts, Kuntara.

Abstract

Religious moderation is a perspective, attitude, and practice in common life by embodying the essence of religious teachings towards the principle of justice. This study aims to see how religious moderation is in positioning women in the household. The research was carried out using library research. Data collection techniques by collecting various sources including articles, books, Al-Qur'an, and hadith. Data analysis by providing a re-interpretation of the verses and the paradigm of society that is gender biased. The results of the study show that women in the current context must have an appropriate position in realizing their rights in the household, so that their position in a moderate way can build mutual values in the household in a way that is fair, balanced, equal, democratic and treats both of them equally good way.

Abstract

The Messenger of Allah (PBUH) was easy to give his marriage dowry in keeping with the Qur'an.The history of The Islamic Dowry preserved the Qur'an from its beginning to the present has witnessed an interesting development of the study.The dowry of the qur'an's preservation of the marriage practiced by people today is driven by the lack of conformity with the history that occurred at the time.From previous backgrounds, the author is more studying through a historical approach to discovering developments that have taken place since the beginning of the Qur'an.'The results of this study show that the payment of a dowry from the Qur'an is currently witnessing the development of the meaning of dowry on the one hand, which is actually happening and the bottom now in society today is not limited to concern with the elements of rightsonly women, but increased attention to other aspects as well as the circumstances of the interest of the rightsTherefore, islamic law in its historical review is valid for all time and place. Keywords: RightsWomen: Marriage Dowry: History: Memorizing the Qur'an.
