Abstract

Legal Politics which is the direction of a legal policy made officially by the stateregarding laws that will be enforced or will not be enforced to achieve state goals within acertain period as well as a formal-procedural mechanism that determines whether or not thislaw-making procedure is legal can be related to legal development which cannot be separatedfrom the social reality that lives in a country. The dissolution of political parties is regulated inarticles 68 to 73 of Law no. 24 of 2003 concerning the Constitutional Court. As in other cases,in an application for the dissolution of a political party, there are three (3) possible decisionsthat will be handed down by the constitutional court, namely the application is declaredinadmissible, the application is granted and the application is decided within 60 days. If theconstitutional court is of the opinion that the petition does not meet the requirements. So thatresulted in weaknesses in the constitutional court, related to the existence of Legal Standingholders for proposing the dissolution of political parties which were only proposed by thegovernment. Until now, the Constitutional Court has never decided to disband a political partybecause it has never been brought to court.The purpose of this study is to find out an idea that there is a weakness in theConstitutional Court in the dissolution of political parties in Indonesia. This type of researchis normative in which the writer tries to collect and analyze bibliographical data as a writingsource which is divided into primary, secondary and tertiary data.The results of this study are that the dissolution of political parties is due to partyactivities that are contrary to Pancasila, and the 1945 Constitution of the Republic ofIndonesia. So that there is a weakness in the Constitutional Court in dissolving politicalparties, which no longer fulfills the requirements determined by laws and regulations anddoes not carry out its obligations and does not carry out its functions in accordance withapplicable laws and regulations, in laws and regulations, legal politics has a very importantrole as a necessary reason in the formation of a statutory regulation and becomes aformulation in articles. Indonesia is a democratic country that must uphold democratic valuesand the concept of law must have an obligation to guarantee legal order, guarantee theupholding of a law as a prosperous socio-economic concept for service.Keywords: Legal Politics - Constitutional Court - Dissolution of Political Parties

Abstract

Law Number 52 of 2009 concerning population development and familydevelopment, population is matters relating to the number, structure, growth,distribution, mobility, distribution, quality, and welfare conditions relating topolitics, economics, socio-culture, religion and the environment resident. Inwriting, the author focuses on the ideal spacing of child births in Law Number 52of 2009 concerning Population Development and Family Development. Thepurpose of writing this thesis is first to find out how to regulate the ideal spacingof child births in Law Number 52 of 2009 concerning Population Developmentand Family Development. Second, to find out how the ideal concept of spacingchildren's births in Indonesia is in Law Number 52 of 2009 concerningPopulation Development and Family Development.The author conducted research using normative juridical methods orliterature studies in order to obtain secondary data through documentary studies,namely by studying and analyzing descriptively comparative laws and regulationswith theories that have a relationship to the problems studied.From the results of the study there are two main things that can beconcluded, firstly, the regulation regarding the ideal spacing of child births in lawnumber 52 of 2009 concerning population development and family development isregulated in article 4 and article 21, the second is the ideal concept in regulationspacing of child births in Indonesia in law number 52 of 2009 concerningpopulation development and family development is 18-23 months between twopregnancies is the best and most ideal because the mother has time to recover andreplenish the body's resources.The author's suggestion, in this study, is to suggest that the implementationof the central government and local governments issue further regulations interms of setting the ideal spacing for child births so that there is legal certainty,setting the ideal spacing for child births will have an impact on mothers andbabies so that the health of mothers and babies is maintained and also applies tothe economic, social and cultural sectors of society.Keywords: Policy, Ideal Distance of Child Birth, Law Number 52 of 200.

Abstract

Villages as the smallest government entity within the state framework were affirmed by theissuance of Law No. 6/2014 on Villages (Village Law). The issuance of the Village Law notonly provides regulatory changes but also provides a paradigm shift regarding the Village,which was originally seen as an extension of the regency or city into an autonomouscommunity unit that has the right and authority to regulate and manage its own territory.Therefore, Article 1 Point 3 of the Village Law mandates the existence of a Villagegovernment organizer, namely led by the Village Head and assisted by Village officialsThis research uses normative legal research. Normative legal research is library legalresearch, namely legal research conducted by making library materials as the main focus.From the results of the research it is concluded that, First, the election of the Village Headfrom the perspective of legal politics is a form of manifestation of democracy at the villagelevel by considering regional autonomy in technical related arrangements by involving thedistrict / city government. Second, the weaknesses of this regulation are quantitative-baseddemocracy or only the highest number of votes, the risk of money politics, the risk ofhorizontal conflict in the community, and conflict due to the determination of the winner ifthe results of the highest number of votes are more than one candidate. The idea ofchanging Article 42 of the Regulation of the Minister of Home Affairs Number 65 of 2017concerning Amendments to the Regulation of the Minister of Home Affairs Number 112concerning Village Head Elections does not have much to do other than rearranging thescheme for determining the winner of the village head election if the number of votes wonis the same.Keywords: Village Head Election, Democracy, Minister of Home Affairs RegulationNo. 65/2017

Abstract

The history of the Indonesian constitution can be said to have gone through various stages of development. Each stage gives rise to a unique constitutional model. After the New Order and the 1998 events, Indonesia began a new chapter in the reform era which saw several government era changes. Each government has its own characteristics in running its government. The aim of writing this article is to understand the implementation of the rule of law and democracy in reform. This research is qualitative research that is bibliographic in nature (library research) to examine the concept of the legal state as the main object in this research. The research results show that a constitutionally based rule of law in a country has characteristics that are each adapted to the nation's philosophy and legal ideals. Therefore, in a democratic rule of law, it is the people who are considered to determine the enactment of a constitution. The embodiment of democratization in Indonesia is the existence of the concept of government decentralization since the reform era as an anti-thesis to the concept of centralization implemented by the New Order. The implication is that there is a shift in the locus of power from the center to the regions. With the spirit of decentralization, regions increasingly have broader autonomous authority.

Abstract

Putusan Mahkamah Konstitusi (MK) Nomor 35/PUU-X/2012 mereview beberapa pasal dalam Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan, terutama Pasal 1 angka (6) yang dinyatakan bahwa kata Negara tentang Kehutanan tidak mempunyai kekuatan hukum mengikat. Hal ini memberikan konsekuensi, yaitu memperkuat kedudukan hutan adat. Namun, disisi lain belum terbentuk suatu pola perlindungan yang pasti sehingga masih rawan konflik. Oleh karenanya, perlu dicarikan pola perlindungan hutan adat pasca putusan MK tersebut. Metode penelitian dilaksanakan secara normatif. Kedudukan hutan adat pasca putusan MK Nomor 35/PUU-X/2012, semula merupakan hutan negara berubah menjadi hutan yang berada dalam wilayah masyarakat hukum adat. Sebagai konsekuensinya memberikan perlindungan hukum bagi masyarakat adat. Pola perlindungan hutan adat pada masyarakat adat di Provinsi Riau pasca putusan MK memberikan hak membuka hutan ulayatnya untuk dikuasai dan diusahakan sepanjang memenuhi syarat dalam cakupan pengertian kesatuan masyarakat hukum adat.

Abstract

AbstractGovernment actions (handeling) with regard to the public sphere often directly intersect with the interests of citizens. This brings together the public interest and the private interest. It is said to be of private interest because every citizen constitutionally also has individual rights that must be protected as part of a citizen's constitutional rights. Such positions often arouse opposition, the coercion of will from the government on the pretext of public interest. In this study, the government's liability in the form of compensation to citizens affected by losses due to unlawful acts committed by the government (onrechtmatige overheidsdaad) will be examined. In this study, the focus of this study will be on solving these problems through litigation, namely the State Administrative Judiciary (PTUN) body. The type of research used is juridical normative with a case study and legislation approach. The conclusion of this study is that the application of compensation against citizens due to unlawful acts of the government through the State Administrative Judicial Institution can be implemented according to the provisions of the legislation in force, only that the claim for compensation through the State Administrative Court is only limited to additional demands, the main demand is to revoke or declare void a State Administrative Decree or a certain governmental act, where the amount of compensation claims can be decided on a technical level its operational is considered proportionally by the panel of judges according to the real losses that can be proved by the citizens of the community. AbstrakTindakan (handeling) yang dilakukan pemerintah yang berkenaan dengan ranah publik sering kali bersinggungan secara langsung dengan kepentingan dari warga negara. Keadaan demikian mempertemukan kepentingan publik dan kepentingan privat. Dikatakan kepentingan privat karena setiap warga negara secara konstitusional juga memilik hak individual yang harus dilindungi sebagai bagian dari hak konstitusional warga negara. Posisi demikian sering menimbulkan pertentangan, pemaksaan kehendak dari pemerintah dengan dalih kepentingan umum. Dalam penelitian ini dikaji mengenai tanggung jawab pemerintah dalam bentuk ganti rugi terhadap warga masyarakat yang terdampak kerugian akibat dari perbuatan melanggar hukum yang dilakukan oleh pemerintah (onrechtmatige overheidsdaad). Adapun dalam penelitian ini difokuskan pada penyelesaian permasalahan tersebut melalui jalur litigasi, yaitu badan Peradilan Tata Usaha Negara (PTUN). Jenis penelitian yang digunakan adalah normatif yuridis dengan pendekatan studi kasus dan undang-undang. Adapun kesimpulan dari penelitian ini adalah penerapan ganti rugi terhadap warga masyarakat akibat perbuatan melanggar hukum pemerintah melalui lembaga Peradilan Tata Usaha Negara dapat dilaksanakan menurut ketentuan perundang-undangan yang berlaku, hanya saja tuntutan ganti rugi melalui Peradilan Tata Usaha Negara hanya sebatas tuntutan tambahan, tuntutan pokoknya adalah mencabut atau menyatakan batal suatu keputusan Tata Usaha Negara atau tindakan pemerintahan tertentu, dimana mengenai besaran tuntutan ganti rugi yang dapat diputuskan dalam tataran teknis operasionalnya dipertimbangkan secara proporsional oleh majelis hakim sesuai dengan kerugian real yang dapat dibuktikan oleh warga masyarakat.

Abstract

Women are a group or group that is vulnerable to violence that occurs in society. To overcome various issues of violence that occur against women, special attention is needed from all groups, both community groups and government circles, consisting of the central government and regional governments. This certainly has an impact on the existence of women's groups in the social order amidst demands for achieving Sustainable Development Goals (SDG's). If we refer to the concept of "mainstreaming" itself, it can be interpreted as a process that is carried out to bring aspects that were previously considered unimportant or marginal into the decision-making and management of main institutional activities and work programs. This series of strategies was prepared based on insight, critical awareness and data obtained from gender analysis. Therefore, this study is considered important to look at gender representation in Siak Hijau policies.

Abstract

This study aims to compare how students learn archery skills in terms of physiological ability factors arising from first, middle, and last shots. Arm muscular strength is one physiological ability aspect that affects archery skills. Physical fitness has a big impact on archery success or accomplishment. This comparative quantitative study aims to ascertain how much student learning outcomes for archery skills vary or differ from one another. Thirty individuals from five different classes of Physical Education, Health, and Recreation (2019/2020) were sampled using the cluster random sampling method. Inferential one-way ANOVA descriptive statistics were employed for data analysis in this study, with a significance threshold of α 0.05. The research results show a difference in the average of the three archery skills learning outcomes for the students. The differences are between the outcomes of the first shot (encroachment), middle shot, and final shot. The results of Tukey’s post hoc follow-up test indicated that (1) there was a significant difference (p 0.05) in the average shot result (encroachment) between the first and the middle shots; (2) there was a significant difference (p 0.05) in the average shot result (increase) between the first and the last shots; and (3) there is no significant difference (p 0.05) in the average shot results between the middle shot and the last shot (p 0.05).

Abstract

The fundamental aim of criminal law is to shield society from potential victimization, allowing for the prosecution of wrongdoers, including the offenders engaged in negligent acts. This objective leads to a legal dilemma when negligence originates from the victim, sparking a debate within law enforcement about the entity to bear the criminal responsibility. Therefore, this study aimed to explore the juridical feasibility of designating victims as suspects in the same case where the offender has been victimized. Real cases were used in this study, accompanied by secondary data and interviews with crucial policymakers. The findings show that designating victims of negligence in traffic accidents as a suspect should not be pursued. Consequently, the investigation process should be suspended when the victim is found to be responsible for the accident, as the incident does not meet the criteria for a criminal act.

Abstract

Dampak dari menurunnya harga kelapa tentunya akan membuat daya beli masyarakat juga menurun sehingga para pedagang/petani kelapa dapat merasakan dampak tersebut dan tidak meningkatkan popularitas petani kelapa di Kabupaten Indragiri Hilir. Kemudian peraturan hukum terkait perkebunan kelapa di Kabupaten Indragiri Hilir tercantum dalam Peraturan Daerah Kabupaten Indragiri Hilir Nomor 3 Tahun 2018 tentang Perdagangan Kelapa di Kabupaten Indragiri Hilir di Kabupaten Indragiri Hilir di Kesaten Kesatu tentang Menjaga Stabilitas Harga Kelapa Jenis penelitian yang akan dilakukan adalah dengan menggunakan pendekatan yuridis sosiologis atau empiris. Penelitian yuridis sosiologis atau empiris merupakan suatu pendekatan dengan melihat kenyataan yang terjadi di lapangan dengan cara terjun langsung ke objeknya. Dengan lokasi penelitian bertempat di Desa Pekan Kamis Kecamatan Tembilahan Hulu Kabupaten Indragiri Hilir, sedangkan populasi dan sampelnya adalah seluruh pihak yang terkait dengan masalah yang diteliti. Penelitian ini menggunakan sumber data berupa data primer dan data sekunder, dan teknik pengumpulan datanya dilakukan dengan cara wawancara. Dari hasil penelitian dapat disimpulkan bahwa Dinas Perindustrian dan Perdagangan Kabupaten Indragiri Hilir hanya melakukan pengendalian harga terkait penjualan buah kelapa, dengan tidak tersosialisasikannya Peraturan Daerah tentang Tata Niaga Kelapa secara menyeluruh dan penguatan sumber daya manusia dari Kelompok Tani/Petani yang masih kurang. Untuk menaikkan harga jual kelapa, sebagian besar petani menjual ke pengepul kelapa, kemudian pengepul kelapa menjual kelapa ke anakan yang merupakan perpanjangan tangan dari pabrik atau industri kelapa. Dinas Perindustrian dan Perdagangan juga melakukan pengendalian harga sesuai dengan penetapan harga dan margin perdagangan kelapa yang juga terkait dengan penurunan harga dari agen, serta ikut melakukan pengendalian untuk menurunkan harga agar kembali stabil sebagaimana mestinya. Kendala yang dihadapi adalah terlalu banyaknya rantai perdagangan sehingga menyebabkan harga turun dan kurangnya sumber daya manusia bagi petani untuk mengelola kelapa sehingga menghasilkan kelapa yang berkualitas. Upaya yang dilakukan pemerintah daerah Indragiri Hilir dalam memaksimalkan stabilitas harga kelapa adalah dengan mengoptimalkan peraturan yang ada, mengembangkan sumber daya petani dan memaksimalkan pengawasan agar terlaksananya stabilitas harga kelapa sebagaimana diatur dalam Peraturan Daerah Nomor 3 Tahun 2018 tentang Tata Niaga Kelapa.
