Abstract

The purpose of this study is to analyze the regulation related to community participation in the formation of village regulations as well as the ideal form of community participation in the formation of village regulations based on Article 24 of Law Number 6 Year 2014 on Villages. The type of research used by the author is normative legal research with qualitative data analysis that produces descriptive data. The results of this study state that the regulation of community participation in the formation of village regulations based on Article 24 of Law Number 6 of 2014 concerning Villages has failed because the level of community participation is still minimal. The author in this discussion provides an explanation of legal derivatives related to community participation in the formation of village regulations and the ideal form of participatory and transparent village regulations.

Abstract

Tujuan penelitian adalah untuk mengetahui peranan, hambatan dan upaya agar implementasi Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan di Kota Pekanbaru berjalan sesuai peraturan. Jenis penelitian yang digunakan adalah penelitian hukum sosiologi. Populasi dalam penelitian ini adalah Kepala Otoritas Jasa Keuangan Provinsi Riau; Staf Edukasi Perlindungan Konsumen; Komunitas yang terkena dampak. Lokasi penelitian di OJK Kota Pekanbaru. Teknik pengumpulan data menggunakan wawancara dan studi pustaka, dengan analisis data kualitatif. Dari hasil penelitian dapat disimpulkan bahwa implementasi peran Otoritas Jasa Keuangan dalam melindungi data pribadi masyarakat yang melakukan pinjaman online berdasarkan Undang-Undang Nomor 21 Tahun 2011 mengenai Otoritas Jasa Keuangan di Kota Pekanbaru belum dilaksanakan dengan baik; Kendala Otoritas Jasa Keuangan dalam melindungi data pribadi masyarakat yang melakukan pinjaman online berdasarkan Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan di Kota Pekanbaru yaitu karena kurangnya kesadaran masyarakat dalam melakukan pinjaman online dan tidak mengetahui yang mana. lembaga keuangan pinjaman online legal dan diperbolehkan OJK; Upaya yang dilakukan adalah dengan memberikan sanksi kepada lembaga keuangan yang ilegal atau tidak diizinkan oleh OJK, dimana sanksi yang diberikan berupa sanksi administratif yang diatur dalam PJOK Nomor 10 Tahun 2022 tentang Layanan Pendanaan Bersama Berbasis Teknologi Informasi. tepatnya pada Pasal 49.

Abstract

The function of the DPRD regarding authority in terms of supervision over the implementation of Regional Regulations is also regulated in Article 101 Paragraph (1) C of Law Number 9 concerning the second amendment to Law Number 23 of 2014 which reads: "The Provincial DPRD also has duties and authority carry out supervision over the implementation of Provincial Regional Regulations and the Provincial APBD”. Therefore, the aim of this thesis research is first, to find out the supervision of the Regional People's Representative Council (DPRD) in Siak Regency in the perspective of Law Number 23 of 2014 concerning Regional Government. Second, to find out the influencing factors of the Regional People's Representative Council (DPRD) in Siak Regency in improving the supervisory function. Third, to find out the efforts made by the Regional People's Representative Council (DPRD) in Siak Regency to improve its supervisory function. This type of research is classified as a qualitative research type. This research uses secondary data consisting of primary legal materials, secondary legal materials, tertiary legal materials and data collection techniques carried out using library research methods, then qualitative analysis is carried out. From this research there are three main things that can be concluded. First, what needs to be considered is the implementation process. The responsibility of DPRD members to carry out supervision and guidance is a crucial aspect of their role. They must ensure that appropriate oversight is in place to maintain the integrity and effectiveness of their organizations. Second, . Factors that hinder the effective implementation of the DPRD's duties and functions include limited human resources (HR) for Siak district DPRD members who only have little and limited political experience, inadequate supporting facilities and infrastructure and an inadequate budget. Third, Siak Regency DPRD's supervision of the 2016 to 2019 APBD was carried out through field visits and hearings with work unit leaders. This inspection is carried out in three stages, namely the planning stage, implementation stage and accountability stage. Author's suggestions First, to increase the capacity of the DPRD in carrying out its main tasks and functions, this institution positions itself more professionally and independently as an organization outside the executive agency that has a supervisory function. Second, we hope that the implementation of the supervisory function of the Siak Regency DPRD can be carried out optimally and effectively so that there is a check and balance between the DPRD and the regulator in implementing it. Third, the way to show DPRD supervision is to provide initial Regional Regulations to the DPRD which outlines the responsibilities for implementing the APBD

Abstract

Single Identity Number (SIN) is a population identity number that is unique or distinctive, single and attached to someone who is registered as an Indonesian resident. Indonesian citizens and foreigners who have permanent residence permits are only allowed to be registered on one Family Card. This means that a person who is polygamous, even though both marriages are legally valid, cannot be registered on two Family Cards (KK). This is because each resident can only have one Population Identification Number (NIK) which is recorded on one family card (KK). If more than one family card is recorded, it will be recorded as duplicate data. One case of having a SIN occurred in a person named Mr. S. Mr. S had 2 family cards. The reason he has two family cards is because he is polygamous which requires him to be the head of a family who has two wives and two family cards. This research discusses the Single Identity Number in the Family Card to reduce the number of unregistered marriage couples in Pekanbaru City and what factors inhibit the implementation of the Single Identity Number Family Card as well as the efforts made by the Pekanbaru City Government in the Family Card making service.

Abstract

Penyelenggaraan pelayanan publik merupakan upaya negara untuk memenuhi kebutuhan dasar dan hak-hak sipil setiap warga negara. Pelayanan dalam pembuatan E-KTP merupakan salah satu contoh bentuk pelayanan publik yang diberikan pemerintah. Salah satu kabupaten yang menjadi perhatian dan fokus dalam penelitian ini adalah Kabupaten Bengkalis. Penelitian ini bertujuan untuk mengetahui dan menganalisis Implementasi Pelayanan Publik Pada Dinas Kependudukan dan Pencatatan Sipil Kabupaten Bengkalis. Pendekatan penulisan penelitian ini dilakukan secara sosiologis. Sosiologis yuridis yang artinya meninjau keadaan permasalahan yang ada dilapangan dikaitkan dengan aspek hukum yang berlaku dan yang mengatur permasalahan tersebut. Penelitian ini dilakukan di Kabuapaten Bengkalis. Sumber data yang digunakan ialah dari data primer, data sekunder dan data tersier dengan teknik pengumpulan data dengan cara melalui wawancara, kuesioner dan kajian kepustakaan. Hasil penelitian menunjukan bahwa dalam segi pelayanan dan implementasi berdasarkan asas pelayanan publik masih ada beberapa yang kurang contohnya seperti prinsip profesionalitas pekerja, sumber daya manusia, dalam segi waktu, dan keadilan. Beberapa faktor penghambat yang sedikit siknifikan yakni dalam segi estimasi waktu, terhambatnya karena jaringan dalam pembuatan E-KTP dan kurangnya kesadaran masyarakat dalam melengkapi persyaratan-persyaratan. Upaya untuk meningkatkan kualitas pelayanan publik yaitu Jemput Bola dan Pengembangan Budaya Kerja bagi Dinas Kependudukan dan Pencatatan Sipil Kabupaten Bengkalis.

Abstract

Fast Track Legislation is the process of forming laws through discussion stages that can be carried out quickly to avoid the process of forming legislative regulations being very fast, giving the impression of being haphazard. With the presence of the concept of fast track legislation, it at least limits and gives authority to anything that can be said to be a fast legislative process. The presence of fast track legislation in Indonesia not only creates regularity in structuring legislative functions in responding to emergency or urgent events but also places limits on a legislative process that can be carried out quickly. This research aims to find out the arrangements and practices of Fast Track Legislation in Indonesia, to find out the arrangements and practices of Fast Track Legislation in various countries and to find out projections for the adoption of Fast Track Legislation into the law formation system in Indonesia. The regulation and practice of Fast Track Legislation in various other countries, namely New Zealand, is based on motion urgency. The United Kingdom recognizes the existence of a fast track legislation mechanism to meet people's needs quickly. The United States regulates fast-track legislation in the House Rules and Manual and Ecuador, as stated in Article 140 of the Ecuador Constitution, regulates fast-track legislation. Regulations and practices of Fast Track Legislation in Indonesia where positive law in Indonesia does not specifically regulate fast track legislation mechanisms. The projected adoption of Fast Track Legislation into the law formation system in Indonesia cannot be separated from 2 (two) criticisms if it is later adopted in the formation of laws in Indonesia, namely, first, concerns about the loss of public participation in discussing laws.

Abstract

The Constitutional Court is a state institution that was formed after the amendment to the 1945 Constitution. In this context, the Constitutional Court has a vision in enforcing the constitution which aims to create a state that strictly adheres to law and democracy in the administration of state life. The Constitutional Court has 9 (nine) constitutional judge members appointed by the President, each of whom is appointed 3 (three) people by the Supreme Court, 3 (three) people by the DPR and 3 (three) people by the President. One of the reasons for the DPR's involvement in filling the position of constitutional judge after the 1945 Constitution was the phenomenon of strengthening the DPR in the Indonesian constitutional system during the democratic transition period through changes to the 1945 Constitution. However, this involvement has the potential to give rise to a number of problems, including the existence of the DPR's authority which is very decisive in the selection process for constitutional judges can give rise to problems of politicization. The aim of this research is to determine the implementation of the authority of the People's Representative Council in filling the positions of constitutional judges based on the principles of the rule of law and democracy in Indonesia and to find out the ideal model for filling the positions of constitutional judges from the authority of the People's Representative Council in the future. The results of this research explain that first, the DPR's authority to fill the position of constitutional judge is not in accordance with the principles of democracy and the principles of the rule of law because when filling the constitutional judge, the DPR actually has full authority over the nomination of 3 constitutional judges. Second, the Recruitment and Selection Model for Constitutional Court Judges using a Selection Panel either by the respective Institution Proposing Constitutional Judges or a selection Panel in the form of an agreement with the Institution Proposing Constitutional Judges is a legal reform whose main aim is to produce constitutional judges who have the ideal integrity as a statesman Really.

Abstract

Higher education institutions in realizing the implementation of education,research and community service, always uphold the values and norms in order to createa conducive academic climate. Guidance regarding academic integrity is an effort madeby higher education institutions in order to shape the character of academicians withintegrity, and maintain academic culture in higher education. Based on Article 5 ofPermendikbudristek Number 39 of 2021, it is stated that the guidance of academicintegrity values is carried out, one of which is through the establishment of regulationsregarding academic integrity in producing scientific works. The purpose of writing thisthesis is; First, to find out the Implementation of Permendikbudristek Number 39 of 2021concerning Academic Integrity in Producing Scientific Works at the University of Riau.Second, to find out the inhibiting factors and efforts to overcome obstacles to theImplementation of Permendikbudristek Number 39 of 2021 concerning AcademicIntegrity in Producing Scientific Works at the University of Riau.This type of research is empirical legal research, namely a research approach thatemphasizes legal aspects related to the main problem to be discussed, linked to the realityin the field. This research was conducted at the University of Riau. From the results ofthe problem research, there are two main things that can be concluded. First, theimplementation of Permendikbudristek Number 39 of 2021 at the University of Riau hasnot been optimally implemented. The implementation of academic integrity in producingscientific works at UNRI in the process of its implementation is still guided by the oldregulations and the new regulations are still in draft form which have not been stipulatedin the Chancellor's Regulation. Second, the technical regulations related to academicintegrity in producing scientific works with the Chancellor's Regulation have not beenstipulated due to the busyness of the UNRI apparatus and leadership. Abstract

The constitution is all the provisions and basic rules regarding state administration. A country's existence cannot be separated from the underlying constitution. The supervisory function is one of the spirits of the people's representatives. Supervision is the main role or responsibility of DPRD in representing the community. Supervision must be carried out in a structured and good manner, so that the community is truly fulfilled in conveying their aspirations as well as controlling the work carried out by the government, in this case the regional head. From the results of the research it is concluded that First, Regulations on regional head regulations are regulated in the Minister of Home Affairs Regulation Number 120 of 2018 concerning Amendments to the Minister of Home Affairs Regulation Number 80 of 2015 concerning the Formation of Regional Legal Products. and Law Number 23 of 2014 concerning Regional Government. In the formation of governor regulations, there are two main types: those mandated by higher rules and those formed based on the authority of the regional head. The Riau Province Regional People's Representative Council (DPRD) has the authority to oversee the formation of gubernatorial regulations that are mandated by higher rules, while for gubernatorial regulations that are more related to autonomy functions, the DPRD has no obligation or right to oversee either the ratification or implementation. Second, Although each member of the DPRD has a supervisory function, their responsibilities are limited to commissions in public hearings without a special agenda for annual or semesterly supervisory meetings. Third,Regarding the ideal concept of regulation related to supervision of regional head regulations, considering that there are only general rules, it is necessary to make specific rules related to this supervision. This technical supervision can be made by the Minister of Home Affairs or by the regions themselves, considering that regional authority in regulating their own households has been legitimized through regional autonomy. In addition, technical regulations related to this supervision will strengthen the performance of the DPRD in legislation and supervision..

Abstract

Undang-Undang Dasar 1945 (UUD 1945) sebagai salah satu norma fundamental yang dimana harus dijadikan panduan atau acuan maka kita harus bisa melihat bagaimana menafsirkan setiap bab, pasal ataupun ayat-ayat yang terkandung di dalamnya. Sehingga kita bisa menarik kesimpulan tentang hak dan kewajiban negara ataupun masyarakat. Salah satunya adalah penarikan kesimpulan tentang bagaimana relevansi dari UUD 1945 terutama Pasal 28G ayat 1 dengan hak privasi dari masyarakat Indonesia. Hal ini juga bermaksud untuk melihat kondisi Indonesia yang dimana akhir-akhir ini hak privasi seseorang seakan-akan tidak ada mengenal batasan ataupun perlindungan atas sifat keprivasian-nya. Dalam kata relevansi itu sendiri terkandung makna kecocokan, kaitan, ataupun keselarasan, terutama dalam melihat keterkaitan antara hak privasi dengan Pasal 28G ayat 1 UUD. Tujuan penelitian ini adalah untuk mengetahui substansi pengaturan hak privasi dan untuk mengetahui apakah perlindungan hak privasi dalam Undang- Undang No 19 Tahun 2016 tentang ITE sudah sesuai dalam Undang-Undang Dasar 1945 dan juga melihat bentuk perlindungan hak privasi yang sesuai. Penelitian ini adalah penelitian hukum normatif, karena didasarkan pada penelitian kepustakaan yang mengambil kutipan dari buku bacaan, literatur, atau buku pendukung yang memiliki kaitannya dengan permasalahan yang akan diteliti dibantu dengan sumber data primer, sekunder dan tersier. Penelitian ini menggunakan analisis data kualitatif dan menghasilkan data deskriftif. Dari hasil penelitian, disimpulkan bahwa, Pertama, Pengaturan tentang substansi hak privasi dalam UUD 1945 ini memanglah tidak dijelaskan secara terperinci di dalamnya. Namun jika di lihat dari bagaimana cara kita menjabarkan isi dari Pasal 28 G UUD 1945 dapat dinilai sebagai sebuah bentuk dari perlindungan hak privasi seseorang yang di sampaikan secara umum sehingga pemerintah perlu membuat UU tentang hak privasi. Kedua, Melihat bagimana UU ITE ini, yg berlaku sejak 2008 dan baru sekali terjadi revisi pada tahun 2016, maka perlulah pemerintah melakukan revisi kembali dengan melihat aspek-aspek yang mempengaruhinya, terutama pada Pasal 27 ayat (1), (3), Pasal 28 ayat (2) dan Pasal 29, karena pasal- pasal tersebut di cap sebagai pasal karet. Ketiga, Bentuk perlindungan hak privasi yang sesuai dengan UUD 1945 adalah perlindungan hak privasi yang dibuat sesuai dengan amanat dan isi dari UUD 1945 dan juga melihat dari aspek-aspek lain yang hidup dan berkembang dimasyarakat. Saran Penulis adalah, Pertama, diharapkan pemerintah dapat membuat regulasi khusus yang membahas tentang hak privasi ini. Kedua diharapkan pemerintah melakukan revisi terhadap beberapa pasal karet yang terdapat pada Pasal 27 ayat (1), ayat (3), Pasal 28 ayat (2) dan Pasal 29. Ketiga, diharapkan saat pembentukan RUU khusus hak privasi ini untuk memasukan perihal pengawasan terhadap pengumpulan data pribadi individu.
