Abstract

The Mayor of Pekanbaru issued Pekanbaru Mayor Regulation Number 104 of 2020concerning Guidelines for New Life Behavior for Productive and Safe Communities in thePrevention and Control of Corona Virus Disease 2019 (COVID-19) in Pekanbaru City.However, its implementation is still not effective. The formulation of the problem in thisresearch are (1) Is this Perwako effective; (2) What are the obstacles that make this Perwakoineffective; and (3) What efforts can be made to make this Perwako effective. The purpose ofthis research is to find out the effectiveness, obstacles and efforts so that Perwako PekanbaruNumber 104 of 2020 concerning Guidelines for New Life Behavior for Productive and SafeCommunities in the Prevention and Control of COVID-19 in Pekanbaru City (Case Study ofPasar Bawah Pekanbaru) is effective.The type of research used in this research is sociological law research. Thepopulation in this study are (1) the Head of Complaints, Policy, and Licensing Services for theInvestment and One Stop Service Office; (2) Deputy Coordinator of the COVID-19 Task ForceSecretariat; (3) Head of the Operations and Public Order Division of the Civil Service PoliceUnit; (4) Bottom Market Manager; (5) Lower Market Visitors; and (6) Lower Market Traders,with a total sample of 44 people. Research location in Pasar Bawah Pekanbaru. Datacollection techniques using observation, interviews, questionnaires and literature, withquantitative data analysis techniques.From the results of the study it was concluded that (1) Perwako Pekanbaru Number104 of 2020 concerning Guidelines for New Life Behavior for Productive and SafeCommunities in the Prevention and Control of COVID-19 in Pekanbaru City (Case Study ofPasar Bawah Pekanbaru) has not been effective; (2) The obstacles that caused theineffectiveness of Perwako Pekanbaru Number 104 of 2020 concerning Guidelines for NewLife Behavior for Productive and Safe Communities in the Prevention and Control of COVID-19 in Pekanbaru City (Case Study of Pekanbaru Bottom Market), namely, as follows: (a) Lackof participation of business actors in providing facilities that support health protocols; (b) Thelegal culture of the community (managers, traders, and visitors) that violates the Perwako;and (c) Compassion on the part of the legal apparatus in imposing fines; (3) Efforts weremade to overcome the violation of Perwako Pekanbaru Number 104 of 2020 concerningGuidelines for New Life Behavior for Productive and Safe Communities in the Prevention andControl of COVID-19 in Pekanbaru City (Case Study of Pasar Bawah Pekanbaru), namely, asfollows: (1 ) Business actors must provide facilities to support health protocols; (2)JOM Fakultas Hukum Universitas Riau Volume IX No. 2 Juli – Desember 2022 Page 2Socialization of Perwako to the public and educating the public about health protocols. Abstract

Law Number 6 of 2014 concerning Villages, in Article 26 paragraph (1) states, "TheVillage Head is in charge of administering Village Government, implementing VillageDevelopment, Village community development, and Village community empowerment". TheVillage Law gains the position of the Village as the "spearhead of development" that is morecomprehensive and tangible by taking into account the principle of diversity, prioritizing theprinciples of village recognition and subsidiarity. Then Government Regulation Number 72 of2005 Article 7 letter b also provides an overview of the implementation of village autonomy in abroad, real, responsible manner, in which it is stated that government affairs are under theauthority of the Regency/City whose arrangements are handed over to the village. The programthat is of concern to the Suka Damai Village Government is the improvement of village roads asthe main means of transportation for the community. Based on this, this study aims to find outhow the implementation of the village head's authority on the development of village roadinfrastructure in the perspective of village autonomy in Suka Damai Village, Rupat UtaraDistrict, Bengkalis Regency.This thesis is a sociological legal research, that is, this research looks at theeffectiveness of the law on villages in implementing the authority of the Village Head in SukaDamai Village, Rupat Utara District, Bengkalis Regency. This study uses primary data sourcesand secondary data sources, also uses data collection techniques in this study are interviews, andliterature review, and concluded in a qualitative way.Based on the research conducted, the results and conclusions are obtained that theVillage Government continues to make improvements by utilizing simple materials producedfrom nature, such as forest wood. The Suka Damai Village Government, assisted by thecommunity, did not hesitate to repair the main axis road that was passed by the villagecommunity in their daily activities. However for maximum improvement, the Suka Damaivillage government is still waiting for budgetary funds from the center. As for the obstacles inthe implementation of the village head's authority on the development of village roadinfrastructure, namely the factors of limited budgets, the high need for village infrastructuredevelopment, and the lack of good communication between the government and tha community.Keywords: Village Head – Infrastructure Development - Village Autonomy

Abstract

In the government system of the Unitary State of the Republic of Indonesia,villages have authority based on origin rights as regulated in Village LawNumber 6 of 2014 article 19 letter a as emphasized in the explanation, namelyrights which are living inheritance and village initiatives or village communityinitiatives in accordance with with the development of society. In addition, basedon Law Number 6 of 2014 concerning Villages, Villages are interpreted asVillages and Traditional Villages or what are called by other names, are legalcommunity units that have territorial boundaries that are authorized to regulateand manage Government Affairs, the interests of the local community based oncommunity initiatives, rights of origin, and/or traditional rights that arerecognized and respected in the government system of the Unitary State of theRepublic of Indonesia. The Village Law recognizes the autonomy possessed by theVillage. Village autonomy is defined as providing opportunities to grow anddevelop following the development of the community itself. Villages, or other verydiverse names in Indonesia, were originally local community organizations thathad territorial boundaries, were inhabited by a number of residents, and hadcustoms to manage themselves, called self-governing communities.The type of legal research used is normative legal research, normative legalresearch is research conducted to collect and analyze secondary data. Innormative legal research, secondary data sources are usually only used, namelybooks, diaries, statutory regulations, court decisions, legal theories and opinionsof leading legal scholars.Efforts must be made so that obstacles in the implementation of the formation ofTraditional Villages can be realized to the fullest, namely: (a) Accelerating theformation of Provincial Regulations and their implementing regulations related toTraditional Villages, (b) Providing Comprehensive Traditional Village Referencesand Studies, (c) Increasing Knowledge of Government Apparatus and Communitytowards Traditional Villages, and (d) Optimizing the socialization of RegionalRegulations related to Traditional VillagesKeywords: Origin Right - Traditional Village - Government.

Abstract

This research was conducted at the Pekanbaru City ManpowerOffice. The problem in this research is how to implement RegionalRegulation Number 13 of 2018 concerning the Placement of LocalWorkers in Pekanbaru City, what are the inhibiting factors and what effortscan be made by the Manpower Office in the future. Data collectiontechniques in this study were conducted by interview method which wasconducted to research subjects by taking the Coordinator for DomesticPlacements and Foreign Workers as Key Informants, the types andsources of this research were primary data and secondary data. Thisresearch is in the form of qualitative analysis using analytical techniquesby describing and presenting theories that are in accordance with theexisting problems in the study This research consists of one variable, namely the implementation of Regional Regulation Number 13 of 2018concerning the Placement of Local Workers in Pekanbaru City by usingthree indicators. as a benchmark, namely mandatory reporting, Job SeekerRegistration and Supervision, research results obtained that theImplementation of Regional Regulation Number 13 of 2018 concerning thePlacement of Local Workers in Pekanbaru City has not been implementedproperly. There are still many companies that do not report any jobvacancies in their company to the Pekanbaru City Manpower Office. Thenin terms of providing guidance and supervision of job seekers, it has beenimplemented but has not been maximized, this is due to the lack of budget, lack of socialization guidance and limited resources. The power of theapparatus and the lack of Company Awareness are the inhibiting factorsfor the implementation of Regional Regulation Number 13 of 2018concerning the Placement of Local Workers in Pekanbaru City. For thisreason, it is hoped that the Pekanbaru City Manpower Office will alwayscarry out regular outreach developments to companies, carry outsanctions strictly in accordance with existing rules without exception andmaintain good cooperative relationships with companies in the city ofPekanbaru. Abstract

Article 29 of Presidential Regulation Number 64 of 2020 has alsobeen stipulated regarding the increase in BPJS Health contributions and theentry into force of the increase. As a result of the ongoing Covid-19 pandemicand, economic conditions have destroyed the national economy and reducedthe level of community welfare. The problem in this research is How is theImplementation of Presidential Regulation Number 64 of 2020 concerningHealth Insurance Related to the Increase in BPJS Contributions inPekanbaru City and What are the inhibiting factors in the implementation ofPresidential Regulation Number 64 of 2020 concerning Health InsuranceRelated to Increase in BPJS Contributions in Pekanbaru City: What are thecountermeasures in implementing Presidential Regulation Number 64 of2020 concerning Health Insurance Related to Increase in BPJS Contributionsin Pekanbaru City.And the results of this research can be concluded that PresidentialRegulation Number 64 of 2020 concerning Health Insurance Related to theIncrease in BPJS Contributions in Pekanbaru City has not been implementedproperly; The inhibiting factor in the implementation of presidentialregulation number 64 of 2020 concerning health insurance is related to thisincrease in contributions, namely causing an impact on BPJS Healthparticipants where the impact is on BPJS Health participants who arereluctant to pay BPJS Health contributions; Efforts have been made toimprove the provide services quickly which participants themselves can nowqueue online, namely without queuing for BPJS Health participants can do awebsite that has been provided by BPJS Health, BPJS Health participantsthemselves can participating in a break program in which BPJS Healthparticipants who are in arrears in making BPJS Health contributions canprovide valuables as collateral until the payment of the arrears is paid off.Keywords: Implementation, BPJS, Health

Abstract

Hutan sebagai salah satu penentu sistem penyangga kehidupan dan sumber kemakmuran rakyat, cenderung menurun kondisinya, begitu pula yang terjadi di Provinsi Riau keberadaan hutan sudah sangat mengkhawatirkan. Mulai dari deforestasi, konflik kehutanan, korupsi kehutanan dan lain sebagainya yang terjadi di Provinsi Riau. Oleh karena itu perlu pengelolaan hutan yang lestari dan berkelanjutan, salah satu upaya yang dilakukan oleh pemerintah adalah melalui Program Perhutanan Sosial. Namun disayangkan keberadaan perhutanan sosial di Provinsi Riau saat ini belum maksimal dan belum sesuai dengan yang ditargetkan oleh pemerintah. Jenis penelitian yang digunakan adalah penelitian hukum sosiologis, yaitu studi-studi empiris untuk menemukan teori-teori mengenai proses terjadinya dan mengenai proses bekerjanya hukum dalam masyarakat. Hambatan dalam Pengelolaan Perhutanan Sosial selama ini di Provinsi Riau antara lain : pertama, minimnya anggaran yang disediakan Kedua, Perizinan dan administrasi yang panjang dan berbelit belit, Ketiga, kesalahan menetapkan target perhutanan sosial berdasarkan luas. Keempat, kesulitan menentukan lokasi lahan, terkadang lahan yang diberikan kepada masyarakat sangat sulit untuk dijangkau, Kelima, komoditi yang ditawarkan ke masyarakat tidak bernilai ekonomis. Untuk mengatasi hambatan di atas, maka perlu dilakukan beberapa hal, di antaranya : pertama, tersedianya anggaran yang memadai. Kedua, Dipermudah perizinan dan administrasi Ketiga, Peningkatan kemampuan sumber daya manusia untuk pendampingan. Keempat, lokasi yang mudah dijangkau oleh masyarakat Kelima, komoditi yang ditawarkan ke masyarakat bernilai ekonomis. Oleh karena itu perlu adanya suatu Model Pengelolaan Perhutanan Sosial Berkelanjutan berdasarkan Nilai-Nilai Kearifan Ekologis di Provinsi Riau dengan menekankan pengelolaan berdasarkan nilai-nilai agama untuk menjaga hutan dan melestarikannya secara berkelanjutan

Abstract

Drug crime is an International crime, organized crime, has an extensive network,has large financial support and already uses advanced technology. This study aims to findout how the legal policy of the establishment of Regional Regulation Number 10 of 2021concerning Facilitation of Prevention, Eradication of Abuse, and Illicit Circulation ofNarcotics. The formulation of the proposed problem is how legal politics and legal policieswill be in the future in Pekanbaru City Regional Regulation Number 10 of 2021 concerningFacilitation of Prevention, Eradication of Abuse, Illicit Circulation of Narcotics from thepolitical aspect of law.The research used is normative legal research that uses library legal research. Theresults of this study show that in the process of forming regional regulations, there arecertainly reasons, this is in consideration of the formation of Regional Regulations on thePrevention, Eradication of Abuse, and Illicit Circulation can be seen from philosophical,juridical, and sociological foundations. In a formation of a regulation, there must be a namefor addition or commonly referred to as Ius Contiuendum which means a rule or policy thatwill be aspired to, in Pekanbaru City Regional Regulation Number 10 of 2021 concerningFacilitation of Prevention, Eradication of Abuse, and Illicit Circulation of Narcotics, thereneeds to be a legal policy in the future in order to facilitate the prevention, eradication ofabuse, and illicit circulation of narcotics In other words, there is a Rules that need to beadded such as the existence of legal protections for the community to exercise their rights orwhere present in the judicial process, then there is a need to add related rules that explainthe supervision of the circulation of narcotics through food.The suggestion proposed by the author is that it is hoped that the government,especially the pekanbaru city regional government as part of the control of a country andthe originator of policies through legal politics that are carried out should be able to betterdetail the things produced, especially in the legal products produced. Pola Perlindungan Hutan Tanah Ulayat Masyarakat Hukum Adat Melayu Riau di Provinsi Riau yang bertujuan untuk membendung agar tidak lagi terjadi pertunpahan darah b a ik dikalangan mayarakat adat yang memiliki hak ulayat, maupun pihak pengusaha selaku pengelola hak ulayat dari masyarakat adat, dapat dilakukan dengan pola antara lain, Pertama, Konversi Hak-hak Adat yang Privat, Kedua, Memperkuat Peran Pemerintah sebagai Pengawas, Ketiga, Re-defenisi Nasionalisme, Keempat, Pemetaan tanah ulayat dan Kelima, Keterlibatan masyarakat Adat dalam proses penggunaan Tanah Ulayat Keenam, adanya Peraturan Daerah tentang Perlindungan Masyarakat Hukum Adat beserta peraturan pelaksana lainnya serta pola-pola pemberdayaan partisipatif merupakan pilihan yang ideal untuk masyarakat hukum adat agar pengelolaan hutan adat yang dilakukan oleh masyarakat hukum adat melayu Riau dapat berjalan dengan baik, berdaya guna dan berhasil guna.

Abstract

Licensing in Indragiri Hilir is fully implemented Online Single Submission(OSS) and licensing in Indragiri Hilir is fully implemented Online SingleSubmission (OSS) as well as conducted based Online Single Submission RiskBased Approach (OSS-RBA) in accordance with Government Regulation Number5 of 2021 concerning Implementation of Risk-Based Business Licensing. OSS RBAis a business license granted to business actors to start and run their businessactivities which are assessed based on the risk level of a business. In TembilahanCity there are several obstacles in the implementation of based licensing OnlineSingle Submission (OSS) as in terms of services and infrastructure.The purpose of this research is to find out the implementation of businesslicensing in Indragiri Hilir Regency, Obstacles in the implementation of businesslicensing and to find out the efforts made by the investment service and one-doorintegrated services in improving business licensing services in Indragiri HilirRegency. This type of research is research using legal research methods using asociological juridical approach in which the author tries to collect data andinterview writing sources which are divided into primary, secondary and tertiarydata.The implementation of risk-based business licensing in Indragiri HilirRegency is fully implemented based on Government Regulation Number 5 of 2021concerning the implementation of risk-based business licensing, in theimplementation of licensing there are several obstacles such as the unavailabilityof online signatures, there are still many permit applicants who do not understandhow to register online so choose to register offline and come directly to theinvestment service and one-stop integrated services. Facilities and infrastructurethat are still not in accordance with applicable laws and knowledge and ability toaccess OSS RBA are still at different levels. To overcome this problem, theinvestment service and one-stop integrated services have made innovations calledJAPRI and SIMPATI which are hoped with this system can facilitate the businesslicensing process in Indragiri Hilir district. Suggestions for socialization tobusiness actors regarding government regulation number 5 of 2021 andprocedures for registering permits online with SIMPATI.Keywords: Licensing, Public Service, OSS.
