Abstract

Delegation means delegation of authority to make Law and Regulations. Article 246 paragraph (1) of Act No. 23 of 2014 on Regional Government stipulates that “to implement the Regional Regulation or over the power of Law and Regulations, the Head of Region shall pass the Head of Region Regulation.” The words "implement" and "over the power" which contains ambiguity of command cause philosophical problem related to the validity value. It becomes a sociological problem if such delegation cannot predict the dynamics of society. Furthermore, it becomes a juridical problem due to the existence of vague norm which creates multi interpretation which could potentially miss the aim of delegation of regulation. Specifically, this article has specific aims to examine philosophically concerning the need for delegations of authority to regulate, examine and find the direction of regulation in the delegation of regulation to governor regulation in ensuring utility and justice. This is a normative legal research with literature study which employs statute, philosophy, theories, conceptual and contextual approaches. The study so that with regard to the philosophical basis, delegation of regulation to Governor Regulation is needed to formulate technical and detail norms, the urgent factor contained herein as well as brief discussion and The direction of regulation to the Governor Regulation in the Regional Government Act to implement Regional Regulation or over the power of law and regulations. Such direction is based on command from the higher law and regulations, or established based on delegation.

Abstract

Shifting the notion countries formal law into state law meteriil (wefare staat) within the meaning of the welfare state agency or official  Administrative often take a variety of specific policy measures, among others, creating what is commonly called policy rule(beleidsregel). Such products can not be separated from the association Freies  ermessen. In order setting is a rule or rules of conduct set that regulation (Regeling) can be found in the legislation (Algemeen verbindende voorschriften) internal rules that apply to the (interne regelingen) and policy (beleidrege). Establishing the policy rule (beleidsregel) is located on the beoordelingsruimte (space considerations) given by the legislators to officials or governing bodies to take action on its own initiative public law that is setting, determination and positive action to resolve the problem- governance problems faced. Freis ermessen only intended use in the public interest. Freis ernessen implementation should be morally accountable to God Almighty, uphold the dignity and the degree of human dignity and the values ??of truth and justice, promoting unity and oneness, for the sake of joint / public interest. Tests on policy rule is more geared to doelmatigheid guided by the general principles of good governance

Abstract

Supervision of regional regulations is a new authority possessed by the Regional Representative Council. The purpose of writing this article is to examine the implications of regional regulation oversight arrangements by the Regional Representative Council. This article uses a normative legal research method with a statue approach, a legal concept analysis approach, and a historical approach. The results of the study show that the implications of regional regulation oversight by the Regional Representative Council as Article 249 paragraph (1), letter j, Law number 2 of 2018, namely: cause legal uncertainty due to unclear regulation; raises legal problems if related to article 31 of Law number 3 of 2009, article 245 of Law number 9 of 2015, articles 15 and 16 of Law number 6 of 2014; and raises the problem of constitutionality. Pengawasan terhadap peraturan daerah merupakan wewenang baru yang dimiliki oleh Dewan Perwakilan Daerah. Artikel ini bertujuan untuk mengkaji implikasi pengaturan pengawasan peraturan daerah oleh Dewan Perwakilan Daerah. Artikel ini memakai metode penelitian hukum normative sebagai jenis penelitian, yang dikaji melalui pendekatan perundang-undangan, analisis konsep hukum, dan juga sejarah. Hasil studi menunjukkan bahwa Implikasi pengaturan pengawasan peraturan daerah oleh Dewan Perwakilan Daerah sebagaimana tertuang pada Pasal 249 ayat (1), huruf j, Undang-Undang nomor 2 tahun 2018, yakni: menimbulkan ketidakpastian hukum karena pengaturannya yang tidak jelas; menimbulkan masalah hukum apabila dikaitkan dengan pasal 31 Undang-Undang nomor 3 tahun 2009, pasal 245 Undang-Undang nomor 9 tahun2015, pasal 15 dan 16 undang-undang no. 6 tahun 2014; serta menimbulkan problem konstitusionalitas.

Abstract

This writing aimed to examine the causes of non-compliance with the implementation of the Constitutional Court Decision as well as analyze and axamine the consequence of non-compliance with the decisions of the Constitutional Court in Reviewing Laws and Constitutional Court Decisions. This writing was normative legal research using statutory approach, conceptual approach and historical approach. The study indicated that there are several causes leading to non-compliance with the implementation of the Constitutional Court Decisions; among others are the sectoral ego of state institutions that causes reluctance to implement the Constitutional Court decisions, the Constitutional Court which does not have an executive body, the void of legal norms, the connection with state institutions that are obliged to follow up on the Constitutional Court decisions, and the interpretation of the final meaning attached to the Constitutional Court decisions. These things have resulted in injustice to the petitioners and citizen whose constitutional rights have been violated by policies of government.
