Abstract

The submission of a marriage dispensation application is almost the same as the submission of other civil cases, but if the proposed procedure is not fulfilled or is not appropriate when submitting a marriage dispensation application, the application cannot be accepted/rejected. Basically, the dispensation for underage marriage is a marriage that is carried out to make the prospective bride and groom who have not reached the minimum age of marriage, which is at least 19 years for men and at least 16 years for women in accordance with Law No. 1 of 1974 article 7 paragraph ( 1) . However, the consideration of the Sidoarjo Religious Court Judge in the application for a marriage dispensation was based on the benefit principle, in which the judge saw the two prospective brides and if the request was not granted, it was feared that behavior would further violate existing rules and norms, and so that prospective children who will receive justice will be recognized as legitimate children and have complete parents with marital status recognized by the state Dispensation, Marriage, Minors

Abstract

Bugis people, south Sulawesi, who are predominantly Muslim before carrying out marriage has a tradition of customs namely Money panaik. Panaik money is the giving of some money from the candidates the bridegroom to the bride’s party as a form of respect and as shopping money, customs traditions in the community,This Bugis tribe is mandatory or as a pre-condition of marriage which if no panaik money means no marriage, panaik money is determine based on the social status of the bride’s family, the level of education woman, up to the physical condition, the higher the status of a  woman then the higher the nominal panaik money is determined. In law islam there areno provisions governing panaik money and only oblige the giving of dowry from the male candidate to the female candidate, not there is a provision regarding the size of the dowry but it is recommended that women who well is a woman who does not burden the bridegroom with excessive dowry. This study examines regarding the position of panaik money as a condition of marriage in tribal customs according to Islamiclaw and how the consequences of the marriage law are not qualified panaik money in bugis tribal customs according to Islamic law. This study uses a normative juridical approach. This approach focuses on researching library materials such as relevant laws and other sources. The results of this study are the position of money which is not regulated in Islamic Law, but the law is permissible because it is a form of gift and as long as it is not burdensome to the party giving, but if the demand for panaik money is too high and the prospective groom cannot fulfill it, it causes the marriage to be canceled and eloping, then Islam prohibits something that is superfluous, and the higher the amount of panaik money that can be deliberated as much as possible by theprospective bride and groom.

Abstract

The purpose of this study is to analyze the application of the Supreme Court Regulation Number 1 of 2014 concerning Guidelines for Legal Services for the Underprivileged in the Court in the settlement of divorce cases through a mobile court in the Tuban district religious court and to determine the inhibiting and supporting factors for the application of the Supreme Court Regulation Number 1 2014 concerning Guidelines for Legal Services for Underprivileged People in Courts in the settlement of divorce cases through a mobile court at the Tuban Regency religious court. This research is empirical legal research, using a sociological juridical research approach. Sources of data obtained from this study are primary data and secondary data. The data collection method was carried out by means of in-depth interviews and documentation, and the data analysis used in this study was a qualitative method. The mobile trial was held outside the Tuban Regency religious court building in order to provide legal services for people who live far from the court, in terms of transportation costs and the distance traveled is difficult to attend the trial at the court office. In the implementation of the mobile court, the types of cases that are prioritized to be tried are only mild cases, such as divorce cases, both divorced and divorced, and isbat marriage. The mobile court in a divorce case at the Tuban district religious court is usually carried out at the sub-district office or at the village hall office within the court's jurisdiction.

Abstract

The economic development of the people is a big problem faced by people today, and indeed The solution can only be done by Muslims himself by returning to Allah's rules, in among others by: instilling entrepreneurial traits for each individual people, build strong partnerships/networks with various parties, especially with fellow Muslims, make policies that are more pro-economic growth of the people, by supporting morally and materially sourced from zakat funds, carry out transactions and economic behavior in accordance with the rules of Islamic teachings.

Abstract

Perumahan dengan konsep Islami berkembang sangat pesat, bahkan saat pandemi Covid 19. Tidak adanya konsep baku tentang perumahan Islami memunculkan berbagai macam model perumahan Islami. Tak jarang perumahan Islami hanya dimaknai sebagai perumahan dengan transaksi tanpa  riba. Padahal sebagai salah satu  bagian dari aktivitas ekonomi dan kebutuhan dasar seorang Muslim, pengembangan perumahan harus diarahkan untuk mencapai falah yang terangkum dalam terwjudnya Maqasid Syariah. Karena itu kajian ini bertujuan untuk menganilis perumahan Islami terbesar di kota Malang, De Prima, dengan menggunakan perspektif Maqasid Syariah. Dengan menggunakan metode penelitian kualitatif - konseptual, penelitian menemukan bahwa pada secara umum perumahan De Prima telah melakukan pengembangan perumahan Islami sesuai dengan maqasih syariah. Konsep Islam tidak hanya diaplikasikan dalam transaksi pembiayaan tanpa riba, melainkan juga pada seluruh proses  pengembangan perumahan. Selain itu kajian juga  menemukan bahwa penjagaan terhadap agama (hifdz-al-Din) terimplementasikan dengan baik. Sedangkan penjagaan terhadap jiwa / kehidupan (hifdz al-Nafs) tidak terealisasi dengan baik. Ini terlihat dari tidak adanya fasilitas kesehatan yang memadai, baik di dalam perumahan maupun diluar perumahan yang dapat dijangkau dengan cepat.

Abstract

Defrayal or financing is funding provided by one party to another to support the planned investment, either by themselves or institution. In other words, the financing is funding incurred to support the planned investment. Financing terms in effect means that I believe, I trust. The word financing means (trust) that means financial institutions as sahib al-mal put their trust in someone to carry out the given mandate. The fund should be used properly, fairly, and must be accompanied by a bond and the terms are clear and mutually beneficial for both parties. Each financial institution has syari’ah philosophy to seek the pleasure of Allah. to obtain good in the world and the hereafter. Therefore, any activities of financial institutions which feared deviate from the guidance of religion should be avoided. In the implementation of the financing, Islamic bank must fulfill two very important aspects, namely: (1) syar’i aspect, where in each realization of financing to customers, the Islamic bank must be oriented to the Islamic Shariah; and (2) the economic aspect, which is still considering the gains, both for banks and for Shariah bank customers

Abstract

The development of the field of information and technology is very rapid. The world of education cannot be separated from change. The teaching materials needed are currently in electronic form (e-modules), because they can convey more concrete messages through videos and interactive quizzes, so learning is more fun. The research objective is the development, feasibility and implementation of interactive e-modules for PAI subjects in children.The type of research R and D refers to Borg and Gall: 1) research and information gathering, 2) planning, 3) product development, 4) initial field test, 5) initial product revision, 6) further field test, 7) operational production revision, 8) operational field test and 9) field test. The results showed that the assessments of: 1) material experts 92%, very decent category; 2) 85% of media experts are classified as very decent. Random trials, 39 students in small-scale trials and 166 students in large-scale trials showed, the aspects of use were very interesting, access was very easy, very helpful in learning. The usefulness aspect is very clear, the instructions and presentation of the material are clear. Aspects of presentation of questions and appropriate material. Appearances, interesting practice questions, e-module quizzes are effective and very effective in helping to improve understanding. Thus, this interactive e-module is very feasible and can be implemented as a PAI learning media for children.

Abstract

This paper explores the contribution of Islamic financial institutions in the halal industry from the point of view of maqashid sharia. Financial transaction activities are aimed at achieving mashlahah or economic prosperity for each person and citizen. However, the implementation of this mashlahah as the conceptual framework of sharia maqashid requires criticism that can contribute instantly to sharia business activities. The formulation of each Islamic banking and financial product is inseparable from the study of ushul fiqh and sharia maqashid. Linked to Islamic banking products, ushul fiqh with a maqashid sharia perspective shares philosophical perspectives and rational thoughts about contracts in each Islamic banking product. With the Maqashid Syariah approach, Islamic banking and financial products can grow well and can respond to rapidly changing business progress. This research uses content analysis by conducting a literature review on the theme. This paper formulates that Islamic financial institutions are driven by spirituality and ethical values ​​derived from maqashid al-syari'ah

Abstract

An understanding of assets from a sharia perspective is very important in relation to the halal industry. This is because assets are the object of the transaction as well as one of the pillars of ta'aqud which is the majority of the Intiqolul Milkiyah method. By looking at the urgency of understanding assets from a sharia perspective, this study attempts to conduct a study of assets to produce a systematic asset description. The method used is a literature study. Excavation of this asset description refers to the Qur'an, Al Hadith and books of fiqh to obtain depth of analysis. Finally, this research formulates that haram products are divided into four, namely from the aspect of its essence, how to get it, where to get it and when to get it. In addition, this study also formulates that only assets that have sharia value can be transacted with syar'iyah contracts. And understanding fiqh in relation to the development of the halal industry will greatly help the growth and development of the halal industry in a massive, comprehensive and integrative manner.

Abstract

In particular, human development is subject to the search for fulfillment through an educational process based on Maqāṣid al-Syar'ah. The point of Maqāṣid al-Syar'ah is to protect mankind and protect them from harm in this world and the hereafter from each individual. This research is aqualitative research through a literature review review with descriptive analysis. This study results that the practice of 6 important things in Maqâshid al-syarî'ah is expected to be the main reference in implementing life practices,especially from the fields of spirituality, education, economics and health. This is used as a form of balancing integrated Islamic and general knowledge, this research only focuses on the preparation of human resources in terms of education
