Abstract

This research relates to the Minimum and Maximum Speed Limits ofVehicles Based on Article 3 Paragraph (4) of the Regulation of the Minister ofTransportation of the Republic of Indonesia Number PM 111 of 2015 concerningProcedures for Setting Speed Limits (Case Study of the Dumai-Pekanbaru TollRoad). Road traffic and transportation as part of the national transportationsystem must develop its potential and role to realize security, safety, order andsmooth traffic and road transportation in order to support economic developmentand regional development. Road traffic and transportation safety is a condition inwhich everyone is protected from the risk of accidents during traffic caused byhumans, vehicles, roads and/or the environment. But in reality, theimplementation of this regulation is still experiencing some obstacles.This type of research is sociological law, namely research that wants tosee the correlation between law and society, so as to be able to reveal theeffectiveness of the enactment of law in society. This research was conducted atPT. Hutama Karya (HK) Pekanbaru-Dumai and the Riau Regional Police TrafficDirectorate. Sources of data used are primary data and secondary data. Datacollection techniques in this study were interviews and literature review andconcluded with deductive thinking methods.From the results of the study it was concluded that first, the Minimum andMaximum Limits for Vehicle Speed Based on Article 3 Paragraph (4) of theRegulation of the Minister of Transportation of the Republic of Indonesia NumberPM 111 of 2015 concerning Procedures for Setting Speed Limits have not beenimplemented properly. Second, the factors that affect violations of the maximumspeed limit on the Pekanbaru-Dumai toll road are the human factor and thevehicle factor. Third, the efforts of PT. Hutama Karya and the Riau Police TrafficDirectorate are installing traffic signs, taking action against traffic offenders onthe toll road, and advising all motorists to always check the condition of theirtires and comply with the set speed on the toll road.Keywords: Implementation- Speed Limit

Abstract

AbstractGood law is law that is in accordance with the law that lives in society, which of course is also appropriate or is a reflection of the values that apply in society. The dimension of local wisdom of customary law which is based on cosmic, magical and religious thoughts is correlated with the sociological aspect of the perspective and culture of the Indonesian people. One of the indigenous peoples in Riau is the Kunto Darussalam traditional community in Rokan Hulum Regency. Settlement of ulayat land disputes is still used in marital dispute resolution, in consideration of adat law of tribal mamak, juvenile settlement, and settlement of ulayat land disputes. Keywords: Settlement, Customary Dispute, Kunto Darussalam. AbstrakHukum yang baik adalah hukum yang sesuai dengan hukum yang hidup (the living law) dalam masyarakat, yang tentu sesuai pula atau merupakan pencerminan dari nilai-nilai yang berlaku dalam masyarakat. Dimensi kearifan lokal hukum adat yang berlandaskan alam pikiran kosmis, magis dan religius ini berkorelasi dengan aspek sosiologis dari cara pandang dan budaya masyarakat Indonesia.Salah satu masyarakat adat di Riau yang masis eksis adalah masyarkat adat kunto Darussalam di Kabupaten rokan Hulum. Hukum adat yang masih digunakan dalam penyelesaian sengketa dalam perkawinan, dalam pengangkatan datuk/ninik mamak suku, penyelesian kenakalan remaja, dan penyelesian sengketa tanah ulayat. Kata Kunci: Penyelesaian, Sengketa Adat, Kunto Darussalam.

Abstract

The village is an important part of the Indonesian constitution. When viewed from thenature of the Indonesian state which contains the ideals of the state regarding the justification of theIndonesian state, regarding the formation of the Indonesian state, as well as regarding the objectivesof the Indonesian state, basically all of these are the same as the essence, justification of existence,formation and purpose of the village. Attamimi said that all of this was of course in a much largerscope and in a more modern context in accordance with the era and period when the Republic ofIndonesia was proclaimed. Soepomo even said that the ideals of the country are basically containedin the village community association which consists of its leaders and the people. Soepomo alsoemphasized that the state model known as the Village Republic is the original model of Indonesiangovernment, this is because the basic ideals of forming a Republic of Indonesia government are thesame as the ideals of forming a Village Republic, which is adapted to the real social structure ofIndonesian society. In fact, the form of village government existed long before there wascolonialism by the Dutch East Indies government, as emphasized by Van Vollenhoven.The research method used in this thesis is normative research using a statutory approach.The main data in this study is secondary data, namely legal literature which consists of severalquotations from various related literature sources. The other supporting research data used byresearchers are primary legal materials, secondary legal materials and tertiary legal materials.From the discussion and research conducted by the researcher, there are several conclusionsthat can be obtained. First, basically, the position status of village regulations in the hierarchy oflaws and regulations in Indonesia is Wettelijk Regeling, which is a type of law. This confirms thatvillage regulations are legal products in the form of laws which basically must be regulated andconfirmed in the hierarchy of laws and regulations in Indonesia. Second, that it is necessary toinclude village regulations in the hierarchy of laws and regulations in Indonesia to emphasize theposition and legal certainty of village regulations.Keywords : Legal Politics - Village Regulations - Laws

Abstract

The problem of waste in Dumai City is still a problem, the largepopulation, limited land use and high levels of consumtion have an impact on thecleanliness and beauty of the environment which results in accumulation of wastein various corners of the city. This solid waste problem continues to increase asthe population increases. The existence of the Dumai City Regional Number 3 of2021 concerning Waste Management is a form of Dumai City goverment’s effortto show its seriousness in managing rubbish.This study aims to determine the implementation of the Dumai CityRegional Regulation Number 3 of 2021 concerning Waste Management in theCity of Dumai, the inhibiting factors in the implementation of the Dumai CityRegional Regulation Number 3 of 2021 concerning Waste Management in theCity of Dumai and the effort to implement the Dumai City Regional RegulationNumber 3 of 2021 concerning Waste Management in the City of Dumai.This study uses the type of Sosiological Law research with an approach tofield research techniques, interviews and literature studies. This research wasconducted in Dumai City. The data sources used are primary data sources andsecondary data.The result of this study concluted that the implementation of Dumai CityRegional Regulation Number 3 of 2021 concerning Waste Management in DumaiCity applies a collection and transport system that only emphasizes finalprocessing. The lack of budget result in a shortage of cleaning workers andinadequate infrasturcture in waste management as well as low public awarenessof waste disposal in its place and a lack of firmness in applaying sansctiom.Keywords: Implementation, Regional Regulation, Management, Rubbish.

Abstract

The development of the spread of this virus continues and occurs not only in Chinabut spreads widely throughout the world, including one of them to Indonesia. With a largenumber of deaths and endangering the country, on January 30 2020 the World HealthOrganization (WHO) declared the Corona Virus Disease 2019 outbreak or what is knownas Covid-19 as a public health emergency that is worrying the world and on March 11 2020an outbreak was announced. as a pandemic. So that various protection efforts are carriedout by each country with different policy implementations. Because compared to otheraspects, health is one of the basic human needs and without human life becomesmeaningless. Even though there have been regulations governing health under Law Number36 of 2009 concerning health, arrangements to tackle the spread of Covid-19 in Indonesiaare not only sufficient based on the health law alone, it requires policies from thegovernment to tackle Covid-19 by based on state ideology as well as internationalconventions.Regarding the Covid-19 pandemic from the perspective of this ConstitutionalEmergency Law, and looking at the policies and legal instruments that have been stipulatedby the President, it does not categorize Covid-19 into a dangerous category but falls into thesecond terminology, namely urgent urgency in accordance with Article 22 of theConstitution. 1945 Indonesia is currently in a state of emergency as stated in PresidentialDecree (Keppres) Number 11 of 2020. These difficult conditions require appropriatepolicies in accordance with more advanced and responsive efforts in accordance with lawsand regulations. provision.The Urgency of Implementing Emergency Administrative Law in Managing theCovid-19 Disaster can be an instrument for the government in overcoming an abnormalstate of affairs. Therefore, this Emergency Constitutional Law can be an effective andefficient alternative or solution in overcoming a state problem that is currently in anemergency. In the conditions of the Covid-19 pandemic, the government made a legalchoice as a Health Emergency, but in overcoming the Covid-19 pandemic, various legalinstruments have regulated it so that the government declared the Covid-19 pandemic anational disaster with Presidential Decree (Keppres) No. 11 of 2020 .Keywords: Corona Virus Disease, Lockdown, Constitutional Law Emergency.

Abstract

Undang-undang Nomor 28 Tahun 2009 Tentang Pajak Daerah dan Retribusi Daerah (PDRD) saat ini telah dicabut melalui Undang-Undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Anatara Pemerintah Pusat dan Pemerintahan Daerah. Undang-undang Nomor 1 Tahun 2022 diberlakukan dalam rangka mengalokasikan sumber daya nasional secara lebih efisien. Pemerintah memberikan kewenangan kepada Daerah untuk memungut Pajak dan Retribusi dengan penguatan melalui restrukturisasi jenis Pajak, pemberian sumber-sumber perpajakan Daerah yang abru, penyederhanaan jenis Retribusi, dan Harmonisasi dengan Undang-Undang Nomor 1 Tahun 2022 Tentang Cipta Kerja.Jenis Penelitian yang digunakan adalah penelitian Yuridis Sosiologis, yaitu studi empiris untuk menemukan teori-teori mengenai proses terjadinya proses bekerjanya hukum dalam masyarakat. Adapun Teknik pengumpulan data meliputi: Wawancara, dan studi kepustakaan. Di dalam Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan antara Pemerintah Pusat dan Pemerintahan Daerah, diberlakukan dalam rangka mengalokasikan sumber daya nasional secara efisien, pemerintah memberikan kewenangan kepada daerah untuk memungut pajak dan retribusi  perpajakan daerah yang baru. Namun dalam penyederhanaan ini terdapat sumber retribusi yang dihilangkan dan mengakibatkan berkurangnya Pendapatan Asli Daerah.Dari hasil penelitian dapat disimpulkan bahwa, Presiden dan Dewan Perwakilan Rakyat Republik Indonesia harus melkukan evaluasi dan perubahan terhadap Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Antara Pemerintahan Pusat dan Pemerintahan Derah dalam semangan pemberian otonomi Daerah sesuai denga napa yang dibunyikan dalam Pasal 18 Ayat (5) Unddang-undang Dasar Tahun 1945 yang menyatakan “Pemerintah Daerah menjalankan Otonomi seluas-luasnya, kecuali urusan Pemerintahan yang oleh Unddang-undang ditentukan sebagai urusan Pemerintah Pusat”.

Abstract

Regional Government has the jurisdiction to legally form a regional legal product,which aims to serve as the legal basis for all activities in administering government and as aform of guaranteeing legal certainty in regulating social, national and state life.This research is normative research. This is based on library research which takesquotations from reading books, or supporting books that are related to the problem to beresearched. This research uses secondary data sources consisting of primary, secondary andtertiary book materials. This research also uses qualitative data analysis and producesdescriptive data.From the results of the research and discussions carried out, several conclusions wereobtained, namely: First, the position of the Governor's Call Letter in Positive Law inIndonesia can be said to be one of the legal products in the form of policy regulations(beleidsregel), but when referring to the provisions contained in Regulation of the Governorof DKI Jakarta No. 99 of 2021 concerning the Administration of Official Documents, in factthe position of the Governor's Call Letter is an official directive text, but with the formationof the Governor's Call Letter it is more appropriate to say that it is a policy regulation(beleidsregel). Second, the content and binding force of the Governor's Appeal Letter isbasically an appeal to the public which is persuasive in nature, however there are severalGovernor's Appeal Letters whose content and binding force do not comply with theprovisions in DKI Jakarta Governor Regulation No. 99 of 2021 concerning Procedure forOfficial Documents. Third, the arrangement of content material in the Governor's AppealLetter must be reformulated, so that in the future there is legal certainty in the ContentMaterial contained in the Governor's Appeal Letter.Keywords: Surat Seruan Gubernur - Position - Positive Law

Abstract

Based on Law Number 36 of 2009 concerning Health Article 98paragraph (2), it is explained that drug distribution can be circulated by partieswho have authority in their fields. Furthermore, it is explained in the PresidentialRegulation Number 80 of 2017 concerning the Drug and Food Control AgencyArticle letters (b) and (c), that the Drug and Food Control Agency has theauthority to carry out intelligence and investigations in the field of drug control inaccordance with statutory regulations and imposing sanctions administrative inaccordance with the provisions of the legislation. So with that, minimarkets orgrocery toll roads are not allowed to sell or distribute drugs without a drugstorepermit.In this study using empirical legal research methods, which collected datausing interviews, questionnaires, library research and observation of researchersin the city of Pekanbaru. While the population and sample in this study are theHead of the Center for Drug and Food Control in Pekanbaru, the Head of thePekanbaru City Health Service, Indomaret, Alfamart and grocery stores in thePekanbaru city areaFrom the results of research conducted by researchers, it can beconcluded that there are three main elements, namely, first, that the Food andDrug Supervisory Agency has not carried out optimal supervision. Second, theinhibiting factors for the Drug and Food Control Agency in carrying out its roleare the large number of existing facilities at Pekanbaru, the lack of humanresources at the Drug and Food Control Agency in Pekanbaru, the lack of publicknowledge of the applicable laws regarding drug distribution, not adherence ofbusiness actors to the applicable book rules regarding the distribution of drugsoutside pharmaceutical facilities in Pekanbaru City. Kenga Efforts that have beenmade by the Food and Drug Supervisory Agency, namely by providing educationto the public or business actors providing supervisors on the spot if irregularitiesare found at the place, giving administrative sanctions such as a warning to thetemporary closing of the place of business.Keywords: BPOM – Control - Drug Distribution

Abstract

Based on PERMA No. 1 of 2019 concerning Electronic Administration of Casesand Trials in Courts in Article 1 Number 7 states that electronic trials are a series ofprocesses of examining and adjudicating cases by courts carried out with the support ofinformation and communication technology. In this case, the community expects benefitsin implementing or enforcing the law. Because law is for humans, the implementation oflaw or law enforcement must provide benefits or uses for society. The implementation ofE-Court in the Court must provide benefits and convenience in its use, so that the publiccan feel the convenience of public services provided by the Court using this E-Court. Thepurpose of this research is to find out the extent of public service at the StateAdministrative Court in Pekanbaru.The type of research used is sociological legal research. As for the population inthis study are the Chairperson of the Pekanbaru State Administrative Court, the Registrarof the Pekanbaru State Administrative Court, the Pekanbaru State Administrative CourtJudge; Parties Seeking Justice. The research location is at the Pekanbaru City StateAdministrative Court. Data collection techniques using interviews, and literature, withqualitative data analysis.However, the implementation of E-Court still has several drawbacks. First, everyjustice seeker must be able to use existing E-court applications and these electronicdevices must be connected to the internet such as laptops, computers and smartphones.Second, when the application in court itself is disrupted, such as when the application isbeing maintained or the internet or power failure. So electronic registration of cases orE-court cannot be carried out. Third, at the time of the trial, only those registered withthe account who can see the E-court application can see the account at the court, that is,at the time of registration, the one who can see the trial program, if that party forgets theaccount, the trial program cannot be seen by other people.Keywords: State Administrative Court – E-Court -Public Service

Abstract

The Minister of Communication and Informatics issued regulations regarding private electronicsystem operators through Ministerial Regulation Number 5 of 2020 concerning Private ElectronicSystem Operators. In the ratification of these regulations, according to the requirements for theimplementation of state administrative law, one of the conditions was violated, namely legitimacy, whichmeans that state administrative activities should not cause commotion because they are not acceptableto the local community or the environment concerned.The enactment of this regulation creates problems in the community and disrupts communityactivities, starting from the economic and social aspects. In the implementation of the ministerialregulation there are still many obstacles to achieving the objectives of the regulation. The ministerialregulation also contradicts the regulations above it, namely the Electronic Information and TransactionLaw. By going through an empirical approach with the aim of answering issues based on the scientificside as well as field factsThe results of this research are that the government in enforcing regulations still has somedeficiencies starting from socialization, deficiencies in human resources who master technology, andthere are still many companies that ignore these regulations which impact on the wider community. Forthis reason, it is necessary to disseminate information related to these regulations to the widercommunity and to strengthen human resources who understand technology so that problems do notoccur in the future so that in the future these regulations can improve the quality of the state in any field.Keywords: Implementation, Regulation of the Minister of Communication and Informatics, PrivateElectronic System Operators.
