Abstract

Abstrak Pengabdian masyarakat dilakukan di Pulau Doom Kota Sorong, hambatan yang dihadapi rendahnya kesadaran hukum terkait perlindungan hak-hak perempuan dan anak. Meskipun memiliki potensi ekonomi dan sosial yang besar, masyarakat Pulau Doom masih menghadapi tantang kekerasan dalam rumah tangga dan rendahnya pemahaman hukum. Tujuan kegiatan ini adalah untuk meningkatkan kesadaran dan pemahaman hukum masyarakat melalui penyuluhan hukum yang difokuskan pada perlindungan perempuan dan anak, serta memperkuat ketahanan ekonomi dan keluarga. Kegiatan ini melibatkan warga setempat, tokoh masyarakat serta siswa/i dengan total 79 responden. Metode yang digunakan adalah penelitian empiris dengan pendekatan deskriptif kualitatif melalui pengumpulan data primer dari wawancara dan penyuluhan hukum, serta data sekunder dari studi pustaka. Program dilaksanakan dalam beberapa tahapan meliputi identifikasi permasalahan, penyuluhan huum, konsultasi hukum, pendampingan serta evaluasi program melalui prestest dan posttest. Hasil kegiatan menunjukkan peningkatan signifikan pada pemahaman masyarakat tentang hak-hak perempuan dan anak. Sebelum penyuluhan 70% responden memiliki pemahaman yang sangat rendah, namun setelah kegiatan hanya 15% yang masih pada kategori tersebut, sementara 60% masuk kategori “cukup dan baik” dan 25% “sangat baik”. Penyuluhan juga berhasil meningkatkan kesadaran siswa/i terkait hak-hak korban dan prosedur pelaporan kekerasan. Meskipun program ini berhasil meningkatkan pemahaman hukum secara signifikan, tantangan seperti rendahnya kesadaran awal dan keterbatasan pemahaman hukum di kalangan aparat distrik masih dihadapi. Diperlukan upaya berkelanjutan seperti sosialisasi, pelatihan dan kolaborasi bersama tokoh masyarakat serta peningkatan kapasitas aparat distrik untuk keberlanjutan program ini guna menciptakan lingkungan yang aman dan bebas dan kekerasan di Pulau Doom Kota Sorong. Kata kunci: penyuluhan hukum; kesadaran hukum masyarakat; hak-hak perempuan dan anak; perlindungan perempuan dan anak. Abstract Community service is carried out on Doom Island, Sorong City, the obstacles faced are low legal awareness related to the protection of the rights of women and children. Despite having great economic and social potential, the people of Doom Island still face the challenge of domestic violence and low understanding of the law. The purpose of this activity is to increase community legal awareness and understanding through legal counseling focused on protecting women and children, as well as strengthening economic and family resilience. This activity involved local residents, community leaders and students with a total of 79 respondents. The method used is empirical research with a qualitative descriptive approach through primary data collection from interviews and legal counseling, as well as secondary data from literature studies. The program was carried out in several stages including problem identification, legal counseling, legal consultation, mentoring and program evaluation through prestest and posttest. The results showed a significant increase in the community's understanding of the rights of women and children. Before counseling 70% of respondents had a very low understanding, but after the activity only 15% were still in that category, while 60% were in the “fair and good” category and 25% were “very good”. The counseling also succeeded in increasing students' awareness of victims' rights and procedures for reporting violence. Although the program was successful in significantly improving legal understanding, challenges such as low initial awareness and limited understanding of the law among district officials are still faced. Continuous efforts such as socialization, training and collaboration with community leaders as well as capacity building of district officials are needed for the sustainability of this program to create a safe and violence-free environment in Doom Island, Sorong City. Keywords: legal counseling; community legal awareness; rights of women and children; protection of women and children.

Abstract

This study aims to analyze the validity of the detention clause diploma by the company through the perspective of labor law and power relations theory. The phenomenon of diploma withholding is still found in the practice of Labor Relations in Indonesia, although it has no explicit legal basis in labor regulations and is often justified as a form of safeguarding the interests of the company. This practice reflects the inequality of positions between employers and workers, giving rise to an urgency to reassess its legal legitimacy within the framework of protecting the fundamental rights of workers. The research method used is juridical normative approach to legislation and conceptual. The results showed that the detention of diplomas is contrary to the principles of freedom of work, the principle of equality, and respect for human dignity as reflected in Law Number 13 of 2003 concerning manpower amended by Law Number 6 of 2023 concerning the establishment of government regulations in lieu of Law Number 2 of 2022 concerning job creation into law. The conclusion of the study confirms that the diploma withholding clause in the employment agreement is invalid and should have been declared null and void. The novelty of the study lies in the use of Michel Foucault's theory of power relations to explain the detention of diplomas as an instrument of control that maintains the structural dominance of employers over workers in modern industrial relations.

Abstract

Introduction: Economic globalization has strengthened foreign investment flows in developing countries such as Indonesia and Vietnam. However, investment policy orientations that overemphasize economic efficiency often ignore social justice for local communities. This inequality raises the need to revisit the legal framework that governs the relationship between foreign investors and the recipient community. Customary law is seen as a source of values and moral principles that can strengthen social legitimacy in the practice of foreign direct investment (FDI).Purposes of the Research:  This study aims to analyze how customary law can play a role in restoring social justice through the implementation of corporate social responsibility (CSR) and performance requirements in foreign investment, by comparing the legal frameworks of Indonesia and Vietnam, this study seeks to find a model of customary law integration that is able to balance economic interests with the social and cultural values of local communities.Methods of the Research: This study uses a normative-comparative legal approach by analyzing laws and regulations, policy documents, and CSR implementation practices in Indonesia and Vietnam. Data was collected through literature studies and content analysis of various primary and secondary legal sources. A comparative approach is used to identify similarities and differences in the application of customary law as the basis for foreign investment policies in both countries.Results of the Research: The results of the study show that Indonesia has adopted customary law principles, such as mutual cooperation and social justice, within the legal framework of CSR and investment performance requirements. In contrast, Vietnam still emphasizes socialist state policies without explicit recognition of local customary law values. The integration of customary law has been proven to strengthen the social legitimacy and sustainability of investments, as it fosters corporate social responsibility that is in line with community values and promotes more equitable and inclusive development.

Abstract

This study aims to analyze the role and patterns of adolescent involvement as drug couriers in Sumbawa Barat Regency, identify the factors influencing adolescents' vulnerability within drug trafficking networks, and assess the effectiveness of law enforcement and prevention strategies implemented from the perspective of child protection and the juvenile justice system. The method of research used is a qualitative approach with a case study strategy thru in-depth interviews with law enforcement officers, field observations, and the study of official documents related to narcotics cases involving adolescents. The novelty of this research lies in its specific focus on examining the position of adolescents as drug couriers in the Sumbawa Barat Regency, which has been minimally studied in the literature on juvenile criminal law in Indonesia. The study's results indicate that law enforcement against juvenile drug couriers still faces various obstacles, including legal procedures that are not yet fully child-friendly, weak rehabilitative orientation, and lack of coordination between law enforcement agencies and rehabilitation institutions. This study concludes that there is a need to strengthen the capacity of law enforcement officers, optimize rehabilitation programs, and consistently apply preventive and restorative approaches so that the handling of drug cases involving adolescents is not only repressive but also capable of sustainably reducing the involvement of adolescents in drug trafficking.

Abstract

The rapid development of information and communication technology has significantly transformed students’ social interactions, particularly through digital platforms, which has also increased the risk of cyberbullying. This study aims to examine the role of educational policy in mitigating cyberbullying and its impact on students’ cognitive development. A quantitative approach with an ex post facto design was employed, involving elementary school students as research participants. Data were collected using Likert-scale questionnaires measuring educational policy implementation, cyberbullying experiences, and cognitive development, and were analyzed using descriptive statistics, multiple regression, and path analysis.The findings indicate that educational policy has a significant negative effect on cyberbullying, suggesting that better policy implementation contributes to reducing cyberbullying incidents. Furthermore, cyberbullying has a significant negative impact on students’ cognitive development, particularly in terms of concentration, critical thinking, and problem-solving abilities. The mediation analysis reveals that cyberbullying acts as an intervening variable in the relationship between educational policy and cognitive development. This means that educational policy not only has a direct influence on cognitive outcomes but also indirectly affects them through the reduction of cyberbullying.These results highlight the importance of strengthening educational policies that integrate digital literacy, character education, and preventive strategies to create a safe learning environment. Effective policy implementation can minimize the negative impact of cyberbullying and support optimal cognitive development among students. This study contributes to the existing literature by providing empirical evidence on the interconnected relationship between educational policy, cyberbullying, and cognitive development in the context of digital education.

Abstract

This study aims to analyze unfair business competition practices and their resolution mechanisms in government procurement of goods and services in Indonesia using Lawrence M. Friedman's legal system theoretical framework. The study method used is normative legal research with a legislative, conceptual, and case study approach, which is analyzed qualitatively through a review of legislation, decisions of the Business Competition Supervisory Commission (KPPU), and relevant legal literature. Case studies were conducted by analyzing three KPPU decisions that represent patterns of tender collusion in procurement, namely the Revitalization of Taman Ismail Marzuki (TIM) Phase III case, the provision of clean water in North Lombok, and the construction of the Prabumulih Mall. The novelty of this research lies in the simultaneous integration of weaknesses in legal structure, legal substance, and legal culture to assess the effectiveness of antitrust law enforcement in the procurement sector. The results of the study show that the main obstacles to the enforcement of business competition law not only stem from regulatory loopholes and definitions of norms that are not yet operational, but are also influenced by institutional capacity constraints, weak inter-agency coordination, and a permissive culture towards collusion in procurement practices. This study emphasizes that strengthening the effectiveness of law enforcement requires practical measures such as refining the norms prohibiting collusion, integrating sanctions and a database of violations into the national e-procurement system, and strengthening the synergy between KPPU and LKPP through a post-decision monitoring mechanism to prevent repeat violations. The conclusion of the study states that regulatory reformulation, strengthening of supervisory institutions, and renewal of the culture of compliance are key prerequisites for the realization of transparent, fair, and accountable procurement governance.

Abstract

Penelitian ini menganalisis keterbatasan Undang-Undang Nomor 30 Tahun 1999 dalam mengakomodasi arbitrase digital serta merumuskan model E-arbitration Framework Indonesia. Metode yang digunakan adalah hukum normatif dengan pendekatan konseptual dan perbandingan. Hasil penelitian menunjukkan bahwa ketiadaan pengaturan eksplisit mengenai kontrak elektronik, tanda tangan digital, bukti elektronik, serta prosedur dan putusan arbitrase digital menimbulkan ketidakpastian hukum dan hambatan dalam praktik, khususnya pada tahap pembuktian dan eksekusi. Secara praktis, kondisi ini menurunkan efisiensi dan kepercayaan pelaku usaha terhadap arbitrase nasional. Penelitian ini menawarkan model E-arbitration Framework yang terstruktur melalui integrasi aspek normatif, institusional, prosedural-teknis, teknologi, dan kapasitas sumber daya manusia, dengan berlandaskan asas otonomi para pihak, kepastian hukum, dan efisiensi. Kontribusi penelitian ini terletak pada perumusan model konseptual-operasional sebagai dasar reformasi hukum arbitrase Indonesia yang adaptif dan aplikatif.

Abstract

Introduction: Legal pluralism in the health sector is an important issue in countries with high social and cultural diversity such as Indonesia and India. Both countries have dual legal systems that combine state formal law with customary law that lives in communities, and the regulation and implementation of health services in practice are often colored by overlapping authority, local cultural values, and differing views on the legitimacy of traditional healing. This phenomenon poses challenges in realizing justice, access, and equity in health services. Purposes of the Research: This research aims to examine in depth the relationship and dynamics between the customary law system and the formal legal system in the context of health law in Indonesia and India. This study seeks to identify forms of interaction, potential conflicts, and opportunities for harmonization between the two legal systems in regulating traditional medicine practices and modern health services. Methods of the Research: This research uses a qualitative approach with comparative study methods and normative legal analysis. Data was collected through literature studies and analysis of laws and regulations. This approach allows mapping the relationship between customary norms and formal law and their influence on national health policy. Results of the Research: The results show that both Indonesia and India face similar challenges in integrating customary law systems with formal health laws. In Indonesia, customary law is constitutionally recognized but has not been fully integrated into health regulations. In India, traditional medicine systems such as Ayurveda and Unani gained stronger legal recognition. The study underscores the importance of an inclusive model of legal pluralism to ensure the protection of public health without neglecting local wisdom.

Abstract

Pemanfaatan musik di ruang komersial menimbulkan kewajiban pembayaran royalti sebagai bentuk perlindungan hak ekonomi pencipta. Namun, mekanisme pemungutannya oleh Lembaga Manajemen Kolektif (LMK) kerap memicu sengketa, seperti dalam kasus Mie Gacoan. Penelitian ini bertujuan menganalisis pemanfaatan karya cipta di ruang komersial, kedudukan hukum LMK, dan konflik hukum dalam sengketa Mie Gacoan dengan LMK menggunakan metode yuridis normatif melalui pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa meskipun LMK memiliki kewenangan normatif yang kuat, lemahnya transparansi, akuntabilitas, dan kepastian tarif royalti menimbulkan konflik serta ketidakpastian hukum. Oleh karena itu, rekonstruksi tata kelola LMK melalui penguatan regulasi, standardisasi tarif, dan peningkatan mekanisme pengawasan diperlukan guna menjamin keseimbangan antara perlindungan hak pencipta dan kepastian hukum bagi pengguna komersial.

Abstract

Policy brief ini menyoroti peran LLDIKTI Wilayah VI dalam memfasilitasi tata kelola Beasiswa KIP Kuliah di Perguruan Tinggi Swasta (PTS) Jawa Tengah. Kajian ini menunjukkan bahwa fasilitasi yang berjalan saat ini masih lebih berfokus pada verifikasi administratif melalui sistem SIBRAJA, sementara pembinaan substantif bagi pengelola PTS masih terbatas. Kondisi tersebut diperparah oleh rendahnya pemahaman regulasi, tingginya rotasi pengelola beasiswa di tingkat PTS, serta belum optimalnya integrasi sistem informasi. Temuan juga menunjukkan bahwa kapasitas kelembagaan PTS berhubungan dengan kualitas layanan yang dirasakan mahasiswa, terutama dalam proses pencairan beasiswa. Karena itu, penguatan kapasitas sumber daya manusia menjadi prioritas utama, diikuti dengan perbaikan pembinaan, integrasi sistem informasi, penataan lini masa pelaksanaan, serta penyempurnaan petunjuk teknis. Mengingat cakupan kajian masih terbatas, temuan ini perlu dipahami sebagai indikasi awal untuk mendukung perbaikan kebijakan lebih lanjut, termasuk melalui pelibatan pengelola program di tingkat pusat.
