Abstract

In handling crime cases with the use of technology information oftenrequires forensics. Forensics is an activity for conduct investigations andestablish facts related to criminal incidents and other legal matters. Forensicanalysis is an important step in computer crime, especially when it comes tobringing it into court.The type of research used is normative juridical research. In this research,the researcher discusses the level of legal synchronization, which aims to revealthe extent to which certain laws are compatible vertically or horizontally.The conclusions that can be obtained from the results of the study areFirst, Digital Forensics Legal Arrangements in the Criminal Evidence System inIndonesia are not specifically regulated in laws and regulations. However, Article5 paragraph (1) of Law Number 11 of 2008 in conjunction with Law Number 19of 2016 concerning Information and Electronic Technology (ITE) contains a formof expansion of evidence outside Article 184 of the Criminal Procedure Code.Where in the law it is recognized that Electronic Information and/or ElectronicDocuments and/or their printouts are legal evidence. Where in article 5paragraph (2) of the Law on Information and Electronic Transactions it isclarified that the evidence referred to in paragraph (1) is an extension of legalevidence in accordance with the applicable procedural law. Second, the Role ofDigital Forensics in Information and Electronic Transaction (ITE) Crime Trialsin Cases Violating Morality and Its Relevance With Judges' Legal Considerationsin Making Decisions, namely in examining digital forensic evidence, applyingprinciples, it is important that the process takes place in accordance with the law.applicable and the basic principles can be applied properly. Abstract

Referring to Komnas Perempuan's 2020 Annual Notes, it notes that thereis a new type of gender violence, namely cyber-based or online gender violence.Cases of violence have continued to increase over the last six years, an increaseof 300% in Online Gender Based Violence (KBGO) compared to the previousyear (2019). Komnas Perempuan stated that this type of violence has anincreasingly complicated pattern of violence because it occurs in the digitalrealm. Ranging from character assassination to sexual harassment through cyberattacks.The type of research used is normative juridical research. In this research,the researcher discusses the level of legal synchronization, which aims to revealthe extent to which certain laws are compatible vertically or horizontally with thismatter.The conclusions that can be drawn from the results of the study are: First,the current criminal law regulation against gender-based sexual harassment onsocial media has not fully supported the advancement of internet technology. Thistype of violence is the same as direct violence, the difference is that now gender-based violence has shifted to social media or cyberspace. Therefore, social mediais considered not to have a safe space for women. To get protection for KBGO onsocial media. Second, the ideal idea of gender-based sexual harassment on socialmedia in the future is that the PKS Law actually has articles that regulate humanrights. These articles can also be used as a reference to fulfill women's sense ofsecurity and rights to freely surf the internet or social media. Abstract

Assembled firearms are also called small arms because they are replicas and are assembled followingthe patterns of standard combat firearms, which are produced by illegal "home-made" gun manufacturingfactories by the public. With the ownership of homemade firearms by civil society, law enforcement must becarried out against anyone who violates the law according to applicable regulations, namely the EmergencyLaw of the Republic of Indonesia Number 12 of 1951. In this case, the Pekanbaru City Police plays the roleof law enforcer. In the 2017-2021 period, cases of the use of homemade firearms are still common, andthere are also cases that have not been resolved. The purpose of writing this thesis, namely; First, knowingthe law enforcement against the use of homemade firearms in the jurisdiction of the Pekanbaru City Police.Second, obstacles in law enforcement against the use of home-made firearms in the jurisdiction of thePekanbaru City Police. Third, efforts to overcome the use of homemade firearms in the jurisdiction of thePekanbaru City Police.This type of research is sociological legal research, namely research that seeks a correlation betweenlaw and society. This research is descriptive, that is, the researcher tries to provide an overview of the casesunder study.The results of this study are that the misuse of homemade firearms still often occurs in the community.The Pekanbaru City Police have implemented preventive and repressive law enforcement, although thereare still internal obstacles such as a lack of information by the police, as well as external obstacles such asa lack of community participation.Keywords : Homemade Firearms – Police – Public

Abstract

Extortion is an action that often occurs in people's daily life activities, extortioncan occur with various backgrounds and certain motives. Extortion in Dutch apersingand in English is called blackmail is a common crime. The word extortion in Indonesiancomes from the root word "squeezing" which can have the lexical meaning of "asking formoney and other types with threats".Type of research this can be classified into types of research sociological,because the study’s author lan gsung conduct research into the location or field poinythat in carefully in oerder to provide an overview as complete and clear about theprablem that ivestigated. Research is conducted in police of the Riau police while thepopulation and the sample is a whole party that is associated with a problem thatinvestigated in the study of this source of data that is used primary data secondary andthe data tertiary tecnique of collecting the data in the study is to interview and study ofliterature.From the results of the study, it can be concluded that law enforcement againstthe criminal case of extortion in Pekanbaru is still taking legal action in the form of aninvestigation or investigation to determine the suspect. The process of resolving the crimeof extortion, namely: the first with the investigation process, by collecting informationand a collection of documents or evidence, the second by carrying out a case title, thethird if in the implementation of the case title that the incident is a criminal act then aninvestigation is carried out by taking or collect evidence, examination, confiscation,search, arrest and detention. Meanwhile, the obstacles faced in law enforcement againstthe criminal act of extortion that occurred in the jurisdiction of the Pekanbaru city resortpolice were the lack of witnesses in handling cases of criminal acts of extortion so that ithindered the investigation process and Weakness in proving through words or threats bymouth making it difficult to prove. So the effort in overcoming the criminal case ofextortion is to complete the evidence based on Article 184 of the Criminal ProcedureCode in the form of: witness statements, expert statements, letters, instructions, andstatements from the defendant.Keywords: Law Enforcement – Domestic Violence – justice

Abstract

In essence, corruption can damage the structure of government, and become amajor obstacle to the running of government and development in general. One of thecauses of non-optimal development is the practice of corruption, because corruptionaffects the investment climate, economic growth and increases people's income. InIndonesia, the perpetrators of criminal acts of corruption at a certain period can besentenced to death by a judge. However, none of the perpetrators of the CorruptionCrime of disaster relief funds have been sentenced to a death penalty in accordancewith the Corruption Crime Act, in the conditions of the Covid-19 Pandemic, they havefulfilled the elements under certain conditions. The objectives of this research are:first, to find out the application of Article 2 paragraph (2) of Law Number 20 of 2001concerning amendments to Law Number 31 of 1999 concerning the Crime ofCorruption against the perpetrators of Corruption Crime of Disaster Assistance,second, to know that the judge's consideration is not applied Article 2 paragraph (2)of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999concerning criminal acts of corruption against perpetrators of corruption in disasterassistance.The author conducts research using normative juridical methods or literaturestudies in order to obtain secondary data through documentary studies, namely bystudying and analyzing comparatively deductively against laws and regulations withtheories that have a relationship with the problems studied.From the results of the research, there are two main problems: first, how is theapplication of Article 2 paragraph (2) of Law Number 20 of 2001 concerningamendments to Law Number 31 of 1999 concerning Corruption Crimes againstCorruption Criminal Act perpetrators of Disaster Assistance, second, 2 What is thejudge's consideration not to apply Article 2 paragraph (2) of Law Number 20 of 2001concerning amendments to Law Number 31 of 1999 concerning criminal acts ofcorruption against perpetrators of corruption in disaster assistance. The author'ssuggestion from the results of this study, it is hoped that the judge can implement theapplicable Constitution, which has regulated the death penalty, which can be imposedat a certain time, in which case the Covid19 pandemic conditions have met theelements of certain conditions. Abstract

Review is regulated in Article 268 Paragraph 3 of the Criminal Procedure Code(KUHAP) "Limiting an application for review of a decision can only be filed once". Based on thedecision of the Constitutional Court Number 34/PUU-XI/2013 stated that Article 268 Paragraph3 of the Criminal Procedure Code against the 1945 Constitution of the Republic of Indonesiameans that a review cannot only be submitted once but may deny the principle of litis finiriopportet more than once. Therefore, the purpose of this thesis research is first, to find out theregulatory mechanism for judicial review in criminal cases after the Constitutional Court'sdecision Number 34/PUU-XI/2013 is related to the principle of litis finiri opportet. Second,knowing the relationship between legal certainty and justice after the Constitutional Court'sdecision Number 34/PUU-XI/2013 is related to the principle of litis finiri opportet.This type of research can be classified into the type of normative legal research. Thisstudy used secondary data consisting of primary legal materials, secondary legal materials,tertiary legal materials and data collection techniques were carried out using the library studymethod.From the results of the research problem there are two main things that can be concluded.First, the Mechanism for Review Arrangements in criminal cases following the ConstitutionalCourt decision Number 34/PUU-XI/2013 associated with the principle of finiri opportet is notregulated regarding the limitation of review. cases will never be finished which has run awayfrom the principle of litis finiri opportet (A case must have an end). Second, the relationshipbetween the principle of legal certainty and the principle of justice after the decision of theconstitutional court Number 34/PUU-XI/2013 is associated with the principle of litis finiriopportet: This Constitutional Court decision has denied the principle of litis finiri opportet,namely that every case must have an end, the aim of which is to realize justice and findingmaterial truth. The author's suggestion is First, the government follows up regarding the settingfor limiting the number of times you can apply for a PK. Second, it is suggested that judicialpower, both the Supreme Court and the Constitutional Court, is expected to combine 3 (three)important things in deciding cases, namely legal certainty, expediency, and justice.Keywords: Judicial Review - Constitutional Court - Litis Finiri Oportet Principle.

Abstract

ABSTRAK Pada saat Pandemi Covid 19 sistem pembelajaran di STEBIS IGM dilakukan secara online. Hal ini memberikan keuntungan bagi para orang tua karena mereka tidak perlu menyiapkan uang lebih untuk membiayai transport dan jajan ketika berada dikampus. Para orang tua hanya perlu memberikan uang membeli kuota internet. Penelitian ini bertujuan untuk mengetahui adakah perbedaan uang saku yang diberikan oleh mahasiswa STEBIS IGM pada saat pandemi dan new Normal. Metode penelitian yang digunakan adalah metode paired t-tes. Adapun sample yang digunakan sebanyak 55 mahasiswa STEBIS IGM. Proses pengambilan sampel dilakukan dengan metode simple ramdom sampling. Hasil penelitian menunjukkan nilai signifikansi 0,00 yang berarti terdapat perbedaan uang saku yang diterima mahasiswa STEBIS IGM pada saat pandemi Covid 19 dan New Normal. Jumlah uang yang diterima saat Covid lebih sedikit dari pada saat New Normal. Kata Kunci: Uang Saku, Covid 19, New Normal ABSTRACT During the Covid 19 Pandemic the learning system at STEBIS IGM was carried out online. This provides an advantage for parents because they do not need to prepare extra money to pay for transportation and snacks while on campus. Parents only need to give money to buy internet quota. This study aims to find out whether there is a difference in the pocket money given by STEBIS IGM students during the pandemic and the new normal. The research method used is paired t-test method. The sample used was 55 STEBIS IGM students. The sampling process was carried out by simple random sampling method. The results of the study showed a significance value of 0.00, which meant that there was a difference in the pocket money received by STEBIS IGM students during the Covid 19 pandemic and New Normal. Abstract

A steam power plant (PLTU) uses demin water to generate 3x350 MW of electrical energy. Reverse Osmosis Desalination system is used to treat the 190 m3/hour of desalinated water that is produced from seawater. Solar energy will replace the 225.41 kW of electrical energy required for the RO desalination pump in order to lessen pollution and the greenhouse effect caused by PLTU. The PLTU is situated in Pelabuhan Ratu Sukabumi, West Java. This region has a solar radiation potential of 3.189 kWp/day/m2 and a deployment space for PV modules of 6,167 m2, divided into two zones: the ground and the roof. The needs analysis is carried out by utilizing software simulations that estimate the power requirements of desalination pumps and the potential of electrical energy from solar radiation based on land availability. According to the modeling findings, PLTS can produce 1024 MWh/year of electrical energy with 1,458 pieces of 450 Wp PV modules and 5 units of 120 kW inverters.

Abstract

Cyber crime that has been developing lately is the Bigo Live social media application,which is an Android-based application using IOS which is currently being favored by users,especially from Indonesia. Technological developments have brought new forms ofpornography. In Law Number 44 of 2008 Concerning Pornography, that the meaning ofpornography is pictures, sketches, illustrations, photos, writing, sounds, sounds, movingimages, animations, cartoons, conversations, gestures, or other forms of messages throughvarious forms of media. communication and/or public performances, which contain obscenityor sexual exploitation that violates the norms of decency in society.This research is a normative legal research. This is based on library research whichtakes quotes from reading books or supporting books related to the problem under study.This study uses secondary data sources consisting of primary, secondary, and tertiary legalmaterials. This study also used qualitative data analysis and produced descriptive data.From the results of the research and discussion conducted, it is necessary to reformthe law regarding sanctions against connoisseurs of live pornographic content who carry outpornographic transactions so that it becomes a permanent job for perpetrators of livepornographic content. So that the level of criminal acts of pornography in Indonesia can bereduced. The imposition of sanctions on connoisseurs of live pornographic content is equatedwith the perpetrators of live pornographic content so that there is no difference between thetwo because they both commit criminal acts (pornographic transactions) and advise the stateto improve moral and character education for all generations of the nation about theimportance of moral values and avoidance the younger generation of pornographic contentthat is rife on social media.Keywords: Sanctions; Criminal; Content Connoisseurs; Live Pornography.

Abstract

The regulation of human trafficking has been regulated in the Law Number 21 of 2007concerning the Eradication of the Crime of Human Trafficking. However, the efforts of theIndonesian government in implementing various policies to combat and prevent cases ofhuman trafficking do not reflect as we expected. This problem is derived that’s faced by theinvestigator when carrying out investigative activities in the field. The main issues in this studyare: How are the implementations of law enforcement against the perpetrators of the crime ofhuman trafficking as a Transnational Organized crime by the Directorate of General CriminalInvestigation of the Riau Regional Police; What are the obstacles and law enforcement effortsagainst the perpetrators of the crime of human trafficking as a Transnational Organized Crimeby the Directorate of General Criminal Investigation of the Riau Regional Police.This type of research is sociological legal research conducted at Sub Directorate IV ofthe Directorate of General Criminal Investigation of the Riau Regional Police. The datasources used are primary data and secondary data. Data collection techniques were carriedout by interviews and literature review. The data were analyzed qualitatively which produceddescriptive and meaningful data using deductive thinking methods.The results of this research are law enforcement against the perpetrators of humantrafficking has been divided into preventive and repressive manner. Example preventive lawenforcement efforts are in the form of counseling, outreach, seminars or outreach to the public.Meanwhile repressive law enforcement begins with investigative activities. Obstacles in thisimplementation are: the local communities being secluded and does not want to cooperate withthe investigators; Strategic location of Riau Province; Limited investigative budget;Inadequate facilities and infrastructure; Lack of human resources in Sub Directorate IV of theRiau Regional Police's Criminal Investigation Unit.
