Abstract

Research findings show that the proportion of drug users who suffer from mental disorders is still very high compared to that of drug users who do not suffer from mental disorders. The reason is that the use of drugs can cause addiction, which means that users will continue to do so that which affects the central nervous system and results in mental disorders in drug users, for example in two cases in the Denpasar District Court with cases of narcotics abuse where the defendant had bipolar disorder. This study concludes that the judge's consideration includes the reasons for bipolar mental disorder as mitigating factors. In the case of abuse of narcotics, the Defendants BJJ and YAR, even though they were bipolar, still did not abolish the sentence against the two Defendants in these two different cases..

Abstract

In the current technological era, developments occur in all aspects of life including trading activities, namely online shopping. Online shopping began to grow and develop into a habit for the community. Mothers' shopping habits are increasingly turning to buying and selling online for more practical reasons. Abstract

This study aims to determinea form of tackling the crime of cockfighting gambling.The method used in this research is empirical or sociological research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive analysis techniques. The results of this study indicate thata form of countermeasure carried out to tackle the crime of cockfighting gambling by means of preventive and repressive measures. In the preventive action stage, basically, stakeholders try to take precautions before the crime occurs. However, the most important role in preventing the occurrence of a crime is the supervision of the local community who then cooperates with law enforcement so that the crime of cockfighting gambling is easily detected.The countermeasures carried out by the authorities should be carried out with good coordination and cooperation, so as to make countermeasures that are right on target.

Abstract

The purpose of this study is to analyze and construct a model of legal protection for victims of illegal investment crimes.  This research is a type of normative research using several approaches, namely the statute approach,  case approach, and conceptual approach.  The analytical technique used in this study is using analytical descriptive techniques. The results showed that the legal protection model for victims of illegal investment is to reform the Money Laundering Law with an asset recovery approach to the Corruption Eradication Law. The concept contained in Article 18 of the Corruption Eradication Law is an additional crime that can be conceptualized in the provisions of the Money Laundering Law.

Abstract

The main problem in this research is the process of investigating criminal acts of incest committed by the biological father against the child in the jurisdiction of the East City Police. biological father of the child at the East City Police. The aim of the research is to find out and explain the implementation and investigation of criminal acts of incest committed by the biological father against the child (Incest) at the East City Police. Abstract

The purpose of this research is to find out how legal protection efforts against women victims of dating violence by the Gorontalo City Resort Police. The research method used in this research is empirical research method with qualitative approach. The result of this research is that the high number of violence is a concern for the wider community, especially the number of violence in dating relationships for unmarried women is quite alarming lately. The 2016 PPA symphony states that of the 10,847 perpetrators of violence, 2,090 perpetrators were boyfriends/friends. Dating violence is an act of violence against a partner who is not yet married, including physical, emotional, economic violence and activity restrictions. This violence is a case that often occurs after domestic violence, but still does not get the spotlight compared to domestic violence, so sometimes it is still overlooked by victims and perpetrators.

Abstract

The purpose of this research is to find out the legal settlement process for cases of misuse of personal data in prepaid cellular card registration. Researchers use the type of empirical juridical research is to use the type of field research (field research). By using a descriptive study, a systematic, factual and accurate description or painting of the facts, nature and relationship between the phenomena being investigated. The result of this research is that there are indications of the practice of utilizing customer personal data for the personal interests of unscrupulous outlet officers. Some cases show that customer data, such as phone numbers and addresses, are misused for the purpose of offering other products or services that are not related to cellular card registration. This clearly violates the principle of personal data protection and harms consumer trust. The practice of selling customers' personal data to third parties without the knowledge and consent of the data owner was revealed. Some mobile card registration outlets are known to sell customer data, such as demographic profiles and call history, to marketing companies or other service providers for commercial purposes. This practice not only violates privacy rights, but can also lead to potential misuse of data by irresponsible parties. There have been cases of falsification of customers' personal data by unscrupulous outlet staff for certain purposes. Some reports stated that the outlet staff recorded false or incomplete data in the registration form, hindering the process of identity verification and monitoring by the mobile operator. This practice not only violates the law, but can also trigger various criminal acts, such as identity theft.

Abstract

The implementation of fines as a legal instrument plays a crucial role in shaping public behavior concerning waste management. Despite the existence of numerous regulations governing waste management, the effectiveness of imposing fines remains limited in raising legal awareness and reducing waste volume in society. This study aims to explore the ideal framework for implementing fines to enhance legal awareness and minimize waste, emphasizing more effective and systematic law enforcement. Utilizing a normative juridical and sociological approach, the study analyzes existing regulations and identifies obstacles in the application of fines in Indonesia. The findings reveal that while fines have the potential to reduce waste, the main challenges include insufficient public education, weak law enforcement, and inconsistencies between the amount of fines imposed and their intended deterrent effects. The study recommends strengthening waste management regulations, increasing community participation, and implementing proportional fines coupled with stringent monitoring systems to achieve significant waste reduction. With a more ideal regulatory framework, it is hoped that public legal awareness will improve, paving the way for sustainable waste management practices.

Abstract

This research aims For discussing the application of diversion for children who are perpetrators of the crime of distributing pornographic videos from the perspective of legal protection against children's rights as victims and causal factors . The method used in the research is legal empirical with qualitative descriptive data analysis that describes and explains data and field facts. The results of the study show that the application of diversion to children who are perpetrators of the crime of distributing pornographic videos, viewed from the legal protection of children as victims in Gorontalo, is basically to protect children as perpetrators of crimes and provide them with the opportunity to improve themselves and not affect their future. This is also one of the legal policies in the context of protecting children as perpetrators of pornography crimes. However, the implementation of diversion still has an impact on the existence of mental/psychological and physical pressure on children as victims. Therefore, from the aspect of protection for victims, the implementation of diversion in cases of the distribution of pornographic videos does not pay enough attention to the rights and mentality of the victim, because the perpetrator continues to distribute the video to his friends during the mediation process. However, the PPA unit of the Gorontalo Regional Police prioritizes the resolution of children's cases outside the court through this diversion and is the main choice in its resolution, on the grounds that there is no deviation from the requirements of diversion, namely criminal acts with a threat of less than 7 years and not a repetition of the crime. The factors that influence the implementation of diversion against children who are perpetrators of the crime of distributing pornographic videos at the Gorontalo Regional Police are the Intention of the Perpetrator and Family and economic capacity limitations; Lack of public understanding; and The absence of LPSK in Gorontalo thus hindering and influencing the provision of decisions on compensation that must be received by families and victims of the distribution of pornographic content in Gorontalo.

Abstract

The phenomenon of violence against pets is increasingly prevalent in Indonesia, including malpractice committed by pet shops that provide medical services without proper authorization. This study aims to analyze the criminal legal liability for pet malpractice by pet shops and to identify the inhibiting factors in law enforcement in Gorontalo City. The research adopts a normative-empirical approach through a two-month field study using purposive sampling techniques involving cat lover communities, victims, and the police. Primary data were obtained through interviews and observations, while secondary data were collected through literature studies. The discussion highlights the case of Liga Pet Shop, which performed tail docking and administered restricted drugs without authorization—acts that fulfilled the elements of actus reus and mens rea, violating Article 302 of the Indonesian Criminal Code (KUHP) and Law No. 41 of 2014 on Animal Husbandry and Animal Health. However, criminal liability was not strictly enforced and concluded only with an apology. Inhibiting factors include weak specific regulations, limited competence of animal forensic officers, lack of investigative facilities, low public legal awareness, and a permissive culture in dispute resolution. The proposed recommendations include strengthening regulations by establishing standard operating procedures (SOPs) for pet shops, enhancing officer competence through animal forensic training, providing adequate investigative infrastructure, and launching public legal awareness campaigns. The study concludes that reforming the animal legal protection system is necessary through an integrative approach combining repressive, educational, and preventive measures to achieve fair and effective law enforcement
